7. No, she doesn't have to change her name if she doesn't want to - changing name does not affect the process

9. Once you get immigrant visa you can get the social security number - not before. Doesn't make a difference until you're in the US - THEN you need it.

You need to look at your case through consular officer's eyes:

- has your wife been married before and if yes how long ago was she divorced?
- who was her previous husband? American, immigrant and how old was he?
- how old are you and how old is your wife?
- what are your education levels?
- what do you do for a living?
- religious background?
- families on both sides accepting of this marriage - or is there some resistance?
- does she have children and what are their ages?
- how often has your wife visited you in Egypt and hoc much time did she spend there?

Answering all these questions may help you understand why your K-1 was returned.

I am Canadian and married to a US Citizen.. .we married in December - filed Visa Paperwork in March... is it possible for me to move to the US while this processes or change my status?

And if not: how long typically from the time you get the initial application acceptance letter does the next stage happen? And is that when the application is sent to NVC?

You can't MOVE to the US before you have an immigrant visa, but you can certainly come for a visit provided you get through POE - arm yourself wih home ties documents - letter from employer, mortgage papers/rental agreement, bank account, any other financial obligations you have in Canada that will make you return there after your authorized stay in the US (can be up to 6 months).

Can anyone help me, at no point did anyone tell me I needed to keep the chest X-ray CDR I was given at the embassy, it looks like I have left it at my friend's house who I stayed with in London but given all the things I've accidentally left there before that he's not been able to locate I am now more than a bit concerned. I got the letter with my visa and it says I should be prepared to hand it over at PoE! At the embassy the rather jovial official just told me I might want to see it for my peace of mind, not that I needed to keep it! Really worried now. And I haven't even looked at it, just thought it was an extra I was given! :(


Chest X-ray is NEVER asked for at POE - what would they do with it, they're not doctors. The x-ray results are on a sheet of paper with your medical files - that's all they want.

I will be mailing out our cr-1 petition in a few day. I was talking to a friend and he mentioned to me about imbra and that got me a little concerned. I am wondering if my wife and I should be concerned about it. I'll give the details to hlep. My wife and I met through a dating website in Oct 2010 it is 100% free to meet and chat with members. www.findloveasia.com I traveled to China in May 2011 and we were married in June 2011. I am concerned because a lot of people are saying lots of different things about imbra. Some say it only applies for broker sites, some say imbra isn't applied if the site we met through is free, and some say imbra isn't applied if we are married. You may want to read a bit about filing petition when beneficiary is in China. They want a Evolution of Relationship document - basically you write how you two met, list any red flags and write down how you overcome them. So, if she doesn't speak English well - you provide evidence how you communicate...

Not for I-130, no joint sponsors there. She can be a joint sponsor for I-864. You'll always be the primary sponsor for I-864. All you'll need from her is copy of her green card, last three year of taxes and filled out I-864.

OP, whatever you decide to do, you need to understand the only option you will have is to get your husband back to Mexico. Once I-130 is approved, at his interview in the embassy he will be denied for overstaying and for entering without inspection. At that time you will need to file waivers I-601 and I-212 which will need to be approved before he will be allowed back into the US.

Be prepared for a long wait and a lot of $$$ for lawyers. Laurel Scott does Wednesday free chats, so you may want to contact her - she has a lot of experience with Mexico waivers.

You may want to consider all the red flags you may have in your case. Marrying so quickly after coming for a visit in June certainly can trigger a red flag. How old are you and how old is your wife?

Hey there, I'm the fiance of Mad_Scottish. According to the USCIS, as long as he enters legally (VWP), he can stay. When I asked what he should tell the people at the airport, she just repeated that as long as he enters legally, he can stay. I get that they have a lot of people trying to get loved ones into the states, but you'd think that since you're paying them, they'd provide MUCH better and more concrete answers to people. We're not committing fraud, we just fell in love and want to live the rest of our lives together! I wonder if it's this hard to get into Scotland... :angry:

Oh, and USCIS told me that we can file the I-130 and the I-485 AOS stuff simultaneously while he's here. My mom just sent an email to the lawyer so my fiance and I will keep everyone posted. Thansk for everyone's help!

Please remember that when you call the USCIS information you are NOT speaking to an immigration officer. You are speaking to a low wage call center employee who does not understand immigration processes and works off a script in front of them. What you were told is wrong and is considered visa fraud. You are not allowed to enter on a visa meant for one purpose - eg visitor - with the intent of using it for a totally different purpose - eg remaining in the US and applying for benefits from within the US.

As you have already applied for the K-1 visa you obviously have the already established 'intent' to get married and immigrate. His entry at the border would be considered both visa fraud- and depending on what he told the border at the time (eg only coming in for a visit, etc.) it could also include misrepresentation. Misrepresentation is considered one of the 'high sins' of immigration and leads to a refusal of the requested immigration benefit (green card) deportation and a ban on re-entering the US, often for life. If this is someone you love, don't take a 'convenient' but illegal short-cut that will indeed cut short the rest of your life together in the US. You can be guaranteed that if on his entry he says I am entering the US as a visitor so I can get married in November and stay in the US to get my green card, he would be denied entry - and probably given a short ban at that time as well for intent to violate immigration law.

