Well I am sorry to tell you that your wait is not uncommon and should be expected to wait a while.  I have been waiting 5 months since I got my reciept.  Perhaps you might want to consider doing a K-3 visa for your spouse which has a 5 month waiting period instead of a year or more for the I -130.

Hi All,

I actually bank with USAA here in the US already.  However I am still living abroad with my husband in Morocco as we met during my Peace Corps service in Morocco 2011 -2013 and I stayed in Morocco after my service ended.

 

I would have to call them from Morocco as I can't add my husband to my account.  I looked into setting up his own account - it also requires a phone call.

 

I guess we will just pay the $165 once we are back in the US!

Wait until your husband gets back. He doesn't have a bank account set up? How was he able to pay the AOS and IV fee than? You needed a bank account for that.

Both the AOS and IV fees don't have to be paid online - you can send a check into the NVC via snail mail.  I paid for my husbands fees using my personal checking account.

Alien registration number change related to I-130 March 10
Called USCIS and been told same thing , that my case is in processing time frame , nothing else he knows
Suggested to do info pass to Local CSC
Will wait till next week and do that
Anybody did info pass ? Reason in my case? And do You guys think it will help me to find out whats going on ?

I have experianced something similiar - we got an email our Alien number changed and 22 days later we got approval.  SO.. don't give up hope.  There is movement and someone is looking at your case!

We just got our email notice that they APPROVED our I -130!!

They technically approved it March 13th although I just got the email today at 2:45pm - Moroccan time.

 

It took use 198 days = 6.6 months to get this approval.

 

There is hope!

My husband and I also filed in August for our I 130.  We recently got transfered from the National Benefit Center to the California Center this past week.  I now have gotten two emails from USCIS saying " February 24, 2014, your Alien Registration Number was changed relating to your I 130."  Is this good news?

Bring several copies of your original birth certificate

Passport (get this notorized at the embassy) get a couple of copies

FBI and State Background Check

You might also need a certificate of residency -from the local police in Algeria... as I needed one in Morocco but not sure about Algeria.

 

You may need documents translated in order to get married - and it will be important during the visa process that you have used an embassy certified translator for any documents not in English - and that you get a statement stating they a certified translator from which ever translator you use -

Second hire an attorney to write your marriage contract - this way it will hold up in Algeria in case you may need a divorce (note this isn't me second guessing you or your husband's intentions - this is me saying Allah is the best of planners and we never know what might happen in the future so its best to prepare for the worse case)

I would suggest your fiance if she would consider giving birth in Morocco look into either birthing at Sheikh Zaid Hospital.  There are some Facebook groups she could join for English speaking women in Morocco as well.

 

I have personally seen in Rabat before I got pregnant- She delievers babies at Clinic Agdal in Agdal Rabat  - She is highly qualified and highly recommended her English is passible and she is more comfortable in French or Darija.

I am also pregnant 14 weeks 6 days as of this post. I live in Morocco with my husband.   My husband and I are at the NVC - inshaAllah awaiting a case complete.

I can only speak to the fact that in the MENA region - AP -administrative processing takes much longer than for couples going through the visa process in Europe or Latin America.  AP is when they finally get Homeland Security involved as USCIS has been absorbed under that umbrella so to speak to do the background checks on the individuals who have been interviewed.

 

From talking to couples both here on the visa journey website and the visa journey Facebook group - depending on the security situation in the given country, if that country is home to groups deemed terrorist organization, if that country is unofficially on the Homeland Security black list for visas based on terrorism threat assessment - AP can go from a month to years.

 

I suggest you contact once AP goes over a month - your congressional representative, CAIR - Council on American Islamic Relations and the ACLU for further legal advice and aid for your case.  Your congressional representative can request further information and put pressure on the Consulate, State Dept and Homeland Security to hurry the background check up.  CAIR can advise you on your rights and lawyers that can help and ACLU could perhaps take your case for free.

Your first step is to contact the US consulate in Casablanca and ask for the reason you were given a 221g.

 

Once you know the reason you can prepare more evidence or if its based on the income requirement - then either get a co sponsor or work to find a job that would give you an income that meets the 120% that the consular visa officer at the interview based on their personal choice can enforce.

 

Yes I highly recommend in such a situation - getting an immigration lawyer well versed in 221g cases.  I recommend calling your local ACLU office (http://www.aclu-nca.org/ )and your local CAIR office for local recommendations.

My husband's case expedite request was approved on 9/16/2014.  His case was shipped out on 9/17/2014 and I called NVC to follow up today and the supervisor I spoke to said that she could see my husband's case had been entered into the Casablanca Consulates data base.  

 

I checked the ceac website for my husband's case status it said "Ready."

