When you get to the POE make sure you give them a new address where to send the GC - confirm before leaving that they have entered it and that you are in the SAVE system.

As I understand it the Permanent Residency is conditional for 2 years and then after 2 years you have to still be in a relationship and file paperwork for the Green Card to stay in effect. In this case if the petitioner is not supportive of you coming to the US you will lose your legal status.


Not really true - the OP will enter after their 2nd wedding anniversary and will get 10-yr card. No removal of conditions for her.

We made a mistake of having my sister (on F-1 student visa) travel through Toronto to Europe on Bosnian passport. We assumed that it would be the same as Schengen airports in EU and that she would be at the airport within specified zone. Wrong assumption we learned.
She boarded a flight from ORD to Toronto without a problem - lady from airline even came and told her she was good to go - she just looked at her student visa and let her through. Problems arose when she landed in Toronto without the transit visa - she was put into secondary inspection and had to sign that she won't seek admission to the country and made to stay at the airport (with no one checking on her) until the next flight the following day (overbooked flight so she was given 600 Canadian dollars to take the next one).

As soon as she landed in Vienna, she went to the counter and got her return ticket changed from flying into Toronto to flying into DC and then to ORD.

Always double check the rules of the transiting country - we should've done that as we bought the ticket in February and she flew in April - would've had plenty of time to get the visa had we researched it ahead of time. Now we know.

Not necessarily. When your wife is called for an interview, she should let the embassy know that she will do it once your child's case makes it to the embassy. That way both are issues visas at the same time.

You do need to find out where did the child's approved petition go - try calling NVC again or USCIS for cases status of the approved petition.

So you're a military spouse? If he is in Germany, go for DCF! It will be so much faster - I think it's done these days in around 3-4 months.

Just follow the guide for DCF, and get his paperwork from command (employment letter, LES, I-864 only at 100% of poverty line for military personnel) so you have it for interview.

If you have questions, feel free to ask, we've been through the same thing 3 years ago (my hubby is also military).

This means that the consular officer will not be able to issue a visa to any of the beneficiaries of the petition and will be required to return the petition to the Department of Homeland Security (DHS).

If there are compelling humanitarian circumstances, the consular officer may recommend that DHS reinstate the petition. Alternatively, the applicant may contact directly the DHS office that approved the petition to request that it be reinstated for humanitarian reasons. If DHS reinstates the petition, the consular officer will contact the applicant(s) soon thereafter.

So if I understand right, filing the I-130 is the start of the cr1. And If i wanted I could file the 129f to start the k3. Well what is the harm in filing the 129f?
I got back the I-797C over the weekend and reading through it and about halfway through the document it says that the I130 could take a long time etc.
So If i file the 129f, and the I-130 gets approved first just abandon the 129f, or does it not work like that? I have been sifting through the forums, I appologise if I had missed a post with this answer in it somewhere else.

The only harm done will be that your I-130 is pulled out of the adjudication que so they can adjudicate it with I-12f - meaning you lose time in line for approval. Also, if you go for K-3 that will be more money to give to the government and longer wait time for the green card (have to cough up $1010 for adjustment of status to get the green card) and of course longer time before you can start working.

Weigh your options as CR-1 is taking almost the same time as K-3 but comes with the advantage of having gc when you enter the country.

Hi VJ'ers,

Hope all is well. I wanted to know of stories of anyone who has had their initial Green Card lost in the mail, and was told that they have to file an I-90 for a replacement.

I am a US Citizen (by Birth) and find the system of Third World Countries far advanced then ours.

My wife came here in August on an Immigrant Visa with no trouble. POE was a breeze.

A month later a letter comes from DHS saying they need biometrics (they lost her fingerprints). We went and got that done.

A month later we get welcome letter. Yay!

6 weeks go by nothing happens. I made an infopass appointment. They said Good News and Bad News: Good News is Greencard was mailed out. Bad News is that it was probably lost in the mail. I have to File an I-90 now, wait 6 months, and pay about $400.

This is absurd. Even when I was in India, such a sensitive document is always sent through delivery confirmation and we are charged for it (which we gladly pay for). US Government does not even offer that (even after charging so much for Visa fees).

I am a Tax Paying Citizen who sends his Taxes every year via Delivery Confirmation, because if any of my documents are not reached to the IRS, then I am penalized. Why does DHS not follow the same rules? I smell government fraud. The DHS did not show me any confirmation that this sent out and lost. That is troublesome and I have lost all faith in the system. I guess they can do this to anyone to make an extra $400 per person.

What is even worse then the monetary and time value lost is that even if that Green Card was stolen or lost, it hurts our Nation's Security because of Identity Theft. Our Country is seriously in the stone age when it comes to processing Immigration at every level.

I asked the Immigration Officer, who can I talk to about the above. He said, "Write a letter to Washington". I said by the time I get a reply, I may already have my wife's Green Card, and he said, "Yup, there is no phone number".


We had a similar thing happen to us - never received the GC after 6 months from POE. USCIS infopass told us "it happens all the time, file the I-90 and say you lost, or mutilated the card" (the card which never came and we never moved)!

