Personal experience - spent a year as an exchange student (J-1) and they did not ask for those records. I believe it even said so in that sheet they send you what to bring to the interview (immigrant visa).

If he applies for F-1 there won't be any deferred enrollment - the university has to issue a I-20 with which your boyfriend then needs to pay the SEVIS fee and then go to the US embassy and try to get the F-1 visa.

I'd ask about deferred enrollment even before attempting the F-1 visa. Didn't you consult the international student office and the head of the department at the university?

Send a letter withdrawing your petition to both the USCIS service center that adjudicated it and the US embassy that has her case. Make sure you add a copy of approval notice so they can match up your case and definitely get return receipt with signature so you have your bases covered should something unexpected arise (with USCIS you never know).

All your fiance has to do is not show up at the interview or go there and let them know you are moving to Europe and for that reason you two will not be following through the K-1.

After that you can get married and do DCF if you qualify per residency.

As a matter of fact, in the list of requirements it clearly says police records from all countries except US where the applicant resided for 12 months or more.

I was on a student J-1 visa and did not need to show any police records from the US (was there for a year).

There has been recent discussion about this, specifically debating whether a non-EAD holding person can 'volunteer' for their own company and their co-owning spouse withdraw funds in their own name. You are perfectly entitled to set up a company, as you said, and you can work for him if he's allowed to hire/ pay staff. The hiccup seems to be how the non-EADed person avoids 'benefitting' financially from the existence of the company until the EAD is received.

If he is setting up a bricks and mortar business, I would suggest that once it's open for trading, he not set foot on the premises, and I would have you as the USC listed as co-owner. That way, should immigration do a check, there isn't any argument that someone not authorised to work is actually working.

How quickly is the business likely to be set up? The advice is that the AP/EAD takes 60-90 days after filing for AOS and is valid for 1 year, or until the GC arrives. If he's not taking any action until he arrives, then you may well find he gets his EAD in time for opening the business anyway.


Thanks for the advice! He would start the process of setting up shop while here on a VWP. It's actually an internet business, which would likely be mostly run from home, although he'd have a warehouse where he'd store the product he is selling and a van for making deliveries. I *just* sent in the K1 packet this week. We would like to start selling in May or June. I'm assuming, then, that we'd want to make sure that until he got his EAD, he wasn't driving the van or visiting the warehouse.

As far as the virtual side of the business goes, what can and what can he not do?

How does the non-EAD person avoid benefitting financially when he's married to the person he's employing, their expenses are joint, accounts joint, etc.?



Since he is on VWP, if he comes over to visit you in December, you could get married, file I-130 (don't forget to withdraw K-1) and have him go home until visa is processed. Would be cheaper in the long run and he'd be able to work asap. If you want a big wedding you can do that later.

Go the CR-1 visa way and you'll cut down on cost AND get the GC right away.

The only way for you to get a SSN is to file for AOS and once you receive EAD you can go back to SSA office and request it. No other way around it.

So your going to give up a $55K job so she can pursue her $10K job in europe? That doesn't make much economical sense. (unless you can get the same type of work over there)

If you go the K-1 - she would have to wait at least 3 years before trying to get USC.

If you get married there, you could bring her to the US with a CR-1, however, she would have to respect the "time" out of the US for LPR purposes.

If you get married on the K-1, AOS, then go back to Brussels, you would have to consider her LPR status (I do not know if her work would allow the LPR freedom to go outside the US for 6+ months) - and if you do go back, and lose the LPR because of the time limit, you just sunk a lot of time and money.

There is no way you would lose your USC by living in Brussels with your wife. (you still have to pay US taxes though).

If she really has her heart set on this job - then you may want to look into joining her over there - for the duration, and then if she wants to come to the US later, do the CR-1.


That is $10k per MONTH! I'd jump on that opportunity any time!

As long as fiance has enough money to prove to the embassy he can take care of you and the children, there shouldn't be any issues. Make sure he makes 125% for the family of 5 (fiance, you and children).

How tough are they on you when there is an age difference? We have one of about 13 years, but I, the female, is the younger one. I have read when the woman is older it throws up some flags, but for our situation do they often make a big deal?

