IR-1 / CR-1 Spouse Visa Process & ProceduresG-325a
Hello all,

First of all hello to all you wonderful people who are out here helping each other and learning more and more about the process.

Hubby is preparing for applying IR-1 for me and I was wondering a few things about the G-325a form. First of all

1) My mom expired 15 years ago, so shall I put Late ABC while giving out her first name?

2) I do work for a private organisation but I am an outsource staff, so all I get is cash in hand at the end of the month, really don't have any proof of my working status other than my I-Card, they haven't and I am sure they won't issue me a working certificate (long story, but i don't complain with the payment I get), so I was wondering, shall I leave the working status as unemployed? or Shall I type in the organisations name any ways? Don't see the Consulate asks for any proof of work, but only asks me to name it.

3) There is an option with the form--"Applicant's last address outside the United States of more than one year." what shall I put in here, do I need to put the same address as what is my residence address or is this not applicable for me, since I have never been to USA?

Thanks all in advance!

thanks so much guys!! i really appreciate your replies so much!!

The interview letter usually asks the visa applicant to bring original and photocopy. Embassy keeps the photocopies while returns originals. But Embassy can keep any original, if it wants to. Don't forget to take proof of relationship and ongoing communication (wedding pictures, other pictures together, email printout, phone bill records, etc).

What if they don't ask for all these things, and you don't bring them, would they reject your visa based on that?? For my wife, I think she will take with her to the interview (when it actually gets scheduled, it has not yet, although the case is complete): (1) Interview Letter, (2) Medical Exam results, (3) Her Passport, (4) some photos with us together, engagement, wedding, etc... (5) any required passport-type photos that embassy may ask for, (6) the couple of letters which I mailed to her - we mostly communicate on the phone (calling cards etc).

However, she does not have a photocopy of my US passport - do you guys suggest that I send her a copy of this? Would the embassy want to see this? How important is that?

Thanks!

I would suggest you to send the copies of your passport to your wife. I have seen a girl getting rejected during my own visitor's visa, because she didn't have the photocopies of her husband's passport.
You can just scan your passport and email your wife and she can take the print outs at her place, that will be much faster way than to rely on post.

IR-1 / CR-1 Spouse Visa Process & ProceduresFilling up the form i-130
Hello Dunhill,
Thanks for all the clarification, but just one thing which I would like to know more

[quote]This form needs to be filled by the petioner and you just need to sign !![/qoute]

I don't see the form i-130 asking a signature of the benificiary, I only see the signature needed are of the petitioner, or am I missing it somewhere, if you can help me out with that.

Thanks again!

IR-1 / CR-1 Spouse Visa Process & ProceduresFilling up the form i-130
Hello all,
We are filling up the i-130 file and need some instruction about it, my husband is the USC and I am the benificiary, well I guess in this case I am the one wearing pants whistling.gif because my husband is too scared to take the responsibility of filling the forms, basically he can blame me later on if we get rejected because of wrong filing devil.gif
Anyways, here are a few things which I would want to get cleared with---

With the form i-130, question number 7
Other Names Used (including maiden name)

I was wondering, if I should place the Hindu name my husband got with it, he is a caucasian and we married through hindu rituals and he got a hindu name during that time, he has never used it in his day to day life, but shall i give it out anyways, as far as I have read the chennai consulate guidance, it says to bring religion conversion certificate during the interview time if the marriage has been done through hindu marriage law.

question number 10) Alien Registration number
what shall we give into that?

question number 13) Has your relative ever been to US.

I don't have any relative in US other than my Husband, who is a USC, so shall I put him in that catagory? If you suggest I do so, then what shall I fill in for the 14) number where it asks if the relative is currently in US, then how he or she arrived as, my husband is born there.
Basically what shall I put forth with the 13th number question, leave it as N/A or put my husband's name.

question number 20) If your relative's native alphabet is other than Roman letter, write his/her name and foreign address in the native alphabet.

