The current processing times are MUCH faster than what they used to be.

Remember, we are in a recession. Where is the US government going to get the money to re-vamp USCIS processing? Will that money come from the military budget? Or perhaps tax hikes? Perhaps we can just borrow more money from China!

Also, It's an election year. No one is going to vote in someone in favour of USCIS processing times which it affects such a small percentage of the population

I know it is tough, we waited 178 days for our NOA-1. That is longer than the current processing times. In fact, when we filed it was 7 month processing, so in just 1 years it has sped up a bit

Actually, almost all USCIS funding comes from the fees collected for the processing of applications. If you read some of their reports it even breaks down how much of each fee goes to different costs - personnel, facilities, equipment, software.

We were able to get copies of the 1040 income tax returns of our co sponsor for the past 3 years, and it looks like their W2 information is listed on the front page of each, however we don't have the actual w2's. do we need W2's if we have the 1040's? or would copies of the w2's suffice if we can get them? or do we need the originals.

Get the sponsor to obtain 4506T-EZ from the IRS (snail mail takes around 10-15 business days to receive).

If they have a fax machine, those can even be faxed to them, they just have to call IRS 1-800 number with their information.

If you wanted it issued automatically it could be 3 weeks or so... GC probably within 30 days



That thing rarely works for spouse visa even if you check the box you want it sent to you - the system is just not connected to SSA and people wait and wait and wait and in the end finally go to SSA to discover they never received any info about them.

The best bet would be to wait 2 weeks after POE and then go to SSA office with filled out form, immigrant visa and passport.

If representative is not helping, contact senator. Just email is sometimes not enough - there's a local office in your area so go there in person with all documents/notices you have received so far (copies, leave originals and another set of copies for yourself).

I keep seeing things on here about what service center your paperwork is going through, and Ive been too afraid to ask because I didn't want to look like an idiot, but here goes. How do I figure out which service center has our paperwork? We've had our NOA1 now for 2 months and it still says "initial review" so Im getting a little antsy about when it will move forward. No RFEs as of yet. But I also know that once it gets to NVC we are looking at at least 7-9 more months in Montreal. Anyway, thanks a bunch!



Service center is determined by the State you live in - East coast goes to VT, Midwest and West to CA. That's why they have the WAC and EAC as part of the case number.

You can find the list of where each state belongs to under the instructions of a form - where to send - if you live in such and such state VT or CA address. With the lockboxes, you send to one central location and from there they route it to appropriate center.

Hey guys,

Does anybody know if I am allowed to take all of my personal belongings ONLY on the 1st POE (ie, activation of visa) or can I tell them "well, I'm activating my visa now on this POE, but on a later trip I'm going to be bringing a whole buncha other stuff with U-haul, which I couldn't bring this time"

Where can I read about how many things I can bring with me on POE or if I can also bring similar quantity of goods on subsequent trips??

go online to cbp.gov - do a search on "new immigrant" - you will find lots of resources and learn that you have 10 years since immigrating to move your possessions to the US customs (and duty I believe) free.

It was the same with a friend from Bosnia - she could never (so far) register her marriage in Bosnia - they kept asking for the original and the person who apostilled the paper had to be the same one who signed the certificate which is impossible. I believe she ended up not doing anything with Bosnian authorities or consulate.

Since baby is a USC, don't bring him to the interview. Only intending immigrants are allowed in.

No, the father will have to submit another I-130 for the child. He hasn't been a USC for 5 years and for that reason he can't get the child US citizenship.

One can certainly get married in the US and file for CR-1 visa - no restrictions on where the marriage took place. Have a friend who got married in the US, went to her home country to get her CR1 visa.

thanks for the quick response-I'm still confused about the joint sponsor situation. See, the I864A she has filled out- but it appears that she must add him to her household and claim him on her taxes. I'm VERY VERY confused and extremely concerned in this point... the other points are cearing up in my mind- it's the joint sponsor thing that has me very confused.

IRS and USCIS forms are two separate things. Husband can't be claimed as dependant for IRS tax filing purposes - she is just sponsoring him, NOT providing for him. I-864 is in case the immigrant draws specific benefits so the government can go after sponsor and co-sponsor to get the money back - rarely enforced simply because the immigrant does not qualify for those benefits for the first 5 years, and by year 5 he can already be a USC.

Disability issue - get a SSA statement of benefits - should have explanation on your disability income and whether it is taxable or not.

ok...here's the dilema...I am with my husband in Pakistan. We are leaving in less than 10 hours to fly to islamabad to the embassy there.I am a disabled American (NOT pak-American) I DO have a joint sponsor. We will be living with her (I was living there before I returned to pk) She is single and lives alone. So my questions are many(naturally lol)
#1- what income level must she meet?? $18212?? Correct, unless the 2011 poverty levels change.
#2- does she claim him as a household member and file taxes on him? No - read on who dependants can be - your husband does not qualify.
#3- which form does the joint sponsor fill out exactly??? I-864 or I-864A if it is from a family member or member of household (as it seems you will be in the same household)
#4- any idea of how long this will take? I'm ready to go home! lol 3-6 months is usual, but since you're in Pakistan, there could be additional administrative processes done on your husband's background - from 2 months to even more than 6 months depending on the case
#5- I receive disability checks from the govt- how will this affect my disability payments? Will I go to jail???ugh...so much anxiety... I'm gonna start a friggin clinic for survivors of the immigtation process LOL No, why would you go to jail? As your husband's principal sponsor, YOU will also fill out a I-864 form. If you haven't done your taxes in the past, you will want to catch up on the last 3 years of it. If insufficient level of income reported and no need to file taxes, you need to provide a statement from you with supporting evidence why you didn't have to file taxes.

opted for the IR1 rather than the K3 cuz it seemed like a better idea- no work permit and 2 more years of waiting for his LPR.

