For those of us who are dumb and maybe blonde (like me), what is CFO? And is it in the States? And do you have the correct visa required to go to it (whatever it is)
If you have to travel out of the US to any country (other than one inside/considered part of the States) you will need a valid passport....

No doubt someone will know but I can't find the link, but on this site we have some pix of CSC from a link given on a newspaper report showing how it works. It was HUGE - they have a seperate storage building for files - they use forklifts in there (I am not kidding) and the the shelves go up almost to the ceiling. After I read the article and saw the pix it amazed me they don't lose more than they do, paperwork wise.
I can only imagine working there is more than a little soul-destroying.

The key word in intent. If you arrive on VWP with no intent to marry and have plenty of ties to your home country, showing you will /have to return at the end of your visit, but you then marry your partner this is not illegal.
Remember that when you do the AOS the burden of proof is on YOU to show that no intent to immigrate was present at the time of entry to the US. If this is not believed or AOS is denied on the basis of fraud/no proof, the partner MAY face deportation (I've over-simplified but that's the bottom line) which MAY include a ban from re-entry.
Some people marry in the US, after entry on VWP, then RETURN to country of residence; this is also not illegal as you are not immigrating. The person can then either apply for K3 or DCF.
Also; even with VWP there is no guarantee of entry to the USA. If the Immigration officer belives you HAVE intent to immigrate you can be refused entry and sent back.
With a K1 you are stating intent to marry (and immigrate, altho technically the K1 is not an immigrant visa, but I don't know anyone personally who has used K1 and NOT immigrated), and on arrival WITH the K1 and docs, after visa approval from US Embassy in country of residence, you have received official 'permission' to do this.
K1 and K3 can take a few months - DCF CAN take less time (but there are no guarantees with any visa waiting times)
Make sure you know all your legal choices/options before doing anything and good luck :)

Nebraska are currently in the process of sending their K1 apps to CSC (California) and, AFAIK, will no longer be dealing direct with K1s themselves.
You should STILL however send your initial filing to them - and THEY will forward it (assuming NSC is your local office...)

And re the photo, sure why not? lol But Id just do the ONE of those type..photos are just PART of the evidence not the whole..keep copies of any visa card reciepts showing payments made in your fiancee's home town, any hotel bills etc..if you don't have the original boarding passes then e-tickets copies are good - luggage tags too (and most people forget to take those off until they use the bags again so you might still have those)..all that good stuff

James I also backpacked around the world and you don't need to put residences unless you WERE 'resident' in those countries..police reports (for UKCs) from foreign countries are required if you spent 12 months in one location - I was in Australia for 8 and they said I wasn't required to get a police report for that..

At this stage you do NOT need to take/send originals to USCIS - you WILL need them for the interview though (except the USC's birth cert - I was told when I attended that I didn't require the original of that even though I had it with me, lol)

Also CSC are currently dealing with some apps transferred over from Nebraska (and they already deal with the ones from TSC)..then of course there is IMBRA and its impact on all cases approved after 6 march.

What 'other documents' are you referring to?
They need to see originals of: Bcert (beneficiary plus any K2 kids), mcerts/divorce certs (both), police report, passport, all paperwork pertaining to the petition (airline ticket stubs, receipts etc), emails/photos/letters etc, ring receipts (if you have them)I-134 and accompanying documentation etc etc

Edit to add: All this for INTERVIEW not the initial filing!

Well for one thing don't lie about what happened - its possible they have a record of it - so lying would be a definite bad move.
They may not ask of course at interview - but I *think* there might be something about 'have you ever been denied access to the US' (or something along those lines) on the packet 3 forms.
Be honest - you made an honest mistake - you believed one thing (that having been a resident before you could just go back) but found out from the POE person that this was not the case, he gave you a recommended course of action to take (apply for K1) and you took it. You weren't arrested and you weren't intending to defraud anyone.
Always be upfront and honest in your dealings with the government / immigration - and try not to panic - many people have been turned back at POE and gone on to make a successful K1 application :)

You must report the stolen/loss passport inmediately. Unfortunately, the consulate will not replace a loss/stolen visa with a new passport. You must obtain a new passport and then have you fiance(e) petition for you again.

That's right. If your visa is loss once it is issued, no replacement visas are available. You must start all over from the beginning.

OP should report passport stolen to UK authorities asap - and also CHECK with US Embassy about visa - I know many years ago when i had a passport stoeln abroad, which contained a US visitor visa (before VWP) the US consulate in Sydney just re-issued the visa..that's the only reason I'm asking if you are 100% sure..

