I came home from work late tonight and got my approval notice in the mail. As you can imagine all the emotion im going thru. I also received a Notice of Decison on my previous petition that was sent back last June too. The notice was dated Sept. 16 stating that my petition has already expired, and that I am able to file another. My new approval notice dated Sept. 17 stated that my new approved petition will be forward directly to the consulate. It does not mention anything about going to NVC first,like my first petition. I did notice both petition were touched the same day. I assuming they had reviewed my first petition along with my new petition, and approved the new one. I had attached a rebutal to the first petition along with my new one, hoping to get my old one reaffirmed. But I guess the first one expired so they approved the new one. My question is has anyone had a second approval notice that was forwarded directly to the consulate and bypass NVC????


good.gif I just received my NOA2 yesterday. It also says that the petition will be forwarded to the consulate in HCMC and nothing about the NVC. This is a little puzzling becuase I thought it went to the NVC. I have read and read and thought I was familiar with the process but still confused. Anyway the good news is that they are approved!!! Still work to do but were getting closer! Good luck and best wishes. (It's almost funny because I just returned from 2.5 weeks in Nha Trang with Doan and just as I return I receive this!! Ia was not expecting for another month becuae process times have been behind!!! Very happy and excited!!!

There was another couple there too (Elmer from Houston and his wife) They had been rejected on K-1 and were on another go around as CR-1 and they also received PINK (Sorry in all the excitement I forgot Elmers Wifes Name!)

Doan and I arrived at the consulate about 6:15 and ended up about 10th in line when they let them in around 7 where Doan waited (standing) for about an hour. We were off to the cafe to wait.

Doan was called to submit initial documents and the lady was very (VERY) rude to her. Tossed around her documents then gave them back and told her to organize them again. This was comeplete BS!!!

She was called around 9:30 (which was actually her appointment time). An american man around 50 interviewed her. She said he was very nice. She was asked around 10 questions or so (I will post them later - she is resting now). All in all she said the interview lasted about 5 minutes. The pink was already in the folder in front of the CO. After asking the questions and looking at a few documents and pictures he said Welcome to America and filled out the pink and gave it to her.

Jim just called to let us know they got PINK also. Phuong and the kids had to go back after lunch so not sure what all happened with them. We are just so happy that they all got pink and will be having dinner at Ralphs tonight to celebrate.

OK! I need some help. My fiance in Brazil was denied a K1 Visa. Here is the reason.... the U.S. consulate
general in Rio de Janeiro believes that good and sufficient cause supports revoking this petition on the grounds that
the relationship upon which the petition was based, is not genuine and was entered into primarily to confer
immigration benefits on the beneficiary... Now the petition is being sent back to Homeland security to be revoked.

So, the counsel didn't give any reasons as to why they felt it was not genuine. I suspect that the reason my fiance, who is 48, was denied the visa is because one of her grown up daughters (she is 31) is leaving in the US illegally. I must say that there is no reason for a denial based on that fact. Her daughter is an adult. I met my fiance on MSN and have communicated with her for more than a year. I did visit her in May of 2009 and we really liked each other. Later on we decided that we should get married. I knew about her daughter being here illegally. What should my next move be? I am told to appeal to Homeland Security. Wouldn't it be better to just go to Brazil and marry my fiance and then apply for a K3 or CR1? Any advise would be helpful. Thank you.


How many visits did you have together? Petitioning the USCIS and applying for visa at the embassy are two totally different situations. Its not to difficult to get through the USICS but rarely do we see a couple get a K-1 visa from one of the more difficult countries without multiple visits prior to the interview. Was she given any 221g's prior to this? Typically they give a 221g and request more information to allow you to try and prove a bonafide relationship. If you got this at 1st interview then they definately see something they didnt like. Appeal can be lengthy, maybe better to marry and apply for CR-1. Hopefully some others will chime in with their experiences from your consulate. Best Wishes.

The fact that your still communicating tells us something is right between you, maybe just didnt have enough to prove bonifide relationship or somepiece of the pie was missing. It takes some time to really get used to navigating the site. Relax a little and get some rest, what you just finished is the easy part. After you take a break, start compling your proofs and things. Lots of pictures, receipts, documents that show proof of the two of you together etc ... You've got a bit of a wait until you'll receive your NOA2 but its never to soon to start gathering and preparing!!

We received our NOA2 on Sept 21 09 (hard copy was dated Sept 16)
I called NVC on Sept 23 and they said they sent to HCMC consulate (Vietnam) on Sept 22.
My fiancee received Packet 3 from consulate on 10/19

We did not arrange our appointment - it was set by the consulate and the date was received with packet 4 about three weeks after we submitted the docs required by packet 3 (DS230 Part 1 and DS 2001).

However its not the exact same process for all consulates/embassies so you should check with others from your specific consulate/embassy or check the embassy website for further information.