I do not think the embassy in PK does DCF but I'm gonna give it a try- and if they don't then at least I will get some infor from them (I hope!)

Wife is not getting US citizenship any time soon.

If you qualify to file DCF, yes, you do have to withdraw the other I-130 you already sent (2 months ago). You should also check with embassy how long you have to be in the country to qualify for DCF filing - usually is 6 months, but some countries have different requirements.

Read up on I-864, poverty guidelines - both forms available at www.uscis.gov under forms section.

Sorry but I believe this is incorrect. You must fulfill the 2 year residency requirement in the country that issued the J1 visa to you. I.E. if Russia issued her the J1 visa, she needs to fulfill the 2 years there in Russia. Any time spent out of Russia, in any other country other than Russia, stops the clock until she returns.


Russia does not issue American visas - that is the responsibility of the US Dept of State.

Here's my case - J1 sponsored by the US Gov't. Had to spend two years in my home country which I did. My clock started in July 2002. I did have 2-3 months absence as I was traveling. Had no problems getting a tourist visa to the US and spent a month there. CO knew about J-1 requirement and for me it was never an issue. My place of residence has always been my home country - who's to keep me from traveling if I disclose all of that on the forms?

Your wife does not have to spend entire 2 yrs in Russia only. As long as she left the US on time and went to Russia she is fine. 2-3 months visiting other countries (US included) is also ok - her main residence is in the Russia even if she is visiting the US and the G325a should reflect that.

Also, definitely go with the CR-1 visa = only I-130 petition and don't even bother with I-129f - that's useless these days.

Hello:

I need serious help. My wife and I applied for K3,k4 Visa in October 2009. All documents approved and sent
to the National Visa Center. In February the National Visa Center Electronic informed me that K3 and K 4 Visa applications were being converted to CR 1. Not once did the National Visa Center inform either of us our 2 1/2 year old son was no longer attached to my wife's Visa.

All of the documentation submitted from start to finish included our son. Even the DS 230 application was inclusive of our son. The National Visa Center completed our file and set an appointment for June 1, 2010 Visa Interview.

I contacted the Guangzhou Embassy 5/3/2010 to confirm some things. I was informed our 2 1/2 year old son could not immigrate to United States on my Wife's CR1 Visa. I had to start all over with I 130 application for our son.

I got a Washington DC number. Visa office who would oversee all US Embassy's. They also told me with the change in February our son was not included on my wife's CR 1 Visa. They were very sorry, but there were other cases just like my situation. Anyone have any ideas?

OP, what seems to be that you have not learned from your previous topics with the same issue?

1. Your wife not-knowingly used a scammer and the person took off with $450 - you're not getting your money back, sorry - learn from that.
2. Immigration's web site is www.uscis.gov - all forms you need can be found there under FORMS section
3. Your wife has to file I-130 if she wants you to immigrate to the US as her spouse - she will have to pay all the associated fees.
4. If you click on the guides at the top of this page you will find instructions on how to do everything yourself (you and your spouse)
5. you will not qualify for tourist visa as you have clear immigration intent - wife is USC

Don't forget -once I-130 petition is approved, you have one year to complete the process in NVC. If you have doubts, definitely put a hold on the processing until you resolve the uncertainties.

Sorry you had to go through this but it's better that you found out early and not after you are married to this person.
I am sure you can pull the filed petition early on and it is the right thing to do. I certainly would not want to be with someone who is cheating on me, and no type of blackmail (including this emotional one) would work on me.

You need to stay strong, break off whatever you had with this person and move on - I am sure you will find someone special who will love you for you (and not for money or getting into States) very soon!

With DV Lottery, you can apply for citizenship after 5 years of being a PR. Marriage with a USC gets you that in 3 yrs (if you go the CR-1 route) - I think it's a bit longer with K-1 because of AOS and actual date when you get conditional GC.

The K-1 visa issued? to you is for you to go to the States and get married to the original petitioner -- not the girl you are involved in now.



If you want to get married to the current girl she could come to Egypt, you two get married and you start a CR-1 visa - involves a wait time of course but at least you will do it the legal way.

You may want to notify the US embassy that you will not be continuing with the K-1 process and to get your passport back from them.

We all know that things used to be different "back in the day" - ie prior to 9/11 or even prior to the last big re-write of the INA in 1996.

I have always wondered if immigrants who had been here previously on, say work or J visas, were given Social Security cards with the restriction printed on it.....................



I can tell you about that as I received my first SS card when I was on J-1 visa - entered the country prior to 9/11 in 2001. My SS card had valid for work with INS authorization only (don't remember the exact wording) but I did work on-campus once the people at BECA (Fed Govt) allowed me.

I-130 is needed only AFTER you have received your NOA2 from USCIS...at the interview stage. guides6ly.gif

I-130 is NOT used at any point of a fiancee visa process from initial filing all the way through adjustment of status.

After the fiance arrives and they get married they will file for AOS which will include the I-130 among other forms.
NOT True either, K-1 adjust status based on K-1 visa, the I-130 is NOT used when a K-1 adjusts status.

ONLY if the K-1 marries the US citizen OUTSIDE the 90 days of the I-94 would they need to file an I-130.



Can you tell I did DCF and not K-1 star_smile.gif . I just saw it's actually the I-485 K1s use instead of I-130. My mistake - you learn something new every day.

Yeah, i have read that, but i fail to see where it says "all countries EXCEPT the USA" any docs referencing this? are you speaking from personal experience?




Personal experience - spent a year as an exchange student (J-1) and they did not ask for those records. I believe it even said so in that sheet they send you what to bring to the interview (immigrant visa).
