Calm down girl! He's just tried to make you realize that with no job and frequent visits your chances of being denied at POE are much higher than if you had a job.

 

Rule of thumb is to stay outside the us double the time you just spent (3 months for you), so try going in March.

 

Why don't you work any more? We always tell people not to quit their jobs or start booking venues, wedding receptions and such UNTIL they have an (immigrant) visa in hand.

IF you have a green card, go back to your country and get married. Upon return to the US, file I-130 for your spouse. It will end up being F2A visa - children and family members of LPRs. It will take more than a year and closer to two years before your family can join you in the US, no way around it.

Umm, go to the city hall or local court and get married for under $100. Doesn't need to be expensive, all you need is the legal paperwork to start the process - get an expensive celebration later on if you want it...

 

Thousands of people get married in the US - as long as you leave afterwards and not try to adjust status you're fine with immigration.

 

You'll need a police certificate from your home country (UK) and any place you spent more than 6 months in after the age of 16 - not needed for US - USCIS/Embassy takes care of the checks for US side.

Why not get married in June 2014, he starts I-130 process, you go do your work overseas. Do note that if you spent more than 6 months in a country that is not US or your home country you will need police certificate from there.

Your lawyer is correct in that there is no appeal for a denial.  The writ of mandamus however, is not an appeal.  It is a court order compelling the USCIS to reach a decision on your case.  It is one way for you to force their hand to either approve or deny your fiance's K-1.  Contrary to what you may think, the USCIS will not simply deny it to comply with the mandamus, so it may be a way to escalate your visa request, if it should sit in AP for a long time.  Talk to him [lawyer] about it and find out what he thinks...

 

 

 

Not quite sure you can force end of AP via writ of mandamus -  it's DOS, not USCIS - USCIS has done their thing by approving I-129f. DOS can take as long as they need to take to process AP - seen how long some people have been in AP in Pakistan or Afghanistan?

I don't think it is "breaking the law".  I think it is a question of intent.  The child is not the petitioner, only the derivative beneficiary.    And can't you apply for an AP at the same time you send in the I-130?   I would think the AP would let them in.

 

No you can't apply for AP when you send in an I-130 petition. Where did you get that wild idea? The child will be processed overseas at Bogota embassy when his time comes.

 

OT: I see you're fairly new on the boards. I suggest stepping back and not jumping into people's topics if you're not certain about the answers to the questions asked. Your wrong answer could cause someone a lot of heartache and immigration problems if they were to follow your advice.

You need to list ALL children on the application, whether they are immigrating or not.  Once the child is granted a K-2, it is basically to allow entry into the country within 6 months.  If the child does not come right away, I don't think it matters.  You will marry in 90 days and start the I-485 process.  As long as the child goes to the K-1 interview in the country of origin, AND the I-485 interview in the states, as a derivative beneficiary, all should be fine.  If the child's K-2 goes past the 6 month date and expires, they can probably get an ESTA visa waiver or a travel visa to come for the interview and then go back with an Advance Parole if they don't have the LPR card yet.

 

Definitely do some research on this though.   For now though, do list ALL children.   You will get nailed if you don't.   They need to be on the I-129 even if they are not immigrating.

 

Do tell how you imagine not breaking the law by having someone come in on a tourist visa with pure intent of adjusting status???

1) You list both on I-129f. You'll only pay for one child come the interview time.

2.) No problem. You'll petition him via I-130 as you will have married his mother before he reached 18 yrs old thus establishing step-parent relationship.

 

Do figure out any paperwork needed from the father to immigrate to the US ahead of time. I've seen cases being held up because of that. Also, ALWAYS make a certified copy or two to have as a back up - you never know which authority may be asking for it in the future and if you provide the sole copy to the Embassy/USCIS you will not be getting it back.

A friend can do it for you in your own place just stand in front of a white background, take pic according to state.gov instructions and then crop it so the size fits - you can re-size based on pixels or percentage of original photo.

 

That's what I did for my mom's visa photo - sister took it and it was over 1Mb, I resized and resized until it passed the validator and then mom submitted it.

