Most can do this without the need for an attorney or agency. You should both read the K-1 guide here very thoroughly and get a good understanding of the process.

One thing to keep in mind, if you use an agency or attorney, it is still your responsibility to review all of their work.

There are multiple steps to the process which starts with the USC filing an I129F petition.

Once the petition is approved it is forwarded to the NVC and then to the consulate in your country. Then you (the beneficiary) are provided with instructions on how to apply for the visa.

Upon visa approval - you then can come to the US and get married and file for permanent residency.

Please read the guides here on VJ and get a good understanding of what to expect. A typical K-1 case without any RFE's may me completed in around 6 months (sometimes shorter - many times longer).

There is no EASY process or fast process - read and understand and you should be fine.

The I129f, G325A's, letters of intent to marry, proof of meeting within the past two years come first.

The I-134, DS-156, DS-156K, DS-230 Part 1, etc..come later.

Start with the guide and try to get a good understanding of things before you get to much more confused!

Only the USC's birth certificate is required for the I129F petition. The beneficiary does not submit a BC until the interview at the consulate.

If the USC had a foreign birth certificate (as would be the case with a naturalized citizen) then yes, it would need to be translated. If the USC has a BC that is in english then it would not require translation.

Note:
(It is best to check with each spefic consulate also - Vietnam HCMC consulate did not require a translated BC & documents but I cannot say for sure that all consulates are the same).

As "Pax" has poined out quite clearly - please be careful here.

While many consulates do not require documents to be translated, the USCIS does! I made the error with my wifes BC. We did not get it translated for the consulate but I had to get it translated for the AOS application.

Remember, if the consulate does not require it, if it is a document that will be required by USCIS for AOS then you will still need it translated at some point. It may be much cheaper to get a certified translation done in your home country than in the US.

(It cost us $55 USD here just to have a BC translated).

This is simly my opinion but I think that a second K-1 petition with a new petitioner within 8 months of the 1st would be a big red flag. I would be fully prepared to explain this. I would expect a CO may want to know why the 1st relationship ended, how you met another USC in a short time period and became engaged etc..

Look at it from the view of the Consular Officer and remember that they are trained to look for things like the short time duration. The burden is on us to prove to them that the relationship is true and factual.

Gather as much evidence as you can to strengthen your case and best wishes.

People just don't seem to understand this question at all, i would like to dare anyone to read and try to understand before post any comment...i am divorced now,, well divorce from both previous wifes, the only problem is that while marry to my US wife, i was separated from the one in Brazil (now my current fiancee) but not divorced...Until i finally did, (too late, i know) but like LIFE"S JOURNEY said before, this overlap in marriages might bring some issues.. Someone even mentioned something about "perjury"... The Model Penal Code in the US(section 230.1) defines bigamy as a misdemeanor and polygamy as a felony...
How complicated we (humans) have made things in this world, right? when everything should be so simple, it's all about papers... and money, and Bull**** and that's how we are loosing our own existence, but. that's my opinion...


Bigamy isn't the point that was made. Perjury was. When you married the second time you committed purjury by falsifying a document that stated you were free and legal to marry.

