ktdc is right, please don't confuse people. 2 PCC are needed, one from the district which issued Indian passport and another from the police station where the applicant is living currently.

About how long will it take to get PCC, it truly depends upon district to district, in my case it took exact 1 month, but I have seen others from Delhi or other places in north where it took only a few days.

PCC of passport will have to be from the district his passport has been issued from, so if his passport was issued at Siliguri, that's where he will have to get the Passport PCC, but if his passport was issued from Delhi then he will have to get it from Delhi office.

As for Police PCC, he will only have to get it from his current residency, that is in this case is Delhi.

Yes, just my dad because my mom passed away long ago. It is not a child care provider kind of a situation but is still attached. You see, my husband will get only one week off and we don't have any other friends or family to provide me some assistance for the first few weeks. So I requested my dad if he would come for a couple of months and help us a little which he has agreed to.
Ok, I will send him the information regarding pregnancy but I will ask him to keep it as backup, only answer if asked. Thanks a lot.

Hey Visajourney folks,
It has been a long time since I have lurked in these forums but here is a little background. I came to USA on IR-1 back in November 2008. I have been eligible to apply for citizenship for a year and half now, but I never applied since I really don't see a need for citizenship. Anyways, my husband and I are expecting our first child this spring and we were hoping to have my dad visit us for couple of months to see his first grandchild. So he is applying for tourist visa that is B-2.

I will be sending my dad all the required documents, as in copy of my green-card, copy of boarding pass of me and husband traveling to India three times so far in the past 4 years, proof of my pregnancy and as such. And of course my dad will have all the required documents showing the properties he own, his bank records, telephone bills showing ongoing calls between us, his monthly pension, my brother's birth certificate proving that my dad has another child who is in India and he will have to come back for him. Also just to add my dad is 61 years of age, so he is a senior citizen.

But what I am wondering is, do I need to send a notarized invitation for my dad? I don't mind to send it, but I feel like even if I post it, he might not get it in time because of the bad rep Indian postal system has got for themselves. I will scan the document and have him take a copy of the scanned document but will that be enough? From the Consulate website that I read, it seems like they didn't focus much on invitation letter. But I do realize its better to be over prepared.

Anyways, any help in this matter would be greatly appreciated. Thanks again.

I also wanted to add that the interview was very smooth for him, he was only asked 5 questions

-How many kids he has
-What both of his kids do
-What does he do
-Which all places in USA he intends to travel
-And how long his daughter has been living in USA

My dad said they didn't ask to see any financial information from him nor any proof of ties to India other than the question regarding my brother who is currently in India, which I kind of found weird, but oh well glad it was smooth for him. So the pregnancy question never even came since they didn't ask why he is traveling to US.

iwaiting, Thanks a lot for DOS suggestion, I totally forgot about it. Anyways, I just called them and they said everything looks good, it's only showing as Administrative Processing because consulate takes 24 to 48 hours to print the visa, but visa has been approved.

My dad just had his B2 visa interview an hour ago and at the interview they told him that his visa has been approved and he should get an SMS alert in couple of days to let him know when he can pick up his passport. So it was a good news, but then I went to CEACStatTracker website and when I put his information it shows that his case is in Administrative Processing. Does it mean they need to go through the paper works again or is it just that I am checking the VISA status a bit too early since it was only an hour ago that he finished his interview.

-- Simple notary will work, but to be more certain do email Delhi consulate and ask them.
--When you go for your interview, before the actual interview, there is a small interview with an Indian CO, who verifies all the documents submitted, most probably you will have to submit your 10th pass certificate and other proofs at that point of time. But as ELW said, don't offer till the time you aren't asked.


ps-- The affidavit ELW has posted is done by notary public, so you will be safe with doing it with any notary public rather than going to Megistrate.

Arya Samajis has their own temple. Our took place in a school actually run by Arya samaj people tongue.gif Let me list some sites for you. Make sure you really educate yourself about the marriage laws, if possible find a lawyer, everything should be done within 500 dollars, shouldn't even take that much but given you are Amreecan and how they would love to rip you off for some money tongue.gif. We did have our marriage at Arya samaj but we never registered the marriage with District court (we were too young that time, me 22, husband 23), it didn't create any problem but I was a nervous wreck with the whole visa process because of it. But you make sure that you register the marriage with District court.

This is Arya Samaj Marriage portal.

Basically you get married under Hindu marriage act, which is almost similar to Civil marriage, because Hindu Marriage act gives both the parties equal rights, anyways you get married under that and then you register your marriage. Registering civil marriage takes around 45 days but by having a Hindu marriage you cut down the time and have it registered within 1 week.

You can have an Arya samaj wedding and then can register it within a week. There is no rule that both sets of parents need to be there, the rule with Civil wedding is that court house will put in your marriage date and if anyone has any objection they can come and complain within 30 days.

For Arya samaj wedding you will need to convert into Hinduism though, its just a ritual thing, you won't have to register your conversion officially, once you convert you can have the wedding next day. Also you might need a No objection letter, basically a notarized letter stating that you are free to marry in India, you can notarize it at Delhi consulate, I think they take a fee of $30 or something for that.

