IR-1 / CR-1 Spouse Visa Process & ProceduresThis is a pilot guide, need your feedback...
Lotto,

Can you add something with your step by step process about Affidavit of support.

I will let you know something briefly about my own case, our visa process has been pretty smooth till now, but when me and my husband met for the first time online and then a relationship began and he started to look through immigration process, what really stuck us was the 125% of poverty guideline, there was it stating for 2 people 125% is 16k (talking about 2003-04) and I dont know why or how me and my husband were counting it as add 125% to that 16k amount, so that would mean add 20k to 16k thats 36k, and that time around my hubby was earning 19k per year, so he was above 125% of poverty line, anyways just keeping it short thats what hampered our whole time frame, we basically lived these 4 years of LDR because of that one silly mistake.

So if you can just keep it more clarified and I really wish no other couple would do such mistake like we did.

Thanks again for the good work good.gif

This looks great lotto,

I have one suggestion, why not include a format for affidavit from friends or families that they are aware of the relationship. We didn't use any because we had other proofs but still others may need it, also at least with Indian consulates they do ask for these affidavits during interview time.

And did you hear anything yet? its going to be 12 noon in anther 2 minutes in India.

Wish your wife all the best

K-1 Fiance(e) Visa Case Filing and Progress ReportsPacket 3?
Hi FB14, I am waiting on packet 3 as well. This is a good link I found last night from another Jamaica VJ member a few months ago. You can look at the letter she posted that shows exactly what packet 3 looks like. It looks like once your fiance gets packet 3, they just have to send in the DS-230 right away in order to have the interview scheduled, then everything else gets taken to the interview.

Thanks again to DarlingNikki for the help.

See below!

Nicole-N-Nattoy, on 27 January 2011 - 02:34 PM, said:

A lady from the embassy called Natoy and told him she was emailing packet 3. In her email she said to send in DS-156, DS-156k, DS-157, DS-230. THAT IS WRONG!! You are to only send in DS-230pt. 1 for and interview date.

Natoy then went and applied for a non-impediment to show he has never been married. Runs around 8,000JA.

After we sent in the DS-230pt1 there was another problem becuase in the email it also told us to send to Monroe RD. NO WE WERE TO SEND IT TO OLD HOPE RD. So Nattoy went and filled out another DS-230 and sent it to the right address.

Then a week went by and still no packet 4. So Nattoy emailed kingstonivinfo@state.gov. He put are case number on the subject line which will get you a faster response. Then BAM!!! 10 minutes later they emialed us packet 4!!!!!

So now Nattoy has everything he needs for his interview. Except the medical and police certificate. He is going to kingston 2maro to get his police certificate and fingerprints which will cost around 4,000 JA. He has scheduled a medical which will cost 100US at the door and aroud 50us for each additional shots he may need. Which shouldn't be much becuase he has his past vaccination records.

Closer to the interview he will get the passport pics he needs and I also sent him 5 passport pics just incase. He will also pay his visa fees at the apprpriate bank. I sent him everything he needs from me so I think after he gets police certificate and medical and pays fees we will be good to GO:) Hope this has helped.

Hope this helps!

K-1 Fiance(e) Visa Case Filing and Progress ReportsCertificate of No-Impediment to Marriage

Interesting little piece of information I hear from my fiance yesterday.... and just seeing the receipt via Skype now!

He went to the Registar's Office in St. Ann's Bay and they now charge $6,600 for the NO IMPEDIMENT expedited!!! So the price has gone up and get this, They told him they're delivering the form to him?? They sat him down and wrote down the exact directions to his home, and he's waaaay uppa bush, and said they'll be delivering it in 3 days, to his door.

#######??

Hi EagleEyed, my fiance lives in Falmouth but he went to the RGD in Montego Bay and ordered the expedited No impediment as well. He didn't have any problems, although it did take longer than 3 days. I think it took 9 business days and the courier called him to tell him he would be in Falmouth at a certain time so Lance met him at a store there. There were several other people waiting as well. All in all, it went pretty smoothly.

