K-1 Fiance(e) Visa Process & ProceduresNew to this forum, have general questions
Like someone else said some cases get 'touched' a lot, others not at all! We only had one touch just after CSC received it from TSC, then nothing til we got NOA2. All it (touch) means is someone did 'something' with your file and updated the computer to say they had done so.
Having alawyer won't speed anything up - al cases take the same amount of time (more if you get RFE - which means returned for further evidence - or get stuck in security clearance checks - aka 'AR or AP')
You don't 'need' a lawyer unless your case is complicated, however many people use them for the peace of mind (altho we have some horror stories here!) and hopefully retaining one means they will double check all your paperwork BEFORE its sent off, possibly reducing the possibility for an RFE. It doesn't always work out that way, but if you have the funds and want to go that way then that's fine.
Any lawyer that tell you he/she can get your petition thru the system faster than anyone else's however is not being straight with you.
Everyone has to go thru the same checks and waiting times - the exception being members of the armed forces about to deploy.
Much luck! :)

K-1 Fiance(e) Visa Process & ProceduresJust Starting on K1
NOA1 is just a notice of reciept of paperwork issued to the applicant by the service center - if you are in LA your service center will be California.
Touch means someone AT the center picked up and did 'something' to your paperwork and made a note of it.
K1 visas can take an average of 6 months to issue if they go thru without any problems - some take a lot longer - and a few take less.
You mention a time issue - you could always travel to China and marry THERE if time is such an issue, as you will also be living there also.
If you prefer to marry in the US, as aussiewench says, you will have to adjust status before your finacee will be allowed to leave the country - if you leave before AOS it will be seen as abandonment of adjustment and any re-entry will need another visa - a K3 spousal visa - when you eventually return to live in the USA.
Be aware that AOS MAY take up to a year to complete - again it may take longer - or be shorter.
Before you file for a K1 you really need to sort out your plans in full, taking all these things into account.
:)

K-1 Fiance(e) Visa Process & ProceduresJust Curious Question, Anyone filed for hardship for not meeting their fiance?
Rose I know I gave you advice on your other thread (btw thanks for the kind words Rapsberry Swirl (F) ), but I gotta say you really SHOULD listen to us all here - I know we arent YOU, but we've been there, been where you are with the impatience and stuff..
My man and I have been together now 5 years, managing to squeeze visits in when finances allow - which is nowhere CLOSE to how many we'd like and although I think we know each other pretty well, I know for CERTAIN that we don't know each other as well as we would if we lived closer - or on the same continent!
All realtionships take TIME - please don't rsuh things because its a way to 'escape' or rush into something which may end up being a mistake.. especially if by doing so you cut yourself from family. If that happens and, god forbid, your relationship fails, you will be alone in a foreign land with no-one to turn to, or even call for help and guidance.
I would not wish that on you or anyone.
If however, you wait, and your family and/or his see how mature the 2 of you are being by waiting until you can make a real go of things, AND that your feeling remain unchanged and strong, then they may come around and support you too.
Best of luck

K-1 Fiance(e) Visa Process & ProceduresIs this a lie?
Even if you are not 100% sure that you need a co-sponsor but are close to the poverty level + 125% guidelines it would do you no harm to set up a co-sponsor to use if you need one.
This would avoid the problem of attending interview to be told you don't qualify on the grounds of funds, and possibly get an RFE or denial because you already set up a fall back option.
If you find at a later date that the co-sponsor is NOT needed then you can release them from their obligation - but its better to have MORE than you need than less.
Best of luck.

K-1 Fiance(e) Visa Process & Procedureswhy did my paperwork go to california?
They sent them because Texas was SO far behind last year that it wasn't funny - of course California are also an incredibly busy center - so it would have made more sense, IMO, to send them to the LEAST busy center, like VSC, but nooo..lol
I had thought Texas was once again taking applications, as the website is showing dates of last action in the current year, but I guess not as I see yours was a late february application and it still got transferred

K-1 Fiance(e) Visa Process & ProceduresI-134 (K1) query
Its kind of unofficial I think but if you have a few thousand in your bank account (I think but am NOT sure its a min of around £5k) London have been known to take it into account. I believe they are unique in this regard.

