Hi everyone,

I know tax forms are necessary to prepare for the interview, but I didn't work at all in the U.S. in 2007 since I was in China working the whole time. Do I still need to fill out my tax forms for 2007 and have my fiancee present them at the interview? Or can I just use the 2006 tax forms (the most recent)?

You're going to have to show that you can supply enough income to support your fiance at 125% of the poverty level or more.  The 100% level is only for those who are in the U.S. Armed Forces.  (See Form I-864P).  The guidelines for Form I-864 Affidavit of Support are used by the consulates; this makes sense because once your spouse applies for AOS, the I-864 is required.

 

The I-134 isn't ever required, but can be useful to allay public charge concerns.  In your case, it is advisable to use it.  Since you cannot meet the 125% requirement yourself, both you and your joint sponsor should prepare Forms I-134 (with supporting evidence) so your fiance can hand them to the consular officer at the interview.

Although rare, her applying for a B-2 visitor visa before the K-1 is initiated can negatively affect her admissibility to the U.S.  I have had to file waivers for clients whose boyfriends/girlfriends were deemed inadmissible due to fraud/misrepresentation when applying for a visitor visa at an overseas consulate.  I always suggest that the U.S. citizen visit the foreign fiance and not the other way around.  Why take needless risks?

Yes, you can do that. I lived in China while I waited for USCIS to process the I-129F for my then-fiancee. Then when the State Department did its thing it was convenient for me to be there and help her gather all the documents on the visa instruction packet they sent her.

Hi fellow VJ users, 

 

This is my situation.

I am a USC and petitioning for my spouse. I have no income ATM; I've just graduated from the University.

Both my parents are going to be joint sponsors. The plan is that once I move back to the US with my wife, we will be living with my parents and two siblings for a few months.

 

1. As the petitioner, I will be filling up an I-864 form.

2. My father will be filling up an I-864A, since we will be in the same household?

3. My mom will also be filling up an I-864A, since we will be in the same household?

 

 

 

When I file these forms, I will have to physically mail them to NVC, and I was wondering if we will have them back or should I make two copies? One for NVC and one for my wife which she will be using for the interview?

I am wondering this: any March 2013 filers who had RFEs? If so, how long until the service center acknowledge they received the evidence? How long after receiving, did you receive your NOA2s? 

 

I am hoping the wait isn't too long, though I know there is still a wait/process even after getting NOA2.

so I had received an RFE for my K1 visa that said they want evidence for intent to marry. My lawyer sent it out on monday and my online status just changed to RFE response review. If I were to be approved, do they send a letter or will my status change online? Also, approximately how long does it take to hear back from them after they receive the RFE?

I am in the same boat; we just sent our reply to RFE and the CSC received it on August 19th, and my status also says the same thing. I presume the status will change online, and a hard copy will also be received (as all cases of NOA2s do, or should). According to our immigration lawyer, she anticipates we will hear back in 45 days although the status (if you read through) says we'll hear from USCIS in 60 days or less. We had the exact same RFE, too. 

 

I guess the good news for both of us is that we are so close to the next phase of this journey!

My fiance and I received an RFE on August 1st (though we weren't notified until a week later). There were two requests: for two current passport photos of us, as well as a statement of our intent to marry within 90 days of me entering the country. Very simple. Your case could be different, though the letter of intent to marry seems to be a common RFE for us K-1 Visa people.

Just wanted to share the GREAT news that my fiance and I received an email notice tonight from USCIS that our application has been APPROVED! We received an RFE on August 1st, responded August 7th (well, it got sent around the 8th or 9th). I was feeling a little bit down today about the process, wondering when the heck we'd hear some good news. Well the good news is here. And I just wanted to give thanks to this forum for being like an online support group... it's a tough journey for all of us, but this very moment makes the wait seem more than worth it!

Ironically I came down to visit my fiance a couple days ago, so we are able to celebrate this approval together :).

Our letter said the same thing, and I thought it odd there was no mentioned made of the NVC. I almost wonder if they are fast-tracking some applications?? I would love to follow this thread (as it has been moved to a new sub-forum) but not sure where/how to find it.

 

My fiance received our letter today so I have yet to see what it says in its entirety, though I do know it said our case has been forwarded to the consulate in Vancouver.

so i have just received the approval mail for the K1 visa. It does not mention anything about sending it to NVC. It just says that they forwarded my case to the listed consulate. I have seen sample letters saying that it is forwarded to NVC. Is there something wrong? 

