sorry to intrupt, but i hv one que.. i'm indian citizen and here on 2 year conditional green card cr-1 visa...
i wana go back to india in june.. do i need visa or any other paperwork done??
for how long i can stay in india??


No, you don't need any visa, you are an Indian national. For how long you can stay, India won't stop you for however long you want to stay but since you are a Green Card holder, you might have problem entering US if you stay in India for more than 6 months.

Being a GC holder of US, you will have to satisfy the residency requirement of US govt.

Do check the consulate service menu and they do have OCI listed there.

You will have to have a good reason to expedite your interview date. Since you are CR-1 applicant, NVC will allot an interview date. I checked your timeline and according to it you have received your DS-230 instruction package on 3rd of Dec. Have you sent it out yet?

There really aren't many people who had their interview expedited, what you might be referring to are people who got their K-3 interview date and changed it to CR-1 interview.

But either way, you will need a good reason, something like medical emergency of sort to expedite and it will be done by NVC.

Asia: SouthI have some questions regarding getting married
There are a few things to look for before you get married in another country.

--Marrying in Morocco means, your husband's interview for k-3 will be done in Morocco, given you do apply for k-3
--You can apply for CR-1 in which interview would be in Pakistan.
--According to Pakistani culture and norms CO might have his/her suspicion about you NOT meeting with the family of your husband, unless they are also going to travel with him to Morocco. If not then be ready for added scrutiny.

I personally would suggest you going to Pakistan and meeting with his family, that will show family approval and also you will get a first hand idea about the life in Pakistan. You don't have to marry in Pakistan, you can do the engagement ceremony and file for k-1.

I doubt mailing to the consulate will be successful. Consulate doesn't take anything directly, they however do go through VFS. So your best bet is to call VFS Calcutta or Mumbai and ask them if they can accept a mailing package on behalf of your case number.

US embassy/consulates used to give out no objection letters earlier, but they have stopped issuing no objection letters anymore. But what you can do is write out a notarized statement claiming how you are eligible to get married outside of your USA jurisdiction, if you have any prior divorce do make sure to attest those too with your notarized copy.

You can make the notarization copy in USA, at any bank for free or shell out $30 at any of US consulates in India.

There is a fine line between, Registered marriage and marriage registration.

Registered marriage is in other words a civil marriage.

With what I have talked with the local lawyer, according to him both takes 1 month 10 days time no matter what. One party has to show domicile of that given district for the past 15 days, both man and woman (let it be you are married or you are intending to get married) go to the court house, signs a few documents infront of the district magistrate and then you will have to come back after a months time, sign some more papers and you will be issued with your registered marriage certificate.

Only significant difference is that, if you are intending to get married then your and your would be spouses name will be projected at courts enquiry board and also you guys have to give a publication at local newspapers saying if anyone has any objection regarding this marriage they can contact with the district court for that matter.

Now, there are ways to get through every thing in India and most of the places will, but at least its not the same from where I come from, I did offer the lawyer any extra money but he said nothing can happen, I do have family members working at the district court but they too can't "speed" up the actual process.

Whichever way you choose do let your fiance contact a local lawyer and get things sorted out.

Also, whenever you do make the trip to India, do make sure to have a notarized statement from USA saying how you are free to get married to any consent adult of any nationality. US consulates in India used to issue these no objection letters which are a requirement with Indian courts, but US consulates have stopped it, however they can help you with notarization for $30 fee I guess.

About that link, sorry I don't have it anymore, I am not sure but I do think it was with the OP laurarajesh's case.

Since I have been dealing with this issue myself and preparing for the worst with my i-130; I would like to say that "cash" isnt' always the king.

One of the vj members was denied visa at Delhi on the basis that the USC didn't stay 1 month in India prior to getting the marriage certificate, I guess they got the marriage certificate within a week's time or something like that and the official requirement for let it be an Indian by birth or a foreigner is 1 month 10 days to be exact.

I do realise that not every case is being scrutinised like this and every case is different, but then it's better to do it proper way than being sorry later on. And also with what all I have read, it feels like you can do things giving out cash in some parts of India but not every part.

So may be asking your fiance to contact any of the local lawyers of her/his district will be a good idea.
Also are you a OCI? Just make sure your fiancé go to any local family based lawyer or registrar office and clear up things beforehand.

