I'm not sure of the approval of the I-134F for the K-1 Visa. Can we use the I-864F instead of or with the I-134F?


The I-134 was specifically required when we completed packet 4. Do as specified or you will get an RFE - 221g from the consulate to provide the correct documentation.

Just recently another poster used the I-864 in error and got RFE'd. Not worth the risk. Send what your instructions say to send.

What application are you sending? I129F?

If so, you do not NEED to send cards and letters. You must provide proof that you have met in person within the past two years.

Sending proof of relationship at this juncture is optional. However if you choose to front load to some degree, then copies of cards and letters are certainly a good thing. And pictures, receipts, boarding passes, etc...

As a minimum you need to send in I129F, G325A's, Letters of intent, proof of meeting in person.......

Do some more reading and get familiar with the process and its requirements!

And complete your profile and information so its not a guessing game!

Research the B type visas and info contained therin. Typically you cannot work and receive "salary" from a US based employer on a "business/visitor' type visa. There are visas that allow you to work but the are typically apllied for by the employer for the individual - not by the individual.

Yep, Yep, Yep - Once the visa is IN HAND - come on down!!!!!!!!!

Just be careful of the terms "Approved" and "In Hand" - the latter being the key term.

Its not out of the realm of possibility for things to get delayed, even after approval! But once the visa is "In Hand" you are truly good to go!

We were approved on December 15th, then "delayed" and ended up coming on January 16th. But dummy me bought tickets after the "approval" and got bit my the money mongering airlines. Oh well, I should have waited till we had her visa "in hand" but its water over the dam - we are here toghether now!

As long as what you put does not conflict with other information you should be fine. Just try to get it as close as possible and look through your other documents to see if there might be any conflicting information. Sorry to hear about the fire and thank goodness you are ok!

Maybe you could requested past bank or tax transcripts, they would have addresses and may refresh your memory. Also, your employer should have a record of changes of address (if you've been with the same employer for this time).

Hey Mike - 1st, its where you have lived the last 5 years, not the last 5 residences!!! That may help to make it a bit easier. I had difficulty to remember also. I pulled my records to find things to help, for example I had purchased a new home 4 years ago, so I dug up the mortgage papers to see when we closed and moved in. It is important so look through old records to refresh your memory or get with some family or friends and try to get it as close as possible! If you save things you should be able to get it.

Hey Steve,

Take things one step at a time and it wont be to overwhelming. The I129F petition to the USCIS is quite basic.

You'll want to start with the form I129F and G325A.
Go to the USCIS website and click on forms. Scroll down through until you find the I129F, then download it and the instructions. Do the same with the G325A. You will fill out a G325A (biographic information for you and your fiancee).
These forms are saveable on the pc so you can work on them and save them, print them, review them, go back and make corrections etc...

Start out with that and then continue to build. You'll need to create a Letter of Intent to Marry for each of you. There are samples here on VJ. You'll want to gather up the proof that you have met within the past 2 years, boarding passes, pictures, etc.

Read the K1 guide and start working on some of the documents. As you come across questions, drop in and you'll get help and guidance!

K-1 Fiance(e) Visa Process & ProceduresWhat is a "certified copy" of divorce decree?
Take this for what it is worth - this has been discussed numerous times.

A Certified Copy of a Divorce Decree is only obtainable from the Courthouse where the original resides.
The Certified Copy will not have a "stamp". Stamps in most places are not acceptable when a Certified Copy is requested. (may be obtainable from some states through a service but you'll likely pay dearly for it and it still comes from the original holder).

Most times when a Certified Copy is requested they are looking for the copy with the "Official Seal".

So what is the difference?
When you request a Certified Copy - it will be exactly that - a photocopy of the original that is on file there.
However, they will affix a sticker to the document (otherwise known as the seal). But wait, its still not an official Certified Copy yet.
After the "Seal" is affixed, the Clerk of Records will then take a device that looks like a big pair of flat sided plyers and put it over the "seal" and squeeze. This will leave the "Official Imprint" of the governing body on the seal. You can usually tell the difference because on this you can feel the impression on the paper.