Also, how long does it usually take to get a letter from NVC saying that they received our papers? Does NVC usually want us to send in the required documents to them, or do we sent to the consulate or have it present at the interview?

Im sorry to vent here,but I have checked my email all week really hoping to receive my NOA2 every 5 mins,they received my first Rfe on august 27 and I thought yayyy noa2 is coming next,but no!! Just 5 mins ago i receive an email saying they mailed another RFE,my firdt one was the letter of intent to marry,my question is,did i send the wronf info? Why in the world would they not just ask for everything they needed on the first rfe? Im so upset that we have to wait anoother couple of days to see what they are asking for now,and also wait again for the review,and then hopefully the noa..im so tired of waiting all the time sad.png someone give me hope please..

My fiance and I received our RFE August 1st, they wanted a current passport-style photo of each of us, plus a letter of our intent to marry. I didn't read the RFE properly and we typed a letter together, and we both signed ONE letter. I found out afterward that it was supposed to be two separate letters, but we got our NOA2 approval three weeks later. I think it also helped that we got a letter from my best friend, who will serve as a witness to our legal marriage in the United States. 

 

Good luck, Solange_arg. All will be well, you just have to be patient. I know it's hard.

We are in the same boat! Approved August 28th and not in the NVC yet. Jeez Louise, quick approval but slow to get to NVC. I'm visiting my sister in Eastern Canada, not too far from where the NVC is... it is so tempting to go down and just heckle them at the NVC protest6wz.gif . I guess I'll wait a little bit longer. Haven't called the NVC yet to see about a case numner, but seeing as we're coming up on 4 weeks after our approval perhaps they have our number?! Wouldn't that be a nice surprise, but I think it might be a wee bit too soon.

Our NOA2 was on Aug 29th and not arrived at NVC yet..

We were approved August 28, rec'd letter first week of September, and also waiting for NVC to receive it. JUST got off the phone from calling NVC and they still have not received it. California Service Center K-1 Approvals are taking between 41-48 days to be received by the NVC (though I'm not sure how 'solid' or true that number is).

 

Which service center did your K-1 get filed at?

I called the NVC last week -- Wednesday Oct 9, Thursday Oct 10, and Friday Oct 11. On Friday I received our case # from the NVC, and we were a late August NOA2 approval. Our file has already been sent to the embassy in Vancouver (CEAC website says it is "in transit"). Just this last week I was feeling especially frustrated with this whole process, trying to remind myself that the end result of being married to my love and best friend will be worth it. And he is -- but yes, this process is tiresome, and lonely, and difficult. Just remember that all this is for someone you love, and that even on the worst days now, you know in the future you'll be together! 

 

It's funny how our good news came at a time when I was feeling especially down -- I think it goes to show that you always have to try to think and stay positive!

 

We were told ours was forwarded to NVC on Thursday, Oct 10th as well. Here's hoping NVC receives/processes it soon!

Some people get interview waivers (meaning, they will not be having an interview). Others, like me, get a letter in the mail which tells you your interview date & time. I couldn't tell you whether or not you will be getting an interview or not... I know I got my AOS interview appointment in the mail fairly quickly after getting my EAD/AP combo card.

Hey Everyone!! Hope all is well with everyone! Things are good here. Just before his departure from Brazil in January, my husband had a dental emergency and was told that in order to fly he had to have a root canal. Upon his arrival, we had to get him a crown and a permanent filling. Unfortunately, I was unable to get him great dental insurance so it put us in debt. We still haven't started the AOS but we finally have the money. Because we had to wait, does this mean he will have to get the medical again? Can anyone give me any tips? Now I am on a mission to find all of the necessary paperwork and get this going. Did everyone do this on your own? I had help with the paperwork for the K1 Application but I am still trying to decide if I should attempt this on my own.

