Mother's income can not be used in this case as she is the foriegn beneficiary. What daughter needs to do is get a joint sponsor (brother if he is applicable) or use assets if possible.

You can only file k-1 after she gets her divorce decree. The requirement for K-1 visa is that, the couple should have met physically within the last 2 years of filling.

K-1 is the fastest visa but she won't be able to work as soon as she comes to US. She will come to US as your fiance and then you guys can get married here in US legally.

Yes, once the divorce is final and she gets the divorce decree in her hand, you can marry her the next day if possible.

Now about how to bring her to USA. You can't file in Peru unless you are living their for at least 6 months and then apply for DCF. Assuming you will be back in US after the wedding, please file CR-1 visa. K-3 and CR-1 visa takes app. same amount of time and with CR-1 she can come and work in US asap also CR-1 is cheaper compared to K-3.

Please start by reading through the guides, you have lot of time to understand all of this before you get married, so prepare yourself.

Take a lot of pictures when you go to Peru to visit her, letters, emails, phone records, bills of buying wedding ring or wedding dress, as many trips as possible you can make to Peru.

Also not trying to scare you or anything, but her current divorce may be scrutinized at Consulate level. It all depends upon if she was still living with her husband when she met you or not, just things like that. I am not asking you any question, but just giving you a heads up about what to expect.

Please be in these forums and read as many threads you can related to Spousal visa, which will give you a good idea of what to expect and also how to prepare. There is no time limit of how soon can she come over to US, as this process is kind of unpredictable, she can be there within 4 months then again it can also take 2 years time.

Which consulate you would be going through? With recent cases, Delhi and Chennai have let USC spouse enter consulate, but Mumbai doesn't allow. To be on the safe side, ask your husband to get a permission from whichever consulate you are going through by emailing their IV department.

We went through Mumbai consulate and my USC husband wasn't allowed inside, so were other USC's too going through Mumbai.

But none the less its almost is a good thing that your spouse is with you, even if he isn't allowed into the consulate, make sure you have his passport with you as a proof that he is standing outside.

I guess it depends upon who all he counts while paying his taxes, that's how you count the sponsor's household member, so if he and his wife files joint sponsorship then he needs to earn what is 125% of 3 people (him, his wife, and you).

Size of the household will increase if he has dependent children and how many children.

With fiance visa make sure your fiance bring a whole lot of ceremony photographs but also make sure those photographs doesn't indicate any marriage ceremony by any means. I always say, Delhi is notoriously known for asking proofs like reception hotel bill, list of at least 20 guests other than family members, vendor bills.

If you didn't have a traditional engagement ceremony make sure you write a notorized affidavit saying that. Other good thing would be bringing affidavits from family and friends who can attest that you guys are engaged and they have known you for a while. Also proofs like phone bills, postal letters with stamped envelop, emails and chat transcripts would be good to carry.

Regarding questions, its the usual, if you are naturalised US citizen then your fiance will be asked questions like, when and why you went to US, at what year, what is your educational background, where do you work, how much do you earn, where in US do you live.

Just make sure your fiance is confident in answering all the asked questions and on a side note, this happens only with the rarest of rare cases, sometimes American CO accuses of fiance to actually be a married couple but still trying for K-1 visa, and they do make the intending immigrant sign a paper stating she/he committed fraud, so just make sure doesn't matter what happens, let your fiance be firm with what he/she says and don't sign any such affidavit.

Yes, Delhi has some really awful stories of these kinds. Sorry to hear what your fiance had to endure.

About your question, no, he won't be asked for a second interview. Your fiance has to submit all his documents at VFS within 4 month expire period of your approved 129-F.

As others do, just make sure you load them with all the papers possible, don't just take affidavits from parents, but also take affidavits from friends if possible.

All the documentation which were asked from your fiance, it seems like he has a common Muslim name, so even though you submit all your papers at VFS, please still be prepared for AP (administrative process). Since CO was insisting on names and things like that, it is very likely that your fiance may be put for extra review.

ETA: CO must have provided your fiance with a paper, 221-g, which should have list of all the documents asked, so do go through it properly.

You can have a church marriage and then register the marriage. I am assuming that you are the Groom, so make your would be bride some run arounds at the local court house. Marriage laws are pretty confusing in India, every state has their own rules and regulations, actually not just state, but every district follows their own time frame for registering marriage.

It can be done in some places within 1 day but in some places it might take up to 45 days. So ask your SO to go to the local district court and get all the info needed. They might also need you to get a No Objection letter, it will be a simple letter which you will have to notarize in US by any notrary public.

I never knew its a custom in Canada to keep shoes outside. Makes me happy tongue.gif It's the same in India and I had warn my husband from the start that once I come to US, he can't enter the house wearing his work shoes. It wasn't much of a issue for him, he takes his shoes off at the stairs before entering the house.

I do wear slippers in our apartment though, and those slippers never get out of the apartment. It was the same back in India too, you have shoes and sandals for outside and for inside you have your own slippers.

We hardly ever have any guests, so I haven't really had the issue of asking others to keep their shoes off, but I never know what to do when I go to someone elses house, by habit I take my shoe off at the door step, but sometimes they think its amusing how I take my shoes off.

Try to make her independent. I loved it the most, every woman is different but for me it was a blast to go on buses on my own, do the shopping on my own, even if its simple grocery shopping or buying cloths for me.

I walked a lot, trying to understand the roads and directions. Teach her how to pay bills online, how to use electrical appliances which she might not have used back in Philli. In Asian countries people aren't that used to canned food, so it might be a big adjustment for her. I am still not used to all the sodium infected prepacked food of America, I stick to my home cooking.

The more things you do on your own, you gain confidence, you know you can talk, communicate with people without any help. If her English is weak, let her take some classes.