Please do not do this. The 'USCIS information line is not known as the 'MisInformation Line' for nothing. It has ruined other people's lives before when they have followed similarly bad - and wrong - advice. I repeat - it is immigration fraud to enter the US on one visa with the intent to use it as a shortcut to bypass the more appropriate visa. He can enter to get married but he CANNOT file for the AOS from within the US. You would have to re-start the whole immigration process all over again filing for a CR-1 visa with the I-130 - but NOT concurrently with the AOS and he has to complete the process through his home Consulate. This is not an option for you.

Hey folks,

This site has been amazing and the information has been great. However, a small issue has cropped up and what I am ultimately seeking is just a clarification on what has become a slightly confusing point.

There is a slight cross over in my situation and what we have been looking at is what happens in the event we do not get the visa in time for me flying over to the US for the wedding. We have spoken to the USCIS a few times, spoken to a lawyer and read up what we can online and it is almost to a point of information saturation which is fueling the confusion that we (my fiancee and I) are feeling.

ANYWAY.

Issue is, we are currently waiting on a k1 visa as we are engaged (yes i know this is the cr-1 section so please bear with me).

We have cut the timing pretty fine and we have started to enquire about what happens if we dont have the k1 visa before the wedding etc.

What we have found out is the following:

Assuming I dont get the k1 visa in time, I can fly over on a tourist visa (VWP as I am from the UK), and as long as I am honest with customs and immigration and get into the country legally then I can get married. The USCIS representative that we spoke to (08/31/11) said, once we are married I can stay while we get a CR-1 processed, file the I-130 and I file a I-485.

I can then also apply for my AOS and EAD. So as long as I enter the US legally etc I can stay once we are married and be in the US while the rest of the paperwork get processed. The issue that has cropped up and what we cant get an answer too, although it may be very obvious, I just dont like assuming. So I am asking you lovely people :D

I will be in the US on a tourist visa when I get married. That is valid for 90 days. Because we have filed the rest of the paperwork, does that supercedes the tourist visa or does it not? When the tourist visa runs out, I dont have to leave the country because of the fact everything else is being processed....yes or no?

No, you can't stay and file AOS. You can get married and file I-130 but once your WVP time is up you better pack up and leave - you have clear immigrant intent (K-1 filing) and remaining and AOSing would be immigration fraud.

Follow the guides for CR-1 visa.

BTW, the 1-800 number you call is a bunch of contractors reading off of a script. Plenty of people have been burnt or banned from the country based on their "right" ideas.

Has anyone every sent documents to U.S Embassy Islamamabad from U.S.A ? Or do we have to use their AMEX courier service in Lahore, Pakistan.

AT interview they asked my wife to bring proof of on going relationship (dunno why they already had tons of prood) and gave her blue refusal sheet, I just made another set of documentations and want to sent it to the CO. Now can I sent those documents to Embassy thru FEDEX from here Kansas, USA ? or Do I have to use their AMEX service in Pakistan. At interview they kept her passport. I was standing right next to her during the interview and CO was in his 50's trying to speak in URDU language, never could finish his questions in that language. So i felt like the interview was conducted in an unprofessional manner. anyways.

Any help would be appreciated. Btw I am Active Duty Servicemember, and Leave for Pakistan is not allowed for DOD members, thats why we dont have tons of pictures, moneymoon trip etc. All I have is wedding pictures, letter from my unit commander, onpost housing application, DEER enrollment for my spouse, Houseing application on post, DD93, SGLI, ERB and LES, But during the interview CO looked at these documents like what the hell is this....


Yes you can send directly to embassy - make sure to mark it with your case number.

Also - write a letter explaining your last paragraph explaining in plain English what all the documents are - most COs don't have DOD experience.

Hello everybody,
i have just read that 14 different vaccinations are required before my medical. I have had a few when i was a kid but as my doctor during my childhood has passed aaway, the hospital where i was born in West London no longer exists and I have been living in Germany for 20 years, it seems almost impossible to get these medical records (the NHS site suggests asking my (dead) GP). Do I really have to have all these vaccinations in such a short amount of time? It sounds quite a horrific experience and also rather expensive.


You could get a titer test for vaccines - they'll show immunity to what vaccines you had. Do this before you go to the medical, or they may rip you off either by test or by requiring new vaccines.

I've tried my Congressman, Senator and Obudsman from the USCIS as well as emailing the service center where my case is at the moment. Try to find a local charity that does pro-bono immigration cases - then ask about writ of mandamus - this forces USCIS to adjudicate the case.

What happened with Congressman or Senator? You have to pick only one to represent you in front of USCIS - they won't meddle if someone else has already started the inquiry. DId you send the release form authorizing them to act on your behalf alongside your NOA1 and any cover letter detailing your case? Sometimes you have to go in person to your local office of the congressman/senator and speak with their immigration aide - have to follow up on everything done and ask to be forwarded any emails they get from USCIS.

Agreed.

So far, there's a fake Schengen visa and lying on forms - misrepresentation ban. Not sure how do you and he plan to fight this, but I'd be walking away right about now. He seems a tad bit desperate to get into US and you just may be his meal ticket in if you stick it out and pay $$$$$ for lawyer to fight the ban(s).

Computer systems these days are all connected - he may be denied based on previous visa fraud (even if it is Schengen visa) as it will be in the system. He as the applicant is responsible to know if his visa is real or not, can't blame others. You may want to consult an immigration lawyer experiences with Nigeria cases like this to gauge what are your chances.Embassy in SA will have access to all previous system information for his visa applications.

Same as in any other consulate: I-864 and 3 past years of tax returns from the sponsor (spouse) and co-sponsors - if used. Letter from employer or pay stubs from sponsor to show current level of income earned.