I really am confused how to go about this one, my native language is Bangla, but even I can't write my name in that, I can only speak, and my husband has no clue about any Indian languages except Hindi, that too just the greetings and a couple of things, so what shall I do, shall I scan him how to write my name in Bangla and my address and let him copy that? As I figure it out, the i-130 is to be filled by the USC, so he will need to write in my name, or is it really necessary to fill it with the foreign language? All our documents are in English, I hardly speak Bangla at home or outside, its just a namesake native language for me.

Hope to get a solution of all these.

Best of luck to all of you!

IR-1 / CR-1 Spouse Visa Process & ProceduresStatement of petitioner while filing i-130
One quick thing, the phone records are from my side though, my husband usually calls me through his prepaid mobile and all the phone cards he bought for calling me, he never saved those, but I do have the records of me calling him also his dad and brother, will it work the same way or is it more essential that the given records should be from the petitioner only? I realise its a silly question but still want to make sure we put things together perfectly.

This visa journey sure has made me a perfectionist tongue.gif no more half hearted jobs.

IR-1 / CR-1 Spouse Visa Process & ProceduresStatement of petitioner while filing i-130
Hello all,

What all to write with the petition while filing the i-130? Should my husband (petitioner) write about how we met and how long we have been together plus why he rather wants me to be in US than him shifting to India?

And should he make 2 sheets, one for all the documents he is submitting along with the forms and another sheet for this petition?

Thanks in advance for any suggestions good.gif

I wasn't aware of that, and I guess my husband forgot about it. He was thinking about using UPS, but lets see, if not today then tomorrow for sure.

And yes, we have the cover letter with table of content and seperating each evidence.

Thanks for the reply,
The this is that, my husband doesn't have a checking account, he had some problem with aol internet service and just a few other obstacle, so that's the reason we are relying on money order.

Well as for evidence, I thought we will have more phone records, letters and more western union copies till the time I get to the interview time.

Actually not really sure about all the evidence, my husband thinks we are sending too much and I think we are actually lacking evidences tongue.gif

do a search on CR1 timelines and get an idea of how long it is taking for your circumstances -- figure out who would process you - California or Vermont - based on where you live, and look at your fiance's country and you'll find out what the recent trend has been.

Hello,

I am just wondering how to figure that out, I did go through the guides and all the readings but seems I have missed that part.

If it helps my husband(petitioner) lives in Indiana.

I do gather that Vermont is faster.

Thanks

IR-1 / CR-1 Spouse Visa Process & ProceduresRants of an alien spouse
You know, I have come to realise that this immigration isn?t everyone?s cup of tea. Some people just don?t want to talk about it, it does evolve a lot of negativity and separation and they feel they are better off not knowing about it at all.

I can very much relate with you, I am the beneficiary and though we do have a lawyer but it has been me doing everything, lawyer only worked as a second pair of eyes and did give us a few inputs here and there. I was going through a lot of frustration that my husband wasn?t as evolved as I wished he would have been, I wished him to read these forums, acquire more knowledge, read the guides but he just wasn?t going to.

So to make things simple, I just started giving him out "to do list". If I wanted him to scan something or print out something, or taking his 2x2 pics for G-325a (you guys wouldn?t believe it but it was me who made the call from India to the photo studios near his place and determined which photo studio he should go??..damn husband tongue.gif) I would let him know and he had 2 days of time to do it and it worked for both of us, he didn?t have to hear me talking and talking about immigration process after a hard day at work and I didn?t have to go through a frustrating time because of all this. I am hoping to continue the same when time comes for NVC.

Just wish to say that do look more into the whole situation, how is he otherwise, not just the process, not everyone likes all the paper work, so he is one of those guys. He did spend 2 years in your country, so I wouldn't say he is the bad guy, and at the same time you have the right to be frustrated and rant out.

Wishing you a smooth journey ahead.

