K-1 Fiance(e) Visa Process & ProceduresJust Curious
My fiance and I are getting the last odds and ends of our packet together and are ready to send off to Vermont before the end of the month. I'm just wondering, since the increase in fees and the increase in cases being sent, has anyone here on VJ sent in, specifically to Vermont? What are your experiences as far as receipting time for the NOA1? I know in the past it's been about 2 weeks but I've heard now it's up to about a month. I was just curious as, of course, we want to get our case rolling asap. Thanks!

K-1 Fiance(e) Visa Process & ProceduresG-325A Supplements
Hi all,
My fiance and I both have supplements to our G-325A packets. (He's lived in more places than there are spaces and my employment history includes jobs and education-again not enough spaces.) Do we need to make and sign four copies of our supplements since the actual G-325A is four copies? Thanks in advance. Meg

K-1 Fiance(e) Visa Process & ProceduresForeign Birth Cert. and Police Reports
Hi everyone,
Thank you so much for continuing to answer my many questions. I know I'll always find help here at VJ.
Here's my most recent question/concern:
My fiance mailed me a copy of his birth certificate (New Zealand) and he will also be forwarding me the letters he received from the NZ and UK police departments stating that he has no records in either country. Can I stick these in with our original packet when I mail to VSC? Or should I hold them until they ask? Or does each thing go at a different time? Thanks again!!!

Hi everyone,
We've just made it as October filers, sent in the packet yesterday! Wish us luck!!!
We also have a question-my fiance is a photographer and is looking to do a photo story in Russia. He's considering waiting until he receives his K-1 visa from the London Embassy then planning the trip and traveling to Russia for several weeks, then coming to the U.S. Is this advisable? Will U.S. immigration question why he traveled to Russia after the granting of his visa, before he came here? I want him to be able to go, but neither of us want to risk the loss of his visa or denial of entry into the U.S. Has anyone else done this? I'm sure the 6 month clause, him having 6 months to enter the U.S., is in place for a reason? Any advice or experiences would be greatly appreciated!!
Thank you! Meg and Grae

They might ask about the trip but I don't know why they wouldn't accept the answer, particularly if photo stories are his business.

Thank you thank you for all your help!!
And, LisaD, he is from New Zealand originally, born there. But now he lives in the UK and he does have UK citizenship. We've requested to go through the London embassy. :-)

Hi guys smile.gif
Yes he can travel as long as he has advanced parole. Your fiance would enter the country and you guys would get married...then he applies for Adjustment of Status and at the same time, apply for the advanced parole. This takes a few months to be issued. If your fiance leaves without AP, he would be denied re-entry and you'd have to start all over again with a spousal visa.

Best of luck smile.gif

He wants to visit Russia before he enters the U.S. and before we get married. He'll already have the visa in his passport but will go to Russia prior to entering the U.S.

The number on teh back of the check will begin with EAC. Once you have that # you can sign up for status updates on USCIS website. Your NOA1 should be on its way to you now!

Thanks so much! I just signed into the uscis site and it says that they've mailed me a notice describing how I need to proceed. I never expected it to start out this quickly. Let's hope it continues this way!!

My fiance and I are on day 103 of waiting. The initial feeling of happiness is now morphed into anxiety. The waiting is killer!

I know that's what is to follow. But I keep telling Grae, "Keep your eyes on the prize!" We know it'll be worth it in the end as I'm sure you do too.

Definitely worth it!! We just happened to file at the absolute worst time ever - the end of July. Hopefully your wait won't be as long as ours! I just keep praying VSC will pick up the pace with I-129f petitions. Until then, I am just counting down the days until my next trip to England in January! (only It is 76 days, 18 hours, 9 minutes and 45 seconds until Saturday, January 19, 2008 at 9:00:00 AM (Manchester time)! laughing.gif )

Hehe, oh I understand the suspense...I'm headed to England too, in December, to see my fiance! I don't have mine down to such a science though! About a month and a half is how I look at it, biggrin.gif

This morning as I was checking my bank statement online I see that the check is already cashed. Does this mean they've opened our case and we'll be getting an NOA1? They don't cash the check if they're going to initially reject right? I've got my fingers crossed. Thanks everyone!!!

Also, I'm looking at my check online, how do I identify the number on there to sign up for the online tracking account at uscis.gov?

Hi everyone,
Sorry if this question has been asked before. I haven't been on VJ for awhile because we got our NOA1 and I'm just waiting...waiting...waiting now. But anyway, I signed onto my USCIS.gov account today and noticed that there was a date under the last updated column of 11/05/2007. Is this when I signed in last? Or does this mean someone on their end is doing something to the case, ie a touch? Just wondering.
Thanks in advance, Megan

Just administrative. Make sure that your SO knows the new address bc that is something they ask in the interview. I would advise that if you move after you have your interview date, to wait until after the interview. Makes things a little easier during the interview. Unless you can prepare your SO with the new address and then there is no cunfusion. I hope that made sense.