We want to know if the 20 yrs. old can still file for k-2 because of his age. It is said that, you can`t petition kid if the age is more than 21. I wish I was on "military expedite" but I am not deploying anytime soon (I can say that now but you know it can switch on the flip of a coin). What I am afraid of is my I-134 (AOS). In the "past" 3 tax return statements I made/make very little, however after my military school I make around 4,500 a month (avg..70k/less w/ taxes) a year. Will they cut me some slack on that?



If you're military, all you have to prove is 100% (instead of 125%) of poverty level.

Not sure it is a 2 years stamp. I think the officer probably meant it referring to the fact that my initial 2 year residency is until 8 November 2009 and it has nothing to do with the temporary I-551 which would only be valid until 8 November 2008. Of course, this could easily cause confusion with immigration which would probably mean me spending plenty of time in secondary when they sort out a muddle of their own making.

Trust me, you will not end up in secondary inspection if you do not have a GC yet. The stamp is enough. The guy at O'Hare asked me why I did not have it but when I told him it's not here yet and maybe because of fee increase/backlog, whatever he completely understood. They do ask you how long you have been outside of US and write that down in your passport (new oval stamp but on a different passport page and with a new admission date; below it they put how long you were away).

Reading through this thread it seems that this GC farce is not an unusual occurence when this sort of muck-up should be an rare extremely rare abberation. For those, of you who have had these long-standing problems (so long that the original 1 year temporary i-551 in the passport expires) are you left high and dry or is it possible to get a further 1 year I-551 stamp in order to travel outside of the US?

Also, do they normally stamp the I-551 on people entering with a CR1? I've had a look on google images and it shows a block-shaped stamp that reads "processed for I-551. Temporary evidence of lawful admission for permanent residence. valid until ______. Employment authorized."
I didn't get anything like that stamped at POE. I got the standard admitted stamp that I always received when I travelled on the VWP. The only difference being that the officer the on this occasion wrote CR1, my alien number and classed it until 8 November 2009 (2 years from my POE).


You can't get a new stamp if your old one is expiring unless you have I-90 application pending. Then you could get an Infopass and get it stamped. No other way around it, unfortunately.

My visa was stamped on the opposite page and only says CR1 and date of entry (good for one year). I had to explain to people on Vienna airport what it was and why I don't have a green card yet. Took a supervisor to let me in the waiting area for my flight.

Hey Alan and others,

here's an update on my green card: we went in yesterday to Infopass in Chicago. Showed up half an hour earlier and were immediately let in. There were very few people there and we were at the counter in no time after they checked in our appointment and gave us a receipt with a number to watch for on TV screen. A lady working there checked my papers and then read from the computer that my card has been sent off in July '07 and that they have no idea why I did not received it, but that it happens all the time! At that point my husband started inquiring how come no one has to sign for the card when it is delivered either to the post office and then to the immigrant. She said the same thing we all know - that it is being sent via regular mail with no protection and no signature required.

My only option is to e-file I-90 and she says the good thing is you can print your NoA immediately once the payment is processed (CC). So I guess we will have to go that route as she clearly said I won't be getting a stamp after May 2008 unless I show proof of filing.

My husband is now thinking of writing to his Congressman and Senators about this matter.
Also brought up is class action suit for all those people whose green card never showed up (happens all the time) and they had to pay another $370 to get a new one (also happens all the time?).
Does anyone here have any idea what number of people who have never received their green cards and had to refile I-90 (and pay $$$) are we talking about?

It's the knowledge that we might have 6 months plus of horrible mess and fighting and struggling and being blocked and told wrong information that causes the anxiety...

I know it takes a couple of weeks for the POE stuff to get on the 'SAVE' system whereas a K1 is already on it, so it might be that extra leg

I am assured by Florida DMV that my 'immigration status' has been verified and so my driver's license has been issued - I look like an emaciated dog which is no wonder after 12 months of this stuff...... also the Social Security people can see me on the 'SAVE' system though they have sent the case off for verification anyway

So I am that far but no further which is more than some poor people get.

I will read that green card 6 times before I believe the details are all correct - and get a second opinion from 'her indoors'

Then I will check it again the following morning

the POE officers made sure I was immediately in the 'SAVE' system (as I was the only CR1 immigrant at that hour) and it turned out to be true since I went four days after we arrived to update my SS card status and there was no problem with that. It's the misinformation line people who are giving out wrong information that gets to me. Oh well, I have made an infopass appointment for 12/19 so will let everyone know what happens.
Do you suggest coming with a filled form for replacement of the card and check book ready?