Thinking ahead, how hard is it to get a PI passport in the US.  If you get your visa in the old passport and travel to the US, you cannot re-enter teh US until you have AP or the GC which takes time and your current passport will most likely be expired.  You need a new passport anyway, why not get it now rather than trying to get a new one in the US.  The only reason I can see of waiting is to get the new passport in your married name, but having the passport in your maiden name and the GC in your married name is not usually an issue if you carry your Marriage Certificate with you when you travel.

Did I read about another fee increase??? Are they serious?

Also, question for N-400 and the biometrics (again). I see some people are getting receipts (NOA1s) for $595 and others for $675. What is happening with discrepancy - are people's old biometrics being used and they're still charging the $80 or what? If the biometrics from I-751 is still valid, why pay another $80 for something they already have? And since January 2009 all returning PRs get their picture taken as well as fingerprinted (index fingers only) at POE so it looks like they don't really need new biometrics.

Also question about GCs that never show up (either CR-1 visas or AOS). Why such lax security (plain envelope, no signature required) when sending such an important document as someone's GC? Why do we have to jump through hoops to prove we did not change address but never received GC and were still asked to pay additional $380 for something never produced - direct info from INFOPASS "happens all the time, submit I-90 saying you lost, mutilated or detroyed your GC and pay another $380"? [We ended up involving our senator and only the 2nd sending of I-90 (no fee) was accepted]

Hey everybody! Thanks for the help in the past that this forum has provided.

I wanted to clarify something from those people who have already completed the CR-1 process and had their significant others in country with them already.

When we were approved in Lima, my wife received a stamp in her passport that was valid for one year, stating that it "serves as temporary I-551 evidencing permanent residence for 1 year." In the stamp above, it says admitted blah blah blah then a date May 5, 2010.

Now we already have our conditional green card for her with the standard 2 year expiration date that will expire in May of 2011.

My question is, do I need to do anything with the visa in her passport before it expires?

It is my understanding that she can travel freely with the green card and that the stamp is no longer necessary.

Any guidance you can give me would be supremely helpful. Thanks!

Me and my wife have been married for over 3 years.
I went to the final interview at the embassy, and they granted green card.
Now, I know that I have to enter the US within 6 months.
However my wife just got a job offer in my home country and she said she would like to stay and not returning to the US for a while.
I was so ready to move to the US so I gave up my job, apartment, etc.
I thought about giving up the green card and remain in my home country but since I already have a job offer in the US, I would like to leave.
We talked about it and decided to go long distance relationship and will be together in few years in the US.
The question is, am I still going to be able to stay in the US legally even though we are separated (but not divorced)?



Yes, you'll be fine on your own - you'll get a 10-year green card (so no removal of conditions required). If you want to go for the citizenship after three years (based on marriage to USC) they will ask about marriage proof so bear that in mind.

Are you sure you didn't mail everything in April and not March? Often times it takes up to 2 weeks or more for the check to be cashed and NOA1 sent to you. Once you see the check cashed expect NOA1 shortly.

I was going to pose a question re the SSN but this is part of what I was going to ask re this thread so I'll do it here. I'v checked off the YES in the DS230 for the SSN to be applied for by 'the man' lol - so my question was around obtaining the actual number itself prior to getting the SSN card mailed out. This is related getting on my wife's medical coverage when I finally get down there. They will require an SSn so I thought I could get the number assigned before I get the card rather than waiting.


So it sounds like it's in the data bank so I should be able to get it then? Correct?

Also what are people's experiences with checking off yes on the DS230 and getting the SSn without any problems? Comments?




I think they can tell you what is the SSN that was assigned to you. If the card doesn't show up in a week after POE, definitely go to your local SSA office and re-apply.
From what I know, in over 50% of cases it won't come even though you checked that box.

My wife was stamped and processed in FLL from Medellin on a CR-1 visa. The customs agent told her that she could work immediately using the registration number on the visa. I thought that she had to wait for three weeks before she received a SS#. She is desperate to work and we are both confused. She asked the guy twice and twice he said she could work using the number. This number is only 8 digts long. You need 9 numbers for a SS#. Plleeeeeeeeezzzz help. Thanks



Just go to SSA office and apply for the card. Should get it within 2 weeks even though it normally arrives in a couple of days only.