Thanks for your response. The move will be based on a job I have accepted so I won't have much control over when I move. They'll tell me a start date and tell me to be there basically. Thank you for the information-all good to know! smile.gif

My husband applied for the six month visa also from the UK to come here and of course denied even thou we had not filed any papers yet. We totally understand why he could not come here aka strong ties to the USA - but when he asked them if he could do the VWP they said sure but make sure you check the box that states VISA was denied and after speaking with a good friend in charge of customs at JFK - he said this" You stand a 99% chance of him being sent back period. So we opted not to even try. If you do try make sure that you check that box.

Cheers and gl

Thank you Susie. This is kind of what I am expecting but as long as it does not affect the K1 visa then I am going to give it a go through Canada so that I can at least see her there if I can not cross the border. Could you ask you JFK friend if this is the case for me?

Thanks again

I too am awaiting my divorce to be final here in the States. My SO is from New Zealand and had travelled back and forth on the vwp several times throught the past year and a half so that we could spend time together as I worked out my own mess. On his last attempt to enter he was turned away at the POE and told he would have to wait for the K1.

You could file for a waiver or a new visa but that takes time too and even then it's still up to the CBP at the POE who will already know about you in the system. You could get lucky but that's alot of money and emotion to put on the line.

I'm sorry. sad.gif I know just how difficult this is. We will need to wait until April to even begin the K1 process to get Russell home.

Best of luck to you.

Thank you Kim. Good luck to you as well. I am going to stay up in Canada and try to cross the border under the vwp there. If I get denied they send me back to Canada so at least my fiancée can come and see me and I have relatives there so not all hope for spending time together is lost.

K-1 Fiance(e) Visa Process & Proceduresvwp travel after visa denial
Hi all

I am a newbie here and need to know an answer to my question below.
I applied for a tourist visa as my and my fiancee are still waiting for her divorce to go through before we can apply for a K1 and I got denied under 214b. I think this was because I was open and honest about wanting to spend time with her before we started the K1 process. Now my question is can I enter the US under the waiver program? I have asked the London Consulate who said I could try but on the 194w waiver it states that if you have been refused a visa you need to go to the embassy and get one? This is so confusing to me and my fiancee as obviously we want to be together but do not want to affect our K1 when we start the process. please helpsmilie.gif as mife without her is awful sad.gif

As a lot of others have said it is best to do the double wedding thing IMHO as this way you can make sure that there are no mistakes made and thus you would have to endure the heartache of being apart again as well as the risk of getting denied when you reapply.

You have been the biggest help to me I am indebted to your kindness and time!!!
Okay I have no boarding pass but I do have my passport stamped so I can photocopy that! Otherwise I have a hotel receipt but one that concludes only in my name.. I bought biscuits and chocolates for my better other half and I have that as a receipt and I even have a receipt of the BK meal I had before boarding back to London...... I also have car rental receipt for my last trip. Is this sufficient??

As long as you have stuff bought in the same area on the same day then that should suffice. Lets say you were together in Niagara, if you have a receipt for dinner and he has one for lunch it shows you are in the same area at the same time. I think some pictures of the 2 of you together would help as well.
I like you are just starting ( or planning to start ) the K1 process and this site is superb for helping.
I have also found a calling number from the uk that only costs 1p a minute to US land and cell phones if that helps with your expenses. It does not show on your phone bill as you calling a specific number but if your other half has phone records that show the times you called are times he was not making calls then you will be fine.

MY better half is like me in that we are not happy the process takes so long but even more unhappy that we have to be apart through the whole process. I wish they would bring out a visa that allows you to stay with your OH while the process is in place and it is one that you cannot marry on thus stopping the USCIS worries about just getting married. We will get there though as the outcome is to be a beautiful life together and that is all that matters smile.gif

You can try but odds are if you are there all the time they will stop you at the border. That is what happened to me although I was denied a visa instead of getting stopped at the border. I guess it is just luck if you manage to stay in the us while the process is ongoing. I am sure every single one of us would stay with our loved ones if we were allowed but alas that is not the case for most of us, leaving us with heartache and anguish at months apart sad.gif

Sorry I could not be more cheery. I guess if Canadians get 6 months visiting rights you could just about manage it if you are lucky with your processing times.

When you enter Canada under VWp you get stamped for 6 months from the uk I believe. If this is the case can you leave and come back under the same visa or do you get a new one everytime?
Also, Toronto international has an American POE from what I have read. Can I use this to try and get a VWP or is it best to cross at the border with proof of ties etc? The last thing I want to do is get turned away and sent back to the UK when I can stay in Canada if I do not get across th border.
