Same as in any other consulate: I-864 and 3 past years of tax returns from the sponsor (spouse) and co-sponsors - if used. Letter from employer or pay stubs from sponsor to show current level of income earned.

No, you don't need to change your last name unless you want to.

Marital status is not a part of ID or license.

No, you don't register your marriage in the US - you just provide a copy of marriage certificate with English translation if it doesn't have one, to whoever asks for it - usually for benefits like medical insurance. You also don't go and get married again.

Yes, you can do consular processing of immigrant visa in Bahrain - indicate that on the I-130 form. Also make sure to obtain the necessary documents from the Philippines around the time of your interview - police report from all countries where you spent 6 months or more after the age of 16.

My wife conditional green card expired June 2011. She was out of the country taking care of her sick mom. Now she is ready to return. I am guessing a K3 needs to be done ? IS this the best way or are there other suggestions. Will the fact that she let it expire cause a problem?

Now you start all over again by filing I-130 petition. She can't back until she has an immigrant visa in her passport.

I have this scenario, my wife is in the Philippines and i filled her a petition to get her in US and got approved, then suddenly she got a job in other country, and her petition papers came while she in the other country, what would be the case of that? And what should we need to do if that happens?

Any info would be very helpful.

1. You'd contact the consulate in the country she is working in to request your file from Manila embassy.
2. the consulate would contact Manila to get the file transferred over.
3. the wife would interview in the country she is working in - she'd probably have to do medical in that country, but obtain all required paperwork (police, marriage certificate) from PI.

Now i just need to reconfirm whether i can still file DCF here in Islamabad. Will do that first thing in the morning.


On another note, suppose that the embassy does not accept DCF applications anymore. What would be a better option from the following:


1. I send the I-130 petition to the chicago lockbox as soon as possible, and then follow all procedures accordingly which will take a minimum of six months. And run the possibility of being away from my wife for an extended time period if i end up coming back to the US (for work, etc)

2. We wait to apply, and once we both come to the US (my wife already has a non immigrant visa valid until Nov. 2014) we file the I-130 along with the I-485. This way we'll be together and wont have to spend time apart.


Option two would be fraud - wife clearly has immigrant intent.

we are both in Pakistan. We both live here. I am a resident of Pakistan and have lived here since 1998. We moved from Florida.


In that case, you are only filing I-130 AND you're filing it to Chicago lockbox as there is no longer DCF for Pakistan - they don't have a USCIS office there: http://www.uscis.gov...000082ca60aRCRD

Follow guide for IR/Cr1 visa and don't expect it to be over soon - 6 months at a minimum.

I was married in the Egyptian Embassy in Athens, Greece. We have been married a year and previously lived in Athens, Greece. Because conditions were getting bad, we decided to leave. I had went to USA for a month and half but missed my husband who went to Egypt. I flew to Egypt and now we are currently living in Alexandria, Egypt. My question is can I file the I-130 now or do I have to wait six months before filing or can I still file (instead of the Chicago lock box) but does it take longer? I have been living in Egypt almost two months. Thanks for any help!

Since Mid-August 2011 you can't file DCF in Egypt - it does not have a USCIS office. File I-130 to the Chicago lockbox whenever you are ready to start the process.

My wife and I had beeing discussing the idea of marrying here in the US. We are already married in her home country (honduras). A friend of mine recommend me to it, because he says it is easier to obtain any document without presenting the honduran marriage certificate, which is in spanish and traductions are always needed (besides the fact that every time we need a traduction I spend 70$).
Also that a US marriage certificate has more validity here...

What do you think?? Has anyone marry in your wife/husband country and here in the US???


Honduras does not have international form of marriage certificate? Get one translation and keep a copy of it - submit copies of the original certificate and notarized copy of translation.

Yes they do, why wouldn't they check the previous history of the applicant.

Does she work or is she unemployed or on disability?
Did you need a co-sponsor for AOS?
Are you of the same religion?
Does her family know of and approve of your marriage?
Does your family know of and approve of your marriage?
Have you attempted to get any other visa to US - tourist, student, DV, other immigrant visa?

I-130 filed by USC will take less than a year until visa in hand in most cases.

I-130 filed by LPR will take 2-3 years until visa in hand.

The more I look into it, the more I realize I do have to file for divorce.
So, I'm not going to open a whole new topic on the divorce thread, I'll just ask here: if my GC expires September 2011, do I HAVE to file for ROC 90 days before that ? If yes, I'm filing and then, I'm patiently waiting for the final divorce decree to be issued, which I will later provide to USCIS as an RFE.
If not, can I file when I get the divorce decree?

What are the stipulations about that?

I know I ask a lot of questions, but I would apreciate feedback from whoever has experience. :help:



You can file 2 weeks before GC expires - that will give you another year on GC to work until it is resolved (approved or not). You WILL receive a RFE for divorce decree and you will have up to 89? days to respond to it. If you don't have decree by that time expect hearing before the IJ where you can plead your case and have judge rule on your residency - extend tiem to obtain the decree.

You can absolutely NOT file when you get the divorce decree IF that happens after the expiration of your green card.

May want to get the licenses up to date. Also, if you can't come up with some items - include a letter of explanation so you're not RFEd.
Had any doctor's visits - either you or wife? Include the explanation benefits from the medical insurance - should be the same address you're living at.
Any greeting cards to both of your from family or friends (birthday, holidays...)?

Don't think you can ROC while being outside - only military personnel's family can ROC from overseas as the base is considered US soil.

If you want to be outside the US for extended periods of time either wait for spouse to obtain citizenship or give up the GC and reapply when you're ready to stay in the US until naturalization.

I was thinking in sending my joint “tax transcripts” from the IRS to the USCIS. But the IRS told me that they could also send me my joint “accounts transcripts”. Don't need account transcript (shows payments, adjustments, collections) - all USCIS wants is plain tax transcripts.

Don't think there will be any additional charge - your petition just won't get processed and that's what you want. You may get a notification saying they won't do anything until you send another form of payment, but just ignore that.

Look, no one can tell you one or the other is right. There have been cases where people sent their reschedule notice (AOS) and were denied for failing to show up at the interview because the notice didn't make it to the IO who was scheduled to interview them.

Where is friend's husband? What does he say about this? BOTH of them will have to attend the ROC interview. If she can come back and still make it to 7/13 interview, I'd say all the better.

If married to a USC (which you are) and still married to that very USC, you can apply after 3 years minus 90 days.
