IR-1 / CR-1 Spouse Visa Process & Proceduresvisa on hold because of my religion
Simps,

From what you have said, there are 2 potential red flags, lack of religious document and secondly that you and your wife met through a relative.

The pointers out here I am saying are to make sure you look your case from the CO's POV.

--According to Indian Muslim marriage act, both the parties need to be Muslim to be married. I would suggest you let your wife contact the Qazi who did the marriage ceremony and get a notarized statement from HIM stating that he knows you and to his best knowledge you are a converted practicing Muslim when you got married to your wife.

--As someone else suggested earlier, get affidavits from parents, try to get as many affidavits from friends and families of both sides, in US and also in India.

--With the assumption that your wife has told the CO how you two met, that is through her relative, try to make sure to get an affidavit from that relative too. This will show transparency, let that relative point out why he thought YOU to be a good candidate, make sure the affidavit states that you are a practicing Muslim and wife's family approves of that.

Usually when its an arrange marriage fixed by relatives of Indians living in US, CO's do scrutinize it, because a lot of cases are about deals made between 2 parties where money was given to the USC to bring a relative from India to US. You just have to make sure CO looks beyond those stereotypes in your case, just bombard them with all the proofs you can have and do go personally for the next interview, be confident with your answers.

Best wishes rose.gif

IR-1 / CR-1 Spouse Visa Process & Proceduresvisa on hold because of my religion
Indian Marriage system is a bit complicated. There are civil marriage where religion doesn't matter and then there are shot gun religious marriages, where both parties should belong to the same religion, if not then they have to convert. That's why India has Hindu, Muslim, Christian, Parsi Marriage boards.

Simps, did you have a civil marriage? That is apply at court house, then wait for 45 days and then finally get married OR did you have an Islamic Nikaah and then registered your marriage? If you had the latter then yes you will have to provide with documentation that both the parties are of the same religion. I am not really sure how Mosque would work, but they can give a statement but with Hindu Marriage of ours at Arya Samaj, they did give my husband a Hindu certificate, it wasn't anything official by the court of law but it was provided by the priest. We were never asked for it and religion was never mentioned in the interview but I would assume I would have to submit this certificate if it was asked at any point.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about G325 A and mailing I-130
I am not sure of your first answer, did he go to work there or just travelling, if its travelling then no he doesn't need to include that since residency is claimed after 6 months of stay at a place but if it was regarding employment, he will have to list that along with all the employments in the past 5 years.

But for the 2nd one, yes you have to mention the Unemployment period while filling G-325a.

Sealed envelop has her medical report. I don't know about Japan but in India if there is any problem with medical, the doctor lets the beneficiary know on the day of medical exam and beneficiary will have to do further treatment or exams accordingly.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow much is your phone bill?

Wonder if i should change to Vonage.

Currently I call through my cell and home phone by calling a Reliance Global Call number and then wife's India number. Cost is $1.99 a minute.

I use up about $100 a month just on talking on the phone. Luckily though we use the internet/webcam quite a bit too.

That's pretty high, try looking into airtelcall home, the plan I use to call my family in India is No rental plan and I pay 1.6 cent/minute.

I entered on Nov 19th, and no signs of welcome letter, SSN card, and green card I do not even expect. Today I went to the local SS office, and they could not even find my name in the system. I applied for a new one at the spot.

As I could understand, POE sends the content of yellow envelope to USCIS, and then USCIS sends the welcome letter once they get the documents? Does the welcome letter also contain the case number with which I could check my green card status?

are you serious? you should at LEAST get a welcome letter.. yeah, the POE sends the envelope to USCIS then USCIS send the welcome letter. it's a NOA with a receipt number which you could check your case on the USCIS website. my husband's status says this:

Application Type: OS155A, IMMIGRANT VISA AND ALIEN REGISTRATION

Current Status: Approval notice sent.

On December 9, 2008, we mailed you a notice that we have approved this OS155A IMMIGRANT VISA AND ALIEN REGISTRATION. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

How did you check your case status online for SSN? I mean which number did you put. Did you put the same number as you did in like WAC2008****** or is it some other number?

When I put the WAC one which we got with our NOA-1 while filling i-130, it shows me the old message of approving our case.

