I know it can be frustrating but try not to focus on others dates except for very general guidelines. There is so much inconsistency, even within the same service centers, so try not to let it drive you batty! Your still well within the time frame.

When I filed our I-129F I fully expected to wait 5 months as the USCIS had posted at that time - so I was very pleasantly suprised when I retuned home from a visit to Vietnam and found our NOA2 in the mailbox at exactly 3 months!

After that the next three months blazed by and we were together again for the interview. Now getting ready to apply for AOS.

I agree - have not heard of many cases where the petitioner was requested for biometrics. Is there anything from the past that you are aware of that would have flagged you for this? As metnioned, may be something that came up during a background check.

If there is something, maybe best to start working on addressing it. If not it could be some form of error.

As far as the income requirement, you would need a co-sponser if you cannot show income or assets that meet the criteria. Past returns are good for establishng income history (more applicable at AOS for the I-864) but you will need to show proof of current income at the time of interview or have a co-sponser.

Once you get through this phase and get NOA2 (that would be the Notice of Action indication petition approval), the case would be sent to the NVC (National Visa Center) and then forwarded to the consulate in Brazil. Then they (the consulate) would send your finacee instructions on how to apply for the nonimmigrant visa and what other documents are needed.

If the Petitioner (US citizen who puts forth the K-1 Visa application) does not earn an income that is equal to or greater than 125% of the US Census designated 'Poverty Threshold' for two persons, approximately, $14,570 for two people w/o children under the age of 65. At 125% of poverty threshold, one will need to make $18212 USD. If your loved one did not make this amount or greater for 2009 taxes, or until he/she makes this much money you will get turned down!

Ahh I got it finally. Childhood friends, separated for years, find each other, ohh I get goosebumps - its the making of a great love story.

The good news is your both young. I can imagine how much you are anticipating your upcoming meeting.

We are obviously not your parents or family but I would recommend seeing how things go after your meeting. You have time, I know nobody want to hear that but in reality you have some challenges ahead. I don't know how difficult the Jamaican consulate is but I dont think its a puchover.

Your really going to want to establish a very strong case for yourselves. You have options and time to think about them and read and learn about the process of immigration through fiancee or spousal petition and visa.

Establishing the proof required may take more than one visit, may not. Others who have been throught he Jamaican consulate can give you a better idea there.

In any case, I wish you both the best. As you move along and learn, and after your meeting, make sure you keep us posted (if you'd like).

Am I missing something here. She is 19 and you met 9 years ago in school, that would have made her 10 years of age. How old are you?

When did you start communicating or have you been in contact all along? I'm not trying to pry into your personal details but a CO might and very deep.

Just trying to figure out how and when the "relationship" started. You will have the burden to prove this and as mentioned, its not so easy as it sounds.

As far as K-1 or CR-1, in either case it is the USC who initiates the process, a petition for aliens finace(e) or petition for alien spouse. Applying for a visa (by the beneficiary) only comes after the initial petition is approved.

Going a little deeper.

If you chose to file for a K-1, the others have told you about the two step process.
Step 1 is for the USC to file a peition for alien finace(e) to the USCIS. In all reality, this is the easy step. It has minimal requirements. You must prove that you have met in person within the past two years, provide proof of meeting, an application (I129f), Bigraphic background info for each of you (G325a), a letter of intent to marry form each of you, and a few other documents from the USC. It's generally not to difficult to get past this (provided you complete the paperwork properly and have proof of your meeting (save any baording passes, receipts and things that can show the two of you in the same place at the same time, as well as some pictures.

Step 2 is typically much more difficult. If Step 1 is approved, the petition will make its way to the consulate. Depending on what country you are from does make a difference here too. Some consulates are much more difficult that others. During this step, the consulate will send the beneficiary a list of instructions and forms to complete (visa application). The application is submitted to the consualte and then they send further insructions for items and documents that are needed for an interview. The burden is upon the two of you at the interview to provide sufficient documentation and proof that you have a real and factual relationship. This is the tough part. In some countries one visit may be enough, in others it may not be enough. There are alot of supporting documents that need to be obtained and the USC will need to show he can support you.