 

So I followed up with an email to IVCasablanca@state.gov

 

The Casablanca Consulate replied with "Thank you for your email inquiry. This office has not yet received the petition you filed on behalf of your spouse.  Usually immigrant visa cases are scheduled by the National Visa Center (NVC) in the United States.  We only receive files at this office after the interview has been scheduled and a packet mailed to the applicant. "

 

I want to know is this unusual?  Especially given an NVC supervisor has seen that my husband's case has been entered into the Casablanca Consulate's data base??

 

Is there an extension or direct number I can call the Casablanca consulate to follow up with them about my husbands case?

So first who ever is the Moroccan citizen in the relationship should go to the local courts and get a list that they have of all the documents needed for a "mixed marriage."

 

I married my husband in Taza and the list my husband got was completely different from the list my friends husband in Ben Guerir got from the courts.

 

Your American Spouse to be will want to get the following documents -

State Police Background Check - *note that if the state police background check does NOT have the embossed seal that he/ or she should ask for a document or note explaining why it no longer has the embossed seal on the document

FBI Background Check -*same deal with the embossed seal - if it comes with a note bring that along and make sure that is translated into Arabic by the translator you choose from the list on the US Consulate in Casablanca's list online.

Original Birth Certificate or New Certified Copy

Any documents not in Arabic will need to be translated - make sure to use a translator from this list from the US Consulate - so when you start the IR/CRI visa process - you can get the letter of certification for all the translations and reuse them - so you don't pay again to retranslate the documents with the right translator later

Notwithstanding both Algeria and Morocco's reputation for being high fraud consulates (with Morocco pipping Algeria for the crown between those two), it's rather judgmental and condescending to "caution" someone about her beloved, especially couched in language that essentially infers that since you met your husband in person, that's somehow... better? There are more than a few solid couples who met on the internet and are still going strong, even in MENA. 

 

The Maven,  You can feel its judgemental and condescending all you want.  The POINT I am making is that she need to not just having a chat based relationship - if said relationship is heading towards marriage - then she needs to A. Meet the Person face to face more than one time  and then move on to evaluating if this is a real marriage prospect for her.  As you don't know my personal history - let me clue you in - I have tried the online marriage websites - everything from Single Muslim, Half Our Deen to Muslima .com -- and its completely the same but different for Muslims than it is for non Muslims.

 

There is a cultural and religious subtext that you may or may not be aware of as someone who is married to an individual from the UK where the most popular baby name is Mohammed.

 

So I don't really care that you feel what I am saying is judgemental - I am being completely honest with her about A what she can do to make sure this guy is 100% on the up and up and B. What she needs to be prepared for when it comes to doing the IR/CR1 visa process in the North African region. 

 

Its not as easy as the London Embassy/Consulate - its much longer and more difficult especially post 9/11 with Homeland Security absorbing USCIS and other branches use to be independent functioning parts of the immigration process.

So first things first - I will caution you to relationships started over the internet.  This may be hard for you to hear since you are in the first blush of the relationship.  The embassy and consulate are going to be closely looking at your relationship because Algeria is a HIGH visa fraud country as is Morocco - where my husband and I met and currently live.  

 

The man you are currently interested in should do all the work if he is so interested in getting married to you.  He should be asking local court officials what paperwork you would need etc  They should give him a list and an idea of how much he will have to pay the local judge for the marriage contract.

 

I would personal suggest drawing up your conditions for marriage with a lawyer in the US and then get a lawyer in Algeria to legalize and submit everything with your marriage contract to the court you get married through - so items such as custody of future children, a clause about parental abduction is included  and your freedom of movement in and outside the country is covered (all just in case better safe than sorry parts of the conditions)  I wouldnt suggest it unless I personally had a friend who went through such a thing with an ex husband who is Algerian.

 

I can tell you what paperwork I needed to get married in Morocco - and you will need to get these documents translated into Arabic for the courts and judges.

 

Birth Certificate

Passport

FBI Background Check

State Background Check

Paperwork from the US Consulate in Casablanca - you in Algiers - stating you are free to marry

Medical Report - stating I am AIDS/HIV Free

Some judges will also want a pregnancy test done.

Legal background check done by the Ministry of Justice in Rabat, Morocco

*Note if any paperwork doesn't have an official seal - it should come with a paper stating why its not embossed with the seal

 

You need to seriously consider making several trips to Algeria before marriage to make sure this person's intentions are pure and get to know his family, friends, neighbors etc.  Especially if your planning on doing a IR/CR1 visa for your future husband in order to establish this is a REAL relationship and have enough history that it does NOT look like a visa fraud case.

 

InshaAllah everything will work out.  Pray Isthkhara before every action moving forward with this man.

Hi!

Actually I know of two friends who had children during the process or their spouse was pregnant during the process - for each of them it sped up the process - especially since one of them sent in sonogram photos with their i 130 petition and the other send photos in of the baby when they got asked for more evidence.