Let me join the club of those who still do not have the physical green card.

For me, it has been close to 6 months - I arrived on 5/31, first welcome letter 7/6 then another one on 7/19. Called the useless info line first in October as I wanted to give them time since they had the fee increase in July. Told me the same thing I can see on case status online - it has been approved but they do not know why I still do not have it and they will do the "service info request" or whatever that is called and that I should call back on 11/29. I call on 11/29 no news, but the guy tells me call tomorrow maybe we will have news then. I call on 11/30 only to be told by a lady that since I called the day before I now need to wait another 30 days before I call them back.

Now I am just going to make an Infopass for next week and go see should I just apply for a replacement of the card I never received.

I hope no one else has to go through anything similar to the above!

Yes, that is correct. Once NVC accepts DS3032 then they will generate IV fee(DS230) which is $400.00.

Again, they still have not sent a response from that DS-3032, which was emailed to them. The NVC told me that it could take up to 2 weeks.

I'm just having trouble with the Affidavit of Support. I understand that I will complete the I-864 (whether I work or not) BUT if my father (who I live with) can be my joint sponsor...he would have to complete the I-864 A...correct? Because he is a household member?

If, I can get a close family friend to be a joint sponsor (rather than my father)...they would also complete the I-864 rather than the I-864A...correct?

I recently came back from Europe (with my hubby) and am looking for a job. I am having a hard time with the Affidavit of Support, I just worry about using my dad b/c he is in & out of the hospital. Hedefinitely would be able to help me but I would hate bothering him.

Anyway, so my husband has to complete the DS-230, which he DOES NOT Sign or complete the 2nd page correct? He then would have to mail that to me, along with a copy of his birth certificate, police records, a copy of his passport, 2 passport pictures...ANYTHING ELSE?

When I receive all of that, I can mail it to NVC...correct?

Yes, you can have a close friend be a co-sponsor if they meet the requirements (income 125% above poverty level and satisfying the number of people they support (spouse, children) and your husband).

Hubby does not sign the DS-230 until he has his interview - he has to sign it in front of them.

I strongly suggest your husband contacts the USCIS line for military 1-877-CIS-4MIL (1-877-247-4645) so you can go through the process just a little bit faster.

You can manage all the paperwork, it's just getting him to sign the paperwork (I-864) later in the process.

The Jakarta embassy contacted me (the USC) and my wife (beneficiary) by email. Including Packet III with all of those medical forms.

Interview notification also came by email, to me, (USC) not to my wife. They CC'd (copied) my congressional caseworker in the email.

K visas and immigrant visas are all handled by the IV, not the NIV section, of the Jakarta embassy, even though they are non-immigrant visas. That means you cannot set up the appointment yourself.

They took about (2) weeks to interview after the package arrived from the NVC. Statistically they beat almost every other embassy.

Questions? Call them directly. Continue calling until you reach an American aka bypass the locals on the switchboard. Send me a PM and I'll give you a name of a guy from the Consular section who helped us. (assuming you are the USC?)

For your baby, why didn't you just do the consular report of birth abroad and gotten your child a US passport, I presume you're the USC?

Hi everyone,

Although my case is not spouse related, but it's a general question. My parents have got an interview in Abu Dhabi (U.A.E.) and they're going to have to schedule their medical exam the day before the interview. I'm really concerned that they won't have the test results that early. Can anyone please tell me how long does it take to get the medical test results back and how long prior to their interview they should schedule their medical?

I'd appreciate it if anyone could tell me where do you find the US government approved doctors (panel physician) to schedule your appointments with? Is there any list for that?

Consular staff at the embassy should have provided your parents with the list of the approved doctors for the medical exam and that list should have also contained info on when to do the exam (how long before the interview). My paper said to do it at least 2 weeks in advance but when I received a copy of my medical exam when they issued my visa I saw that HIV and syphillis results were back 4 days after they took my blood.

Maybe the US embassy in UAE website will have the information you are looking for. And you or your parents can probably email them - don't forget to put the case number in the subject of the email!
