Passport stamps are your biggest help, as they are the best proof that you were in the same country together with no doubts.  Focus on things that like that really can't be faked.

 

Please don't stress too much about the pictures -- they're nice to include as secondary evidence but you don't need more than a few (2-3) at all, as long as you have the other evidence.  (Do be aware that you can add the time-stamps in any photo-editing program or simply write them on the back -- USCIS doesn't really require the burnt-in time stamp on a negative or anything like that.  All I did for my photos was put captions underneath stating the full date and location and names of people in the photos, and write the same information in sharpie-pen on the back side.  No RFE.)

 

But consider finding other types of hard evidence as well -- perhaps credit card statements showing purchases made in the same town at the same time period.  ATM withdrawals -- I printed my bank statement from the month I spent with my fiance and circled the ATM withdrawals I made in his town.

 

However, in re-reading your post, it might be helpful if you post the actual wording of the RFE.  Something strikes a warning bell: you say they ask for "circumstances under which we met and established our relationship" -- they MIGHT be asking how you initially encountered each other.  Was it online, a website somewhere, did you study together, were you introduced by family friends, what?  Have you explained how you first met your fiance, in addition to your physical presence with him?  You do need to explain BOTH how you initially got to know each other, as well as provide proof of meeting in person in the last two years.  Make sure you've covered both of those and you should be ok!

From my browsing here, London is very unique about the financial side.  You really should check in the UK regional forum about their requirements -- my understanding is that they're unique because they do allow the UK beneficiary to self-sponsor, and are generally quite lax about the I-134 from the US petitioner as well.  But check UK forums or wait for UK-specific answers here!

When I was watching WAC numbers constantly, I would occasionally see ones that had been in initial review become "unavailable" like that for about 24 hours.  The next day (sometimes 2 days) later, they would come back as Approved or RFE.  I think it's very similar to the "alien registration change" that many people get prior to a decision, and to the "name updated" that is similar.  Their system is wonky, so there are NO guarantees ... but I do think it's likely that you're in store for good news very soon, given that they are processing filers around your date!

USA citizen petition I-129F submitted February 2013.  Receipt date received shows as March 4th.  Canadian fiance still has not received any application package.  We have had no contact at all at either end.

 

Welcome to the world of the fiance visa: waiting, waiting, and more waiting.  I'm sorry to disappoint, but you're in for a long wait, and there's no reason why your Canadian fiance would ever have been contacted yet.  You're totally within the norm and everyone else is waiting right along with you.

 

If your NOA1 was March, it's likely that your petition might be approved by October.  Possibly by September if you're lucky and Vermont speeds up a bit.  After that, it will take a further two months minimum (more likely 3 months) for your fiance to work through the consulate stage on her end.  You're probably looking at a December wedding, assuming things stay about the same as they are now.

 

Customer service reps at USCIS are next to useless.  They are not trained and have little actual experience other than reading from a script they're given.  It's no surprise that they gave you false hope, but I am sorry for you all the same.

 

As Jay-Kay said, there is no way to plan any firm dates with either the K-1 or the spousal visa.  That's the life of the visa petitioner, unfortunately.  I don't recommend changing to the spousal visa at this point, because the wait is just as long (if not longer) -- unless your fiance really needs to work right away upon entering the USA.  That's the major difference and for some people, it is necessary.  Otherwise just stick with it and join the waiting club here!

I was starting to worry about my case getting to NVC after NOA2 May 17th ... since there are a small but growing number of horror stories here about USCIS never sending the files on, or sending them to the wrong place, etc ... and some filers several days ahead of mine (May 18, 21, 24) had already gotten through NVC completely.

 

However, today when I called after the agonizing weekend of wondering whether I might be in for more delays, my case was there!  Just today.  Hasn't been shipped out yet but I did get my case number.

 

It took mine 17 calendar days after the NOA2 to just arrive at NVC.  (10 business days, they say to allow 15 business days max.)  If your NOA2 is only May 24, you're still within very normal times, I think!

 

Also note that CR1/IR1 cases are processed much more slowly.  With spousal visas it seems to take on average of a month, if not two, to get to NVC.  K-1 does go faster and is usually about 7-10 business days -- not calendar days.