 

In each of these cases it was the wife - a US Citizen who was pregnant!

 

I hope this lessens your worries  and congrats on your pending bundle of joy!

Asalaam alaikum!

 

So the US Egyptian Consulate Website says -

Translations (Foreign Language Documents)
A consular officer may provide notarial services to non-English speaking applicants. However, the officer must be able to understand the document in question. Translations of a foreign language text should be provided by the applicant. If the consul is not comfortable providing the service, s/he will decline and direct the person to a local notary or foreign consul who can communicate in the same language.

 

For the consular officer to notarize an affidavit of a translation, the translator must appear with photo identification.

 

See the attached file from the US Egyptian Consulate for their recommended translators on this response.  Some of them may allow your to scan and email the document - then your spouse could go pay and pick up the translation - then scan and email it back to you. 

 

However I dont think thats needed because according to the I -130 instructions - "Any foriegn language document must be accompanied by a full English translaton that the translator has certified complete and correct, and by the translator's certification that he or she is competent to translate the foreign language into English."

 

In your case - I would submit with the I -130 a copy of your original marriage certificate and a copy of the translation - it doesnt need to be certified by the US Embassy to be used for the I -130 or the I -129F.

Excellent advice.  I know in Morocco that several people who have posted about the interview have stated that they ask where the spouse is and if they are nearby - say in the cafe across the street- they get called into the interview. :)

They might also want statements from people who know the couple that its a real marriage.  So ask people who know them well for example people who attended the wedding, knew of their courtship etc.. to write letters, get them legalized etc and send those in with the RFE

So it breaks down like this -  According to US Federal Poverty Guidelines 

 

If its just you and your wife in your household - you are NOT supporting anyone else- You count as a 2 person household.

 

According to the Federal Poverty Guidelines  you need to make at least the following -

100% -$ 15,730 a year

 

The NVC and consulate will can require that you make an income of at LEAST 120% of the Federal Income Guidelines which for a household of two is $18,876.00.

 

Because you have currently been unemployed for the last three months I would advise you to find a co sponsor for your Affidavit of Support packet.

Why am I saying this?  Because you might have your AOS packet go through the NVC only to have you wife denied the visa at the consulate based on the choice of the consulate officer who can hold you to the 120% income guideline.

 

If they don't deny your wife's visa outright they might give you a 221g - which basically puts you in visa limbo.

 

I hope this is helpful and I highly recommend you getting a co sponsor to ensure your wife is not denied or given a 221g based on lack of ability to support her.

90 days before your 2 year green card anniversary not wedding anniversary. When he receives and receives his green card the expiry date will be on it.  So you arrive November you would be filing 21 months from that date.

Can I suggest why not arrive in US after your wedding anniversary. He will get a 10 year green card and no removal of conditions.

Thats a great suggestion.  Only problem I am pregnant and the medical care here in Morocco is horrible where we live and we can't afford to commute every month to a larger city to see a OB/GYN.  I really would prefer to give birth back in my state with my mom and in my home country the USA - where everyone speaks my language - English!  I have heard to many horror stories of botched births here in Morocco from women I know personally or through a mutual friend to trust giving birth in Morocco with my husbands and I's first baby!

 

My husband agrees with me as he works as a fire fighter here and knows the state of the medical system is ok to crappy at best.

 

Thank you again for that suggestion - we would do if we weren't pregnant :)

 

Do you know if we can file to remove conditions early??  Like once my husband gets his green card?

Hi All!

 

So my husband has his interview on 10/10/2014.  However we won't fly back to the US until late November/ early December most likely after the interview date.  My husband has to wrap up leaving his government job here in Morocco, sell items from our apartment and move in to my in laws pack etc before we leave.

 

Our anniversary is 3/8/13 and if we fly back in early December - we will no longer have time to file as USCIS in the instructions demands we file for removal of green card conditions 90 days BEFORE the second wedding anniversary and that means filing before December 8th 2014.

 

Advice, suggestions, tips??

 

Not sure as to a solution for this problem.

Lines open at 7am NY time /East Coast time.   If the lines are busy keep calling back!

 

I start calling at 7am NY time from Morocco which is 12 pm noon here in Morocco.

 

I average a wait time of once I get through between 25 - 40 minutes on hold.

 

I always request to speak to a supervisor as the NVC normal staff have told me all sorts of misinformation when I was dealing with them.

 

I also always take notes of the wait time, what representative I talked to, name of the supervisor I got transferred to and the questions that I asked and the answers to those questions.  So if the call gets dropped - I can say I was speaking to X person when I called .. can I please speak to them again ??

 

I also was super nice and polite  to every person I spoke with regardless of how much I wanted to throat punch them through the phone at times.