This is a general overview. If you chose to get married and file CR-1, it is a little different but you still have the burden of proving that your relationship is factual and real. It may sound silly but this is where most people fail. Not because they do not have a true relationship but because they fail to provide sufficient evidence to convince the Consular Officer that this is true.

It can be a very stressful process so you want to be mentally prepared for everything.

If you let the VJers know what counrty you are from they can inform you of more specific hurdles you may have to overcome particular to that country. There is not equality for all in this process unfortunately.

I'm not trying to scare you or anything, just want you to know that it can be a challenge. The better you prepared and the more you understand the better your chances.

Your both young and have some challenges ahead of you - be prepared.

Rather than sitting on pins and needles, when I sent our petition I prepared myself for a 5 month wait, while I was still anxious I was not expecting to receive anything anytime soon.

After 2.5 months I went to visit my fiancee in Vietnam. When I returned home, guess what was in the mail box, my NOA2, postmarked 3 months to the day from the NOA1.

What a pleasant suprise. If you mentally prepare for the wait, then you can alleviate some pain and agony and if you get it before your expectations, then yahoo!

Waiting sucks and is frustrating but alot of it is our own state of mind.

Use your "spare" time wisely and become as knowledgable about the upcoming steps as you can. So many wait for the NOA2 and then are scrambling when they get packet 3 and 4 and still dont have any idea what to do (not saying that is the case - just saying)

If you file the I-129f petition and it is approved there would be an expiration date (4 months). If you didn't continue it would expire.

If you continued and she filed for the visa after petition approval and she was approved for the visa, sje would have 6 months to enter the US or it would expire.

Nothing would prevent you from filing again but they may want to know why the original petition or visa was "abandoned".

If you chose to move to Canada and work and got married there, and then decided you wanted to come and live in the US you could then file for DCF (if you meet the criteria).

You do have a lot of options to discuss and consider. I guess the first is to decide where you want to live and work so you can then determine the best avenue.

I don't think its all that unusual.

Once the visa is issued the beneficiary has 6 months to enter the US (make sure you check the ACTUAL expiration date on the visa when it is issued).

The 90 days you have to get married starts the day the beneficiary enters the US (also pay close attention to the I-94 date stamped at POE).

If the beneficiary visits the US and they ask at the border if you intend to get married - make sure the reply is "Yes - after approval and entry to the US on the K-1 visa". Don't want to get caught up in the semantics of a "trick" question.

Yes there absolutely are guidelines. Attached is a link to the info for the I-864P guide used in conjunction with the I-864 for AOS. You want to meet this. The requirement for the I-134 I believe is 110% but since you'll need to meet this for AOS you might as well see if you do (some consulates want to see this requirement met anyway).

You need to have your REAL marriage within the 90 days, all the rest is just fluff!

Once you have the legal marriage certificate you've meet the requirements for immigration and can start your AOS process. You will then have all the time you need to plan whatever else it is you wish to do.

You are right - 90 days can fly by in a real hurry. I know for us, I had taken a month and a half away from work to be with my fiancee (wife now :D ) for the interview so when we came to the US I had to return to work and was (still am) so busy.

We did a civil ceremony. My family is "old family" so we are not going to have another big wedding. We had a full blown cermony in Vietnam with her family and friends with over 350 guests. Now were just content with or civil marriage and are planning a big party this summer with friends. No more pressure - just fun!

Don't stress it out - take care of the immigration requirements 1st, then take your time and plan something out that can meet your expectations ~without all the stress of rushing to get things done. There is still plenty to do in regards to AOS and you don't need to much stress hanging over your heads.