I can't believe it... i did everything i could to fix the situation but still in my mind we were in for a tough year plus of waiting.  I hope it's good news - omg it would be so heartbreaking now if it goes wrong again.

 

Well,  i think the lesson is that maybe they aren't immovable,  there is some chance to get approved still if you can get on top of things quick enough and the circumstances just seem so strange.  Thanks to Congressman Duncan Hunter and his aides for their help,  and to the embassy staff for reconsidering.

 

And also,  a sincere thanks to all the VJ members for your support and ideas,  maybe one of those ideas is what made the difference.  

 

Just noticed that you contacted Duncan Hunter.  I have to put in a second GOOD WORD on his office -- I was one of the "skipped" November filers at CSC, waiting for approval when all the cases around me were already done.  I contacted Hunter, Feinstein and Boxer, and Hunter's response was IMMEDIATE and extremely helpful.  (Feinstein responded 3 weeks later, and Boxer has still never answered.)  I can't say it's 100% due to Holly's (Rep Hunter's caseworker's) inquiry, but I got my approval only 48 hours after she filed the inquiry at CSC.  So yes if you're in the San Diego area and need help, contact Duncan Hunter!!!

You should of course check with the embassy and in your regional forum here on VJ, but in general ... you don't send explicit "proof of domicile" for a K-1 interview.  Your I-134 support documentation already provides most of that anyway (W2 and taxes, paychecks, etc.).  Perhaps the page you were looking at was a general page covering both spousal and fiance visas?  Because the proof of domicile is far more important and specific for spousal visas.

 

Check with the embassy to be sure, but I'm guessing you don't need anything at all in that regard.  Unless MENA consulates are different, in which case get advice from other MENA people!

You're filing for K-1 ... generally speaking you shouldn't need to prove domicile because you filed in the US.  It's different with CR-1 spousal petitions where the couple might be living together abroad.  Has the embassy told you or mentioned that you need to prove domicile?  Or have you been living with your fiance in the foreign country?

 

Generally us K-1 people don't need to worry about domicile at all, so I'm puzzled why you're asking.

That adjudicating officer should be ashamed.  There is absolutely no reason OR SPACE to put anything in question 3, if you answered no to question 2!

 

I also did not check any box in 3, having answered no to 2.    I wonder whether we'll get an RFE as well!  But I can't believe anyone would think to write in N/A since there is no space available to do so!  wow.gif

Could you provide the actual text of the denial or refusal form he received (was it a 221G or a flat denial, that could make a difference)?

Based on what you relate, it doesn't make sense to have denied him, so I'm wondering if it's possible you simply were missing a particular piece of proof (e.g. did you include your birth certificate and the birth certificate of the co-sponsor? were all forms signed? that kind of thing...) and that you might be able to resubmit the evidence to gain approval.

Tyler, it does look like a large number of approvals came in around 6:30 this morning.  Mine was included -- although the email was sent May 18, the notice date on the status is May 17, Friday still.  So for whatever reason, it does seem they skipped their usual Friday night update and did it early Saturday morning.  I'm sure you'll be running your harvesting again soon, but just wanted to let you know if you don't already!  Maybe no need to panic for the "stoppage" you're expecting, quite yet.

There have been other Friday nights where the status/database was not updated until 11:45 pm.  After watching the dashboard site closely for four weeks now, I'm not too panicked yet -- if it gets to 1 a.m. and there are still no updates, okay, that's bad.  But I suspect 10:30 is too early to call it a day for a Friday night.  Their usual update time on weekdays seems to be 8-9 pm but Fridays are nearly always later, in my experience.  Tyler certainly has been tracking this more closely than me, though ... so perhaps I'm wrong?

Explain what you mean by pendulum, please. 

 

I simply mean that no one can predict which applications will be processed in normal time, and which will take forever.  Currently the CR-1s are at the really awful long end of the pendulum, but there are going to be times, past or future, where K-1s will be taking forever, as there have been in the past.  I am not trying to place any type of petition over any other, so please don't take any offense.  Do whatever you can, organize and write letters and take action as we did when the K1s were taking 9+ months with no movement, when the CSC said petitions were flooded and lost and there were catastrophic delays ... it was not a fun time to be waiting, and I never want to go through it again.