I am just wondering, has there been any fast approval of i-130 from VSC?

I do see all the k-1's especially, january & february filers of VSC being processed within 30 days or 45 days time frame, but haven't yet seen any of the IR/CR-1 in the same position.

Yes, it has to be a certified copy from the issuing authority. Do know of dunhill from India getting an RFE because they sent notarized copy, so do more search on the issue.

Hi folks,

Well me and my dad were making plans of going to a few Eastern European (through that Schengen visa) countries and then to Bangladesh this summer. Well I really wish to go with him, can keep in touch with my husband through my lappy, so that won't be a problem, but I'm wondering will this in anyway might effect i-130 process? May be further AP or asking me to show police certificate from these countries during my interview at the last stage, I don't know really, just want to go for a 40 days trip.

Thanks for any help good.gif

Other than the usual ritual of checking visajourney in every 30 minutes and checking USCIS page every morning (though I am good at it, I check that only once a day).

Now the guilt part..........well you know, one of those astrology forums, where people give out free consultancy, well I did put out our(me and hubby) infos (birthdate..etc) and asked how soon thigns will happen and who will move where, even if he moves to India I am damn ready to embrace that.............but my shitty luck, not a single person answered my board question tongue.gif, so I guess we will live this online marriage for another 20 years to come jest.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresHow many times?
Am I the only one who checks USCIS only once a day ohmy.gif

Ok, may be here is the deal, I wake up every day at 3:30 am Indian standard time, to spend time with my husband, and that's around 5:00pm in Indiana, so well I in my head I have this idea that since its 5pm there so they(USCIS peeps) must have completed their day work and left for their home, so there is no need to keep checking every hour, and if I will get any approval I'll get an email alert right?

And once I am at work, I can't breath or do anything else other than work, thank god for that, time do pass by quickly at work tongue.gif

So basically time difference is my reasoning of not checking.

Oh, but I do check VJ every other hour devil.gif , just refresh the page to see if there has been any news or who all got their approvals

IR-1 / CR-1 Spouse Visa Process & Proceduresjust a small clarification
I am just trying to learn about the NVC process as much as possible, so I was going through all the topics and did see how most of the people who did use joint-sponsors, they are somehow related to the petitioner.

With our case, my husband's this year's income is well above the poverty line but we will need a joint sponsor because of lack of taxation of previous years, and a good friend/colleague(he is a USC) of my husband has lend his help in this regard. I was wondering if that would be ok or not, or does my husband really needs some relative to be the joint sponsor or anyone can be a joint sponsor as long as he/she is a USC and have filled past 3 years of tax returns.

Thanks for the clarification good.gif

I guess our lawyer is going to be our choice of agent but I am not sure. I have been reading other posts and there they were saying how their lawyer got the NOA-1 and then the lawyer forwarded them that receipt, but with us, its my husband (the USC) who got the NOA-1.

Hi lotto,

I am just wondering about one thing, when you make packages of i-864 and the IV pack, do you send both at the same time, or i-864 is sent by the USC while IV pack is sent by the beneficiary?

If that's the case, then can it be possible for the beneficiary to first send his/her IV package to USC and then USC sends it to the NVC (well this is totally for personal reason, I feel like when I am using DHL's $100 service, then I should also send a few personal items to my husband tongue.gif )

IR-1 / CR-1 Spouse Visa Process & ProceduresHow many of you have sent original documents to NVC ??
QUOTE
The NVC wants originals then completes it's case and sents us a embassy appointment letter directing us to their web site which says Ensure that all necessary original documents will be available at the time of the interview? Does this mean I have to get all those documents again? Or will we just need the passort, OF-230-I, OF-230-II, photos, and supporting evidence of relationship?

It only means US officials at some point would like to see your originals, say if you have sent your original birth ceritificate at NVC but certified marriage certificate, then during the interview you have to show them your original marriage certificate.