K-1 Fiance(e) Visa Process & ProceduresI-134 (K1) query
My SO posted this in the foreign Embassy forum - which might not be the best place, lol - so I'm re-posting here :)

(Posted by LenJayUS) Depending if my place of employment figures in my shift pay and normal over time pay (it's consistant each month... unless I take a vacation)... I'm going to be close, probably slightly under the 125% poverty line.

Would they take into consideration child support? I get $550.00 a month in child support from the egg donor of my two kids. Would I put on the form that the kids are paritially dependent on me? Likewise, I believe Jay will be recieving child support for her daughter as well... would that be considered as well?

Anyone got any thoughts? I'm thinking that MY child support is unlikely to be included as its for HIS I-134 info (tho I have enough I think to self-sponsor if the London Embassy allows it)
Cheers fellow VJers

K-1 Fiance(e) Visa Process & ProceduresStupid Question
I believe at the interview! :)
Take things like emails, photos, letters (with envelopes showing dates IF you have them - but really who keeps this stuff?), flight ticket stubs, visa bills from trips to see your honey, phone bills, engagement ring receipt if applicable,..anything showing proof of ongoing relationship.

K-1 Fiance(e) Visa Process & Procedurestravel tomorrow
The airline you are flying with should be able to answer ALL of your questions; in most cases connecting passengers are forbidden to leave the airport (and do not go out of the flight side area at all) and are therefore not required to go thru immigration although you may be required to go thru security again for safety reasons.
I do not know if you will physically change airplanes, and be required to disembark, and re-board, but the airline WILL know. Call them and ask - they have customer service helpdesks for a reason :)

Im not sure why this would an issue..you havent re-married yet have you? You're 'engaged' and all that is is a statement of INTENTION to marry - its not a legal situation, just a civil one.. no docs are signed.
You can't marry anyways til after your K1 is issued and you are Stateside by which time 30 days are sure to have elapsed either way.

K-1 Fiance(e) Visa Process & ProceduresBrand new to the forum and clueless...
lily think that would be a K3 visa - marry then art and apply for the K3 - I think witht aht one there's no AOS required and travel/work can therefore commence once the visa is apporved and he moves.

(edit scuse the spelling its real late here and my brain has gone to bed already :) )

K-1 Fiance(e) Visa Process & ProceduresWHAT should i do???!!?!?!?
Inform the lawyer of the omission and take his advice - your fiance hired him to assist you both, and probably is paying a fair fee for it too, so he should be the one helping you thru this.
I don't disagree with the other posters btw - but I think as you DO have a lawyer you should make full use of him :)

Aww 'Nita hun! *HUGS* You have GOT to stop calling the NVC - its just making your stress worse - have Paul do it, you HAVE to step back for a bit or you're gonna make yourself ill!
Yodrak is bang on when he mentions the privacy issue - Paul should be doing the legwork because if they tell anyone, it'll be him and not you, and the continual brush offs you're getting will just send your blood pressure thru the ceiling. Try and remember that the level of your panic and anxiety won't make them move one IOTA faster than they are already - and it might end up putting you in health issues.
Many many hugs and mojo to you sweetie..
I agree btw about getting Paul to ask his congress person to see if they can sort thru the confusion on his behalf.

K-1 Fiance(e) Visa Process & Proceduresdisappointed

I hate rude, ignorante people - yes, I'm rude and ignorant on occassion, but not to the degree of some people... "Stay in your own Country", "Stay in your own race"... blah blah blah...

People at work like making the comment about I have a mail order bride... most do it in fun, but some don't.. and it's really starting to piss me off...