 

I hope sincerely that processing times will improve for everyone. But knowing USCIS as I do now, I strongly suspect that there will always be times when THEY focus on approving certain types of petitions faster than others, for reasons known only to them.  It's not fair and it's stupid, but the system we have is pretty much broken and I don't have much hope of it ever being "fair" to all.

 

I do sense that you're really really defensive, and I hope I'm reading that wrong.  I mean no offense and I wish all filers the best of luck in this horrendously uncertain waiting period.  Please don't think anyone wants anything but the best for you.

There are always going to be fast and slow processes, I think, no matter whether K-1 or CR1 or AOS or ROC or anything!  We filed K-1 last year, November 2012, and it took us well over 6 months just to get NOA2, then another 3 months for visa issuance -- total of 9 months from filing to POE.  At the same time, there were filers waiting nearly five months MORE than us -- many July 2012 filers for K-1 waited 14 months from filing to POE, on a K-1.  I am really sorry that the CR-1's are taking so long right now ... it's not fair and it's frustrating but the whole system is a pendulum and there will never be balance and fairness, I'm afraid.

 

OP, congratulations, consider yourself VERY lucky to have gotten the NOA2 in record time, and good luck on your upcoming steps!

USCIS has been doing this for years, confusing people, there are several posts about it every month.  Our NOA2, even last year, said "forwarded to the listed consulate" but of course it was not -- it was forwarded to NVC, and then onwards to the consulate.  ALL I-129F petitions pass through the NVC, I've never heard of any exception, ever.  Why the NOA2 has to be worded that way, we'll never know ... it is simply wrong and misleading!

My fiancé filed June 2012 we received NOA1 exactly one month later and I do agree I think we may have been a few days out which is something we discussed after it was filed. I would rather appeal than reapply the process is so long and drawn out

 

If that is the reason (that you had not met exactly within the previous two years, but a few days more) -- then in fact there is no justification for you to appeal on.  The error was yours: you did not meet the criteria for filing.  Appeals only work when it is an error on USCIS part, not yours.

 

I'm not trying to criticize, just trying to save you time and money and frustration: if your denial notice does say that you did not meet in the two years prior to filing, then you really can't hope for an appeal, since that is true and USCIS is in the right.  Your best choice is to meet now and file again.

Quite apart from the dangers of flying at such a late stage in pregnancy, I do have to ask: what about health insurance/medical coverage if she manages to arrive in the USA and have the baby here?  Does she have coverage?  My husband arrived in the USA last fall and we're STILL working on getting him good insurance, so I would question whether your fiance would be covered at all for her delivery in the USA.  Just another reason I would suggest waiting and having the baby in her home country, the costs here would be outrageous.

We got married on Friday. smile.png  Nothing very big, just a courthouse wedding as we planned, with my immediate family as guests (unfortunately none of his family could come), but it was a very nice simple ceremony and neither one of us wanted anything more!  No honeymoon, since I teach I can't take off during the semester, but we'll plan something for the December holidays locally, maybe San Francisco or that area.  Wedding pics attached, if it works correctly!

 

We went to get Mikko's social security number last week, and it seemed to go okay, so we're waiting for the card to arrive in the mail -- hopefully next week or the week after.  (Crossing my fingers that there's no delay or problem with that!)  Once we have the SSN, life should get busy again, since we'll want to open joint bank accounts, change some utility bills to him, and all of the normal life stuff.  And in a few weeks, once we get our official marriage certificate (takes about 2-3 weeks here), we'll get the papers ready for AOS filing.

 

We may try to get a California state ID after his SSN arrives, but the timing is getting tight and they may not allow it.  If not, we'll have to wait until after his EAD arrives in a few months, not the end of the world but I would like him to get a state ID to make certain things easier!  I'd also like to figure out if he will qualify for the health exchange (Obamacare) in California, which I think he will -- I can't put him on my insurance since I actually don't really HAVE normal insurance, I'm in COBRA temporarily and will be switching to Obamacare myself in a few months.

 

Other than those things, life has been relatively quiet and PEACEFUL.  Not quite stress-free, what with the shutdown and various other things to do, but lots of time together when I'm not working, and many new purchases to help him settle in -- also a lot of outings on weekends, since I feel like he's shut inside all week when I'm at work, and I don't want him to feel too confined!   Overall, we're settling in really well, he's keeping in touch with his family on Skype several times a week, and there isn't much else to report, really! smile.png

Congrats to all of us, we deserve it I think!! -- and my best wishes to those of you still interviewing/waiting for visa!