I haven't yet been to social security office mainly because I don't know the road directions out here and by the time my husband gets back from work its past 5 pm, so SS office is closed by that time, I am not in that much of hurry but still getting my SSN would achieve at least something and I can at least do some volunteer work, or get a DL rather than sitting at home all day.

What about i-1864/i-864a, can the joint sponsor be a friend of the USC who is willing to help out? Or is it necessary for the joint sponsor to be a relative?

Also, does a joint sponsor get any benefits in tax redemption for future as he is counting the applied immigrant to sponsor?

K-1 Fiance(e) Visa Process & Proceduresi need your advice
hello,

firstly as others have said a lawyer isn't really needed, even if you get a lawyer, it will be the part of you and your fiance to fill up the papers and arrange all the documents, like letters to each other, chat logs, flight stubs, things like that, you are basically paying a lawyer only to be a second pair of eyes and also to point out a few things if they are missing.

we have hired a lawyer ourself, i was against of it but my husband wanted one, we do have a kind of a situation, so lawyer did help so far. i have no complains with our lawyer, just make sure you choose from AILA.com its acronym for American immigration lawyer association, you can also find someone local through that site and its a legit site, almost nothing to fear about.

K-1 Fiance(e) Visa Process & ProceduresUsing EMAILS and YAHOO CHATS as PROOF ..... help!
I am an IR-1 filer and my petition hasn't yet been approved, but I can tell you what my husband did, he printed out the Inbox of his gmail, where there are tons of emails written to each other, basically you don't give out the content yet you do give out that you do have a bonafide relationship. And since gmail also stores every day chats in the same mail box, so it becomes much easy for us.

And really you don't have to make it all fancy with faces ( tongue.gif ) just make sure while printing the chat log, you are also printing the date and time, that is much better than the emoticons.

Hope it helps, have a smooth journey ahead good.gif

K-1 Fiance(e) Visa Process & Procedureschange case status
You can not change your case status like that. If you marry, you will have to cancel your K-1 all together and file either K-3 or CR-1.

Since you are so near to get an interview date, I would suggest to go ahead with the interview and give co-sponsorship papers, you will need joint sponsorship with all types of family visa, let it be K-1, K-3 or CR-1. If consulate rejects joint sponsorship (which I highly doubt) then look for a second plan, for now stick to K-1.

Best of luck good.gif

ETA: There was a case from Japan, it was on the news on Visajourney too, how the couple first applied for K-1 but because of wrong info given by US consulate in Japan, they got married in middle of the process and that beneficiary was actually banned for 10 years on allegations of misrepresentation. Anyways they did win the case but after going through a great deal of pain and suffering.

K-1 Fiance(e) Visa Process & ProceduresComplicated situation: Marrying Indonesian, but obtain greencard in syria
QUOTE (sweetchops @ Nov 16 2008, 08:20 PM) <{POST_SNAPBACK}>
im still confused. If shes married to me, why would they care whether shes shes a potential immigrant to USA or not. If she immigrates and stays in USA, fine, big deal. IF not, fine, big deal. i dont get it. Why should a regular Visa be harder than an Immigration visa.

Ok, just a guess. Are they afraid maybe she will get the Tourist Visa, then suddenly leave me and go to the USA without me and stay there? or possibly go to the USA to "visit" family, then run off and not come back to Syria with me? something like this? Thats all i can think of.

Yes to what you said, those are the usual suspects.

Plus lets evaluate a bit

Tourist visa?
Cost-- $131
Time to get ? May be 1 month at most, once you can slot an interview date online
Paperwork?Almost none

Spousal visa?
Cost--$ 825 + medical and other stuff, so lets calculate it as $1000
Time to get ? With DCF around 2-3 months, with other routes anywhere from 6 months to 1 year or even more.
Paperwork?3 steps, USCIS, NVC and then Consulate level, have to bring in Affidavit of support papers, which aren?t part of tourist visa.

There is a pretty big difference between immigrant and non-immigrant visa, so there are potential differences too. America deals with the largest influx of illegal and that?s why consulates are so tough on guarding their national interest (I am in no way taking their side, but these are the facts). A lot of people do abuse the system and that?s why it is hard to get tourist visa.

And not just for someone from a third world country like Indonesia, but maybe look into Canada forum and see how many Canadian spouses had to return back to Canada when they tried to come to US through VWP to meet up their US spouse.