Hey there folks,

Our case got approved a while back and now we are getting prepared for the interview. But once the case got approved, we waited for 4 days and contacted the NVC. The NVC said it received the case the next day it was approved by the USCIS and sent the case to the embassy the following day which is the 12th of february. We were given a case number by the NVC too. Finally, we contacted the consulate to check if the case has been received by referring our case number but the consulate/embassy replied that they havent received it yet. It's been 6 days since the NVC sent the petition to the embassy and if they use premium services such as DHL, Fedex etc. i am pretty sure it should have reached the embassy by now.

So i am wondering what is taking it this long or how do we track our case from here on and how long does it take normally for the petition to reach the embassy after the NVC has confirmed the case has been sent and assigned a case number?


Things vary but I can share what I know from our case (Vietnam Consulate)
NVC sent ours on 9/22/09
Not sure when consulate received it but my finacee received packet 3 from the HCMC consulate on 10/19

So it was about a month from the time NVC sent till she received the packet.

Sometimes its like trying to move a stubborn mule to get info from the consulates/embassies - try and be patient (I know, much easier said than done)

You all filed in mid to late November. I would expect late Feb to March you should see NOA2. There appears to have been some "dead" time during the Christmas and New Year holiday and alot have been wondering.

Hang in there - it can be 3-6 months but most I have followed were more in the 3-4 month range.

Your still on the early side to be getting worried - we all know how hard the waiting is but use the time constructively. Read everything you can and plan ahead for the next steps. The more you review now the more "comfortable" and prepared you will be down the road.

If you look at others who have filled in their timelines you can get a good idea of time frames.

With no rfe's I'd expect between 6-9 months from I129F to Interview. It's all available here - take some time and read, read, read.

A new addition to the list of december filers. I discovered this place rather late. We received our NOA1 on 21st DEC and I think VSC has been hitting the snooze button an awful lot of times since then.

Woa - dont get worked up yet - your still inside the "normal" processing time. If you got NOA1 in late December it is still a good probablilty that you'll see NOA2 by the end of March, that would be about normal. After the NOA2 things usually move a bot quicker. Just as an example our timing was - NOA1 June 09, NOA2 Sept 09, Packet 3 Oct 09, Packet 4 Nov 09, Interview Dec 09, so 6 months from start to finish. It may still be realistic to be in late May or June. We were actually delayed on our own behalf because we didn't send the packet three documents back right away, we waited about three weeks while we reviewed and prepared information.

No one can know for sure so you have to sit tight and wait (I know waiting stinks - but hopefully soon you'll know and be on your way to the next step). Good Luck and Best Wishes

Hi guys!

My fiance sent our I-129F on Jan 15th (friday) and he sent it with "saturday priority" and it arrived at Vermont Service Center the day after (Jan 16th). It's been 12 days now since it arrived and still no NOA1! I checked the processing times on VJ and it's longer than usual. Should I be worried? Why is it taking so long?! How unusual is it with a late NOA1? I can't understand why it's taking so long time, they dont really have to review anything beside notify us that it's in their system and that they are gonna process our petition..
Anyone else that had a late NOA1?


For reference:
I mailed our I129F on 6/15/09, received NOA1 in the mail on 6/29/09 and and it was dated 6/19/09. So it took 4 days to process and 14 days to receive the hard copy in the mail from the day sent. You have nothing to worry about at this point. Sometimes a little shorther, sometimes a bit longer. Sit tight for another week and GOOD LUCK along your journey!

NOA1 = Notice of Action 1 = Confirmation that your petition has been received.
NOA2 = Notice of Action 2 = This will be sent upon approval of the petition

The times vary and typically can be between 3-5 months. When we filed, the USCIS website data indicated that the current processing time was 5 months but we received approval in 3 months (so the data listed is just a general guide)

Different times of year and case loads can affect the processing times also.

After the NOA2 the USCIS will send the packet to the NVC. They will issue a new case number for the consulate and send the packet to the consulate of jurisdiction for your case (the one you indicated in your petition).

Then the consulate will send packet 3 to the beneficiary....complete and send the forms required then they send packet 4 with interview date. A bit more to the latter part here but this is the basic flow of the process.

My fiance is getting onto the plane right now and I think that I might be more nervous then he is! I feel so bad for him having to say temporary goodbyes to his family and friends, and when I called him, and heard him somewhat crying, yet happy, I couldn't help but feel so guilty. I know he is happy to come here to be with me and wants to be with me here, but then I know how difficult it is for him to say those byes in the airport, I've gone through that myself and it is so painful..... Ai, I have freaking butterflies the size of eagles in my stomach right now...
Have any of you had these feelings?