K-1 Fiance(e) Visa Case Filing and Progress ReportsCertificate of No-Impediment to Marriage
Hi Katie, he will have to have the certificate of no impediment to marriage for his interview. He gets it from the Registrar General's office. It costs $5500 JA for the express service, which is supposed to take 7 days, but if you look at alot of other posts on here you will see that it has taken longer for alot of people. Once you get the NOA2, it is one of the things he will have to work on getting for his interview.

K-1 Fiance(e) Visa Case Filing and Progress ReportsCertificate of No-Impediment to Marriage

Here is an email I received today (08/30/2011) from the Registrar General regarding the Certificate of No-Impediment to Marriage. My fiance lives in MoBay, so I'm assuming anyone could go to their local Registrar General's office.

I hope someone else may find it helpful!

"Please be advised that your fiancé? can visit the branch office of the Registrar General’s Department in Montego Bay and apply for the No-Impediment certificate. He will need to provide the information to the Customer Service Representative. He just needs to give them the details of his birth his father’s name and the parish he lives in since age 16 in Jamaica. The cost will be J$5500 and the turn around time is 7-10 business days.

If there is any other matter you will like us to address please feel free to contact us at information@rgd.gov.jm

Do have a great day. “We aim to satisfy”"

Just wanted to note, Lance went to the RGD and they told him he had to have his birth certificate to apply for this. So even though it was not requested in the email from them, they apparently do request it at times.

Thank you Nikki!! I appreciate all the advice I can get! Our I-129F was approved on August 24th. Do you think it's too early to have him apply for the no-impediment now? I don't want him to get anything too prematurely but I am trying to get him as prepared as possible! I just don't want anything to be outdated by the time we get to the interview.

Thanks again!

K-1 Fiance(e) Visa Case Filing and Progress ReportsK1 Visa Expedite Process for I-129F
I agree, people who have more extreme emergencies should apply for the expedite and should also receive it. Unfortunately I am not the USCIS and cannot control their decisions. I personally decided to request it based on my information and I'm happy the USCIS made the decision that they did. I thought this was the kind of group where I was supposed to share good news and share the information I was learning about the process with others going through the same thing, but I am new to this group so maybe I misunderstood.

K-1 Fiance(e) Visa Case Filing and Progress ReportsK1 Visa Expedite Process for I-129F

WOW!!!!! I did not know they had expedited services. I have ran into some changes in my life that I am in need of my fiance getting here like two weeks ago! So does he still have to go through the interview process in Kingston? I have retained a lawywer do all my paperwork so do you think that will make a difference? Like should I have him do the request or should I do it myself? WOW!!! Congradulations to you for think so smart!

Thank you Crystal! I am so happy! As to your question, the expediting only applied to the i-129f petition. Now that I have the NOA2, as far as I know everything else progresses normally. Meaning, the application still goes through the National Visa Center, and Lance will still have to have his interview just like normal.

If you have circumstances that fit into the criteria for expediting then I think it could be worth it to call the USCIS and request it (it obviously worked for me).. On the other hand, since you are probably so close to having your NOA2 anyway, then I don't know if it will really speed much up for you.

Good luck!! I hope you get your NOA2 soon!! Maybe your fiance and mine will have their interviews right around the same time. :-)

K-1 Fiance(e) Visa Case Filing and Progress ReportsK1 Visa Expedite Process for I-129F
I am definitely not an expert on this, but I don't think it hurts to try. I would just frame your request within one of the USCIS guidelines to expedite. That was the first question they asked me when I called. If you can frame the request within those guidelines then I think it's worth a try!

LOVE IT!!!! so happy for you/yall! and kind of jealous... and wondering if I can do the same with my fiance in Mexico

Obviously we ALL (all k 1 visa people) want to be with our fiance's as soon as possible. I know I cant think of anything else. I sent the i-129f packet out a few weeks ago, i got the NOA1 saying they have received it.

could I send a request to expedite if my fiance wanted to come here and be able to enter school (university) by next year? would that be a viable reason or not?

K-1 Fiance(e) Visa Case Filing and Progress ReportsK1 Visa Expedite Process for I-129F
My I-129f Request for Fiance visa has been approved as of yesterday, in 29 days!! Today is my birthday and getting the email that it had been approved was the best birthday present ever! I am pretty shocked that the request to expedite worked. I read a couple forums that talked about it though, and I thought it wouldn't hurt to try. I had a few people ask me about what I did to request the expedited process so I thought I'd put it in the forums in case others were interested as well.

