Hi Monica very sorry to hear your news ... I'm like you I just don't understand what does it take to prove the relationship to these people!!!! They know nothing of your life and they sit and judge everyone so harsh. The day I sent an email to the consulate and got a response back the next day saying that they sent the case back (it's funny the same day as my email) was sent!!! I contacted my senator who did a inquiry on the case and got a letter from the consulate stating that the case was not denied but returned for review and they also stated that my fiance was treated very fairly and with respect. What a joke!!!!

Wow. I had no idea you went through all that!
Well....I have personally enjoyed 16 adult years of freedom as a single gal. I am now looking forward to the ol' ball and chain and all the new ways of doing things my hubby can bring with him. Fortunately, he's a very laid back personality so maybe that will make it all easier on him. I'm just praying it actually happens this time.

Don't be so sure!! As numerous people have said before, the wait is nothing compared to the transition to the U.S. A whole new culture, a whole new way of doing things, a whole new way of living, etc, etc, etc.

We had two denials & four or five interviews. Or one denial and one time ban depending on how you look at it, and then a reversal of the time ban - with four or five interviews thrown in for good measure! My husband has been here for a good amount of time now.

So, as someone who's gone through both experiences - my advice is - do everything you can to be together, but savor your free time as a "single" gal before he gets here. Both situations have their ups and downs. Enjoy the ups and hold on through the downs.

I am certainly hoping that time comes. You and I both started this about the same time and here we both are waiting for USCIS to make a decision again almost like it's right back at square one, it seems. I am hoping this last time goes quicker for us both and we both get through. I appreciate your kind words and your prayers. My husband is aware of your case as well. I do believe it helps to know we are not the only ones that have waited so long.

I have heard so many people say that actually getting the visa and getting the spouse or fiancee here is the easy part of the journey and that it gets harder once they are here and dependent on you for every little thing and making all those hard adjustments to a new life. That has not been the case for those second filers among us. I would trade the frustrations of adjustment for all this waiting and wondering anyday. After of this, I don't think anything will ever come between us again.


I agree with you nothing can be more frustrating than the wait ... I'm in the same boat 2nd filer and more waiting ... best wishes :thumbs:

Not that I thought they could do much anyways, but my senators were useless....Regardless of what I asked them to do, because the consulate said our case has left for the US, they won't do anymore inquires....I guess I don't blame them, I mean, what else can they do if the consulate says our file left already. Oh well :unsure: I am just really disappointed my husband won't be with me when my baby sister gets married in a couple of weeks. Everybody was hoping he would be here for that :(

Thanks everybody...we are both sooo excited & after the NOID reasons, I don't see anything NEW they could come up with, so now I just need to get all of the affidavit of support stuff sent out, which brings me to a question. If the interview is in January or Feb does he need the 2010 tax returns also?? I don't know what the timeline is for that...I'm also hoping to be able to be there again & hopefully get a visa in hand & have him come back with me...I know I'm probably dreaming...but it's the least they could do...LOL I mean we did get a NOID out of CSC...that is definitely something that barely happens :) But for now we are just going to focus on this awesome step & worry about the rest when it comes. Thank u all so much for your support. And to crossed_fingers: the service centers here & the consulates both have to approve any petition for a visa to be issued, so if they deny again, it comes back to CSC again...not gonna think about that right now :whistle: But like NigeriaorBust said, they can't deny for any of the same reasons as the original denial, because the reaffirmation proves that the reasons were not valid :dance:

Today we signed the contract and are officially married! The courts won't be operating tomorrow because the adouls are having a big meeting in Rabat. So Thursday or Friday we will get the signature of the judge to approve the contract. Then Monday we will have it certified in Rabat and translated. I arrived the 17th and return the 2nd. Just enough time.... Just not long enough with each other.....

Hello everyone....
I have been asked to post a description of my husbands CR-1 inteview experience, There is not a whole lot to say... The day was a bit nerve racking for the both of us and some details have been lost amongst the chaos....

