IR-1 / CR-1 Spouse Visa Process & ProceduresSpouse NVC case number assigned to DS-3032/AOS Bill
That's great news for you then! In a week or two the NVC will email you and your spouse the DS-3032 form along with an invoice for $70 and the website and info you need to pay online. Have the beneficiary fill it out, then send back to the NVC. Some people emailed, some mailed, some did both. Its up to you. Once that fee shows paid, print out the receipt with the barcode and send in the AOS package (with tax returns and proof the petitioner meets the income requirements either alone or with a co-signer). Once the 3032 is accepted, you will get another email from the NVC with the IV fee bill for $400. Pay that online, and when that shows paid, print that barcode and send it in with the 230 package with original documents and copies so that you will get the originals back. The 230 needs to be filled in by the beneficiary. You will need to gather a good amount of paperwork, so get started! All the detailed info you will need is in the shortcuts.

ALso i want to inform u all i had hired lawyer long time back for I130 approval as it took too long for approval.

Weeks back i talked to my lawyer that if we can pay BILLS online? He said NO thats not there policy. so he wants me send it by snail mail.

Any advise welcome.

I believe if you have an attorney and his name is on the I-130, he will automatically be the agent for you DS-3032, so one may not need to be filled out.

I agree with msnoob, having an attorney when you are in the NVC stage may slow you down as you are at the mercy of their office, whereas if you were doing everything yourself, you can do it right away and not have to wait on the attorney or more likely his secretary doing his job (I used to be a legal secretary, attorneys very rarely do their job when it comes to paperwork, that is what their secretaries and paralegals are for.). The NVC does accept payment online, but it has to be from a US checking account, you will need the bank's ABA number and the account number, but again, you are at the mercy of your attorney and if he insists on snail mailing, you are pretty much stuck.

Not to scare you off of having an attorney but in 80% of the cases I've read about with people who had attorneys on the boards here, the attorney had no idea what the proper process was for filing or for what is needed at the interview. Take that into consideration and always always always ask away here if you have questions. The VJ people here are so nice and will always answer a question.

Good luck!

As Canadian Wife said, follow the short-cuts, they are a huge help. Make sure you have all the info you will need for this stage, the Police Certificates, the Petitioiner's tax info, etc. Having these things done ahead of time will save you a lot of hassle and stress when it comes time to file your paperwork.

And as far as them not taking your email addresses, I would call them again tomorrow and see if they ask for your email addresses. If they just got your case in the system it takes a day or so to be able to accept email addresses for some reason.

IR-1 / CR-1 Spouse Visa Process & ProceduresAt the NVC stage - photos
QUOTE (trailmix @ Nov 9 2009, 03:30 PM) <{POST_SNAPBACK}>
Really it depends where you are having your medical. If it is in Toronto at Seiden & Associates - they ask for 3, they used to do medicals in Calgary as well and I think my Husband had to take 3 there as well. You will also need 2 for the interview in Montreal.

Does it matter if they match? I had 2 photos left of him from the USCIS stage and since I electronically filed, I scanned those photos of my husband and sent them on to the NVC and figured I could use those for either the medical or the interview. But doesn't the consulate in Montreal ask for Canadian passport photos not US passport photos? I could just wait for the e-mail, but hubby is such a procrastinator that I'm asking him to go get his blood titer test now since he doesn't have his shot records. I'd like him to get his photos done now too so no rushing around later. And he calls me pokey! HA!!

How long does it take the NVC to respond to an email from your attorney?

I never personally e-mailed them as a few people said it took like 2 weeks for NVC to respond, that is why everyone calls!!!

I emailed them once just to let them know they sent me an e-mail and it wasn't meant for me. It took just about two weeks for them to acknowledge that email and write back that they were looking into the issue and thanked me for letting them know. I felt so bad for the people that the email belonged to that I cc'd them on it when I returned it to the NVC...

I think all we paid is $70 + $400 or so as fees to NVC.

Plus the $355 to the USCIS to file the I-130
Plus the mailing fees
Plus the passport photo costs
Plus the medical fees (vary depending on Country)
Plus travel to the consulates and possible hotel room for the night
Plus the cost of the Police Certificates
Plus... plus... plus.... it all adds up.

Good luck to you!

K-1 Fiance(e) Visa Process & ProceduresAdvice needed: US Citizen marrying a Canadian
QUOTE (eye0eye @ Jul 19 2009, 11:02 PM) <{POST_SNAPBACK}>
Thanks again for the replies. My fiance does live just outside of Vancouver so I guess that would be a bonus for us in terms of processing time.
Now we just have to decide.. be apart before or after marriage I suppose.
So if I'm correct: The K1 might take longer to have her here and working, however, it has the advantage that we can live together immediately after being married. The CR-1 may be faster to gain permanent residency but we will have to marry and be separated for the first 6-12 months. Decisions decisions!

Thanks again everyone, once we decide which way to go I will post our timeline!

My husband and I debated much like you are now.... spend time apart before or after marriage. We decided on the CR-1 simply because there is no travel restrictions after the visa is approved. He was afraid if we filed a K1 and we got married he wouldn't be able to travel back to Canada if a family member got sick or he needed to leave for a funeral or something. He wouldn't be able to do that until he got his parole (travel) papers. That was the big decision maker for us. It really stinks not being with your spouse all the time after being married, but after all the paperwork is done and he is here permanently we will have the rest of our lives together. What's a few months to wait now?

Good luck to you!

Personally, I believe I will be laughing a lot like I did during my wedding. I have a weird defense mechanism.

