First off, K-1 visa is for people who are engaged to be married. You are already married, so it doesn't apply for you, nor can you apply for K-3 because you already have an approved i-130 petition.

I am sorry but all you can do is wait. I am assuming that your husband comes from a Muslim background as you used Inshallah at the end of your question. I don't want to be a bearer of bad news, but a lot of Muslim beneficiaries are put into AP.

As others have stated you can't do anything other than wait, consulates do more of thorough background checks and you will have to wait for their verdict. If your spouse is all clear, there is nothing to worry about, its all the waiting game.

May be you should read through Administrative forum to get more ideas. You can also try MENA forums as a lot of MENA beneficiaries are put through AP.

If you are a hindu or your registered marriage certificate was from a civil marriage, then you don't even have to show your religious marriage certificate. But if you belong to other faith you may have to show your religious marriage certificate during your interview, you won't need your religious marriage certificate otherwise.

I got married to her under Muslim religious law and we registered our marriage at Indian Gov. registration of marriage. We have 2 certificates now one from Indian Gov and one from Religious person. So can i send both certificates for I-130 or just one?

So can u tell me if ur husband applied for I-130 petition from India of some US? and yes you are telling me not to send religious certificate so is it okay for me not to send? Whenever you do file i-130, just send in your Govt. of India issued marriage certificate, even for NVC send the same one, but do take that religious marriage certificate during your interview and everything will be fine.

If you want you can make an affidavit to be on the safe side, but really religious marriage certificate doesn't hold any merit if you do got the Govt. of India issued one, which you do.

And yes, I am Indian and my husband is white. My husband petitioned i-130 from US. Our petition went through California service center.

She doesn't need to apply for any visa regarding her visit, she is from England and they are one of the VVP countries. You can visit but you do risk the chance at POE, so be prepared for that.

Here is the thing, my native language is Bengali, I can speak it but I can't write that language.

As long as you are living in U.S., it will be o.k. for IR-1.
But you have to file I-90 when your I-551 permanent resident card is due for expiration.
That will cost $290 plus $80 for biometric.
Your permanent residency will not canceled as long as you maintain the residency in U.S.
But if your greencard (I-551 permanent resident card) is expired, you can not use the green card for travel, or other purpose.
So pretty much you have to renew it every 10 years.

You don't have to go back to India since you can file I-90 with USCIS in the U.S.
Permanent residency is granted to you, so your husband's death or divorce will not affect your permanent residency.

But if you make any crime or felony charge, you can be deported with permanent residency cancelation.
Also, if you travel too many times, or stay out of U.S.A for extended period, then USCIS may think that you are not living in the U.S., so they can cancel your permenant residency, and kicked out from the airport.


Thanks a bunch for the clarification. I just don't want to lose my Indian citizenship, US citizenship would be a great but as long as India doesn't allow dual citizenship, I would stay away from it and this clarification has really made things easy.

If you have been married less than 2 years then you get conditional greencard, that means your husband will get 2 year green card upon his arrival to US, and once he is in US you will have to apply for removing conditions to receive 10 year green card. I am not sure at what point of time you apply removing condition, as I was IR-1 beneficiary, but I think its 90 days before 2 year GC expires, someone can correct me.

For IR-1 couple, they automatically receive 10 year Green card upon arrival to US.

While you wait, the best thing is the educate yourself about the VISA process, and read more about the NVC process. There are shortcuts like this which will help you fly through the NVC process and will cut short the time from 2-3 months. The record time at NVC using these shortcuts have been 13 days.

Your wife can't move to US with 2 year visa after the approval of petition, but more likely she will have to go through the entire process which is NVC and then interview stage at Tokyo consulate. Once that is done and VISA has been issued she can move to US with 2 year or 10 year visa depending upon how long you two have been married.

You are correct, but sometimes POE officials refuse to stamp IR-1 even though beneficiary is entering US after 2 year wedding anniversary.

If your wife already had a tourist visa then she can try but as you have shown the concern about POE, it could be true. Just make sure she brings all the ties back to Brazil and also your i-130 notification or something, which will show that she has to go back to Brazil for the interview, thus making her stay in US temporary for the time being.

If you have only applied i-130 then it comes under CR-1/IR-1 visa, you will have to apply i129f to make it as K-3. Its better to stick with CR-1/IR-1

About the translator, it has nothing to do with Gujju community really. I am Bengali and the translator was sitting next to the American CO, I think they just sit for those just in case scenario, they didn't ask me if I need any translation or not, but the translator joked around with me because of my "Ganguly" surname.

That should be fine, you are just proving his citizenship. I just sent my birth certificate and I was fine, but the passport also shows his visits.


If one is a naturalized citizen then they need to send copies of their passport but if you are a born citizen then either of your birth certificate or your passport will work.