Thanks so much people. Just I have a problem. I misplaced my DS2019 and I hope that wont delay the whole process.But if it helps I have an official transcript from the university where I got the scholarship, I also have a letter of admission coppied and added to the K-1 app. Is that relevant?There is like almost 25 pages and photos for proof of relationship, Itinerary (for both of us, when I went to the states and when he came back to visit),and everything included in details. Me and my fiance, are so frustrated, and trying to make this thing work out cuz, you see by june we will be separated for a year, and as you all probably know, it is very frustrating to do the online chating calling, and not seeing eachoter.It makes me be in a status quo position,for almost a year now. I cant find a steady job, cuz I dont know when I am gonna suppose to leave, and I want it to be sooner. Its so very frustrating as I said and sometimes, the only thing we have to hold on is to eachother. I saw, on this site that the processing time for macedonia is almost a year and there have only been a couple of casses, and Im worried. And at the end I am not really stoked that I am gonna live in the US, just I want to be with my fiance, and due to thefact that he is bound to live in the states for a couple of years he cant move to my country. Basic Summary - can vary some at different consulates
USC (petitioner) sends I-129f packet to USCIS
USCIS sends NOA1 to petitioner acknowledging receipt (usually a week or two)
USCIS sends NOA2 to petitioner upon approval of I129f petition (typical 3-5 months, depends on service center, may be shorter, can be longer)
USCIS sends approved petition to the NVC (National Visa Center) for background check
NVC assigns new case number and forwards approved petition to the Consulate
Consulate sends packet 3 to beneficiary (letter with instructions how to file visa application and things that will be needed for interview)
After receipt of packet 3 - consulate will process and send packet 4 to beneficiary (interview apointment letter with instructions for medical exam and documents required for interview)

Hard to say without knowing what it is that he had a problem with in the past.

You should be aware that the HCMC consulate is a very tough one. As Kevin and Tuyen said, continue to build and grow your relationship.

Right now he should focus in the RFE with the USCIS and get past that.

Have you had an engagement ceremony? Two visits is doable but may be very difficult. If it is possible for him to slip in another visit and have an engagement ceremony it would definately strengthed your case at HCMC for interview time.

Not sure what is complicated about your situation - from what you have posted is looks perfectly normal!

1. - read the K-1 finacee guide and get familiar with the forms and process.
2. step - Get engaged (does not have to be anything too formal but you wil want to pick an engagement date because you could very well be asked at some point (like the visa interview).
3. Start on the forms - (you can see the required forms in the guide section) There are a few forms that you (the beneficiary) will need to complete and send to your "fiancee" to be submitted with the petition.
4. Review review and review the petition package prior to the USC (your fiancee) sending it.
5. When everything has been checked - your finacee sends to the USCIS.

After you file you will receive NOA1 (letter confirming that your application has been received. The after about 3 months (more or less) you wil receive NOA2 (notice of approved petition - unless there are RFE that need to be addressed)

After the petition is approved it goes to the NVC (National Visa Center) and then to the consulate. The consulate in turn send a packet (letter) to the beneficiary with instructions on what forms to complete to apply for the visa and what things to start gathering for the interview.
After the consulate receives the required forms they will send a notice of interview appointment and further instructions for medical exam, interview appointment date, etc...

That is it in a nutshell.

As she is the USC, her child really has no affect on the process other than an additional family member to account for on the afadavit of support (which will be required later).

CR-1 you would have to wait until you get married to file.

So depending on when you plan to visit again and get married would be delays in the CR-1.

Neither is fast - looking at 6 months minimum from the start of processing (in most cases), could be less, more often than not it is more.

I would not consider either "easy" but neither is necessarily more difficult than the other either.

Not knowledgable about getting married in Romania so I am not sure what hurdles you have to jump to do that.

All comes down to when you want to start and how you decide to go about it. Good place to start is in the guide section and some thorough reading to understand things a bit.

I was in VN visiting Doan when the NOA2 came in the mail. When I returned home I called the NVC and they said it was sent to the HCMC consulate. The next day I received a letter saying the same. Best bet is to wait about two weeks from the time they sent it till you call.

As far as pictures go - you will get tons of advice - then you'll still be confused because everyone does it the way that is most comfortable to them. What you do want to do is organize them and present them in a manner that is easy to pass to the interviewer through the slot in the window. A picture book usually does not work to well.

Since our photos were all taken with a digital camera, I put them all into power point slides. I organized them by date and location and added captions that briefly described the people in the photo, where we were and what the occassion was. I had about 15 pages with about 8-12 pictures on each page covering two visits in January and April of 2009. Some examples of photos I sent are - at her parents home with mom and dad, visiting relatives, TET holiday with her family and relatives, Company Party with her Managers and friends, photos with her brothers, places you visit together, engagement ceremony, eating out - its good to have a variety.

