My husband was almost jobless from 2005 to mid of 2007, so there are no tax returns of him of 2005 and 2006, but in 2007(from august to december) he earned around 20k and counting that his annual income should be around 40k.

According to USCIS guidelines he should get a joint sponsor because it asks for last 3 years of tax returns, but our lawyer and a lot of people here says that he won't need a joint sponsor.

I think we will go ahead filling the i-864 with w-2 and his pay stubs and employment letter.

We have recently been approved at USCIS and we are looking forward to the NVC process but our biggest obstacle right now is my husband?s tax return papers, which he still hasn?t got it.

My husband did file this year?s tax return as married filing jointly, with my notarized passport and everything (he applied on 9th of April), anyways we weren?t sure if his tax papers got lost or something, but yesterday he got a mail from the state tax (Indiana) stating that addressing me (the beneficiary) which basically said this-->

So after getting this mail, its clear that IRS hasn?t lost his papers but they are taking their time to issue the returns.

I know there still is time for AOS part, but what if he still doesn't get his IRS returns by that time. Now my question is, what shall we do? Should my husband go ahead with i-864 with the help of joint sponsor or should he wait for say a month of time to get his IRS return papers?

I do hope my husband will get his tax return papers by the time my interview is scheduled, and may be we can show it that time.

You will need one PCC from Police station which is compulsory and another one is from Passport office. A beneficiary isn't needed PCC from passport office IF his/her passport is less than 6 months old, but if its more than 6 months old then he/she has to get that PCC from passport office too.

Asia: Southmarriage registration help
Hello folks,

Well I have one of my biggest fears that our petition will get an RFE based on the fact that we didn?t provide any court documents with our marriage, though I have provided my government issued electoral and state identity cards where my husband?s name is stated.

Anyways, I am trying to prepare for the RFE, if we do get it, then my husband will fly to India and get the marriage registered.

Now I have talked with a local lawyer in Port Blair and he has suggested 2 ways of doing it, one is pretty fast, takes only 2 days where as the other ones takes 1 month time.

1) Both me and my husband takes an oath in front of a notary officer and he provides us with the notarized certificate.


2) On the first day of my husband?s arrival, we go to district court, signs some papers, wait for 1 month, get back there sign some more in front of the district magistrate and get the court stamped certificate.

Now my question is, which one shall I choose, the first one sounds more tempting but I don?t want to do any more blunder mistakes. So if you guys can help me choose, I would really appreciate it.

Note, that the last para is for the notary officer. This is the usual basic, now I don't know if you both are of the same faith or not, it shouldn't matter if you are get married as Civil law, but if you are first doing customary marriage or getting married through Arya samaj, both of you need to be of same religion.

India doesn't allow dual citizenship, but PIO and OCI(overseas Indian citizenship) are replacement for dual citizenship.

With OCI you can travel in and out of India anytime you wish for and you can also work here, other than government jobs or things like you can't run for any political position, but you can buy land and other sorts of things.

But basically its you who needs to decide do you want to give up your Indian citizenship or not, you only hand over your Indian passport after you have been granted citizenship of any other country, in your case it would be of USA.

Well I did receive my NVC case number, and all this time I thought it would be Chennai for us, but its Mumbai.

Anyways, my husband will be coming to India during our interivew (whenever it happens or if it happens), I would like to know, does Mumbai consulate allows the US spouse to be at the interview?

Hello folks,

I finally received my PCC from passport office today, which is good news.

But while at the passport office, the officer out there told me to get ECR stamp on my passport; he said it will be easy at POE, now I was doing some googling when I got back home.

I am doubtful if I should get ECNR (emigration check not required) stamp or ECR (emigration check required) stamp?

And also how important it is? Do realize it won?t have much value for IR-1 visa to USA, but I do see list of other countries, and if I would like to visit them ever I might need either ECR or ECNR.

Basically I am clueless about this whole ECR thing and if someone can clarify it to me.

Your time line says you already have got the visa last year, so not sure who you are asking this for. But here is the checklist for DS-230 to be sent to NVC


--2 Passport Size Photographs (2X2 inches) of the Beneficiary
(Write down NVC Case# and Beneficiary?s Full Name and Date of Birth on the back side of both the photographs lightly)
--Completed and signed form DS-230 Part 1 by the Beneficiary
--Completed and unsigned form DS-230 Part 2 by the Beneficiary
--Photocopy of the Passport?s Biographic Data Page of the Beneficiary
--Original Birth Certificate of the Beneficiary
--Original Marriage Certificate of the Beneficiary and the Petitioner
--Original Divorce decree if applicable
--Original 2 Police Certificates of the Beneficiary ? One from the Passport office (this is optional if the passport has been gained not more than 6 months time) and the other from the Local District Police Station

PCC is equivalent to CBI check. At least for Andaman, I had to apply at superintendent of Police and then SP forwarded my application to CBI, a CBI officer came to my house, verified things, took photocopies of my marriage certificate and passport copies. Once cleared at CBI, they forwarded it to local police station, PS summoned me, I had to write down a few more things, things like who is financially responsible for my immigration. Once done at PS, PS forwarded it back to SP!