Not sure for Bangkok what gets submitted with upon receipt of packet 3, for Vietnam is was just the DS-230 Part 1 and the DS-2001. The other documents were not required until the time of interview.

You should have two options:
1) You can request an extension to the I129F with the consulate. The NOA2 date listed would be the petition expiration date. If you want to wait past that to submit the visa application you probably should request an extension.

2) Submit the packet 3 info and see when your interview is scheduled - if you need more time then request a change of date for the interview. Many consulates will automatically extend the petition expiration date automatically as long as the case is active.

You should wait to hear from other Bangkok filers though since they will be much more familiar with the workings of the consulate there. Just wanted to let you know that there are options - just need to get you the best advice from others who have gone through Bangkok!

NOA1 - Notice of Action (letter) that the USCIS sends to the petitioner when your petition is received.

NOA2 - Notice of Action sent to the petitioner when the peition is approved.

Packet 3 - instructions sent to the beneficiary on how to apply for visa after the USCIS sends the approved petition to the NVC and the NVC forwaeds it to the consulate.

Packt 4 - interview appointment letter and instructions for interview.

Just for clarity, "coming to the USA" probably requires nothing at all except the UK passport and a US passport. If the OP wishes to permanently reside in the USA, the appropriate path is to marry (wherever) then follow the path to an immigrant spouse visa through a direct consular filing in Australia. No need to deal with any of this unless and until a few months before you intend to actually begin residing in the USA.

Is it your intention to come to the US?

If you are planning on coming to the US in the future, your best bet would be to marry in Australia and then at the appropriate time, look into the DCF process.

K-1 isn't an option under your current circumstance. The K-1 is for a USC to petition for finace(e) to come to the US for the purpose of marriage - as the USC does not reside in the US this would not be applicable unless he returned to live in the US prior to filing.

As mentioned, if you look into DCF - pay particular attention to the US domicile requirement.

my husband file me a K-1 Visa last 2008 of November and it takes time to complete all the papers we both need to support the petition. 1st the USCIS send us a letter that they got all our papers and the petition is on it's way and they start processing it. it takes 6 months before we heard good news from them and receive a letter telling me instruction to do like going for medical at saint lukes and the date of my interview at immigration manila city. my medical at saint lukes takes 2 days. the result will be given the next day after all the blood exams and physical exams they did to me. it's been a long day waiting so u need to be there early. if u cant pass the medical exams they will hold your papers and they wont approve your papers. it just happen if u really have a serious thing about your health, if u past the medical exam saint lukes will get your passport and forward it to the immigration for your interview. before u will go for interview u need to get all your papers together that will support the petition, a prove that you are single from NSO and some pictures of you and your petitioner that will show your real relationship to them or any form of proof. after interview your consultant will ask u questions very easy about u and the petitioner so it is very possible for u to pass it. and they will tell u right then if u pass or not. and they tell me i pass. and they tell me to wait like 1 week cuz they will send me a package containing my passport and visa on it.

I'm a bit late jumping in but I thought I'd let you know what we did rather than just debating what might and might not work.

We were K-1 through Vietnam (known for being a particularly difficult consulate)

I provided the following:
Letter of Employment
Copies of past 2 years tax returns (all schedules, forms and w2's I file electronically so I just printed copies)
Most recent 6 months of pay stubs
Most recent 6 months of bank statements

Additional for informational purposes:
I am well above the minimum income requirement
I created a cover letter identifying the included documents and had it notarized (even though it was not required - I had it done at work by our company notary so I just figured why the heck not)

I know my example may exceed what alot say is required but when I considered my own peace of mind this is the route I took.

We had no problems and no questions regarding this.

You can provide more than what is required, we provided additional photos, receipts and boarding passes, etc from all visits we had prior to the filing of the petition (also referred to as "front-loading".

The photos with family are generally not required to get the petition approved but they certainly can't hurt. My thought has and always will be - the more the better (but I am also a proponent of frontloading).

