I actually went to bed at 4 am (we had a fun filled drunken night tongue.gif ) and woke up around 11 in the morning. Then I went for some shopping alone while hubster was still sleeping. I had some chinese for lunch got back home by 2 pm, then me and Joe watched a movie, I also cooked beans in really slow heat while watching the movie. Once the movie was over we went for a small ride on our bike, did that for half an hour, went to Walgreens, got ourself some BB icecream and milk.

Got back home around 15 minutes ago, its 5:45 pm right now, Joe is playing his WOW while I will be online for a while and then around 7pm may be we will take our dinner tongue.gif

Yum!! BLue Bell ice cream, the best. I love the Cookies & Cream and the Continental Divide. BLue Bunny is also very very good/.

I love cookie dough, but my new favourite is strawberry plus home made vanilla.

IR-1 / CR-1 Spouse Visa Process & ProceduresG-325A vs. DS-230 - Native alphabet
I didn't write on both and it wasn't a problem at all. Even at VFS when I went to submit my forms, the VFS guy out there asked me if I want to fill out the native alphabet thing, when I told him how I can't write my name in Bengali, he said its ok to leave it blank.

IR-1 / CR-1 Spouse Visa Process & ProceduresChange of Address?
If your inlaws are getting the mail then there is no need to notify them. Whenever you will receive your approval notice it will come to your inlaws place and also you can do all the future corresponds for NVC from the same address.

USC has to show domicile and your inlaws address works perfectly.

IR-1 / CR-1 Spouse Visa Process & Proceduresis it true????!!!!???
There are factors for AP. There are cases from India, especially from Delhi consulate that the couple are Christian but still they are put into AP, reason-- Inter-racial marriage.

Almost all the inter-racial marriages from Pakistan gets a home visit from Islamabad consulate.

Most of the time AP has nothing to do with USCIS, sure USCIS approves cases on their own basis and they hardly care about your religion or country but all these matters when the petition comes to the interview stage. COs are trained to work according to cultural pattern of the country they are working in. I remember someone from Chennai consulate got into heated interview just because his wife was 2 years, only 2 years older than him.

So yes, its true that if your spouse is from Muslim country or he is a Muslim then there is a big chance of him going through AP.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat does Final Review mean???
Final review basically means the head supervisor needs to review it one more time and stamp it with case complete. Usually there are other staffs reviewing your papers and when they find everything in place then they give it to their supervisor for one last review.

So your case completion should be soon enough.

IR-1 / CR-1 Spouse Visa Process & ProceduresK-1 --> K-3?
QUOTE (NatashaW @ Mar 29 2009, 11:09 AM) <{POST_SNAPBACK}>
star_smile.gif UPDATE 2: We just spoke to an immigration attorney experienced with K-1 denials/revocations. After hearing our story, he thought that one possible red flag to the CO was that my fiance applied, in the year before meeting me, for tourist visas twice to the US and was denied (this is not unusual for youngish unmarrieds in his country). The attorney suggested we get married and then I submit an I-130. He was careful to warn us to be sure to still respond to all inquiries based on our original K-1. In fact, he suggested that, once my congressman confirms with Vermont that they've received our application (bounced back by the CO based on 221g), I should submit a package of materials to Vermont with our version of events at the CO interview plus tons of our supporting evidence (photos of us, alone and together with friends; chats transcripts (1 for each week), postcards, cards, letters, phone bills, etc.). He also explained that we could let the K-1 process continue without marrying, but that it would take significantly longer. Either way, he was optimistic that we'd be successful.

I thank all for their suggestions and words of support.

NatashaW

good.gif I think this is a really good suggestion from the attorney. Its good to see how positive you are and not all gloomy and doomy. I really hope carefully taken steps will give your fruitful results rose.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresK-1 --> K-3?
If you do decide to marry and reapply again, then may be it would be better to go with CR-1 than with k-3.

About your K-1 denial, have you tried to contact your senator, congressman and see what you can do. Sometimes abandoning K-1 might help, it has 4 months of life anyways.

If you do follow CR-1 or K-3 path, make sure to send a whole lot of evidence during your initial filing as well. It will help you at later stage during consulate interview, CO will not be able to deny the fact that you didn't have any evidence if the same thing occurs again, your congressman can question CO on the basis of what was submitted during USCIS processing.

I wish you good luck rose.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresOverstayed in Hong Kong
I don't think overstay will be a matter for US government. US is only concern about people overstaying in their country.

But yes you might need PCC if you have mentioned her staying in G-325a

IR-1 / CR-1 Spouse Visa Process & ProceduresDS 230 QUESTION...
DS-230 needs to be filled only by the Beneficiary.

Part 1 should be signed by the beneficiary and part 2 will be unsigned, beneficiary will sign PART2 in front of the CO during his/her interview at the consulate.

IR-1 / CR-1 Spouse Visa Process & ProceduresThis I-130 case has been sent for a standard interview
I remember of a woman whose SO is from Mexico and who filed around the same time as we did for our i-130 and she got the same letter.

She did post an update a few month's back saying she was still waiting for the interview. I am really not sure what happened to her case though. If I can find her name I will let you know and you might contact her. I will do a few searches and let you know.

IR-1 / CR-1 Spouse Visa Process & ProceduresDid your passport have your maiden name during your interview?
QUOTE (jiskat08 @ Apr 1 2009, 09:09 AM) <{POST_SNAPBACK}>
Eric, ur wife shud have a passport with her MARRIED NAME.. the consul will be checking her passport and of course since she is married - all her documents should be in married name..

I told her about it.. She can go to an agency and it will take for 10 days OR if she wants, she can go directly to DFA here in Manila and after 3 days, she can get a new passport (with MARRIED NAME).

That is wrong that a woman has to take husband's last name. It should be your choice. All my papers were done in my Maiden name and I am still carrying my maiden name.

Why I didn't change-- because I like my name as it is, and my husband didn't care if I take his last name or not. Name wasn't a problem at all.

Now if Philippines have some kind of rule that a wife HAS TO take the last name of her husband, then may be you should do it.

IR-1 / CR-1 Spouse Visa Process & ProceduresPCC from Ahmedabad, Gujarat, India
This is getting ridiculous every time I hear stuff from Ahmedabad. There are no frigging rules for a woman to change her last name and they can't force someone to do so.

I agree what K.D have said, you have to put some pressure on them, see if your wife could directly talk to the head of Passport department.

IR-1 / CR-1 Spouse Visa Process & ProceduresPresue a K3 for faster processing.
Will he get a French PCC if his status becomes illegal? If so then I guess you can take the chance, US consulate will only be bothered about PCC. Plus there is a better chance of your husband not going through AP being in France, but no guarantees on that, because I remember last years Iranian case going through South Korea where the male beneficiary was put through AP, it was a short term AP though, guess only around a month or so and they were expecting it.

I am not sure how the processing time are going right now, but do your research and see if K-3 is processing faster or not. Last year a lot of people had to take a back seat because they applied for k-3 instead of stand alone i-130.

I think CJ Vasani was one of them who was saying how it cost him around 3 months because of i-129f filing.

IR-1 / CR-1 Spouse Visa Process & ProceduresWill this affect my husband's petition?
Is your husband is petitioner or the beneficiary?

Either way it shouldn't effect much given he had steady job for the past 3 years, if you guys can show his last employnment letter and also bank assets it should work out.

If your husband is the beneficiary, it won't matter at all.

Best of luck in these tough times rose.gif