May be things are different here because it?s a union territory and we have a bit different emigration rules out here.

Not sure for K3 but for CR-1 NVC schedule interview by second week of every month for the next month. So the Interviews for October will be scheduled by 14 September.

And with the new online payment CR-1 is much faster, may be only 2 weeks more than K-3 anymore. The fastest it took was 23 days for case to complete at NVC.

Indian consulates are better for giving out interview dates; beneficiary doesn't have to wait for months unlike other consulates.

Did you use Indian Postal Service? If so, their Speed Post for USA is partnered with USPS and you can track your mail. I was trying to find that specific link for you, but I guess Indian Postal Website has gone through some changes since I last checked.

I should clarify though about that 5 month thing, it happened only once, I do usually use Registered Mails of Indian Post to post packages to my husband and he gets them anywhere from 10 to 20 days, but not sure why he it took 5 months for that specific package.

I used DHL 4 times till now and though its expensive yet it took around 5 days from Andaman Islands to Southern Indiana.

Now I have also once used Speed Post from Indian Post office, and my husband got the package exactly 5 months later........you just gotta love them. Glad it was just random things for him, no official papers.

I have actually called Lilavati Hospital and booked for a November 11th medical checkup. The lady receptionist was quite helpful on the phone and told me they have inhouse physicians who I will have to go after done with my labs.

One question though, she said to bring 2 passport size photographs of mine, I forgot to ask her about the size. What kind of passport photo did you submit, I mean 2x2 US standard size or Indian size passport photo was sufficient?

I have asked this question on IR-1 forum but posting the abstract of it at regional forum too in hopes I might get some valuable answers.

This is for people who have done their medical from Mumbai. NVC lists 2 labs in Mumbai for medical examination, which one is nearer to Mumbai consulate? Breach Candy Hospital & Research Centre or Lilavati Hospital & Research Centre. Also according to their site they have just listed Labs, but no physicians have been prescribed. I do assume that once all the checkups are done, one has to go to a specific doctor with those reports, so which doctor/doctors to go after lab work is done or for Mumbai the same labs does the evaluation work also?

One can file DCF from Delhi embassy, but you should be staying in India for more than 3 months for that and any other visa than Tourist visa. Basically you will have to show residential ties to both India while you were staying and also to USA as your domicile.

Also its required to submit bonafide relationship proofs during initial i-130 submission for DCF, so be ready with joint bank accounts, rental lease, bills and all.

I recently had my interview in Mumbai consulate and my USC husband wasn't allowed to enter.

Before the interview, I did email Mumbai consulate asking if my husband can join me for the interview or not and they did reply with a Positive answer but on the day of the interview, guards didn't allow him to get inside, even after us showing the Print out of that email, they said if my husband will be needed he will be called.

Anyways just go there and be prepared to wait outside.

I have seen couples in my neighbourhood back in India who never had child and it was ALLRIGHT. Sure once in a while they would hear some remarks about how child makes the life fulfilling and all those blah blah but I have seen them sticking to each other.

With desi mindset, yes there are a lot of couples or especially men who go on to find a new wife or try to find a surrogate who can fulfill their (more like their family's) wish.

Not wanting to get personal, but what is your mother in law's take on this subject? I think that will be the most essential thing in your relationship. Your husband will be living with you in US, so you don't have to worry about him hearing things from his relatives other than his own mother. He won't be constantly asked about when you guys are having a kid and that will take off a lot of pressure out of this whole issue.

And as others have said, please don't give up hope. I wish you all the luck rose.gif

It's not a problem. They must have taken blood sample of your wife and they do the blood test. They determine which vaccines to take depending upon the blood sample, age and sex of the intending immigrant.

In my case, I had to take 2 vaccines, I guess one was MMR and I forgot the other one. Another girl who was with me had to take 3 vaccines and she was asked to continue her vaccination after entering US (I guess it was something like, you take one shot today and the next shot 3 months later)

Anyways she was a K-3 applicant and I was IR-1 but both of us went through the same procedure.

Go for CR-1. If it wasn't for this site we would have went through K-3 as well, but after reading through and looking through timelines, we decided for CR-1/IR-1 and I will say it has been the best choice.

Also look for which service center your brother will fall into, compare the timelines of service centers, so you will know what to expect with i-130 approval.
