Thanks everyone for the replies.

I'm getting the feeling that so long as I make sure to keep evidance that I departed the U.S. on time (i.e. didn't actually overstay my visa waiver) then there should be no problems or delays with applying for the K1.

Also, if I understand correctly, the US are not going to worry too much because it'll look like I only overstayed by about 3 months.

I'll be returning my i94w form and the necessary evidance tomorrow, and I get the feeling that hopefully, if they don't process it in time, or make a mistake somehow, then I'll be able to explain everything at a later date during the k1 application process.

I just was worried that they'd have some database somewhere, enter my name, see I apparently was still in the country, and turn me down. I read that there are millions of people that end up not returning their i94w forms, so hopefully they'll be understanding that it happens. I just don't want to be treat harshly as an excuse to be turned down for my k1 application.

Thank you for your reply, Slightly Bonkers. That information was very encouraging.

I'm not too worried if they question me about it. I made sure to photocopy everything at least four times!!! I sent them photocopies of my boarding pass and e-receipt. I also sent them a letter from my college confirming that I've been attending class there since November 08. And of course, I also included my i94w (the original, not a copy, though I do have copies of that, too.)

If they do stop and question me, then I'm hoping that showing them my evidance will be enough to satisfy them. I'm just worried in case we don't even get to the being questioned about it part, because they'll realize when they see our k1 application that I didn't return my i94w. And if they didn't update their records in time, then they could turn us down immediately for the visa.

How long was it from when you returned your i94w form to when you began your k1 application?

Hi, Koakland. I'm getting ready to send everything (i94w, evidance supporting my return to the UK, etc) back to them on Monday. I intend to have it tracked, so I'll know when it got there. Based on how long it seems to be taking my boyfriend and I to post things to and from the UK, I'd expect them to get everything within about 7 days.

We're just worried that they will imediately turn us down for our k1 visa application, just because they have not updated their records and think I am still in the US.

In September 08, I travelled to the US and spent five weeks with my boyfriend. When I returned home, I didn't realize that I needed to return my i94w (visa waiver) form. I only discovered this very recently, after we began looking into applying for a K1 visa.

I'll be posting the documents and such off to the relevent department in Kentucky this Monday, but my boyfriend and I are both very worried that our application for a K1 visa might not be able to be made until after my returned i94w form has been processed. I've read that it can take up to four months for them to do this, which has caused quite some upset because we want to begin applying for K1 visa as soon as possible.

I'm hoping that someone here might be able to tell me whether we'll still be able to apply? Or will we have to wait four months for the i94w to be processed before we begin k1 application?

Could anybody tell me how likely my medical condition and disability is to cause a problem during my K1 visa application?

I was born with a very rare medical condition that prevents me from being able to work. I am under the care of a specialist consultant at my local hospital, who sees me every six months for routine checkups. My condition requires that I take medication daily. My eyesight is severely impaired and I must use a wheelchair outside of my home because I am unable to walk or stand for long amounts of time. Currently, I have a carer who is employed to assist me with tasks outside the home (such as shopping). She also helps me with cleaning my home, washing clothes, ironing, cooking, etc. She helps me for just four hours a week. I am very easily fatigued, which limits the amount of time that I am able to spend doing certain tasks.

The important thing that I should mention is that my condition is stable: I have not been admitted into hospital for over 7 years. In fact, my specialist was incredibally enthusiastic when I told him that I intended to travel to the U.S.

As I hope you'll all understand though, I'm very concerned about my chances of being approved for k1. If they ask me whether I can work, I will have to tell them no. I have no intention of seeking employment in the U.S. I do, however, have the intention of setting up some sort of home buisness as a source of income; even if it isn't quite as much as a person working full time could hope to earn.

This is something that my boyfriend and I have already considered very carefully, and we are both very certain that he will be able to support me without us having any need to rely on the state to take care of me. Both of his parents have also agreed to sign additional afridavits of support. In addition, my boyfriend owns his own home and does not have a mortgage to pay off. Will things like this work in our favor?

I filed in march, have received my NOA1&NOA2 just waiting on my interview date now. The montreal consulate has received my information from the NVC and its being processed. I know this because my lawyers have contacted the montreal consulate and my lawyers were told it shouldn't be much longer. So I'm anxiously waiting. I also heard somewhere that montreal is delayed(not sure if this is accurate or not?). Other than that I was told that my process thus far is where it should be. That's not too bad then! We contacted a law office for whom my brother in law's sister works and she told us that Philly/NY is our best option right now as they're currently about a 7 month waiting list - would be nice if it could happen right now but these things take time!

