Hi everyone,

I wanted to post a new topic to gather feedback from others and their experiences. The short story...I filed for a K-1 in 2005 it was approved and we married, but the marriage ended within weeks (mutual more my issues). I filed again in 2007 w/waiver and it was approved. After 4 years my second marriage ended in divorce.

I'm on the verge of making plans to move overseas, but in the event that is delayed. What are my chances with a third immigrant visa over a 7-year period? I would appreciate any sound and constructive advice.

My fiance and kids arrive on Sunday, August 7 at Detroit for their POE. Is it possible for me to be with her during the inspections? She will need to get her bags prior to the inspections. Anybody with a POE experience who can render assistance? Are the international baggage claim areas off-limits to non passengers?



Yes, international baggage is off limits to non-travelers. You will have to wait outside the doors leading from the baggage claims. Since you're not traveling with her, you will not be able to be with them in the secondary for inspections.

I am a 2004 dv winner.
you need to get a letter saying you are a winner, than you need to check your DV number and if it has a chance
100,000 letters are sent but only 100,000 G.C are issued (me and my ex wife and two kids took 4 on one number so high number never gets processed)
In 2005 ,when I actually got my G.C numbers above the mid 30-40,000 had a very little chance (my number was in the 18,000 and I got my G.C only in April and the last G.C issued in September.


If you have the letter in hand and your number is low and you only starting your K1 application, only than I'd continue with the DV.
If not, continue with the K1 process.

As of this year, no more letters are sent - applicants have to go online to check if they were selected by using their confirmation number they received when submitting electronic entry.

I also got an email saying i won the DV lottery last week :( but unfortunately i am at the end of the Visa process now and just waiting for interview.

Just out of curiosity I wonder.....if for some awful reason i was denied K1 visa at interview, if i could then go ahead and use this winning DV lottery option...any ideas? :huh:

Don't think UK is even eligible for DV - unless you claimed birth in Ireland.

so yesterday was my blue slip interview for my 14 year old son who for whatever reason decided he wanted to test out marijuana. well he got the one year ban. the paper stated he won't be eligible for a visa until june 29 2012.to anyone who has been through this before,when this date comes, how do i go about reopening the case?



Can't you set up so son gets tested every 3-6 months until 6/29/2012 and show up at the next appt with the evidence he's been clean for that period?

Wait, he knew how to fill out the I-129f form but failed to read the INSTRUCTIONS where it clearly says what's to be submitted and what periods are covered?
Page 1, Section Who May File this Form?, number 2 clearly states "and have met in person within two years before your filing of this petition"

I strongly suggest your friend hire a lawyer in this case as he can't follow instructions and will mess up any other immigration petition filings.

....but my boyfriend is American and technically if I marry him I will be able to stay in the US. That's why I was worried about the "timing" -- I do not want that whoever checks our papers will think " Oh wait a minute he just got divorced, what if this is a fake thing?"

we finally decided to end this relationship. it was hard for both of us specially after all we've been through. even now I have the visa in my hand but we cant continue anymore :(

Well the petitioner should be the one to withdraw the petition and you as the beneficiary want to also notify the embassy you will not be going through with the visa. Letter or email to the consular section with your case number, DOB, petitioner name and withdrawal information should be sufficient.

my son and i got here in the us last july 2 and married an active duty member of usarmy. thing is we cant seem to make them approve our benefits such as deers and other us army family benefits such as command sponsorship because i cant give them a document stating that he is under my full custody under the philippine law given that i had him out of marriage and never married his biological father but he signed his birth certificate but never stood for his responsibilities since then.. i dont have any way to contact him and i think its better that way..please help me

Hi everybody! PLEASE I NEED your help. We are at last step. I passed interview but the oficcer asked my fiance to send him more finantial documents. My fiance is in Military. Now he is not on active duty, he doesnt work as i understand he is in active reserve. but 2010 he almost spent in Iraqi. So he sent tons of bank statements and W2 and 1040 for year 2010. But it not enough for them. Now we got this kind of request:
" We need current statement that clearly states his salary and benefit amounts. The Petitioner does not need to send us his whole MMPA printout, just an official statement of his yearly salary and regular cash payment benefits."

Can somebody ... who really knows how it should look like please advise!!! We got fight with my fiance bcuz of this...we cant understand what exactly they want to see and who can give that official statement...maybe it's pay stubs or idk / cryyyyyyyy

How could they ever know/find out about about an 'out of wedlock' child in an interview?



