Um correct me if I'm wrong, but my US h usband only needs to send in a photocopy of all his passport pages right? Not a copy of his birth certificate as well?
Just checking...
Am starting to second guess the package as I'm sure everyone does!

Thanks,
LGG

That should be fine, you are just proving his citizenship. I just sent my birth certificate and I was fine, but the passport also shows his visits.

If one is a naturalized citizen then they need to send copies of their passport but if you are a born citizen then either of your birth certificate or your passport will work.

IR-1 / CR-1 Spouse Visa Process & ProceduresThe NVC is waiting for return of biographic forms from the petitioner...... WHAT DOES THIS MEAN????
Don't rely on NVC message, a lot of times they don't update. If your husband has sent both i-864 and ds-230 then talk to a customer representative on monday. Hopefully both the packets have entered the system together.

And once both the packets have been reviewed and there are no additional documents required, your case will be completed. Then depends upon which date of the month your case gets complete you will be notified of your interview date. But again, don't rely on NVC AVR, talk to the customer representative.

Also make sure you document the fact that you are a student right now. A student right now means you have a way to upgrade yourself in the future, right now you may be earning only 10k a year but once you complete your studies, depending upon whatever you are studying will show that you are on your way to earn 40k or whatever per year.

Do remember that you will also have to file i-134 or i-864 (depending which path you are taking, k-3 or cr-1 respectively). So you will have to document why are you getting yourself a joint sponsor.

Will it be like a cover letter saying why i am having a joint co cponsor? do i have to send them my school id and all that, and schedule as prrof that i am in school???????????i am actually trying for teh cr-1 and the form will be the i1864.... wacko.gif

i so appreciate your help....

Yes you will have to put a cover letter explaining why you need a joint sponsor. I am not sure if you need to put in your school id or not, someone else might help you with that. But I would suppose that it would be helpful to prove that you indeed are in school. Anyways don't fret so much, if you have someone to be the joint sponsor(who has sufficient income to show) then there isn't anything to worry about.

they use the address you provided on DS-230

Not in our case. With our DS-230 we provided my FIL's address because we were wanting to move out of our then address asap (was too small). We came to US but could't move out asap because of delay on getting SSNso we waited out for SSN before moving to new place. The current address we are in wanted to have my SSN too so that they can add me with their lease.

Anyways we got my green card on our then address rather than my FIL getting it. It worked out for us, because I got my GC and then 2 days later I got my SSN, so we were stuck in that old apartment.

So I am not so sure where they would send out the GC, as someone else have suggested contact post office and do the post forwarding, make sure you enroll your wife's name also with post office as the GC will come addressed to her.

i-864 form itself doesnt need to be notarized, but if you are usign a joint sponsor then you will have to submit a notarized document stating why you need one.

But other than that, its your w-2, tax returns, your bank statement, your past few paychecks, letter from your work.

I hope I am not missing anything else.

IR-1 / CR-1 Spouse Visa Process & ProceduresMUMBAI PLEASE HELP!
The guy at the window was really confused because they usually don't get much of CR-1 applicants. Most of the family based visas going through Mumbai consulates are F-1 visa, where the applicant not just submits i-864 but he/she also has to submit all the other documents such as bank statements, pay checks, employment letter and so on.

Since Mumbai consulate didn't give your husband any kind of note to what exactly he has to submit (which I find highly unusual because usually a consulate does note down about missing documents or any extra documents needed) so it is safe to assume that the guy at the Window wouldn't just take i-864 form, but he would want the whole Affidavit of support document.

The best you can do now is make sure you have all the other supporting documents as the AOS package when your husband goes next to VFS rather than just i-864 forms. It will serve you no good if you go only with the forms, you will have to submit the whole package again.......as per as my understanding goes. Someone else with better knowledge might add something or rectify me.

Best wishes.

that is just ridiculous. send bank statement, but why is VFS dictating anything? they do not have any authority. E-mail the Mumbai consulate and get the facts straight and show the e-mail copy to VFS once the issue is clarified. They cannot override what the consulate says. Has husband been given the new interview date? If not, e-mail Mumbai consulate and ask for one.

thanks all for answering. My husband had enough of it because the guy at the counter is confused himself. i dont understand how the interview officer said "TO TAKE ORIGINAL COPY OF I-864 TO VFS" and you will get ur visa. i hope we had the name of that officer. when he had an interview last month, he told them 2 please write a note so they wont trouble him but the officer said we do not have the authority to write a note... what does this mean? i mean its really stupid and they are making a big issue out of all this. i dont get it guyz.... but yes thanks for all ur response we both r so worried about it especially when im over here its so frustrating. yeah the scenerio is worse but they didnt give an interview date bc he already had 1 and i dont see a reason to do it over again. they told him to come on thursday hyst TO GIVE A PRINT OUT OF THE CHECKLIST. i think the guy is really confused and messed up in the brain bc we had all the required documents send to nvc and now the office in mumbai has it. i dont understsand why they cant look at that and y they still didnt give him our documents back. i was with him last month during his interview i just came back last week. im really confused guyz. hope u guyz dont have to deal with this #######! im really so mad and cant wait to thursday. o god!!!!!!!!!!!!

anybody have more advice????????????? PLEASE HELP! IM REALLY CONCERNED!

