K-1 Fiance(e) Visa Process & Proceduresfiling I-129F with children

thanks for that fwaguy .. appreciate it

kath

Besides the letter(s) from the father(s) you will possibly also need any proof of custody for minor children under 18. They should get passports too if possible/appropriate.

Jim

thanks everyone!!!

wot does 'notarised' mean? is itsigned by solicitor?

i have residence order over my 2 youngest children, but nothing over my eldest. his father isnt on the birth certificate will i still have to get some kind of proof of custody??

my partner is filing petition for myself including my 3 children, do we need to hand in copies of their birth certificates and letters of consent from their fathers to remove them from the country? or are these things i take to interview?

also wen i was younger i changed my name, should we include copy of my birth certificate and change of name form in with petition?

K-1 Fiance(e) Visa Process & Proceduresan anyone find I-134 that has not expired?

It pays to read the instructions on both the form AND - very important - on the webpage from which you download it. That page says what the most current version of any form is and which versions are still okay to use that may be older.

This whole process goes down a lot easier if you take a deep breath and READ read read everything you possibly can. There may still be questions after, but there's lots of answers there in front of you. I know it's a stressful nightmare of a process, but you can take the edge off too.

Thanking you all!!!!

K-1 Fiance(e) Visa Process & ProceduresPassport-style photo with I-129F

I worried about this mine are not quite 2x2 our English photobooths just don't seem to do that size. I have sent what I got out of the machine but admit I am bit worried. Any English people done the same and either got away with it or not as the case maybe? It would be good to know.

Emma

The ones from a photo booth tend to not be acceptable quality. In our case my fiancee gave me 2 that were 1"x2" and they were acceptable, they were full frontal view.

Go to a photo shop that does passport photos.

I'll need to try that again, I have had 3 lots done already and the backgrounds all came out a nasty blue/grey colour. I'll try a different town.

Do you think I should ask my husband to hang fire on posting the I-130 until I get the better photos done? Aaargh who would have thought after the pain staking time we spent doing the forms the photo would be the problem!

Advice please.

K-1 Fiance(e) Visa Process & ProceduresQ18 Review please :)
Many thanks, I had a feeling we were off-mark with it, but wasnt really sure what it was meant to acheive, which is probably why its confusing. That and I'm never one to say things simply - I blame my parents... :))

Listening to your comments makes a lot of sense, reworkings will be done.
Thanks again for your input, sometimes you just get too close to be able to see the big picture 8-}

K-1 Fiance(e) Visa Process & ProceduresQ18 Review please :)
Below is the answer we've come up with. I'd appreciate comments, as I'm not sure how formal/informal to make it :) had a fab 2 weeks with my now official fiance and would like to get this on the road :)

We spent a wonderful fortnight together, from 17th August 2006 to 31st August 2006, at Pamela Parsons' residence at <her address>, with the exception of the night I flew in, where we stayed at a local Comfort Inn after the long flight. All three of Pamelas' children were home during my time in the U.S.A., whom I met for the first time in the flesh, having chatted online to all of them over the last four years. During the two weeks we established a rapport and had family meals and events such as board games, pool, watching movies together and the more mundane events such as cooking/washing up etc.

Included in the attached sheets are evidence of the meeting:
The E-Ticket – includes the flight itinerary (double sided)
A collage-copy of the boarding passes, two flights per trip (London, Gatwick to Dallas, Ft Worth to Nashville, Tennessee, and the reverse trip)
A copy of the Hotel bill from Comfort Inn, Nashville for the night of the 17th August 2006
A collage-copy of the passport stamps.
Two photos of us together during my trip, with dates and descriptions on the back
A copy of the receipt of the Bridal set of rings, including the engagement, and both wedding rings (left in the U.S.A.)
Copies of two phone bills from Reynard Cobham to Pamela Parsons ( ?? give dates ??)
Copies of two of the many cards Pamela sent to Reynard.

We initially met and became friends online around May 2002? in a gaming environment known as Everquest. Our friendship grew stronger over the following months and we began to spend more time together on Everquest and also communicating via a text-based chat messaging system known as ‘Yahoo Messenger’. After about 6 months Pamela let on that she was married, with three children but that both she and her partner (Morris Parsons) had grown apart over his persistent drinking and neglect, and that the only reason they were still together was for the benefit of the children. We continued daily contact via e-mail/Yahoo Messenger and Everquest for a further four months or so before our first phone call. Around the end of 2002? Pamela had been diagnosed with breast cancer and was required to go through chemotherapy. At this point there were more regular phone calls to provide support and a morale booster as the therapy took its toll. Reynard decided to visit Pamela in the US towards the end of the therapy . This took place from 1st to 8th August 2003 where he stayed at a Holiday Inn in Memphis and had Pamela join him for the week. From here to the present day, we continued to send cards via post, electronic cards via the internet, as well as presents every birthday and Christmas, alongside the daily chats either on yahoo or more recently through the ‘Skype’ PC-to-PC “phone system”. There were also regular phone calls up until the discovery of the ‘Skype’ system, which has saved us a lot of money!