A copy with just a stamp is just a copy. Without the "seal" with the imbedded impression on it it is just and always will be a copy (Not a Certified Copy).

I've been down this road, I went to the courthouse, and I requested and got the Certified Copy.

I'm not trying to be sarcastic or anything, just trying to explain it in detail with clarity. Its better to go through the trouble to get the "real deal" than to send a "copy" and get an RFE.

Even though some claim that you can get a copy notarized and have it be considered a Certified Copy, I wouldnt go that route. You can get documents notarized almost anywhere, but you can only get a True Certified Copy of a Divorce Decree in one place.

Its highly advisable to have two complete copies of everything. Send one to your sweety and keep one for yourself. Its not uncommon for the consulte to "lose" or "misplace" things! Always advisable to have backups.

As far as the vaccinations go, it may be more expensive to have tests done to try and confirm vaccinations than to have them done again. I know in Vietnam it was dirt cheap to get vaccinations. There is a minimum required for her to enter the US (for Vietnam it was just td vaccine). Were completeing the rest here as we speak (and at the local health department for no charge to boot!)

One of the first things you both will need is patience. Hopefully his illness is temporary and recovery is expected soon (we will say a prayer for both of you on that).

It would be highly recommended that he visit you at least once in the PI. (From my reading and understanding, the PI is not the most difficult but is certainly not on the easy end either - we were through Vietnam and did multiple visits becuase it is a very difficult consulate). We did 2 visits before the I129F pretition and two more before interview (actually the last visit was during the interview time).

The process can be stressful so you both need to have strength, patience and lots of love. You cannot rush the process either, it is what it is, but if your love and desire is to be together you will prevail!

Thank you all for your answers. To my absolute amazement, we no longer need to slow it down. I got a jaw dropping offer from my one and only uncle... half gift, half loan, and it is enough to cover the visa and it's expenses, and the AOS. My fiance and I have enough saved up for his flight to move here, and for things wedding like the marriage license, minister fee, etc. I'm just in shock, and so grateful. There was just no way in a million years I saw this coming, I truly thought we were at the end of our road and would have to end the Visa process.

You can wait a bit before sending in the packet 3 documents (we waited a few weeks - but you could wait longer). There is a expiration date on the NOA2 but typically when a visa application is in process at the consulate they "automatically" extend out the date. It makes sense that if they receive the DS-230 and are in the process of scheduling an interview that this can occur. (That is - they have received the packet 3 docs and things are scheduled - some times the interview would be after the expiration date of the NOA2). It would be best in that case to request an extension from the consulate to be on the formal and safe side.

You may get a lot of debate on the topic of "automatic extension", and I'm not sure it works the same everywhere so it would be best to send in a request to extend it.

For us (Vietnam), there was about 1 month between the NOA2 and receipt of packet 3, we waited a few weeks to send the DS-230 and DS-2001. Then about 3 weeks to packet 4 and another month before the interview (so total was a little under 3 months from NOA2 till interview).

Options:
1) If possible, borrow some funds and keep moving forward
2) Hold on to packet 3 (maybe a month or so)then keep an eye on the NOA2 date - if getting close to expiration and you have not received packet 4 with interview appointment then send a request for extension of I129F
3) Send in Packet 3 and get interview appt, then request reshedule

I hope that is not all jumbled and full of confusion - sometimes I'm not so good at writing what I'm trying to say! (especially after reading and training on ASME Section III code books for two weeks straight)

You can request an extension by all means. Just email the consulate and tell them you want to postpone the interview. I would suspect they would extend it as long as they could. At the end of the new extension, you could always try and ask for another, but if they won't give you another extension, and close the file, you will be able to reapply once you have new employment again.

You'll have to pay all fees again and go through the same process if you reapply. (This is only if you don't get an extension).

You've mentioned two separate things here:
1) Petition extension
2) interview rescedule

The interview could be rescheduled if you sent in the packet 3 info and received an interview date.

If you delay sending in the packet 3 info for a while and your petition (NOA2 expiration date) is approaching you can send a request in for an extension of the I129F.

Two diffenent scenarios but both in either case the request would be sent to the consulate.