Asking for CV is very common in Family visa given the applicant has degree on technical field. It is kind of an extended background check, where they make sure you haven't worked for an organization which might be related to any terrorist groups or any sort of things. I have seen at least 1 case from India (bio or nuclear chemist) and 1 from Canada who were asked to submit CV.

Not sure about how long it took for the Indian one to get his VISA back after he submitted his CV but with the Canadian one I think it took around 3-4 weeks time. Anyways there isn't anything to worry about, Consulate is just trying to make sure they cover up all the bases, so submit your CV and it will be a few more weeks time before you hear something.

I am really not sure at which forum to post this topic, but just posting it with South Asia.

Anyways, reading all the good/bad experiences at the consulate level and the whole of visa journey made me wonder about something, how was it say 20 years ago? In the 80?s or 90?s, do realize it used to take around 2 or 3 years for the CR-1/IR-1 visa and K-3 has been introduced after 2002 or sometime around that.

I wonder if the beneficiary spouse was allowed to come to US while CR-1 is still in progress.

I don?t want to jump on to conclusions but if the SO wasn?t allowed then do feel the present Visa journey followers are much luckier than them.

Just wondering what the situation was like around that time. Did they have any loopholes to bring their spounses sooner than what we are going through, say around 10 to 12 months approx. or was it harder, may be the screening wasn't but the whole process was much more time consuming than what it is now.

I know it doesn't hold any relevance in today's time but just wondering about it.

We have just filed our i-130 but we (more of me the wife) are pretty skeptical that we might get an RFE based on that our marriage wasn't registered.

So me and husband have talked about it and have decided for him to come to India and get the marriage registered if we do get an RFE. The question is the requirement of No objection letter.

He is already married to me, he is just coming to India for registering, so what kind of a No objection letter should he make? and also I do know in India he can have it done by any of the US consulates, but what if would want to come prepared from USA, which department should he contact in USA for such a no objection letter?

Also, since I am from Port Blair, I have talked with a couple of lawyers and registrar office here and they all say it will take around 45 to 50 days to get it, they don't even want their hands to be greased innocent.gif , but I do know and have read other VJ members having it done within 1 week. Just wondering if you guys can show me which lawyer to get in touch with for speeding up the process?

I think that would hinder her case even more. She is already married and has claimed so with the USCIS, how can she apply for K-1 in this case? Most probably if she goes that way, it will be taken as Fraud.

India has both religious marriage laws/boards and civil marriage law. If you are a born Hindu, you don't have to convert or you don't need any conversion certificate. But there are many factors to it, OP, does say her father is a muslim, may be OP has a Muslim name/surname given by her father's side, and that raised the question of being a born Hindu. Also, did OP only have a religious ceremony (with pundit and family member) without attaining any kind of Certificate?

I am trying to more and more learn about the whole process, I think I have grasped the USCIS part but NVC part is still unclear to me, but hopefully I will learn it by the time we get to that.

Ze22, I do realise that you have sent your original certificates, just wondering how safe is it to send the originals? I am more thinking about notarising it by any of the public notary officer.

We have just started our i-130 petition, but I would like to educate myself as much as I can.

I was reading through the Indian posts and have seen a few people saying how they went to Delhi embassy to submit their DS-230.

Well my consulate is Chennai but I am from Port Blair, so its not easy for me to travel back and forth. So I would like to know is do I have to submit DS-230 at the Chennai embassy personally or I can post them. I do realise I have to go there personally when I get an interview date and when I have to submit the police certificate and other documents, which will be only 10 days prior to the interview.

Also as Dunhill pointed out "We should get attested/certified copies from issuing authorities it self!!"

Do I really have to take those from the issuing authority? Because we got married in Jamshedpur and that means I will have to go to Jamshedpur to get them attested? Or can These be attested by any gazetted officer?

First of all sorry to be bumping onto an old post tongue.gif, but reading this made me think for a bit.

Here is the thing, I am a born Hindu, I have never in my life worn a Bindi other than on our wedding day. I am Bengali, and in our custom, married woman is ought to wear some red & white bangles and sindoor. Again I don’t wear those. What I wear are my wedding ring and a gold bangle which has another crust of iron inside it (it’s another Bengali custom).

My husband is white, and he is more into Hindu religion than I am, though we first met online through Yahoo's Hinduism chat room, but our views on religion are different. He is more of a Bhakti marga kind of a guy, where as I am more of an Advaitya kind of a girl. I don't believe in rituals.

Well what I am wondering is, I know its going to be something in a long run(slap myself and remind to stop making future plans already headbonk.gif ), but whenever in months to come or may be in a year to come, and I have to go to Chennai for my interview, should I be the good Indian girl, wearing Sindoor a nd a Sari(again, worn that thing only 4 or 5 times in this 25 years of my life on earth) or should I just be me?

For DCF, you will have to live in India for at least 3 months or so, actually the guidelines at Delhi embassy isn't clear, they only say for a certain amount of time, so most people take it as 3 to 4 months of time, plus you have to take care of another specific, that is you can't be living in India on tourist visa, you should acquire an Entry visa if you wish to go for DCF in the future.

If I am not wrong, then Delhi embassy works as USCIS, gives the approval notification (NOA-2) and forwards it to the local consulate, that is Chennai in this case.

But I am wondering, who works as NVC? The i-864, where do you submit that?