The “marriage” between Pamela and Morris eventually became too much for either of them to bear, and they divorced, with the official date being 14th November 2005, although Morris had actually moved out to live with friends since February 2005. Pamela and all three children then had to move out from their home at the end of 2005 and ended up in Paducah, Kentucky staying with relatives until they could find a place of their own.

Many thanks for reading :)

Don't despair julie - it will come eventually - ours took over 90 days before NOA2 and we only hd one touch the day after they got it - so it seemed like they'd forgotten us - but they hadn't.
(F) Hope its not TOO much longer - one good thing with CSC is that take so long most people havent been caught up in the 'recall' stuff for NOA1's for march 6th and after (trying to be positive here! lol)

K-1 Fiance(e) Visa Process & ProceduresBig Disappointment...

Well, I had originally thought my lawyer received Packet 3 over 6 weeks ago. And we couldn't understand why my fiance had not received it yet??? Why would they send it to my lawyer and not him? And why wasn't my lawyer telling me about all the things I need to gather for my fiance's interview which could be in a month or two if he were to receive Packet 3 any day now? After several failed attempts to contact my lawyer by phone I finally made an appointment to see him. I of course went to the appointment with my defenses up  ! I was thinking he was so inept... Well the joke was on me because he never received Packet 3  !!! It was a BIG miscommunication that his secretary conveyed to me and I misunderstood her... Blah blah blahhhhhhh  ... So now it all makes sense why he's not telling me anything, because he has nothing to tell me!

He basically told me that I have to chill and wait... I told him about VJ and I kept comparing other Muslim cases to mine that had been approved or have interview dates and started after me and I made him crazy! He told me to get off the website  ! And was I "paying him or the website"? So he proceeded to tell me what he's seeing that I'm not seeing on the site... He has a Muslim client in Egypt who has been waiting 4 years for his security clearance. He has had several men denied in other Middle Eastern countries recently... Well that really brought me back to reality  . He said the crime that Resul is charged with is that he is male, young, and Muslim. He said the embassies have been really jerking the Muslim men around a lot lately. He wanted me to take the "rose colored glasses off" and see reality... He thinks we will be ok and should be able to get the visa in due time, but he made me sign a letter that I will attend the interview in Ankara when it is scheduled. I wasn't planning on going to the interview. Not that I wouldn't want to be there for Resul, but it's more money that we don't have! And God knows we will need more money when he gets here, as I see the government will be eating up more money with all the future applications and filing fees  ! It doesn't end! My lawyer wrote in the letter that he "strongly suggests that I attend the interview", and then he said to me "and I'm telling you, you have to go". He said that if we want any chance of getting this visa I better go. If I go it will strongly validate our relationship and if there are questions or problems I will be there to answer. So guess who will be going back to Turkey??? LOL

This news really brought Resul and I down :crying: . It's been 6 months since we were together and we are going crazy  . I've spent the last 2 weekends on the cam crying to him and then he starts filling up :crying: . We are so tired of being on the cam and talking on the phone. We just want to be together as I know every one of you want. Do any of you veteran VJ-ers have some pointers on how to stay positive, strong, and less emotional during times like these? One day he is up and I am down, vice/versa... We've even started playing games on Yahoo IM to break up the monotony. Thanks for listening to me vent  ! I took a couple of weeks off from VJ because I was stressing myself out reading everything and worrying about everything. But I'm back and trying to be strong! Thanks for your help... :help:

~Debbie :luv:

4 YEARS?!!! Is that for a K1 or K3? Cos if not..he shouldn't be comparing cases!
I think I see why he said 'get off the website' - he might be worried you're getting bad info or info that is so at odds with his own as to perhaps 'misdirect you'. Obviously he hasnt SEEN the site - as you know if we aren't sure, or think the situation is complex, we always advise to see a lawyer! Perhaps also he doesn't realise one of the primary functions here is support - as others have gone/are going thru the same situation as you (regional forums are same country even).
As far as staying positive goes - DO visit the regional forums here then you can get the input of others who have fiances from the same country as yours is and know how the system works from a personal experience angle.
Remember, while its natural, worrying is something that will not help you move forward - its an emotion that will keep you treading water so to speak - and remember also tht this is just a tiny part of your eventual journey together. It's not the sum of it, nor is it infinite.
(F) I hope things begin to move soon for you.