So yes it?s a complicated system, but that?s how it is, it?s not that easy as you are thinking it is. Make a solid plan of what you want for your future, where you want to stay with your wife and then decide on which path to take.

Best wishes.

oh wow, so I can get her a tourist visa that lasts 10 years?? That would be real nice. is it multi entry??? And why would they deny it? I would find that somewhat offensive for them to deny my wife the right to visit my family (which at this point would also be her family) once a year. Would they actually deny her that right? I dont understand why they would allow her the VIsa to immigrate, but not a tourist VIsa to visit family once a year.

Because she is a potential immigrant. She has much more stronger ties to remain in US than returning back to Syria........so counter attack them showing she has more stronger ties to Syria than in US, thats how it works.

Ok, on the positive side, im glad to hear I can go through the procedures in Syria. On the other hand, im still confused about one thing. Can I go through the Immigration procedures in Syria, even if i dont have a set date for when to bring her to the USA? in other words, can i get the green light to bring her back, then just bring her back to the USA whenever I feel like moving back, whether it be in a month or in 5 years???

Assuming you would be doing DCF, once VISA is granted, your wife will have 6 months of time to enter US. DCF or any immigrant visa is for making US as your domicile, so no, she just can't have her visa and then decide to enter after 2 years of time. And once entered, she will have to stay in US making it as her permenant residency.

Another problem is, I dont know when I plan on moving back to the USA perminently (if ever), but obviously I still have to visit friends and family back at home at least once a year. It will be a little weird if I cant bring my wife with me and my family never meets her (doubt my family is going to come to syria). My grandma is getting old and id like for her to get a chance to meet her. Also we plan on having children at some point. So what do I do if I just want to bring her to the USA with me once a year or so to visit family for a couple weeks? I was told the immigration is only to bring her back perminently. ANd please tell me theres a better way than to simply get her a stupid Tourist visa, because Tourist visas for America take months to get for people from countries like Syria or Indonesia, and im not going to go through that every year if it takes half the year just to get the visa.

Option in this scenario is Tourist visa for US, but again she is an Indonesian citizen, so chances are slim to none for attaining tourist visa, but you can always try, will have to show strong ties to Syria (given you guys apply for tourist visa in Syria). As for whenever you guys have your kids, it doesn't matter where the child is born, as long as ONE of the parent is US citizen, child automatically attains US citizenship, you will have to report your child's birth to nearest US consulate and get paper works done for it and your child will get US passport.

K-1 Fiance(e) Visa Process & ProceduresIs VERMONT on fire now?? (fast responses)

I don't think there's any middle man. NCV accepted our case super fast, and then sent the case electronically to the embassy in Oslo.
You should be sure to email the embassy with your name in it. That's how we got things rolling so fast from there, I found out on the day they got it that they had it, and they sent my packet before they even got our papers in the mail.
I also scheduled my interview via email instead of snail mail, which made it a LOT quicker.
It's a great way to keep in touch with the US embassy in Oslo, and they respond pretty fast too!
Also if you live in Oslo, you should go to the gate of the embassy and deliver your packet, that's when they emailed me back and told me to schedule my interview that day!
I have sent probably 20+ emails back and forth with the embassy, stressing about everything, haha!

Hope your case goes fast.

K-1 Fiance(e) Visa Process & ProceduresHOW TO REPLACE AN IMMUNIZATION CARD
I found this article on the Jamaica Observer regarding replacing lost immunization cards. It has some pertinent information about possible means to replace the card rather than re-taking required immunizations.

Hope someone finds it helpful!

http://www.jamaicaob...MUNIZATION-CARD

HOW TO REPLACE AN IMMUNIZATION CARD
BY VICTORIA ROSE

Monday, January 05, 2004

An Immunization card is like a passport through life, which one needs in order to conduct business especially to do further educational studies at home or abroad.

However, while some parents tend to keep this important document safe for their children, there are others who are negligent. All Woman spoke with Dr Karen Lewis-Bell, Director of Family Health Services in the Ministry of Health to see how one can replace the card if lost.

She said that persons who have lost the card can first return to the clinic or private doctor's office where they got it initially. "Usually the records are there and they can try to get the information and a new card can be filled out with the information on file," she said.

What if the clinic or doctor's office no longer exists?

