Fiance probably submitted it in August vs March. Unless you have a delivery confirmation receipt, you won't know when exactly he mailed it. NOA1s are usually coming within 3 weeks of them receiving a petition.

She's an English citizen, but she is living in Australia.

I never said anything about her coming here on a tourist visa, nor having any intent of adjusting status while she was here.. not sure where you got that from.

Just wanted to know if we can get her medical done in the U.S. We were pretty sure she'd still have to do her interview in Sydney, but it was worth asking since we weren't positive.



 

 

 

In terms of what needs to be done at this point in the game, can she have her medical exams done here in the U.S. or does it have to be in Australia?  Does she have to do her interview in Australia, or is there some way that she could do it in the U.S.?

 

But to give you precise answers - no, she can't do a medical in the US and no, she can't do an interview in the US - everything will need to be done in Australia as her visa will be issued there.

No, she can't come to the US and finish processing there - that would be immigration fraud - coming to the US on a tourist visa with intent to adjust status.

 

She can come visit within terms of VWP.

Send a letter withdrawing the petition to the same place from which you received your NOA-1.

 

If you want to be on the safe side you can send a copy of the letter to the US Embassy in his home country, just as an FYI.

You can call the Embassy/DOS and see if they can tell you the visa has been activated at the border.

I do think he's in the U.S. and "divorcing" you so that he can live his life now as he pleases.



I don't think embasy or DOS can tell you anything more than the visa has been issued. It's the CBP that can do that.

Depending on your husband's age he will need to register for selective service - men 18 through 26 are required to register.

Change of address at POE even though they ask for the address where you will be staying during pre-boarding checks of the flight so he may want to give the new address there as well.

Thanks again to everyone who took the time to respond. I am just finalizing my plans and will be traveling in August. I thought I would have to wait longer but things just worked out where I could go sooner than planned so I am extremely excited, happy and a bit nervous. The trip itself makes me a bit nervous as I have not been out of the country before except to go to Mexico and some of the caribbean islands - but I live in south Florida so the Islands are pretty much like south Florida. So any travel tips would be appreciated!


travel.state.gov has a lot of info - travel alerts, travel warnings, info on various countries... Always be prepared ahead of time. Make a couple of copies of your passport info page and any valid visa pages and scan one to yourself and give copies to a trusted friend. That way, if you lose your passport, they can verify your information faster and get you a new one. Bring a supply of antibiotics, anti-malarials for duration of your stay (if the country you are going to has malaria). Be current on your vaccinations.

Definitely enroll in the free Smart Traveler Enrollment Program (STEP): https://step.state.gov/step/
In case something happens, Embassy can provide assistance if they know you are in the country.