I'm a mail order bride? Cool - and you only wanted a new PC monitor ;)
Are you gonna pay my shipping?
Oh and I come fully assmbled and no batteries required

K-1 Fiance(e) Visa Process & Proceduresdisappointed
Also it was an odd thing for them to say in the first place as it pre-supposes that no native born American is illiterate.. obviously the person that responded to you was uneducated, narrow minded and probably has a sad personal life and can't find anyone to love them so resents others finding love anywhere. That person has to be them 24/7, which sounds like retribution enough.
Your relationship is stronger than annonymous spite so just ignore it and be happy that neither of you are like that sad loser who spat such vitriol :)

Im typing this FROM the US so you can see I didnt have an issue :)

As an e-ticket holder I didnt have my return ticket BUT Iprinted off my Itinery before I left which celearly shows the return flight and the POE guy was happy with that.
Jaylen BritNot TellingUnited Kingdom2006-03-30 10:05:00
K-1 Fiance(e) Visa Process & ProceduresSO Doesn't speak English!
You could of course telephone the POE and ASK them about language problems etc. Most have very helpful info desks; find out if they have translators around working the time of day he will be arriving. You needn't give them all your personal info - just that you have a friend flying in who speaks only French and Arabic and want to make sure he has as smooth a time as possible, and that it won't cause THEM (the POE people) any problems either.
Jaylen BritNot TellingUnited Kingdom2006-03-18 07:05:00
K-1 Fiance(e) Visa Process & ProceduresSO Doesn't speak English!
Does he speak any Spanish? More than possible they'd have someone at POE who can speak Spanish..
Otherwise he could learn the phrases he needs to explain he has the K1 visa, and also the phrases to say he speak little English and they'd go from there

K-1 Fiance(e) Visa Process & Procedurestravel to the US
I just got BACK from a US visit using VWP and I have a K1 in progress - in fact we're at packet 3 stage!
I had no problems - tho the POE guy managed to worm out of me I was visiting my boyfriend, lol. I couldn't LIE when asked (he wanted to know the realtionship to me of the person I was staying with), so I told the truth - but I had a copy of my flight itinery (as I was using E-tickets I had no return ticket to show him) and he was happy with that :)

K-1 Fiance(e) Visa Process & ProceduresProof of having met in the last two years and ongoing
Our proof of having met was 3 or 4 photos, my ticket stubs / boarding passes from all my flights (I never threw them away - no idea why not tho, lol), passport entry stamps copies, a phone bill, 2 or 3 emails and that was about it.

For ongoing relationship - interview time - I'll be taking all that, plus another 3 emails, couple of phone bills and visa bills, more boarding passes, cards we sent each other (with envelopes where I have them), and our engagement ring receipts.
Im not taking TONS of stuff - I can't see the point of printing out TENS of emails - they barely look at them from what I heard - and anyways I'll have enough forms and copies/ originals of certificates n what not. I want to carry it with me, not rent a wheelbarrow to get it there!
Jaylen BritNot TellingUnited Kingdom2006-04-10 16:48:00
K-1 Fiance(e) Visa Process & Proceduresthis makes no sence
If it makes you feel any better this has happened to others - they get RFE'd for things they say they've already sent - the only thing you can do is send the info AGAIN - once they have what they need they can move forward with your case - there's no point stressing over it - I know how annoying it can be - but there's nothing you can do except comply with their request. As others have said part of the petition may have become detached and rather than go hunting for it - which could take WEEKS (if you've seen their 'office' you know they store stuff in WAREHOUSES), they've asked you to re-submit which is by far the quicker route.
Best of luck with it :)

K-1 Fiance(e) Visa Process & ProceduresLondon Medicals
yes - only the Knightsbridge Docs can do the visa medical - which costs £160 per adult and I think £80 for a child under 14 (not near my pkt 3 right now so can't check child costs)

K-1 Fiance(e) Visa Process & ProceduresK1- is age a factor?
As you're both young I honestly don't see why your ages would matter as much as the fact you have a genuine, comitted relationship (and you appear to have full backing of your fiancee's parents - always a bonus!) and that you've met and continue to have an ongoing relationship.
If you were 54 and she was 17 then yeah, I'd say age would be a factor!
