If you are married, you will file I-130. F-1 family based immigration visa is for unmarried sons and daughters of US citizens. That does not seem to be your category. So, I suggest you read up a bit on spousal visa, all the terminology, procedures and processes as that is what you will be getting for your spouse.

First:  (F1) Unmarried Sons and Daughters of U.S. Citizens:  23,400 plus any numbers not required for fourth preference.

No problems at all - for someone recently married and returned to their home country, they really don't expect much of co-mingling. Just be ready at the interview to show proof of continued contact - emails, snail mail, cards you sent her/she sent to you, phone logs, skype...

 

Yes, it will take a bit longer (8-10 months total?) but once you get your immigrant visa you will be a permanent resident as soon as you're processed at POE.

By "keep in touch" what do you mean?  Call them once a year or so and just say "please don't throw away my case?"  Or does it need to be something more formal?

 

I think they prefer email - NVCInquiry@state.gov I think is the email address. Just let them know you will proceed at a later date and email later that you're still working on it.

Really? Man that sounds perfect! So when I get approved what do I do? Just not send anything to NVC?

 

 

After you get NOA2 approval I wouldn't be calling up NVC asking about the case number - they'll notify you themselves (email) they have your petition and what the NVC number it is.
From that email date you have a year to get in touch with them so mark your calendar. Yes, you won't be sending them anything until you're ready just keeping in touch every I'd say 11 months.

I wouldn't withdraw anything. Approved petition will be in NVC and all you'll have to do is check in with them every 11 months or so (every year is the rule) so they don't send it to storage. When you're ready to interview you email them and send the required paperwork.

Umm, absolutely irrelevant to OP as her fiance's case is at the US embassy in New Delhi - which means Department of State is to be contacted, not USCIS.

 

 

Also be sure to contact the USCIS Ombudsman office. Here is a handy little escalation guide I found in another forum:

 

"Don't waste your time, money and the Court system resources filing a mandamus action. Filing a frivolous lawsuit can get you into being imposed monetary sanctions. You must first try to resolve your matter with USCIS in good faith, you should have at least sent the Service Center director and District Director two letters inquiring about your case via certified mail with return receipt. 

You should also make an Infopass appointment with your district office and talk to an immigration officer to inquiry about the status of your case (this did it for me when my case was frozen).

Lastly, USCIS has the office of the ombudsman (a person that works for the public to resolve USCIS matters by making suggestions to make the process smoother or by inquiring about cases that have been frozen as far as processing goes) which can investigate the case for you. Check :

Not a problem. You showed you complied with all your visas and didn't overstay and you're doing things the right way.

 

Example - a friend was on au-pair visa, met her future husband, left au-pair job early as her family had issues back home. Came back to the US to visit, got married, returned to her home country and her husband filed I-130. She had no issues getting a CR-1 visa.

Also, there's nothing speedy about immigration process.  I-130 takes at least 6 months to approve so you're probably looking into September/October for interview in Mexico.

It's an I-130 interview for the PETITIONER. You as the beneficiary are not called for that interview. Have your wife go, answer any questions IO may have and you will have your decision on I-130 within couple of days.

Thats great thanks, how come you withdrew your i130 may i ask? Did you withdraw from the US (NBC, CSC etc) and did they send you a letter?

 

My sister won DV lottery and immigrated that way so I withdrew her I-130 petition. It was in CSC, I sent the letter withdrawing the I-130 and perhaps 2-3 weeks later I received a confirmation letter. Yes, from the US (used a US address as I was at that time on work outside the US) - no issues.

If you are taking his last name (optional, not mandatory) and you want green card in married name, you will have to change your passport to reflect your married name. Embassy issues visa in the name that's in the passport.