All of our photos were digital and I put them into power point slides and added dates, places, titles and events to idnetify who, when, where, what. We had no problems using this method at the petition or interview stage, everything was accepted and there were no questions.

You could also do this with some photo software package - lots of options - if you chose to go that route.

Otherwise, its acceptable to write names and dates on the back of the photos.

This is a tough topic to advise on. You need to do what you are comfortable with.

We printed hundreds of emails and a few handfuls of chat logs. At the interview the CO never asked for a single one. However we know others who were asked for many, some were just loked at and others the CO asked them questions from them.

You just never know what to expect from this area. My own opinion is to print at least a few from each week.

Maybe others who have been through your consulate will have a better idea how much this is scrutinized there. We were Vietnam and it seems like there it is totally dependant on what CO you get. Some dont seem to care much about the emails and chat logs while others like to dig deeper.

Better to be prepared and have at least a few handfuls than get bitten by not having enough.

In the event all the info you are looking for is not in the divorce decree you can stop by the clerk of records and get a copy of your marriage record, it definately has the info recorded on it too.

We had the same questions about Vietnam and I am happy to share our information and experience.

We were engaged in Jan 09 and had a full blown TRADITIONAL Vietnamese wedding ceremony in April of 09 (over 350 guests). We also had a traditional picture day with my fiancee in multiple wedding gowns (we went to 8 different places around the countryside for photos.

The picture day and wedding ceremony were wonderful and fantastic events and I am very happy that we chose to do it all. We did it so her family, relatives and friends could share in this special event and because I felt it was very important to show my respect and honor for them. We did not register the marriage in Vietnam

After the April traditional wedding visit I returned to the US and filed the I129F. I DID include all the photos from the picture day and ceremony (certainly good proof of ongoing relationship). I also included a letter that stated that we had the traditional ceremony in respect and honor for her family, that we did not register the marriage and that we fully intended to get married in the USA. We also included our letters of intent that stated that we were both willing, able and free to marry in the USA.

We had not one, none, zero, nada problem with the petition or the consulte. The Vietnamese consulate is a very difficult one and this posed no problems for us.

But as I mentioned, I divulged all the information up front with a full explanation. I can only believe that because I was completly honest and explained everything that it was not a problem. If I had tried to hide something I'm sure it could have been different.

This is only our particular case and I am sharing it so others know that it is possible to do it provided you go about it in the right way.

When it came to the interview the CO did ask my fiancee a few "trick" questions by refering to me as her husband. Each time she looked at the CO and said - He is my Fianace, not my husband, after which he smiled and continued. We were approved for the K-1 with no problems.

They have replied and asked for my fiance to write them and fax them a signed letter asking for the approved petition to be extended. The letter needs to state his intention to still marry me within 90 days of your arrival into the U.S on the k1 visa.

So you should receive NOA2 within the next week.

Now the USCIS will forward it to the NVC. They will review and assign a new case number. Provided everything is ok with the NVC, They will forward it to the consulate.

You will receive a letter from the NVC with the new case number and that it has been sent off to the consulate.

Then your fiancee will receive info on completeing the next steps.

Its perfectly acceptable to two hole punch the I129F package. We punched ours at the top and used a two pronged fastener to secure everything together (about 60 pages).

The cover letter had an index that showed all the information included and the order thay appeared in the package.

I actually saw our original I129F packet months and months and months later when my fiancee and I entered the US. The whole package we sent was still intact as I had originally sent it :blink:

I do recommend fastening this package together - remember - this package will go to USCIS then NVC then US Consulate and all the way back to the POE. A few things will be added at the consulate but for the most part this will be what comes all the way back.

If it is not fastened - it only takes a slip or bump and papers are everywhere.

Obviously this is just one persons personal opinion and everyone here has there own!

Now for the interview stage - I would definately not recommend this but that is down the road.

You will also need to pay the Civil Surgeon when you have the I-693 completed - costs may vary.

If any vaccinations are needed you may have to pay for those too (we had them done at the local health department for no charge).

Marriage Liscence application fee.

Some of these are minor but depending on your financial situation things can add up in a hurry - so just things to consider.