I did the same thing at both ceremonies! I think I hit him with my "flowers" (they were plastic and silk "borrowed" from the Court House because my best friend would not let me get married without holding some sort of flowers) during our first ceremony, then at the second one in the DR, the woman couldn't pronounce my maiden name right, then said that my husband was born in 1921 instead of 71 and those two things combined just started the laughter and very very big smiles.

Cool. I think we're just going to keep our fingers crossed that we get that in time then. My interview is March 5th and the check box is checked for getting one...so three weeks maximum after that puts me getting it at the end of March. So we should be fine.

And if by some chance you don't get your card by April 15th its easy and I believe free to file an extension to file your taxes and that gives you until August to file them.

Ugh...now I'm REALLY confused. Should I be applying for an ITIN then? Or is there a moratorium?

Sorry, didn't mean to confuse you. The link I posted was apparently for something else as Mal said... Its all greek to me!

Wyatt, if your wife is not in a rush to file her taxes, and hoping you are approved at your interview and you move to the US shortly after your approval, she can wait to file her taxes until you get your Social Security number. She may need to file an extension if you don't have it by April 15th, but that is no real big deal...

Just to clarify, he didn't have income in the US, right? If not, you'd only need to get an ITIN to file your own taxes including him on your return.

Wonder why Turbo Tax said that.

Nope, no US income. I wonder, I read somewhere that the IRS is not issuing ITIN numbers until May 1, could I use his SS# once he gets it and still be ok? His interveiw is March 1, and he will be moving here as soon as he gets his passport back.. I could fiile an extension if I need to.

OH here it is, it was on http://www.irs.gov/i...87,00.html#what

*Moratorium on NEW Acceptance Agents Applications Starting January 1, 2010

The Internal Revenue Service (IRS) Individual Tax Identification Number (ITIN) Program is announcing a moratorium effective January 1st through April 30th, 2010 on all new Forms 13551, Application to Participate in the IRS Acceptance Agent Program.

During the moratorium, the IRS will not accept or process Forms 13551, Application to Participate in the IRS Acceptance Agent Program. Only amendments to existing, approved agreements will be accepted during the moratorium. The ITIN Program will resume accepting applications during the new 2010 Acceptance Agent Open Season, effective May 1 through August 31, 2010.

Or do I just do the W7, Oh I'm so confused! LOL

Yeah...the testicle inspection wasn't really obtrusive. Very perfunctory. It didn't bother me as much as my mental image of "testicle inspection" bothered me. It wasn't like...yank yank...YANK...grope...paw...maul...YANK... Just a few quick gentle pokes and prods and that was it. Hey, look at it this way: chances are that she'll be the last woman other than yourself to ever touch your hubby's bits!

CanadaCanadian Girl Trying to Figure out Best Options

You are married...I would go for a CR-1 Spousal Visa. Most posters will agree that the K-3 is almost obsolete due to cost and time....
Having a spouse in the states..I DOUBT you would get a visitors visa or a travel visa...and they are not going to JUST let you in to visit for an extended amount of time...

You can visit while having a CR-1 processing, I did for over a year and really never had any isues until my last trip ..just make sure you bring strong ties to Canada...and be prepared for a lot of questions. NEVER lie to a Customs Officer..they will know!

Yep, ZansGirl pretty much said it all. My husband and I did the CR-1 route. We are now just waiting on our interview on March 1. Our visa journey started in August when we filed the initial papers. We still visit each other. He (Canadian) visits me sometimes for a few weeks at a time since he is unemployed. But he always brings ties to Canada when he crosses the border and when they ask him if he is working he tells the truth and says no but that he is looking. He's only been pulled into secondary once so far (knocks on wood). I go up there when I can. Its just harder for me to get up there because of work.

No matter what way you decide to file, best of luck to you. The people on these boards are very helpful and may I suggest you read the guides and the Wikis as they are great help in the process.

8 hours by car, only an hour by plane. We were pretty lucky. No complaints here!

Same here. He was living near Toronto and I'm about an hour away from Philadelphia, PA, so 8 hours. We drove most of the time. If I found a good fare, I would fly, but out of all the trips we have taken 99% of them were driven. He never once flew here.

I'm catching a ride up to Toronto this weekend with a friend of mine for a lacrosse game and after 31 long days apart, I will see my hubby again! ok ok i am more confused with the taxes now that i went on CRA and reading a publication for emigrants of canada 2009 and spoke to IRS and the person i was talking to was grumpy.

please tell me if i'm right.

1. i file my canadian taxes w/ section 217 as i collected EI & earned canadian income for 2009???
2. i file my us taxes w/ form 1116???

i really dont want to take this to H&R block as i live in a small town and there aren't a lot of immigrants here. Im afraid H&R block will just screw up.

can someone post the thread about US/Canada tax??? i cant seem to find it.

I would not use H&R Block at any time, but especially if immigration and another country is involved. Personally, I would hire a Certified Tax Accountant to help you with these issues. I will be doing the same when my hubby is finally able to move down here. It may cost you more, but tax accountants are a bit more knowledgeable then someone who took a quick tax preparation course at H&R Block or one of those places. IMO.

CanadaMedisys Montréal

The results at Medisys are available in 3 business days I think... I didn't ask specifics because it's not important in my case.

There's a recent review of the other Montreal clinic here: http://www.visajourn...howtopic=238088 - the cost there is $260 and it may be faster, but I'm not sure.

My husband's medical at Medisys is Feb 23 and he was told we should have our results back in time for our March 1st interview (should be ready Thursday, Friday at the latest). He had better pray really hard that there is no problems with his medical since he decided to wait until the extreme last minute to have it done. (last day possible and latest appointment possible)....

Thanks for the review La Souris!