I entered the US twice during the I129F wait, and had no trouble at all when I entered. I dont think my case was even on teh system,a s they seemed to have no idea of it. I'm glad you recommended the bank statement, not a bad idea! He also has the ownership forms for his car (should help right? Can't sell it without them!) And a return ticket. He has visited 3 times already this year and has gone back on time each time, so that should be good right?

Once in February for 10 days, once in April for another 10 days and just recently in August for a month... Hello, and good luck to both of you. My advice is to read the question, what are they asking for:

Applicant's employment last five years. (If none, so state.) List present employment first.

You only need to describe the past five years, so your fiance should describe the period of time from today, back in time 5 years. My fiancee listed her employment and her one period of unemployment. She only went back 5 years.

I would suggest write something like left employment to complete graduation at school name.Some thing that gives them a reason why he was out of work.You should never leave it blank.


No I am on about his general education from first grade to leaving high school. What do you need to put for that period of time?

Sorry I wasn't clear, my fiance is a UK citizen and the final warning was issued when he was 17. It happened 2 years ago, and he did not admit to the crime the police decided it was the 'best option'. As I said it did not lead to a criminal conviction but we know it will show up on his police certificate because it has done before (he worked in a school).

On the police certificate will a 'final warning' cause any immigration issues? If the said warning was actually the first issue the applicant had with the police would this also be a point? My fiance has a final warning on his record for assault after some people smashed his car windscreen and then proceeded to threaten him (was a total accident but the youths involved decided to press charges) any way the police decided to throw it out and he wasn't convicted of a crime, however he was issued with a 'final warning' and we are worried that this final warning may have implications. Any help here is extremely welcomed because we're very worried!

The charge was wholly unfair and should not have been registered at all, and my fiance has put forward a complaint to the ICC who have said/done nothing. Thank you for reading, hope you can provide some assistance!

I have a quick question. I will be moving from Pennsylvania to Virginia hopefully sometime within the next 6 months. We filed with VSC the last week of October and the move will not mean a change of service centers for us. So what I'm wondering is: If I have a change of address will this slow down our processing? Or is it simply an administrative thing? Any answers are greatly appreciated.

He will put a residential address also when he lands. It won't be mine though, likely my grandparents address as we'll probley both stay there while he's around. But he's flying through another airport before he gets to our local one-so that'll be his US POE. He's got his UK lease agreement and his work papers as proof of ties to the UK. I've advised him to have all this and the 129-f packet copies in his bag but to, as you all say, tell the basics and at least he'll have that stuff as proof if they ask for it.

Hi everyone,
I'm in the UK now staying with my fiance but unfortunately my scheduled flight home to the US is on Tuesday-Jan 8th. He has two weeks off from work and wants to come over to the U.S. perhaps on Wednesday for us to be together a bit longer. He was going to fly to New Zealand to stay with his family during his work vacay but due to time constrictions he'd only have four days (waste of a flight, $, and he'll return more tired than when he left) where he'd get at least a week with me in the U.S.
So anyway, we're just talking about what he needs to guarantee entry on the visa waiver program, as he always comes in. I told him he'd need proof of ties to the U.K. such as rent papers and proof of employment. And he has copies of our whole 129-F packet including the NOA1. What should he tell them at customs/POE? Basically I told him he needs to prove that we are willing, want to, and are in the process of doing this process legally and he has no intentions of marrying me upon entry. Any suggestions, comments, experiences, tips-greatly appreciated! He hasn't been to the US since we've filed so we're just entering upon this situation now.

Hi everyone,
We haven't gotten our NOA2 yet but we did have a touch on Sunday and many other October filers have been approved so we think we're getting close. So I'm thinking a lot about the financial information that I will need to provide. I graduated from college in May of 2007 and have been working two jobs since Sept. and Oct. respectively. I make enough money now but because I've been in school for the past four years I have no tax evidence to prove that I NOW make enough.
I've asked my mother to cosponser as I know that she has more than sufficient income and can easily document this. I guess my question is, I know that my mother needs to include the I-134 as do I, but does she also need to include her recent pay stubs, bank information, letter on company stationary, etc. I'm assuming this is a yes because it's included in the paperwork directions. I just want to provide complete evidence that I have the financial background (as I know I do) to support him so as not to be denied. We've come too far at this point.
Any thoughts, suggestions, comments are greatly appreciated.