We received our NOA2 in 3 months (VSC - mailed I129F 6/15/09, received NOA2 9/21/09).

If your I129F petitoin is approved, when you receive the NOA2 you are required to do NOTHING.

The USCIS will forward it to the NVC where it will be reviewed and a new case number assigned. Then it will be off to the consulate. The NVC will send you a letter with the case number and that it has been sent.

Then your fiancee will receive packet and instruction on how to proceed.

While all this is going on, read read read and start reviewing what will happen next. It's never to early to start getting ready for what is upcoming.

VERY IMPORTANT:

Under Indian laws, a religious ceremony/wedding is deemed to be a valid LEGAL marriage in India. Unlike other places like Thailand or Vietnam. Doesn't matter whether you register it or not. I distinctly remember reading about two cases which were denied for precisely THIS reason. Please remember local customs and rules differ from one country to another and the consulates go by those rules.

Do NOT attempt to go via this path. If you have to get married in June/July, withdraw this K-1 petition and file for a CR-1 once you have the marriage certificate. The K-1 is for fiancees. Not wives.


Good Point Sachinky! Best to default to others with experience in the country of your consulate for some specific topics! We did the "traditional marriage" in Vietnam and still did the K-1 so I am glad to hear you chime in and let it be known that this will not fly in India.

Given that, I agree! The couple has a decision to make on where to carry out the marriage and what steps to take, either continue with the K-1 or refile for CR-1.

Still, can anybody explain which seal should there be? We know a couple who got an RFE because the divorce paper they submitted was with an ink seal from the court, they were told 'a golden seal from the state is needed'... :blink:
And does the document have to be named a Certificate? We have a Record of Divorce from the state registrar, no golden seals... will that be okay? :help: If not, where do you get what they want? :unsure:


I went to the courthouse and got "Certified Copies" which had the embossed gold seal. If you go that route there will be no questions.

You may need to specify to the Clerk of Records that you are requesting a "Certified Copy" or they may just give you a regular photocopy that is not "Certified".

Step 1 - Petitioner (The US Citized) files I129F (petition for alien fiance/fiancee) and supporting documentation.
After submission to the USCIS it generally takes 3-5 months for approval.

From the USCIS it goes to the NVC (National Visa Center) where a new case number is assigned and it would be sent to the US Consulate.

After the consulate receives the aproved petition they will send an "invitation" to the beneficiary to apply for the visa.

For us (my fiancee is from Vietnam), it was 6 months from the time I sent the initial I129F petition until her visa was approved.

Do lots of reading and learn about the process.

Why bother to go through all the trouble of checking doument formatting and printing when you should be focusing on the document content!

If something does not fit into a box on the official pdf form, just simply type in "see supplement add a supplemental page. Its the accepatable and proven method and its done all the time.

My indian fiance who has been living in India for the past 17 yrs has partly lived in US.
He lived in Chicago from the age of 15-22yrs. Now how do I go about getting his police record for the time he was here in US, while I live in NY.


Below is a section from our packet 4 statingthat a Police Certificate is not required from the USA (its the last one on the list).

Foreign police certificates are required from all other countries where the applicant has resided for at least

So far law abiding US citizens do not need to register with the local police wherever they go. There is none (yet) to be had.


You missed the question. The question is about her Indian finacee who is NOT a USC but who lived here from age 15 to age 22.

I agree with Bobby+Umit

1) We used the "canned example". (Later on for the interview I submitted a "Reaffirmation of Intent to Marry" for which I used more of my own wording.

2) Same - a few from each month over the time frame. (I dont recollect having any content in my emails that I was worried about anyone reading so I sent tham "as is".

3) We did a little frontloading so I included about 50 or 60 photos laid out in power point then printed onto paper with dates, places, people, events, etc...

4) I didn't number the pages but I did include a "Table of Contents" listing all the documents and the order in which they were contained.

If your wondering what frontloading is - is sending in more than the required info that established your proof of meeting. Some choose to also send in proof of ongoing relationship at the petition stage becuase it gets more info in front of the consulate prior to the interview. We felt it would be beneficial in our case since we were going through a particularly difficult consulate (Vietnam).