When they are more important is later when you get to interview stage. Then it will be extremely beneficial to have photos with her and her family.

We all hear so often that photos are secondary evidence but when you think about it, they are really primary evidence and I think a CO puts a high degree of value in this evidence.

The more visits and the more evidence you can compile the better, especially at more difficult consulates.

Careful - easy for your question to get lost in the midst of other posts - if the future you should start your own topic for new questions.

Anyhow - here is a very brief synopsis
NOA1 - Notification to the Petitioner from USCIC that the petition has been received
NOA2 - Notification to the Petitioner from USCIS that the petition has been approved
Packet 3 - Letter (packet) sent from Consulate to the beneficiary with instruction on how to apply for the visa and what to do next
Packet 4 - Letter (packet) sent from Consulate to beneficiary including interview appointment letter and instructions on what to compile and bring (also includes things needed from the petitioner (I-134 for example).

This is a general summary - not all consulates do it the exact same way. Some combine packet 3 & 4 together - some do via email rather that letter. Always best to post consulate specific questions in your regional forum to get better answers.

The approved I-129f petition carries a 4 month validity period. You can find the dates on the NOA2 you received from the USCIS.

As for the rest - please fill out your timeline and details as there is some differences on how things are processed at different consulates.

Try to relax, submit an Additional Sheet I-129F Part C-2 and give your answer a short explanation that you did not see it because of the Revision Number. This will lead to some "fairly short" delay in your processing.



Agree with Audy_Rob, this is a minor setback and easily fixed. Send in what they are asking for and you will soon be on your way again.

Moving forward always double check the dates of the docs, in some older versions of docs are accepted and some are not - always best to double (or triple) check.

If you answered yes to question 2, then question 3 applies.

So what did you check for question 2?

If you checked no then there should be no rfe.

If you left question 2 unchecked then you need to correct it as part of the rfe.

2) Whether or not they accept your relationship will depend on how well you prepare and how much evidence you provide to establish bonifide relationship at the interview.

For the USC to have the petition approved, you only need to prove that you have meet in person within the past two years.

To get the visa approved you will need to prove and factual and ongoing relationship.

Two separate parts of the process. If you have saved things all along since you met that can be used as evidence then you are well on your way. Keep saving everything.

Well your american fiancee should go to the office of vital records and request a new certified copy of her birth certificate and also to the courthouse to get a new certified copy of her divorce decree so she has them for her own records in case they are needed!

You should never send originals of these as you will not get them back. For documents like these you should send copies or certified copies. The originals could have been taken to the interview and presented if requested. Since the originals were already sent they may not request to see them but they might just ask for them again in which case the "new certified copies" will be needed.

Don't worry about it though, just tell her she should go get some new certified copies and keep on truckin!

Some people are a little harsh.

You can always tell her that this is still such a small step and that in the future you both will be able to look behind, and laugh at what you once were so worried about. 2-3 months extra "waiting", when the one you were waiting to be with is right there to do the time with you.

Help her find something to occupy her time as previously said. Get her a hobby. Some English classes if needed. Volunteer work. Both of you need to be creative here.

Ranger - its not that uncommon for this to happen.

I know it can be very stressful and trying but during this time she needs your love and support more than ever.

My fiancee (now wife) did not have this happen but she was extremely homesick after she arrived (she still misses her family very much and sometimes at night when she cries I just hold her and cry with her - as I really do miss her family very much too).

Does her family have internet access? If so, you can assure her that she can talk with her family every day. I bought a new home pc when Doan arrived and we use yahoo video with voice and she talks to her family almost every day. It costs nothing (except for internet service and initial cost of pc and web cam - which most here have anyway).

Do you have family nearby and are they in acceptance of everything? Doan spends her days with my folks and she loves it. While I am at work she is learning new things and also teaching them things. For some this can be very rewarding.