My husband said he was interviewed by a woman (sorry no description) he said she was nicer than the woman who interviewed him for the K-1.... He was asked questions about

1. my children their name, ages and birthdates and how far away my older children live from me
2. My job, where, I work, how long I have worked there, How much I am paid and how long it takes me to get to work.
3. How many times I have visited him and length of each stay
4. Why I did not visit him last year
5. My parents names, where they live and work
6. My ex husbands name, how long we were married, when we divorced

So far these are the only questions my husband remembers being asked... I kinda comes to him here and there... LOL..

Anyhoo.... I started this new job in September and thought we would not need a sponsor because my income is over the guidelines, but I found out that because my income from 2011 was below we would need a sponsor, this was a few days before the interview that I found out about this.. So his sister who lives in the states said she would be his sponsor. So her husband sent me all her doc's, but I was like I think we need from both because you are married and file taxes together, but her husband said no just her info will be fine. So I emailed a copy to the Consulate and also to my husband to print and take with him to the interview. When his interview was done he was told he needed the original signed page for the I-846.... Just so happens his sister had arrived in casa that same day at 9:20 am... So my husband had to go to the airport to pick her up go to print the page needed have her sign it then take it back to the consulate.... So that gets done... But 30 min into the long train ride back to Fes he gets a call from the Consulate saying that they now need his sisters husbands info :bonk: :bonk: :bonk: :bonk: :bonk: So I call her husband tell him what we need and send him the $$ to express mail it to Morocco ($126 DHL) % days later I get the email that our case was approved and my husband can pick up his visa the next wed afternoon :dance: :dance: :dance: :dance: :dance:

Finally done with the craziness ALHAMDULILLAH!!!!!!!

Perhaps it was your assests that helped you out as I have no assests... I had been laid off in 2009 and was not in a real hurry to get back to work. used the time to go to morocco and to go to school..... If they said your assests put you where you need to be then I guess working doesn't matter if you have the assests to back you up...

Thank you wantknow. I was just planning to use the police record check from Palm Beach County but then I started to worry that maybe it would be better to be from Florida State Police. Glad to know you didn't have any problems. If you don't mind my asking - how long did it take for you to get married in Morocco? I know it is different for everyone.



Once we got everything done it took about a week but I had two previous visits because I could stay for two weeks vacation at a time. Getting the other documents was the hardest and longest

because we are very far from Casa.

Thanks. It is too late for the FBI report now. It takes I think up to 12 weeks. But just to be safe I will take a copy from the local police and from the state police. And I am SO glad you said that about two original birth certificates. I only have one. Fortunately I can order another one and have it delivered before I leave. See what I mean about last minute worries!!!!

How have you been? I know it is hard to adjust to being alone back here in the States after being with your husband. It was hard for me to leave last time and I don't even want to THINK about how it will be this time. But hopefully your case will go quickly and you will have him home with you soon. I hope we all have our loved ones with us soon.

Abbi I just went to the sheriffs dept. in my city in Florida and got a report I had no problems in Morocco :yes: yes we had to make 4 copies of everything here in Morocco.

Going to live with him will certainly not hurt your case if the CO accused him of not knowing you very well. Either way it is a good idea for you to visit and spend as long as possible with him. You have not seen him since February and an extended visit will be good for both of you emotionally, and good for your case further down the road. Good luck and be as pro-active as you can.

You know Im kinda looking through the AOS procedures to see if I can find something that specifically says they wont accept a foreign marriage certificate with your AOS from a K1. But I cant find anything..

Like Aaron said, it would be a real pisser if they reject you for it. The K1 says you have to come to the US and get married in 90 days in the US, however the AOS guidelines make no mention of the AOS application from the K1 person needing to be a US marriage certificate. I guess because K1s can not leave the US, its a one time entry. Its a very rare situation what youre proposing. The only places where someone could get a marriage certificate in the US w/o leaving the US would be at a foreign embassy, so I guess it doesnt come up much and they dont have specific clause forbidding it (?) Doesnt mean they allow it either though...

So IMO it could go either way...

I guess its your choice, if you do decide to marry at the embassy and have a marriage cert from Egypt you can file the AOS under the K1, and hope they dont reject it. If they do then you lost the money and youll just have to refile and pay the fee to resubmit the 130 and 485. Or you can elect to just file the 130 and 485 from the beginning and know that it will be approved, but you already paid for the 129, so its kind of like try to get away with paying for 2 applications, but if you dont you pay for 4 or pay for 3.