I think we all have those feelings!! I was in Vietnam with my fiancee for her interview and for all the goodbyes. It was a very emotional time for everyone. I think I may have cried more times than her!

When he arrives, you will both be so happy, but it can be difficult at times with the feelings of being homesick. Just takes a lot of love, support and understanding. Take things slow and give him time to adjust too. It can be a bit overwhelming to get dragged around meeting new people and going places, just take it easy. You have a lifetime ahead together!!!

Sweetdove, You've got a bit of a problem. If no payment was sent they will most likely just return the I129F petition. I suppose its possible that they could send an RFE but with no payment I doubt they will process anything.

Not sure why you sent a birth certificate for that also, only the USC provides a birth certificate at the petition stage. As far as the USCIS helping, no deal, the will not "help" you with anthing. They just review the information provided and either Approve, RFE or deny.

Have you read the guide for K-1 visa process. How about your fiance? You need to read the guides and understand the process and what is required or your in for a very long road.

Initial application required the I129F petition, G325A x 2 (one for each of you), letters of intent to marry from each of you stating that you are free and legally able to marry and intend to do so (there are samples here in VJ), proof of having met in person within the past two years, Petitioners Birth Certificate. In addition most people are providing proof of ongoing relationship to varying degrees (also known as front loading).

The I129F is simple a petition from your finace requesting aproval for you the beneficiary to apply for a nonimmigrant fiancee visa (K-1). Once the petition is approved, you move to the next phase (but I'm not going into that just yet). You (and your fiance) really need to do some reading and understand the process.

Not uncommon at all for it to sit in this status until NOA2 is sent. Your very early on so you will have the heebie jeebies for awhile. Sometimes you will see a "touched" notification but it really doesn't mean anything other than it was in fact touched (maybe moved from one file to another.

The next significant notification will be NOA2.

Another thing that can be a bit difficult to grasp at first is how big the US is (if coming from a very small country). Doan is from Vietnam and we met another couple in HCMC (Jim and Phuong). Doan asked one day we "can go to visit them", I said "sure but well have to plan a vacation". "Why" she said. "Well", I said, "We live in Erie, PA and they live in San Francisco". "So", she said. :wacko: When I told her if we drive 8 hours a day it will take a week to get there she didn't believe me :rofl:

So I got out a map and showed her, the only real option is to fly out and back. If we want to drive I'd have to take the summer off so we can stop and see all the sights on the way out and back!

For us it's San Diego Zoo (1st thing she wants to see), then shopping, Sea World, the beach..... then in month or we get married and probably will be hanging out in Disneyland....wish it was Disneyworld, I been there 10 times and love that place, but with all this Visa money out of my pocket ...just can't afford trip to Florida. Disneyland is just a few hours drive north. :)


San Diego Zoo :thumbs: I also loved the Wild Animal Park up near Carlsbad (I think - its been too many years and I'd love to bring Doan out to see)

Didn't do to much during the winter while Doan adjusted to the cold, she was pretty amazed by the snow (she is from the South of Vietnam).

More recently we:
1) Took a drive to Cooks National Forest and spent the day walking in the forest.
2) Visited the tiny Erie, PA zoo.
3) Went to Niagra Falls NY for our honeymoon (didn't cross the border!) and visited the little aquarium and the Buffalo Zoo.
4) Taught her how to drive the riding lawn mower :rofl: (her feet can barely reach the pedals hehe only 5' tall)
5) Preparing to plant flowers
6) This weekend I'm bowling in a tournament in Dayton Ohio but after I'm done we are going to visit the Cox Arboretum and Butterfly House

Saving some bigger adventures for summer and better weather, like going to Florida or maybe California to visit friends.

We've got a lot of time ahead so no sense rushing things. Looking forward to getting through AOS and AP so we can go back to Vietnam too!

I think you will find that most of us here do not feel that a lawyer is necessary, unless you have some specific things that may need to be addressed that require legal advice. The paperwork is not that difficult once you read and understand it, however it can be confusing at times and most of us all had questions.

My suggestion would be that you go and read through the K-1 guide section here on VJ. Take some time and read everything very carefully. There is also a section with sample forms that you can look through to get an idea. For sure you will have questions, we all did and still do! Once you do some homework then start asking any specific questions and everyone will be glad to help. Just do some homework first.

In your first question, are you asking if people (USC petitioners) have had the I129f petition approved by USCIS and then had the consulate deny the visa to the beneficiary?

Entry would be denied by CBP and not the consulate, the consulate could deny the visa.

If this is your question, the answer is - YES - frequently. Some times it is a temporary snafu becuase the consulate needs more information, or maybe some paperwork is incorrect, and sometimes its because they feel the relationship is a sham.

It occurs more frequently at more difficult consulates.

If your case is well prepared and you have provided sufficient proofs and documentation then you should not be overly worried about this (we all worry regardless).