I am sorry to hear about your husband's dental problems -- but glad things are looking up and that you can do the AOS process soon. At least you're going through everything with each other in person :)

 

I am not sure about the medical - it depends on when he got it. I believe the medical is good for 1 year, so if he applies for and goes through the AOS process within the year of his medical, he should be okay. If not, I am not sure the correct answer, but I would certainly look on USCIS website for an answer... or, I'm sure Visa Journey has some info, too :)

 

We used a lawyer for the initial K-1 application, but we had several problems with our lawyer, so once I had my interview at the consulate, we decided to do the AOS process on our own. In all honesty, we felt way more confident doing things on our own! We had an RFE using a lawyer, and no RFEs doing the AOS on our own! The forms are all available on USCIS website and Visa Journey has guides for filing... with these, it was not that complicated to do the AOS filing on our own. The key is being organized! I made 3 copies of the AOS package in case anything went missing (fortunately nothing did!). I quadruple checked the AOS package before I sent it... and from initial sending of AOS package, to receiving EAD/AP card, and now recently the green card interview & approval, it was all done in about 4.5 months. Not bad, considering the initial K-1 process taking about 9 months for us!

Is it compulsory that your spouse comes with you? What kind of questions did they ask you guys? Must you have a joint account? Is it everybody that is called for the interview? For the interview, I brought a file of documents to which the officer only asked to see a few. That said, we brought:

  • Certified copy of marriage license (they already had this - but I wanted to be sure!)
  • Joint bank statements (make sure both names - USC & beneficiary - are on documents)
  • Insurance documents/cards (again, good to make sure both names are on these items)
  • Pictures from throughout our relationship
  • Interview appointment letter from USCIS
  • Passport 
  • Birth certificate
  • Copy of medical records if available (they already should have these but I had an extra set

    Other possible items to bring include utility bills, lease agreements, etc. Officer really wanted items with both of our names on it...

    YES - THE USC & BENEFICIARY ARE REQUIRED TO ATTEND INTERVIEW TOGETHER. It should state so in your interview appointment letter... but if not, take my word for it.

    They asked when I last entered US, when we got married, things about each others' families, and from the photos we took, the officer asked me to 'tell him about the photos' (when/where taken). A couple photos had my husband's family members in it, so I had to identify them.





    The other things worth mentioning -- if the beneficiary (non US citizen) has an EAD/AP combo card, and wishes to travel after the green card interview, please be advised the EAD/AP card will become invalid during the green card processing. Inquire about the I-551 stamp for the passport - which is a temporary green card until the real one arrives. It will be good for approximately 30 days -- but it would depend on the officer who interviews you. 



If you have any other questions, I would be happy to answer them. The interview was honestly a breeze, we were in and out within an hour...

Had my AOS interview on 8/26 - approved on the spot, I-551 (temp. green card) stamped in my passport so I could come to Canada for my sister's wedding... the EAD combo card is deemed ineffective once you are approved & waiting for your green card (apparently, as we found out). So, if you have plans to travel around the time of your interview, ask about the I-551 and tell them why!

Yes, it is a 2yr greencard. However 90 days before it expires, you need to file more paperwork to remove conditions. 

Sjs87.. BTW, good luck for your AOS interview. I have a 100% feeling that you will be approved. That's my birthday. They cant deny you on my birthday  :rofl: 
I should be hearing about my EAD in 2 weeks or so (I hope). I haven't heard anything from USCIS since we filed in late May.

I had my biometrics done on June 6, and by July 2 my EAD/AP was approved. On July 11, I received the combo card in the mail. If this is the approval you are talking about, then I would anticipate approximately 30 days after you get your biometrics done will you receive the EAD/AP combo card. As for the green card approval, I have no idea -- I have the same question myself! I thought we would expect an interview date in the mail, but some have said due to a backlog many AOS cases are being approved for green card without the interview.

Hello May Filers!

 

Today was my Biometrics appointment... or so I thought! I stashed away my I-797C notification of my appointment, and took it out last night for today's appointment. Unfortunately the Biometrics appointment was for June 3 not June 6!!! I was a mess last night -- mad at myself for making such a mistake, so I immediately booked in Infopass Appointment -- the earliest available being on June 20.

 

Now, I was reading on forums about just being a walk-in without an appointment; however, the Seattle office didn't state they accepted walk-ins. Still, I had a lot to lose if I didn't at least try, so I drove down and arrived around 8am this morning. The staff were VERY friendly and helpful, and the first woman I spoke to at reception said they are usually pretty friendly and good about accomodating people like me. Phew!

 

I had to wait about 45 minutes, but USCIS did fit me in for Biometrics this morning... boy am I glad! I sure learned a lesson -- double check everything, and perhaps look at important documentation well before the night before!!

 

Anyways, I am glad I sorted things out -- and that our application is NOT considered abandoned (as the letter stated if the appointment was missed). 

 

I hope everybody is doing well and reunited with their loved ones!