I think you have to start the process at the consular post with which you intend to finish it - ie start it in Germany because that is where you will be - Legal Asst Code 16
This may or may not be of use US consul in Germany

K-1 Fiance(e) Visa Process & ProceduresWHAT DOES THIS MAIL FROM NVC MEANS? WHERE IS OUR PETITION????
goldie - they told us they didnt have our case for two weeks..and CSC said it was sent..then one saturday morning, NVC sent an email telling me they'd sent it to London.
When did they send it to London?
The day AFTER they said they got it - which was almost 1 week prior to the week they told me they hadnt received it yet (the 'we have sent it email contained 'date of receipt at NVC' which previously was unknown to me..and them too apparently as on the phone they said they didnt have it then!).

K-1 Fiance(e) Visa Process & ProceduresMY Case GET RECALL after my Interview APPROVED!!!
Honestly I dont think the congressman is going to be able to DO anything if the petition has only JUST been recalled - if the law says the checks have to be done for anyone with NOA1 after march 6th, then thats what they will have to do..
If tho, they start taking a LONG time to get thru them then yeah - maybe someone like a senator or congressperson could expedite things..(they can't prevent the checks being made tho) guess it depends entirely how 'long' they estimate the delay will be.

K-1 Fiance(e) Visa Process & ProceduresMY Case GET RECALL after my Interview APPROVED!!!
It sounds like IMBRA - I see your NOA1 date is after march 6th so that would make sense..even though its devestating to get it right at the end here :(
Its just a small matter though - shouldnt cause MASSIVE delay - either the Service center has to run a check on the USC (for any prior spousal battery etc) or they get them to complete a form and do it - not sure which but IMBRA isnt just for people who met thru marriage brokers.
Hope its finalised soon for you (F)

In your post you say the check has not lceared the bank but in your sig it says it cleared the bank yesterday...

Or did you only fix your sig after you made the post??

(And yes TSC can often be like a black hole but things move a lot faster once it goes to NVC)

goldie - by the time NVC admitted they'd got ours they'd already sent it to London!

While antone is quite correct, I've noticed (purely from reading on VJ) that in countries where VWP isn't an option that a B1/2 is quite hard to get if there is a K1 going thru

K-1 Fiance(e) Visa Process & Procedureswhile we are in the neighborhood......
You can't get packet 3 before NOA2 - NOA2 is the petition approval - and the consulate won't have a CLUE who you are until after that - so I'm presuming you just want to get the forms in the packet 3 so you can assist your finacee filling them in? Obviously neither of you can send them in until NVC has sent your case to the embassy (you need the reference number they generate). If that is the idea then honestly I don't know - some of the forms are downloadable - have you checked the website for that embassy?
Also you are going thru CSC so it could be a little while before you get the NOA2.
Best of luck to you :)

K-1 Fiance(e) Visa Process & ProceduresPLEASE HELP: Tourist visa rather than K1 visa
Its not illegal to marry on a tourist visa if your intent on arrival was NOT to marry, (and don't forget come AOS you will have to show that this was not your intention) OR if you intend to DEPART the country after marriage in the US and file a K3.
It IS illegal to enter on a tourist visa and plan to marry AND STAY in the USA.
Best of luck with your choices.
Jaylen BritNot TellingUnited Kingdom2006-05-30 03:04:00
K-1 Fiance(e) Visa Process & Proceduresk-1 imterview is denied often?
Its neither rare nor often - it just happens.
It can happen for many reasons - if the Consulate officer isn't satisfied with something they MAY 'deny' a visa but many times they will allow rectification (say, for example, they weren't convinced the relationship was genuine due to lack of evidence, but you are allowed to provide more info). Sometimes they will not allow this. It depends entirely on the individual case and the adjudicating Officer.
Some visas are denied outright for things like criminal history - like drug convictions (any convicted crime of Moral turpitude, as defined by the regulations, can result in visa denial).

K-1 Fiance(e) Visa Process & ProceduresK1 does my son need his own visa?
If your son has his own passport he will have the K2 put in that - if not, it goes in yours. There will more forms to fill in at packet 3 stage on his behalf and he will need to have a medical - but the kids medical is very non-invasive (no x-ray, no blood drawn). Depending on your consulate he may not need to attend interview - the one in UK doesn't require kids under 14 to attend (though you can take them if you so wish).

K-1 Fiance(e) Visa Process & Procedurestravel on tourist visa after filling the petition for K1
It DOES depend on the country of origin - those of us lucky enough to be able to use the VWP get a few more breaks I think as to ease of travel - people from other countries - especially those tagged as 'high risk for illegal stay' do not enjoy the same freedoms.
OP - you might be better off posting your query in the Regional discussion thread for China and finding out what others have experienced as far as using a valid B1/B2 while K1 is under process.
The thing is you DO have immigrant intent - as you have a K1 pending - and this might be enough to deny entry; but check in the Regional area to see how many managed a successful trip.

AFAIK it is not an option for deniability based soley on being disabled / differently abled as this would constitute prejudice.
There is more than one VJ member whose foreign fiance/fiancee has disabilities and this has not proved an obstacle.