Sorry if this topic has come up before. I'm just wondering what we do next. We received email approval on Friday 2-22-08. I know our petition now goes to the NVC but how do we know when they get it? And when it's forwarded to the embassy? Can we still check the status on USCIS.gov or is that done with the NOA2?
When I get the NOA2 hardcopy will there be other paperwork in it that I need to complete and send to my fiance in the UK? Or is it a list of what you need to send?

K-1 Fiance(e) Visa Process & ProceduresListed Consulate
This might be a stupid question but I think we all know how these little things pop up in our heads throughout this whole process! hehe
Anyway, I got my hard copy NOA2 in the mail today. And it says that the packet is being, "forwarded to the listed consulate." There isn't a consulate listed on the actual NOA2 so I'm wondering if they mean the consulate we requested on our paperwork. I'm just wondering if there is any where that I can check that they are forwarding it to London as my fiance has dual citizenship in the UK and New Zealand. Thanks!

Don't give them a letter, it'll only make it worse. Just totaled up the two jobs, find the total income, and place it on the derived income line. If they ask your fiancee where you got this from, the employment letter will be accepted. I helped someone on this before. The embassy accepted the affidavit.

Your mother need not write an affidivat. Use the form I-134 as well. Also, include the most recent tax returns or better yet, past three years. In the relationship part just put petitoner's (your name basically) mother.

Meg, for the interview the consulate will want to see the original, plus recieve a copy of the documents you mentioned above, for the BENFICIARY of the K1. So that means for your fiance. I was thinking I'd combine incomes (MY 2 jobs) on the affidavit with an * then do the calculations and explanations on a separate sheet. I know there is a part on the support letter that asks for relationship. What should my mom write?

Hi everyone,
Hope all is well. My fiance and I are finally moving through this process. He's received packet three in the mail and is working on that. I'm compiling my paperwork and all the things that the visa journey time line suggests mailing to him. I'm wondering-what originals do I need to send him? I've read that I can send him a cert. copy of my birth certificate and avoid mailing my passport. Do I need to send originals of cards, letters, etc? I'm just wondering because they should have my entire original I-129F packet. The cards are the only thing I can remember that I made copies of. That and my passport I guess.
Also, my mom is filing as our co-sponsor. I make enough money but because I just graduated from college, my W-2 for 2007 only reflects about 1/4 year thus does not show enough income. Anyway, what should my mother right on the Affidavit of Support as her relationship to my fiance. Is co-sponsor okay? I know this has been asked on the board before but I've never seen a real answer to it.

I think it's probably a good idea for you to quit now. It's probably a lot better for you to quit and be trying to find a job you like better, and get settled down with all of that side of your life, before your fiance gets over here in the States. Because you guys are gonna have plenty to deal with without your looking for another job to add to that heap tongue.gif

Thank you for your responses! I agree, there is enough to worry about throughout this process without the stress of the job! Working somewhere that I don't like makes me grumpy and I know my fiance worries b/c he knows how unhappy I am at this job. It's not like I'm trying to lie or become unemployed, just looking for a better schtick. Thanks again!!

I was working it when I completed the paperwork and sent it to my fiance. I still am working it (and will have to continue through my two weeks notice.) But I did send my fiance my mom's complete information as a cosponsor.
I will look for another job as soon as I give my notice here and right now I'm working two, so at no point will I be unemployed or without income.
I've got no worries about the explanation and AOS will be a few months away for us still.

Hey all,
We're in the final throws of the K-1 process. Our case is at the embassy, packet three is sent in, medical is done, we're just awaiting an interview date. I've sent my fiance all of the needed interview stuff including the financial information for myself and my mother who is co-sponsoring for us. I'm working two jobs and have sufficient income but not the back tax information (because I was a full time college student til spring of 07) so I've included my mom's information which is MORE than enough to meet the financial requirements. Here's my question: I am to the point where I HATE one of my jobs and don't want to wait for the interview to be over to quit. Can I give my two weeks notice at work and quit without worry as to the effect it will have on our paperwork? I'm just concerned as it's on my I-134 and my employer letter, pay stubs, etc. are also included.
Any suggestions.

I-134 is a support doc to show that US citizen will be supporting the foreign citizen after they arrive on the NON-Immigrant visa. The foreign citizen's address is not a consideration for this form.

You only need to inform the embassy or consulate of address change so that they can send packets too.


I just wanted to make sure as on the form it includes a section outlining information on the beneficiary and address is requested. You're saying it won't matter if I put the address of the flat he's leaving?