Involved husband's congressman and on the 2nd attempt managed to get the GC without paying any fees.

Your father in law CAN't file I-130 for you. Your wife has to submit the I-130. Read the instructions for I-130 filing up in the guides.

Spoke as in you talked to the USCIS 1-800 people? Seriously, they're not called MIS-information line for no reason.

Get yourself an Infopass appointment and bring the paperwork with you and talk to an IO officer.

Hey all,

I had previously received a CR-1 IV stamp on my Passport. This was before our 2 year anniversary. I entered the US after our 2 year marriage anniversary.

According to my information and research, I was expecting a non-conditional GC. I got the GC today which is valid for 2 years after which I have to remove the conditions.

Is this what is supposed to happen? Doesn't the 2-year rule apply to when you enter the country and not when the visa was issued?

Anybody here experienced the same thing?

Did you show your marriage certificate at POE and made sure they changed the classification?

Make an Infopass and go there with supporting documents and the new GC. Be prepared to have to send in the I-90 to get the corrected GC (their fault so you shouldn't have to pay the fees).

No we haven't started the process. I must say that even though for most people the US visa is harder, for me it is easier because of my hard to prove income which is all what the UK visa is about. I didn'[t want to have to show purchase receipts for my business etc so my accounts can be properly notarised - I dcon;t have the 3 years of tax returns they want either. I've not been in the UK over those years.

It's very hsard not gto look at the Daily Express. I know it sounds stupid, but it hurts that they sell it. I looked at papers in the US and there was nothing like that. Just all benign celebrity junk. There are racists there, sure. But I doubt it's as endemic as in the UK. I've fought with my own father over this issue. He believes the newspaper lie 100% that it is "so easy" to come to the UK. He gets angry with me because I've told him it is hard, h\ard for myself and hard for others. He is impatient that I am stressed out over a process that must be so very easy.

What is stopping us starting the US visa is the marriage certificate is not back yet. Is there anything that can be done to speed it up?


Have your husband go to the court where you married and ask to get the certificate (you may want to get a couple of copies) expedited. I am sure there is a clerk that can direct him on how to request them and get them faster.

Good to hear that and for the plans of marriage and filing the I-130 petition. It may take longer than 6 months for you to get the visa as they need to do security checks before visa is issued.

You need to now educate yourself about the Removal of Conditions process. It is done 90 days BEFORE your 2nd anniversary of the Green Card, NOT a year after receiving a visa.

What a great question to answer on April 1st.

If your interview is in May, the approval will most likely be before your 2nd. wedding anniversary. This, he will, as interviewed for the CR-1, get a 2-year GC upon arrival.

What counts is the date the CR-1 is approved, not the date he enters the US. So the CR-1 will not magically turn into an IR-1 if you wait long enough.


Wrong. If he enters on or after the second wedding anniversary they can ask for it to be coded as IR1 or if the POE won't do it, they can make an Infopass to change it to 10-year one. They have to show the marriage certificate as proof and that's it.

If your child already has an approved I-130, then it's probably at the National Visa Center. Contact them and proceed with getting the petition forwarded to the Consulate. You'll probably need to send a copy of your Naturalization Certificate and pay the visa application fee. You may also need to deal with an I-864.


Look at the notice - clearly states that a petition needs to be submitted for the child - IR2 which means that he does not yet have an I-130 in the system - which makes sense as petition for spouse was started as an LPR and now has to submit another petition for the child (as F2A does not have derivative option).

You need to send I-130 for your child. You don't qualify for CRBA and that's why immigrant petition for the child is needed. Wife will be ok once you're done with child's petition.

Hello there!
I am a US Citizen, applying for F2A my spouse who is right now in the Philippines.
I applied for him last May 25,2011. On Dec of 2011 I received a notice that my petition
is approved.And that it will be forwarded to NVC. After that,I have not received anything
from NVC. But my husband, did receive a mail from NVC that due to limitation of numerical
number he might have to wait.

I dont understand why my petition takes too long. I have a friend that he petition his
wife last August 2011 and how his wife has been approved and will be coming to US in July.

F2A is for spouses of LPR (green card holders) and yes, in those cases, there is 2-2.5 yrs wait time for immigrant visa number to become available.

If you recently naturalized, you're supposed to contact NVC to upgrade your petition and get it re-classed as CR1/IR1. You have to send them a copy of your naturalization certificate.

I really need your advise please.

My husband (petitioner) worked in a good and big company in US for almost 4 years up to the present. In his payslips, deductions were made to his salary for his tax. He said he pay taxes including his income tax regularly thru the company but he did not file it. (I really don't understand what does it mean). Now the NVC asked him to submit his income tax return for the last six years including last year for his AOS. He already talked to their company's accountant last month and work with all his papers for the taxes and promise him assistance but until now we're still immovable. Who could really helped us in this situation? the accountant?, the IRS?, or better we need to get a lawyer?

PLEASE HELP!


He needs to file the individual tax return - form 1040 and any other forms related to his tax return. Yes, the taxes were deducted from his paycheck, but it's not his employer who does his taxes, he either does it himself, or goes to an accountant.