So here's what I did:

I called the USCIS at 1-800-375-5283 on August 16th and followed the prompts regarding the fiance visa process until I was able to get a customer service person on the phone. I just asked her about the possibility of requesting an expedited case and she read off the expedite criteria (see below) and asked me which one applied to me. I told her that I didn't know how financial loss was measured, but I would lose one week's pay if we don't get the visa this year. I have arranged to take a week off unpaid from work in December in order to go to Jamaica and bring Lance back with me, but it can only be used this year. She just typed in a service request that said just what I told her, and told me someone would review it in approximately 5 days and would let me know if they needed further information. On Wednesday (the next day!), I got an email from USCIS requesting more information. Here's what it said exactly:

"The status of this service request is:
Your request for expedited processing has been received. We are unable to determine whether your request meets the expedite guidelines established by U.S. Citizenship and Immigration Services due to lack of information in your request. However, you may submit a letter/documentation as to your financial loss to self/company You may fax the letter/documentation to..."

On Friday August 19th, I faxed the letter to the number they had given me. This is what I did - I typed up a 1 page letter explaining that I had arranged to take time off in December to go get Lance and bring him home with me, and that I would lose the time and a week of pay (I included the dollar amount of the one week of pay) if we didn't get the visa this year. I also put a couple extra lines in about why I want to go help him relocate (i.e. there are members of his family I haven't met yet), and apologizing because I initially thought the entire process took about 5 months and that's why I arranged to take the time off in December. I was very polite and just stated the reason why I was requesting the expedited processing. I also had my boss type up a simple letter on company letterhead confirming that I have arranged for an unpaid week off in December and that I cannot roll that time over to next year.

I didn't get a confirmation from the USCIS that they received the fax or receive anything else from them until last night (August 24th) when I got the following email:

"Application Type: I129F , PETITION FOR FIANCE(E)

Your Case Status: Post Decision Activity

On August 24, 2011, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice."

Honestly, I'm pretty shocked that this worked. I figured I would probably have to have a much better reason involving life or death or something, but I think they just look at your request and as long as it makes sense and seems valid, and you can support it, then I think they will consider it. Either that, or we just got really really lucky.

Anyway, I hope this helps!!

Oh - I included the criteria from the USCIS below.

Good luck!
Sita

Expedite Criteria per USCIS:

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

Severe financial loss to company or individual
Extreme emergent situation
Humanitarian situation
Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
USCIS error
Compelling interest of USCIS
Note: Discretionary expedite requests for petitions and applications that have Premium Processing Service available will not be considered for expedite processing. The only exception is when the petitioner is a not-for-profit organization designated by the Internal Revenue Service. For information regarding premium processing, please refer to the premium processing webpage.

If you have already filed your application or petition:

You can make an expedite request by contacting the National Customer Service Center (NCSC) at 1-800-375-5283. The NCSC will take a “service request” and forward your expedite request to the office with jurisdiction over the application or petition. You also have the options of 1). visiting your local office by scheduling an InfoPass appointment or 2). writing a letter to the local office or service center.

National Visa Center (Dept of State)What should be done after IV FEE Bill Generation
PCC is police clearance certificate. Your spouse will need it while submitting DS-230 package. She will need to get PCC from both her local police station and from passport office. I can't give much detail about how to acquire it because PCC is usually country specific, so may be you can ask about it at regional South Asia forum.

QUOTE (rajkumar_cool @ Sep 11 2008, 08:33 PM) <{POST_SNAPBACK}>
Hi Everybody,
I am PR filed I 130 for spouse and I paid AOS Fee and send DS 3032 which is processed already. I called last night and NVC represantative told me they generated IV BILL and I864 package on sept 9, '08. So what should I do now? I was thinking to pay my IV BILL before I receive the letter. Is it good to pay if so do I have to call them and get new IIN #, Is it same IIN # as of AOS fee bill. and what amount should I pay? How long it normally takes to receive letter after it is generated.