Well, non-disclosing and then later (if it proves it's his child) he turns around and petitions the daughter, or his new wife does, WILL raise issues and possible misrep charge if it's not disclosed at the interview. So new information surfaced after I-129f submission - at the interview time, come clean, provide DNA proof and proceed from there.
They do have everything you ever submitted in your A-file (envelopes included). Any discrepancies not rectified or mentioned at the interview can come back to haunt them.

This better be disclosed at the interview if he or you is ever to petition the child. I'd still ask for DNA now - someone jsut showed up one day and told him he has a 4-yr old child?

Since you just mailed the petition last week, put a stop on the check and that will get it returned to you - whole petition. Usually it takes them up to a month to process the payment and issue a NOA-1.

Thank you all so much for the advise. I feel a lot better now. I paid for all her items to travel with her and she has no keys or mail or any property with me. I was trying to do the right thing by sending her back home, but I guess she has other agenda and I didn't want to get wrapped up in her scheme. She's been gone since the 5th of august. She just contacted me today saying I'm "Obligated" to buy her yet another ticket now that she's decided to go home. I can't afford it.

She could've called the airline BEFORE her departure date and cancelled the ticket - she'd have the funds from the original ticket to use for future travel (only had to pay for any change fees).

Don't feel bad, you did all the right things, it's down on her now to get herself home.

I've never heard of a suspension of a case, it's either approved or denied..suspension suggests that you can't even appeal, is that the case or can you appeal?


Look, consular officer can ask for more proof of relationship if she/he deems what they submitted is not enough and doesn't show a true relationship - that's why they got asked for more proof and not denied. It's on the applicant and beneficiary to provide the information and convince the visa officer they have a bonafide relationship.

I see a lot of things thrown out by the OP blaming the co but all I get is she had an attitude with visa officer and the person dug more into the file. Where was the petitioner, why wasn't he there with OP? OP has been a member for close to a year, she never thought to drop by Chinese regional forum and ask hey, what do we need for interview, China consulates are not easy on K-1 visa applicants?

I wasn't sure how to name this thread because I'm asking a weird question.

My fiance and I are going through the K-1 Visa process and our I-129F was just approved. He's moving over here to the US, where we plan to get married and live for a good while, etc. My question is, if he moves here and becomes a citizen, will it be very difficult for us if we decide we'd rather live in the UK in the future?

I'm just not sure how all of that works or how to go about searching for that particular info on my own, so I'm curious. Any help would be appreciated. :)


Not a problem - after he gets his citizenship you'll start the process for UK immigration - should be similar to what you're going through now except it will be a spousal visa and you'll have Indefinite Leave to Remain (ILR) status.

I spoke with my boss about this today (before posting here) and he did mention that if I had a spouse, they (the company) would need to "take care of the paperwork for that". He said this knowing that I am not currently married and that my fiancee is living in Colombia. He also mentioned he is aware that if she was to become a U.S. citizen, she would need to stay in the U.S. for some time without leaving. He is also the one sending me to Africa in July. --- Considering all of this, I sense that they would work out the paperwork for her (otherwise he would have pointed out that it's not possible at the moment since she needs time to naturalize in the U.S.). He also said family life in this situation is actually quite doable, "especially in Africa, where laws are loose on this."

Also, obviously I am not working for the U.S. government, but the first question/answer here offers some guidance none the less: http://www.state.gov.../flo/c23169.htm So, the Dep. of State would sponsor it.



What do you mean DOS would sponsor it? Unless you're a DOS employee, they will NOT sponsor it.

My fiancé says that her visa pick up letter states that she needs to have a chest X-ray with her at the USA point of entry.. What's this about and whats the reason? All she was given is a cd disc of the chest X-ray she has no X-ray film.. Does she need the actual film or will cd disc be ok? Thanks


No, that's not needed - they don;t have doctors at POE. She can have CD disc in her carry-on luggage.

No, the I-134 is needed for his interview at the embassy - probably 8 months from now. I-864 when you send for his AOS after you're married in the US.

I suggest reading the guides for K-1 visa followed by the guides for Adjustment of Status from Family based visa (K1) so you're familiar with the process(es), the forms needed, documents required, evidence to be sent and of course $$$ to be paid.
Guides are at the top of each page and you already found K-1 visa forum. The AOS forum is a bit further below.

Before your fiance interviews at the embassy both you and the co-sponsor will have to provide I-134 (look it up on uscis.gov). For adjustment of status both you and the co-sponsor will have to provide I-864 and supporting documents (3 past years of tax returns, employer statement that you're working and a statement from you if you're not required to file taxes due to low income/non-employment).