Do you have any pets? We have a little dog and its a great fit because Doan had 7 dogs and she loves them very much.

These are types of things that you can use to assure her if they fit for you.

Doan also fits right in with my friends - even though it can be a bit tough depending on the language barrier at times but its really usefulo to have the interaction for her to practice her english.

Also - we are already making future plans to return to visit her family next year.

There is not really to much you can do other than be the foundation for her - be a piece of granite that is also as soft as a pillow!

Last but not least - it takes two to be successful, hopefully she can gain strength from yours.

Your timeline shows a NOA2 date of 4/21/2010, it should have a validity of 4 months which would be 8/21/2010 (always check the NOA2 for the actual date!).

Hello everyone!
I´ve been reading all kinds of information on this website, and so far it has been very helpful.
However, I still have some doubts, and hopefully someone can help me.
I am brazilian, and I spent 2 years in the US as an aupair.
I´ve met my boyfriend, just 4 months after I got there, and we´ve been dating since then.
I came back to Brazil 9 months ago, and my boyfriend has visited me twice, so we just decided to apply for the fiance visa.
Here are all my doubts.
1-I tried to get a B2 Tourist visa in March, and it was denied. Do you guys think I could have any problems on getting my fiance visa approved over that fact?
Maybe - maybe not, what was the reason for the denial?
2-I spent two years living in Maryland, so how can I get my background checks over there, since I am here in Brazil?
Police report is not required from the US
3-I went to Usa on a J1 VISA, on my DS2019, it says I apply for the 2 years home stay rule, but on the stamp (my visa) on my passport it says I don´t, so would I have any problems?

4-I am filling up the G-325A form, I have a compound name, should I write the second name on the blank that says: "all other names used (include names of previous marriage)"??
On the section that asks about my last ocuppation, can I write down AUPAIR? so would the employee be my host family? or cultural care?

5-Should I send my birth certificate copy, and translated copy with the I-129F??? or just a certified copy of my passport would be enough?
Birth certificate and passport of the beneficiary are not required for the I129f - only for the USC - the beneficiary will need these at the interview.

Well people, I am sure some of you might think my questions are dumb, but this whole process isn´t easy...
I hope somebody could give me some direction.
I appreciate your attention.

It's not clear to me at this point whether it's the US Citizen or the foreigner whose address is wrong. If it's the US Citizen and the petition was only recently filed, then they can change the address by phone but need to wait long enough for a case number to have been assigned. If it's the foreigner, it's not an issue at this point.


Yes I agree with you - I originally thought it was the USC address but I have read the post over a number of times now and I am no longer sure of that!

I know think a little clarification is needed here to be sure.

I think the question that needs to be "addressed" here is - Will the mail be deliverable to the address and apt number as he listed it on the petition. If not, then you might have an issue.

Regardless of whether it is a petiton or an application, if the mail is not deliverable then you will not be able to receive the NOA2.

Once they asign a case number you may need to get the adress corrected.

The filing fee is a non-refundable processing fee. It's what you pay to get them to look at your application. You don't get a refund whether it's denied or approved.


Did someone ask what the fee is for and whether or not they can get a refund :whistle:

Does the Place of Birth on your passport conflict with your birth certificate and/or the other forms you have completed requesting this information.

From what you have posted it sounds like there must be some conflict between some documents and they want to see it corrected.

With the petition, you submit a photocopy of a certified copy. Then take the actual certified copies to the interview for possible inspection. It won't hurt to sign and date supplemental pages for the G325a but I'm 100% certain it is not required.


I agree with pushbrk - for the I-129f petition I would send photocopies of the certified divorcee decrees and take the originals to the interview.

I sweated this one out because I did it backwards and sent the original certified copies in my I-129f and only had the copies for the interview but it all worked out in the end.

In many cases they have rfe's people because they did not have "certified copies". I made sure when I went to the courthouse that I requested "certified" and they put the embossed gold seal on them.