(Either way, you have nothing to worry about in regards to intent or fraud, your intent is sound in getting the K1, you plan on marrying in the US, its just a question of where in the US and if the resulting certificate you get will qualify you to adjust as a K1- you can try to call and speak to a tier 2 rep maybe? perhaps anon so its not tagged to your case and then they do say you have intent to marry in a foreign location and see if they have any idea but like I said I read the guidelines and its not mentioned at all- it just says marriage certificate, nothing about whether it must be a US one for those adjusting from K visas.)

Yes for the CR-1 visa you do have to send the police record when you first apply but you also have to send to NVC. I am just finding out that you need 2 for NVC 1 from the police station and 1 from the courts...

Took me 11 weeks this year with the approval.

I guess my real wonder now is if I can file turbotax online now that he has an ITIN



I used Turbo tax but had to amend my taxes to add my husband & ITIN number go to the help box in Turbo Tax it's very helpful.

and on the timeline it is indicated as the K1.

If you need to have questions answered I would suggest to make it clear what type of visa she has applied for, and as previously suggested post in MENA to have people from Morocco to help with your questions.

I have gotten a lot of help here and so I just wanted to share the love too! There is an app that can be downloaded on your smartphone, iphone whatever phone lol...from google play, windows or whatever market you have called "SMS backup"...you will need to have a google account but what it will do is send all you text messages to your google email account and then wala! you can have them to print as evidence if you and your SO use text messages to communicate as me and my hubby do! This is awesome I think alot of people are faced with this delima ... my I-130 petition was denied and that was one of the issues they found wrong. I only could give them the log of my text but not the text messages. so uscis did not accept the logs as proof. Thanks for tip :yes:

We filed and were approved for an IR1 visa. My hubby just received his 10 year green card in the mail we have no idea what to do next.
I think we are done for now until we reach the 3 year mark and he can apply for naturalization? Or have we missed something?

No make photo copies and save the originals save train ticket stubs too. Keep anything that shows you are there together. Consider another trip before you refile. If I can think of anything else I will share.

It's already been denied. Appealing it will not give you any advantage. Filing a well documented new one with a properly and efficiently managed new process is better in many ways than winning an appeal would be and MUCH faster.

OK. I should have checked the timeline. Your I-130 was denied by USCIS after your RFE response. There was never a visa interview. Now, I get it. You are still better off to begin again with a well managed new process. It's actually better than winning an appeal and much faster.

Your answer doesn't compute. You would only appeal the revoked petition. If the approval of the petition hasn't been revoked yet, there's nothing to appeal. What did you receive from USCIS? Look at it carefully. It will have a title.



4 pages 1st page is a letter of decision which tells me that I can appeal their decision by filing a completed form EOIR-29 I must send the form EOIR-29 and all required documents, including the appropriate filing fee to USCIS ATT: EOIR-29 PO Box 660939 Dallas TX 75266 and last page is the appeal form with instructions how to file and filing fee is 110 dollars


Its: Notice of appeal to the Board of Immigration Appeals from a decision of a USCIS Officer

How much time have you spent together as of today? 2009 I spent 2 weeks vacation first trip and met, 2010 -16 days, 2011 -18 days, present time in morocco 1 month. Please elaborate. Note that time spent together in person is the strongest evidence of a bona fide relationship.

Up to the time of the most recent visa denial, how much time had the couple spent together in person? Total 50 days


Please also clarify the actual status. I-130 Appeal status 30 days to respond Did you receive a Notice of Intent to Revoke? No If so, did you respond?

If you responded, did USCIS decide to revoke the approval of the petition?

First how in the world does she think a denied Petition thats in process of appeal and he will get approved and over here on a K3 which is obsolete. Does she even read up on things. I mean its like she is saying forget everyting he can just come on over and we file while he is here. WOW either she is really that clueless or well vapidly dumb.
"If your I-130 is approved before your K3". A K3 consists of a I-130 and I0-129F. WTH. WOW she scares me.