We had no issues with the photos - and actually at the interview the CO spent more time looking at them and smiling than he did looking at anything else! I guess we were very lucky!

Bottom line is to be organized and present as many photos and as much information as you are comfortable with to show you have a true and factual relationship. It's a good idea if possible to include photos with other family members, relatives and friends too. It goes towards showing acceptance and involvement with them.

Be mindful - this is my opinion based on my experience.

Also,

the letter they sent to her after NVC didn't include and forms so i'm guessing this is the packet 3 letter, on the letter they have a link to download the forms.. we did that and mail it back in almost 2 weeks now and still no reply from consulate.

Do you know how long since we mail back in the forms until we receive packet 4 (appointment letter)

We tried to email hcminfo@state.gov but receive an auto response.

My 2 cents.

If you apply for and are approved for a I129F petition for fiancee, you cannot then get "legally" married outside the US without voiding the petition.

You may however go through the steps without registering the marriage and still have a valid fiancee petition depending on what constitutes a "legal" marriage in your country.

We had a traditional Vietnamese wedding ceremony in Vietnam but did not register our marriage. We even used the wedding photos as proof of relationship in our petition and at the interview. I did however divulge and explain why, when, and where in a letter in our initial I129F petition.

We had no problems whatsoever in obtaining approval for our petition or K-1 visa.

I'm not saying this will work for everyone but it worked fine for us, and to be able to do this so her family, relatives and friends could participate was wonderful.

We are now here together in the US and our wedding date here is set for March 31 :dance:

What you do is ultimatley up to you, just do your homework and understand what potential issues may come up and be prepared to deal with them.

What we did may not be the safest route to go as it is what is perceived in the eyes of the CO but I am glad we did it this way and will have the memories of her family and friends being part of it always and forever.

1st - Please fill in your time line - it is very helpful in determining what you have done and where you are in the process.

2nd - Go, go, go visit and be with your loved one. Visiting after you file is fantastic idea. Great opportunity to accumulate evidence, photos, receipts etc. to support your case down the road when it's interview time. The more visits and evidence the stronger your case will be.

The year we filed I went to visit in January and April, returned home and filed, went back in September and then back again in December for interview.

Always good to make your case as strong as possible and nothing is better for that than being together (and having the proof to back it up)

Here my story:

I booked my tickets about a month after receiving the NOA1 notice. I wanted to visit my fiancé for his birthday, which was a month later.
We were at the beginning of the K1 process, I thought it would be a long journey compared to the statistics. Three days after booking my tickets, my fiancé called me and said we got the NOA2. We have been approved in 35 days only.
I was wondering if it was a good idea to go visit him while we were so close to the end of the process. I didn't take any insurance in case of cancellation, so I decided to go to see him in Colorado anyway.

During my layover in Cincinnati, I was asked the usual questions. When I told the officer I was unemployed. He asked me for evidence for my return to France.I showed him my reservation with the flight back to France, but it was not enough for him. Then, I told the officer that my fiancé and I are in the K-1 visa process. I took out a copy of the I-129F cover letter signed by my fiancé. He said it's very good to want to get married in the rules. He congratulated me and wished me a good stay. He didn't even look at the copy of NOA1 and NOA2. I was so relieved.



Geez - you momentarily put us in suspense, then the good news! Glad it worked out! But then you leave us hanging with no details of your visit with your sweety - we always want to hear MORE GOOD NEWS - mushy smushy :yes:

Thank You guys, and yes I did fill out the rest of the profile. The reason we are concerned is her daughter has a different last name, obviously as she has the fathers last name, so we are thinking what would prevent someone from saying they were not married, even if they were ( which is not the case here), but I would think the visa issuing folks would want some kind of proof that she was never married given the fathers last name is on her daughters birth certificate.

