Fill out the removal of conditions form I-751 by using your married name. That should get you a green card with the last name you want. Alternatively, file I-90 and pay the $$ for it.

Everything you sent them before plus more current:

- bank statements - covering the period you already sent and from December onwards to now (if you have online banking you can print the statements)
- copies of car insurance/medical insurance/renters-homeowners insurance - if you went to a doctor, copy of a bill or invoice from doctor or your medical insurance's explanation of benefits (EOB)
-taxes - since you sent in ROC in December you didn't have 2010 taxes done - now you do - get a copy of the tax transcript and mail it in
- any mail sent to both or either of you showing the same mailing address
- copy of lease or if you live with your parents a notarized statement from them saying they're renting to you for X amount of money and that you and your husband live on such and such address
- copy of utilities bills - you can call up the companies to fax you past bills/invoices which you paid
- cellphone bills
- car registration
- beneficiary designation from employer indicating each other as beneficiary
- life insurance
- wills

We did send in our tax returns with what was downloaded from turbo tax online. After reading up on that looks like we'll probably get dinged on that. Anyone else have experiences with that?

You're fine, don't worry about it. Do expect up to a month for NOA1 to be sent to you and check to be cashed. This seems to be standard procedure with USCIS these days.

Why not use the drivers license plus SSN card? Employer doesn't get to request what proof you show them - it's up to you. I never showed my GC, always DL plus SSN card and it was enough.

She said I was suppose to get a notice in the mail before my green card expired, that its time to remove the conditions or whatsoever, but i didnt not get anything. I'm assuming, it is because we moved after i got my "papers" 2 years ago. So if they sent anything it was to my old adress. :/



Yes, it goes to the last address they have on record for you - even if you did the AR-11 and I-865 for husband as your sponsor, it will still go to the old address.
Make sure to include form G-1145 (free) to track the status of your new case.

Married on November 2009 jointed bills and bank account only on August 2010….we were a little lazy in taking care of that and honestly no time to do it before!

Should I include letter explaining why we are missing in our package joint evidence for bills and bank account for the first 10 month of our wedding or include everything from August 2010 and not to mention earlier?

What about this letter?

"Dear USCIS Examiner,
The following letter is to explain why our Chase bank account was joint in August 2010 and not earlier.
We honestly forgot to do it at the beginning of our life together even if we were already co-mingling our finances.

Is it a problem for you to go online and print the bank statements (couple of them) from the date you were granted a green card? Most banks have it going back several years.

Here's the tricky part... my work is a small business, and we simply don't offer spouse to be part of the insurance since the works pays 100% of it... Life insurance? We are in our mid-20s I don't think we need that. As for the cards... well, in our culture we don't do that, that's the thing a lot of western customs aren't popular among us.

As for the taxes? We married in 08, not before.

Meh, I hope it's simply because I filed the i751 10 days after my expiration date...


That's still 2 years of taxes - 2008, 2009, 2010 - should've sent those in as it shows married filing jointly as part of financial co-mingling. They DO want to see those so if you haven't filed, NOW would be the time to do it and get copies of that or tax transcripts. There was also some credit back in 2008 so why forgo money if it was coming to you?

Never too late for life insurance - even basic one.
Wills, power of attorney for finance or medical issues? I don't buy the we're too young - marriage is about being covered IN CASE something happens to either one of you and the other is left with decision making (health, money...)

Think about it some more - this coming from someone who just started her 30s.

Edit: I see you only just joined - there is a lot to learn USCIS wise when you have a family member from a foreign country.

Get statement of benefits from your HR - you did designate your spouse on any life insurance, unpaid salaries, emergency contact?
Medical insurance cards - as dependent on your plan. Any bills from doctors naming you or spouse for service usage. Any explanation of benefits sent for either one of you to your home address.
Any greeting or holiday cards sent to both of you from friends, family.

Why didn't you send your taxes for the past couple of years?

Sorry but you knew that you had to file I-751. I-90 could be used as proof you knew you had to file something but you filed the wrong thing. Whatever a contractor at ASC center taking your biometrics told you was wrong - here's the deal: you can't blame them, it's up to you to know what's to be done at each step - gov't will not and does not make it easy for you.

The only thing you can do now is file that I-751, include a very nice and apologetic as in it's my fault but would accept this submission letter and hope they accept it.

Worst case scenario - they put you in removal and then you get to go before a judge and plead for them to make USCIS accept another I-751 filing and acting on it.

Get your evidence in line and file ASAP.

Oh, and you seem to have an incompetent lawyer - may want to drop her and find a competent one - seriously, telling you it's ok not to act on anything because you filed I-90? Weird.

Do you have a full driver's license? Use that plus SSN card for employment, no reason to show GC - it's your decision what to show as proof of employment for I-9 purposes.

She did do Biometrics. She actually went in to our local USCIS office a month ago to see why she had not heard anything from them. The woman told her that her Green Card did not expire for 6 months so just wait it out and she would get something in the mail. We did not receive anything except this notice of Denial. Does anyone know if contacting a Congressman can be helpful?




Yes, contacting the congressman will be helpful but you still have to stay on top of it and request updates via email or over the phone from the immigration aide.

Ours was very helpful when my first green card never showed up and USCIS told me to file I-90 saying I destroyed or lost the card AND pay more $$$ - which they never even produced! Fought them with immigration aide/congressman and got my green card close to a year since I activated my CR-1. So yes, they can do things for you.

OP, get the copies of all correspondence with USCIS re: ROC and go see your congressperson's immigration aide. They have direct contact with USCIS and can sort this out for you. Also, if you haven't change your address, make sure to bring copies of other bills that made it to your regular address as proof that it's USCIS error (someone perhaps didn't mail out RFE or notice) and not yours.

Oh, and by the way, I'd reconsider leaving country until you have this sorted out.

The thing is February 10 is my husbands R&R, his R&R is just for two weeks, I am only allowed to send the documents on February 13,2013 since that is the first day of 90 days out of the expiration of my card. We were thinking of readying all the documents, sealed it in the envelope and ask my aunt to send it for us while I am in the Philippines, I wonder if they allow that? My son and I are planning to leave the country on January 20th so I could prepare for his christening and all so once my husband arrives everything is ready and everyday is worth all the time. no preparing and no hassle. so that was my first option, to ask my aunt send our documents on Feb 13th, once she received the RECEIPT, she will fedex it to me in the Philippines so I will have no issues when i re enter US again.. The other option is, i'll file the application when I get back. probably april 2012.


Your husband still needs to sign the I-751 -- it is a JOINT petition so both of you need to sign it -- so bring the paperwork with you, he signs and when you come back to the US send it off immediately.

I was the wife. I have been threatened by his family that he better not have issues with his green card. I have had to have protective orders on both myself and my child against him. He has been arrested numerous times after this post. This seems to be someone that duped me into marriage for a green card. He even filed fake assault charges against me because he would get an automatic green card. The charges were dismissed because I had proof that I was not there. He seems to be posting on this board trying to get advice on navigating the system. He is a raging alcoholic and xanax user that is going to hurt someone behind the wheel. It is very sad and he doesn't want help.


So was the ROC approved or rejected? In over a year's time since he posted, you would have known the decision.

If either one of you went to a doctor, you would receive a doctor's invoice or explanation of benefits statement from the medical insurance - include that as well.