 

It's hard to believe Mikko has already been here almost a week!  He arrived last Friday, and POE in San Diego was very straightforward, only took about 45-50 minutes from when the plane landed.  Had a great first weekend, and immediately bought a large smart TV (since I only had a very very old standard tv from 1990!), so he could spend some time while I'm at work watching TV. smile.png  His belongings are being shipped from Finland, but that will take a few weeks, so in the meantime he's got the necessities and is settling in fine.

 

Only downside is that, as often happens, he caught some bug on the plane, and he's been quite sick for the past couple days, fever and cough and cold.  Nothing needing a doctor, and it's getting better already now, but it kind of put a damper on the excitement (and intimacy!) levels for a few days.  I think it's almost passed now, so we'll have another good weekend!

 

We retrieved his I-94 online, no problems there.  Next Friday we'll go to the Social Security office and see if we can get his SSN -- hopefully that will also go smoothly.  Wedding is scheduled for October 25, but that may have to be pushed back a week or so, since we're still waiting on the lawyers to finish up our pre-nup, so that's adding a little stress just waiting for them!

 

We've been exploring his interests in the area (local shops and things) when we have time, and we'll probably try to get a library card for him next week.  After he has SSN, we'll try for a California state ID (maybe not allowed until after AOS, but we'll give it a try!), open a joint bank account, and various other things, so we still have a full schedule of things to be thinking about .... but it is SO MUCH BETTER to be here together every day and just relaxing in each others' company!

Wedding booked!  October 25 at the county clerk, most of my family will be attending (around 11 guests).  We hope that's enough time to get the pre-nup signed, but it should be fine since we already have it ready to go, just needs official review and signing.

 

I'm so untraditional that I'll probably just wear a black skirt for the wedding (I never even wear skirts normally, and 100% never white!).  And a small dinner at a restaurant afterwards -- that's MORE than enough for both of us and we're very happy with our arrangements! :)

Congrats, pachacuti!  We also have tickets, Sept 13 arrival in San Diego (I live just outside the city).  We think everything's sorted -- moving is a hassle and we did hire a shipping company, so they'll be packing up his stuff on Sept 10 and cleaning his apartment.  Still have to figure out closing or re-addressing his bank account and cell phone, but other than that, we're all set!

 

FOUR WEEKS and we're finally together for good!!!

 

We're looking at a mid-to-late October courthouse wedding.  When I called yesterday, they said that October was already filling up so I had better book it soon ... so probably early next week we'll set the actual date. :)

Happy Snoopy Dance!!!!!  Visa approved!  We met another VJ couple at the Lima embassy (they can speak for themselves) and they were approved too smile.png

 

Now we off to celebrate.  Woo Hooo!!!

 

Congratulations!!!  We went to "the biggest amusement park in Scandinavia" the day after our approval ... where I promptly got sick after a very distressing spinning teacup ride.  Therefore I would not recommend an amusement park, but -- do something fun to celebrate and let the stress finally disappear!  smile.png

I've been taking a break from the site lately, since I was spending 5 weeks in Finland with my fiance before his interview.  But I'm happy to say we had our interview last week, and everything went really smoothly and we're approved and he already has his passport and visa back!  So we're looking at plane tickets now ... he gave final notice to his work and his last day is September 9, so we're planning for him to POE around September 13.  VERY HAPPY and the most relaxed I have felt in a year ... it's great to see everyone getting approved and finally being reunited for good.

We have our interview date now, and EVERYTHING else is ready to go, so I'm actually disappointed that the interview isn't sooner.  We finished the medical, all the forms and clearances and affidavit of support last week, mailed off the "we're ready!" checklist to the embassy -- and they emailed back yesterday with our date: July 24.  At least I'll still be here in Finland then, so I can go with my fiance to the interview, although I'll just sit in the waiting room I expect!

 

He'll still need about a month after we get the visa to give his notice to work, and get his shipping options taken care of for leaving his apartment, so we'll probably have a POE in early or mid September.  Good enough, and I'll enjoy my next three weeks of vacation in Finland with him!