I mean if they already know that in the Philippines an illegitimate child even of they have the fathers last name, is still in the custody of the mother I guess the question is still how does she show this? I'm sure they must need some kind of document or letter or something. we are just trying to cover all the bases so that there are no delays. And really were so in love none of this makes us lose sleep, just want it to go smooth :) we are very appreciative of the reply also.

Its nice to see so many people who have either gone through or are going through this. And for sure its not easy, being a former marine I know all about the hurry up and wait routines with our government.

Yes my congressional office called yesterday also and was told the same thing, they are working on March filings, and K1 is not a priority in regards to all the types of forms they process. They said try back again in 60-90 days, which will put me at the 6-7 month mark from the time we received the NOA1. First this is the government your dealing with, that right there speaks of itself. Then they had the excuse of telling my congressional office the reason other applications filed after ours are processed is when the people at the service center finish other types of applications they are then put on the K1,s so they must just walk by a table and grab a few with no regard for dates, yes that's right they could not even offer a legitimate reason as to why they were not processing them in order of receipt.

so you know what, I am not wasting another thought on when we will receive our noa2, cause the answer is whenever they decide to process it, plain and simple.
I bought another plane ticket to the Philippines yesterday after hearing that ####### of a story and will spend Christmas with my sweetie. I would urge everyone to begin to contact their congressional office and demand some accountability from our government, I don't know about you guys but they were sure quick to cash my check, how many services do you pay for 4-6 months in advance??? Not to mention you are already paying towards this budget in your federal taxes, just sucks!!

I guess its diffrent for everybody, for us we were or at least I was 99.9999 percent in love before we even met face to face and quite frankly I think the love occured very quickly and yes while chatting at that. I have always heard the saying " when you know you know " I never gave much thought to that saying but now I understand it completly. I cant see how after months of chatting, skype, Facebook, letters and acutal visits ( twice in 6 months ) they could be alarmed with somebody professing love early on in a relaionship, plus isnt that what the ninty days is for? once your fiance has arrived if there was any doubt once so ever you still have ninty days to not marry. I wouldnt worry about it, I think they are pretty in tune with fraud and should be able to see legitiamte relaionships when they are in fact legit. I think you will be fine, Good Luck too :thumbs:

I would think you would be fine so long as when you filled out your 129f package you didnt omit anything that they ask about on those forms. I think as Gary/alla mentioned, something triggered a need for more information on mine. It just bumms me out that there is nothing I can do to fix it or move it along, I had originally figured 6-8 months for the process but when your approaching month six and get a letter saying it could take another 6 months it definitly takes some wind from your sails.

Thanks Gary for the Info, I guess better something than nothing, when I spoke to a guy there he said if there was a problem they would have already told me so I take it as you said perhaps they need more information, cause the paperwork was full and complete. Hopefully it will go quick. It was however a bit dissapointing.

Yes thats the thing, they dont even say but looking at it I would assume on the petioner, that would be me, but my god its just insane. It would be diffrent had they said we are doing blah blah blah and we expect to have this accomplished in 30 days or 60 days, but to say within 6 months, that would put us over the one year from 129f filing. My friend said its just a form letter and stall tactic.

so 5 months passes and I put in a service request, I get this back telling me bascially if I dont hear something in another 6 months to call them, our lovely dysfunctional goverment at work. I think we should have just gotten married and she would be here sooner, note they can not even give any date(s) as to how long a " backround check" takes. I can buy a gun in an hour, but cant bring the woman I love here to marry in 6 months????? below is the response pasted below.

It won't be a factor if your application will be approved or not, it's just the hassle that it may bring (like being advised not to fly, sensitive pregnancies etc) and additional paperwork and expensesS if the baby was born before the beneficiary leaves for US.

Thank You, all good replies, just covering all the " what if's ". Things happen even when precaution is taken, and given we are already on month six in the K1 Process, I cant see it going another 9 months ( God I hope not ). But we just want to be covered thats all. Thank You Guys.