Try to send the bank statement asap. You can scan the bank statement and your husband can take a printout.

Sometimes files do get misplaced or there are times when they want more proof of financial evidence. Even if NVC sends everything, its always is the consulate that makes the last call.

Hope things work out for your guys, best wishes rose.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresPassport in Maiden Name, IR App in Married Name
Your visa will be issued on your maiden name because that's the name you have on your passport. Subsequently your SSN and your Green card will have the same maiden name.

It is not a problem, you can change all these once you come to US as well, given you do want to take your husband's last name officially.

Congratulations.

I don't think income tax would be an issue, as per as I can say at Chennai Airport, I was asked those silly questions about why am I going, how long have I been married. I was even asked why did I marry a non-indian tongue.gif

From my understanding, they usually don't ask immigrant visa holders about income tax anymore because your PCC covers everything, especially PCC from passport office. If you read the PCC it clearly states that government of India has no objections for you leaving India permenantly.

Tax clearance was a requirement in early 90s though.

I don't think its a requirement, however I think its just another piece of evidence to help prove your relationship.

Agreed.

I assume she got her passport after being married to you right? So why is your name missing from her biodata page. If you do want to be on the safe side, may be ask her to add your name on her biodata page, she doesn't have to change her last name but biodata page does ask for Spouse's name and given that passport was issued after marriage, your name should have been there.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat should we do?
You have spent enough time with your husband, so don't worry on that part.

One question, while petitioning i-130 did you mention about how you two met in a cover letter? If you did and if you remember which date you mentioned in that, just stick with it.

The interview you went through to receive affidavit of no contest was an informal one at the best. As Paris Heart said, it was an honest mistake, if somehow they did keep the record and did ask about the year of meeting, I am sure Govi can elaborate it perfectly. Please don't be so stressed, its not going to do any good.

Be honest and be positive during the interview.

Touched basically means whenever they hold your file. Usually a touch insures an impending approval but a touch can also simply means they are moving your file from one shelf to another.

Please as others have suggested go to USCIS.com and register your name and your USCIS case number, so that you can check the progress of your petition.

Do you see me using OR. It means anyone from Muslim country or anyone who is from third world country, which includes India too is bound to go through hard interviews.

Seriously I am done with you. My response was not racist, I never compared Iraq to Iran, all I said was -- Iraq, Iran, Cuba, Afghanistan or any other war ridden countries come under AUTOMATED EXPEDITE. Neither did I ever call Iran a third world country. Iran is Muslim country and like any other Muslim country, a lot of Male beneficiary are put under AP.

Now think what you have to think and do what you have to do.

The more you talk, the more I don't care to hear from you. You keep putting your foot in your mouth. First, you didn't have to shower my first and last name within your response. This isn't a dear john letter. What the He#L are you doing even trying to compare Iraq with Iran (apples and Oranges)???
How dare you even compare Iraq with Iran, let alone compare that country with any country where USA soldiers have gone to war, contracted soldiers, expates, and so many people have gone to war and died for our country and many innocent people have died. I am beginning to smell more than disparities. I smell a very prejustice uninformed person trying to make sense of their own uneducated misfortunes. Don't even try to use the input of HSB. You meant what you said in your two lines. You saw my spouse was iranian and you attacked his nationality. Your only two lines and now this response you have given here is loud and clear. You are a shallow thinker with narrow eyes. I am really finished with this topic. I got more information than I have ever wanted and outside the topic. I won't get my husband's tickets yet, because one of the people that may interview him, may have characterics and traits like you and AP him based on him being Iranian and they were the 99% thinker like you. mad.gif

QUOTE (trinket @ Mar 19 2009, 07:16 PM) <{POST_SNAPBACK}>
Lisa Momeny,

I am not sure why you are taking it so personally. I would have said the same thing if it was an Indian guy married to Caucasian woman going through Delhi consulate. May be not 99% in that case but there always is a big chance of him going through AP.

Just because I wrote in one line doesn't mean I was offending anyone. As HSB stated there is a big difference between someone coming on a non-immigrant visa and an Immigrant visa. An intending immigrant is bound to go through intense security checks compared to a non-immigrant one.

If you would like, you might want to look older post, last years post when a couple of petitioner from Iraq were flying threw USCIS while others were waiting forever. And both the petitioner were from VSC, anyone can vouch how slow VSC was last year. That's when I learnt how war zone countries or the countries which US counts as hostile gets automated expedite.

As I said I wish you best of luck, you don't have to take offend on every other poster pointing their views. I was no way disrespectful to you. Yes I posted an one liner, but I thought it?s a given known fact that anyone from Muslim country or anyone from third world country is bound to go through multiple checks and scrutiny. Didn?t realize people would take one line as offending.

I won't post anymore but I still wish you best, and hope you would try to see I wasn?t being offending to anyone.

Good luck.

--Then don't use your first and last name in a message board.

--I am not comparing Iraq and Iran. Did say earlier and saying it again, if the Petitioner belong to countries such as -- Cuba, Iraq, Iran, Afghanistan or any war ridden country, they get expedition automatically.

-- You are reading too much into it and basically calling me a racist.

I have been really very polite and I will continue to do so.