At the interview I was told to come back the next day to pick up my Visa. When I went, I was taken aside and told that my medical results were incomplete. I was then told to go home, and the panel physician would contact me.
Once I was contacted, I need to get a letter from my Psychiatrist to the panel physician. This is the tricky part. I requested the letter in January, and was told in March that the letter was sent straight to the Consulate in Montreal, and that I was not able to get a copy of it, or have a copy sent to the right place. But in May I was able to get a copy and send it the Saskatoon. I was told that that was all the physician needed.
I then got a call 2 weeks ago saying that Montreal was confused about the results, and that I needed to go back to Saskatoon (a 3 hour drive) for yet another medical. I did that last week, and was told that I passed the medical, but the final decision is up to the Consulate.
This is why I was wanting to know about getting married and trying for the K-3.

Given all that, then you have been waiting a week for your case to be reviewed as prior to this the Embassy didn't have the complete medical info.
First you need to confirm the Consulate got the amended letter, which you sent last week, and then inquire what the decision (or hold up) is.
So call/email them again or have the petitioner call.
What a nightmare though.. I hope its all sorted quickly.

The tourist visa (VWP) is good for 90 days, and is useful for meeting friends as well as seeing the sights - make CERTAIN she doesn't overstay - or getting any kind of visa in furutre will be difficult to say the least.
Student visa I doubt she will be able to get until/unless she is enrolled at a US College - check into the fees they charge for international students - its not cheap.
K1 probably ISN'T what you want right now, as you havent even met in person yet; save that for the future once you have met a few times, and both sets of parents are happy with the situation (you will need them onside due to your ages, and if you need a co-sponsor in future).

Is the 2nd DATE the same as the first (I know you only just got it, but look at the DATE APPROVED)? Or is it more current?
Maybe the computer had a fit and spat out a copy and they mailed it?
If not I'd ignore it, but keep it, as NVC seem to have had your paperwork already and sent it to the Embassy (unless the Embassy sent it back to NVC in an IMBRA misunderstanding confusion type situation...) Check with the Embassy.

I did it and it was fine; I even said truthfully I was visiting my b/f - I had proof of ties to my home country - mortgage paperwork, bank statements, fact that daughter's flight came back the week I was returning and had to be there to meet it, and including my NOA2 - which showed I had to return for interview

You have waited a long time - may to now.. might have gone to secondary security checks or been returned for IMBRA reasons by the Embassy - have you checkd with the Embassy dealing with your case (use the NVC ref number they gave you), and see if they got it but returned it to NVC?
I know NVC usually only SEEM to update their records once they've sent the case to Embassy - in our case they said they didn't have it - then a week later told us they'd sent it to London - on the day after we enquired (so, the day they said they didn't have it they were busy approving it and sending it off..)

and if you're shipping stuff, then as long as it arrives AFTER you do in the US its ok (customs requirement that you be in the country when your goods arrive, if they arrive unaccompanied)
I'm shipping mine about a week before I leave (hopefully) cos the minimum it takes on air freight is 10 days, and by ship its 6 WEEKS.

Yeah at POE its the INTENT TO EMIGRATE that's looked at, not the intent to marry per se..and you have jobs in China that you need to return for (so take proof of that if you go to US and any mortgage, rental agreements etc, as much as you can) and you WANT to return to China..so you have no intent to emigrate to the US.
The K1/K3 are ONLY for people wishing to marry AND SETTLE in the USA, (after which you have to STAY and adjust status, which can take months) so they wouldn't be something you wanted at this point in time from what you have said..

Bring ties to your home country just as your fiance would if he were visiting you. Again its the intent to emigrate that's under review - and you don't WANT to do that, so its a good idea to have proof of that. Anything frm your employer stating you have to return by such n such date, or mortgage agreement is good..copy of NOA1, not a bad idea, shows your fiance has intent to emigrate to the US, not the other way around..
Of course they may not even ask you much past 'vacation or business'? at POE.

Same as Cristy :) We did send engagement ring receipts but we werent GOING to cos we were going to get the rings after I went over on K1, it just turned out that we got them early :) As it was - the flippin Embassy didn't ask to see the new letters of intent never mind the ring receipts (or the half a ton of other papers, inc the affadivit of support, I dragged with me to interview, talk about a let down!) :lol:

I think you'll find they didn't need to apply for a B1/2 and just crossed normally - but I'll let them post experiences :) At the end of the day its still down the Officer at POE (needing a visa or not) as to whether they believe there is immigrant intent or not as far as allowing entry tho.

You can visit - there's just no guarantee you'll be admitted tho - take plenty of ties to home country etc - but the final decision is the POE officer. If he/she believes you have immigrant intent you get sent back.
If you're from a VWP country btw you can still USE the VWP visa - I did, and I got thru ok.