"If they went to a particular Health Centre and the record is not available, they may want to go to the parish's health department. Sometimes if the health centre doesn't have the record they may keep the files at the Health Department," said Lewis-Bell.

She added that persons needed to know the name of the health centre and when they got the card so that the information can be tracked. The records of these health departments would go very far back, she said.

Another alternative would be checking the schools that were attended by the child or adult as these should have a copy of the immunization card on file. Although at times this is not done, she said.

"Schools don't always keep copies of the immunization card. The immunization card must be shown on entry to the school because by law the child must be fully immunized in order to enter school. So schools should insist on getting a copy of the immunization card and keeping it on file," she added.

But if all this fails, the Family Health Director explained, then the person would have to get the shots again.

"If it is not from a Government facility and it is a private doctor then they may want to go back to the private doctor. Now if they can't find any of the records that way then they might need to go over the immunizations again and get a new record," she said. "If we don't have the record and we don't know, we can't take their word for it. Without actually written proof. we don't know."

She stressed that there should be no charge to the public to replace the card. "I know some regional authorities have instituted some fees on it, but that is not a policy of the Ministry of Health and we have advised them not to do that," she said.

She listed some of the critical shots that an adult may need to go over as a dose of Measles, Mumps and Rubella (MMR) vaccine, tetanus and polio.

Depending on the work that the adult does, she said, for example, if the person is in the police force, or is employed as a health care worker or fireman it would be essential for him or her to get a Hepatitis B vaccine as well.

Dr Lewis-Bell also stressed the importance of keeping this document safe. "It is very important to keep the immunization card safe and keep in plastic to prevent it from being destroyed by the elements. They should keep it in a zip lock bag if they have one or a thick plastic bag that is taped to keep it from getting wet," she said.

K-1 Fiance(e) Visa Process & ProceduresWhy does the procedures take so longer for some people and for others it's not

Sigh....I know what you are going through..I feel your pain and frustration b/c I am experiencing the same thing. Thanks for the advice

4clife, I agree with the previous post that you should email the consulate if you haven't received your interview date yet. You can email consularkingst@state.gov. If you received packet 3 and you sent the DS230 form to the consulate a month ago then there's no reason why you shouldn't have your interview set yet.

I emailed the consulate as soon as I knew that NVC had sent them the ppwk and then they emailed me back saying we could email them the DS230. My fiance signed it and emailed it to them the next day and then I sent an additional email the next day requesting they email me with packet 4 and the interview date. I got a response the very next day.

In your email just include your case #, your name and dob, fiance's name and dob, and put "2nd inquiry" somewhere in the subject line. I just got the email scheduling the interview on Thursday and my fiance's interview is scheduled for 10/13. Maybe if you mention that your I-129 approval expires next month they may be able to get you in even sooner. If you have a scanned copy of the DS-230 as well I don't think it would hurt to include it in the interview, just in case they didn't receive the one you sent in mail.

Hope this helps and good luck!

K-1 Fiance(e) Visa Process & ProceduresVery Basic K1 Question(s) Regarding Affadavit of Support
Hi there,

1. You do not have to include the Affidavit of Support with the I-129F. Your fiance will need that to take to the interview.

2. The I-134 is what you fill out for the K-1. Make sure you get specifics on what paperwork your embassy requires that be included. (how many years tax returns, w2's, bank statements, etc)

3. In my I-129f packet, I included a one page letter in place of answering question 18, entitled I-129F Supplement: Part B, Question 18. In this letter I explained the circumstances under which we met and the progression of our relationship - nothing too detailed but enough to establish the basis and strength of our feelings for each other.

Hope this helps - good luck on your journey!

Daisychain,

The online payment system is still on Beta stage, they can close it anytime they wish for, that's the reason they (customer representatives) discourage using online payment, though we all are looking for shortcuts, so we do risk that factor.

And I really am not sure why the morning customer care representatives don't give out the IIN, but it has happened to several of VJ posters where they could only get hold of IIN at evening hours, it has been the same with me too, my husband was trying to get the IIN for 2 days and finally got it through a few days ago.

Wish you all the best good.gif

You can pay your fee online now and can get the bar code sheet online like that, you don't need to go through James short cut anymore. Just try to get your IIN (invoice identification number) from NVC operator (try calling after 5 pm Est, and tell them you need your IIN for your record, dont mention that you need it for paying online).