And can I save time getting the signed copy of DS 230 now from my spouse who is abroad? If I can does the DS 230 can be black & white copy or it needs to print in color one? And what other doccuments should I get from abroad to save time. Please help me!

I will be very thankful to all of you. Your help will be highly appreciated.

1) Yes you can pay your IV bill online, it will cost you $400. (once you log on to the site, you will see IV bill being mentioned)
2) IIN number doesn't change, its the same
3) Once paid IV bill wait for a couple of days till it shows being PAID on the payment website, take the print out of BAR code cover sheet and send it along with DS-230 package
4) It usually takes anywhere from 4 weeks to 8 weeks to receive letter from NVC, we paid online and we received after 8 weeks, but don't wait for package from NVC if you are paying online. That's the whole motto of online payment, to make things go faster.
5) Do get DS-230 from your wife, DS-230 should be printed in black ink and of good print quality on 8 1/2" x 11" 20-22 lb white paper.

Also ask your wife to get her PCC so that she can send those along with her signed PART 1 DS-230 and Unsigned PART 2 DS-230. She will also need to provide her Original or Certified birth certificate, your marriage certificate, divorce certificate if applicable.

Best of luck good.gif

If you are waiting for your DS-230 forms, then I do think you have paid your bill already at NVC??

Doubt Lotto's guide will be helpful to you anymore now that you have already paid your bill, maybe you can try Jame's Shortcut and try generating the Coversheet.

If you haven't yet paid your bills then please go through lotto's shortcut lotto's shortcut is much faster.

Just wondering, how do you say out his date of birth?

Don't get me wrong, but this might be a matter of British and American English difference.

Say your fiance's DOB is 4th of September 1970. If I have to write it, I will write it as -- 04/09/1970 ..........Where as my USC husband will write it as 09/04/1970

So may be you are saying the British way and they are saying its wrong because of that.

Okay,

that makes sense. Wife and their agent keep saying you have to. I looked at all the documents and I was like wow I sent all those already. Why would the Consulate send us that Packet 4 and the appointment letter. You have an appointment right after us did you receive that sort of letter in the mail yet.

My husband (petitioner) did receive an interview letter package from NVC, I really didn't ask him what all is there because more or less its the standard package.

I am just waiting for my own interview letter or will have my husband forward his letter to me.

I am wondering, can my husband scan the interview letter and I can use the print out of that scanned letter for Medical and courier fee?

This is what I think crazysamurai. Packets are outdated. If I remember correctly Mumbai consulate wasn't Appointment post around 8-9 months ago, I am not sure of the term to use, may consulate post or what, but do think that's where the confusion is all about.

With appointment post you send everything to NVC and then NVC forwards the same to respective consulate. And this is what present situation is, as far as I can tell, others who have recently been through Mumbai consulate for CR-1 visa, they haven't submitted any other additional document other than their courier fee, courier fee is mandatory, even if applicant decides to get their passport later at the evening of the interview.

I really hope, people who have been through recently would shed some light into it.

National Visa Center (Dept of State)What is VFS?
VFS accepts cash, as a matter of fact for CR-1 they will accept only cash.

Its better if you also bring an original copy of the DS-230 form for VFS also. By rule CR-1 applicant only need to submit the courier fee, copies of passport, their interview letter and two 2x2 photographs, but there have been times (including mine) where they demanded for me to submit DS-230 plus the photocopies of whatever I submitted with my DS-230 at NVC.

So basically be prepared.

Your wife will have to submit these (check this link ) at VFS kolkatta, make sure she submits these 15 WORKING DAYS prior to her interview. You can calculate the days by going to this vfs holiday list make sure to eliminate Saturday and Sunday too while counting 15 working days.

If your wife is submitting everything in Mumbai, then she can submit 10 to 7 working days prior to her interview. If she chooses she can submit her medical at VFS (either Kolkatta or Mumbai) or she can take her medical at the interview.

Does the NVC schedule the interview before they forward the package to the embassy or will they forward it and then schedule the interview?

National Visa Center (Dept of State)Getting letter from Bank for I-846 needs.
Hmm we just took printouts from banks online monthly statement. I don't remember us sending those at NVC but we did take those for the interview, never had to show those though.