Oh another thing which I have seen is, if you have less time and your fiancé doesn't live in any municipal area rather his/her domicile comes under any panchayat raj, then a certificate given by the panchayat holds as much value as registering, since panchayat is part of the Indian government.

Please do more searches and see what all options are available for you and your fiancé and move according to that.

The biggest risk I see is damage done to your property by outsider, if you don't have relatives living near by or someone who you trust isn't taking care of the property.

I am not just taking about the physical damage but also your tenants taking over your property over the time of years. So make sure you have foolproof lease agreements and all the other legal aspects are taken care of.

I don't think Mumbai Embassy allows USC or anyone to accompany the beneficiery. But you can call to double check.
They told my wife that they will mail the passport in couple of days when she went to VFS to pick it up.
It might be just because it was MLK holiday the previous day so they might have been backed up.
Sometimes you do get visa same day, sometimes not. It all depends on them. But they are pretty punctual with their courier system. My wife recieved her visa in couple of days.

True that, Mumbai doesn't allow anyone other than the visa applicant to enter the consulate. We did email them prior to the interview and they did say USC can come along, but when it was time for the interview, they didn't allow my USC husband to enter.

But like any case, if your husband can come and can wait outside that too helps, just to show them he is there. You can have his passport with you while you are in the consulate.

About getting the passport back, we got it back the next day from VFS, on the day of the interview CO did say they were having some technical problem so I might not get my passport the same day from VFS. So I had to make another trip but it was worth it.

I think its all white for all the Indian consulates. Honestly I don't remember getting any slip after my visa approval, I think CO just said visa is approved and I went to VFS with the receipt slip VFS provided earlier when I paid their courier fee.

I wore jeans and a shirt, no sindoor, no bangles nada. I don't wear any of those in my day to day life, I choose not to wear it for the interview either. There were 6 spousal visa applicant that day, all ladies, no one wore anything shiny, either jeans or a simple salwaar.

Uneventful, relaxing Sunday. Lots of soccer and beer. Yay for Germany!

It rained all morning and then it got really hot in the evening. I made fried rice and pork in a sesame and ginger sauce. Rustled up some bread pudding for dessert. I start work this week so I'm looking forward to getting out of the house.

My V-day was really nice. On Saturday hubster got me dozen roses, chocolate and my favourite wine. I thought that was sweet enough and wasn't expecting anything else. But on Sunday morning he surprised me with an Asus Notebook :D

We didn't go out anywhere for dinner because of the snow but I did make his favourite South Indian dishes :P Masala dosa and sambhar.

My husband got laid off from his job in October, the only work he could get was in Tampa, Florida - 3,000 miles away from me! :( He's been there since November. However, the business there just got sold to another owner (who is letting all the current employees go) so he's returning on Tuesday back to California. We are so happy we will be together again but he will be jobless so... hard. Hope he finds work soon. :help:


Hope he finds something ELW, Californian economy is really bad right now, have you guys thought about moving to another state?

I know right :lol: for some reason Joe thinks I would be much safer in a car than a bike. He doesn't drive after a near death accident, so we really need a car to commute. And plus he is tired of my everyday nagging.

We didn't do anything really, watched movie together (Memoirs of a Geisha), I drank wine while Joe drank brandy. We discussed big plans for 2010, reflected back at 2009.

Didn't go to the German restaurant because it was too cold and also decided to be cheap this year, got other big plans to focus on smile.gif. I actually started cooking after midnight, Joe decided to help, by help I mean standing there and opening can of tomato sauce tongue.gif.

I will be sending a big package in a few days (dad ordered 8 non-duality books and I will add in some Belgium chocolates and a snuggie for gramma), but I will send it through either fedex or dhl because I just want to make sure the package reaches them in time or my dad will make me buy another set of the same book.

And Twisted tongue.gif I am not from the same hometown as your husband is, but I did get married at the same town. Your husband is from Jamshedpur (beautiful city and got a whole lot of relatives living there) and I am from Port Blair.

I have sent some money to my brother but they were from western union, I don't really trust Indian postal services with money matter or valuable items.

So the 4 day weekend is over and all I did was a lot of online shopping, slept through out, worked out a little bit and youtubing. I didn't have to cook this weekend because on Wednesday Joe's boss did an awesome bbq and we munched on the left over for 4 days.
