Why are you making this harder than it is? You answer the question as posed: Has your Finace(e) ever been in the US? Yes or No. If she has ever visited the US the answer is yes. If she has never set foot in the US then the answer is no. Do not worry, they will get the other information when you complete the G-325A form for her. What ever you do, do not over think the application form or it will drive you crazy.

UPDATE UPDATE UPDATE!!!

My daughter called the border agent's supervisor to find out what happened and to file a complaint about the agent's rudeness (she was very nice about it).

Surprisingly, they were professional enough to take a second look at the case. A second agent called me to find out our filing information and case status, etc. Luckily, when my fiance left his job in Greenland, it was just on a leave of absence status, and that's what saved him in the end - I think.

I believe the first agent was intimidating and not patient with answers or lack of understanding on his part. But the 2nd agent called and not only was very nice, but also said he couldn't understand why it was denied in the first place. He asked me lots of questions, and it appears they asked both of us the same questions.

But in the end they allowed him entry! Not in time for any flights out tonight, but we'll take that and find the first flight out in the morning. What a day!

We got lucky with this one and we won't push our luck again. But the lesson for everyone else here is maybe to try one more approach if anyone ever gets denied at the POE.

Is getting married in the US important to you?  Because a spousal visa is more elegant and cheaper and the immigrant can work right away, whereas with the K-1 visa the immigrant can't work for at least 3 months.  You could get married now (anywhere in the world) and then chase a spousal visa.  Something to consider.

 

It's fine that the USC lives abroad, but she will need a co-sponsor based in the US and might have to show her concrete plans to move back to the US.

What to send to your fiance(e) once the I-129F is approved (Receive NOA2): 

 

1. A copy of the entire I-129F package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).

2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.

3. Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).

4. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.

5. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.

6. A copy of the NOA2 that you received in the mail.

7. Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

Once we marry I intend to apply for permanent resident status in the U.S., with a view to moving at the end of my contract in June. If we have to marry in January when I need to be in the U.S., am I able to apply for permanent residence status immediately, then leave the country so I can complete my work? Or would leaving after entering mean that we would have to start the whole process from scratch with regards to getting permanent residency? Would having a fiance visa in this case aid the process at all, or would it all have been a waste of time? So basically, the situation would be, we marry in January and I have to leave to finish working--what is the best road to take at that point to secure permanent residency, what would I need to do?

 

The next question is linked--if I can't apply for permanent residency while completing my contract in London, what would I need to do when I arrive in the U.S. at the end of June? Would the stuff that I've done for the fiance visa help me at all? For instance, on landing in June, if I am already married to my fiance, having entered on a fiance visa in January, could I apply for the dispensation to start working immediately?

 

 

 

You CAN NOT enter the country on a K-1 when you are married, the K-1 visa will be glued into your passport and as far as I know you use it the next time that you enter the US. 

 

When you enter on a K-1 get married and AOS you also need to apply for an AP which can take up to 3 months to get approved, if you leave without you can not reenter.

It does not matter who writes the needed information, as long as he signs where he needs to sign and so do you.

 

If he is really bad at keeping paper, just remember that critical mailings like the NOA will be sent to him.  So go to the USCIS website and sign up for email notifications and give them your email address.  That way when critical paper is about to be mailed, you will know about it and can follow up with him to make sure he gets it, send you a copy, and keeps the original in a safe place.

 

 

Really good advise because you will need those form later in the process!

From the guides above,

 

1. Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.
 
2. Color Photo's of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a local photo store such as Walgreens (if at all possible) or if not on a high quality printer. Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back.
 
3. The following items will not typically show proof of having met in the last two years however will show proof of an ongoing relationship: Copies of land line and cell phone bills, appropriate letters and emails, stamps on the letters (to document the date they were sent), and other written documentary proof. For the Consulate in Amsterdam they will mail you the method of payment, you will need to transfer the money to a ABN-AMRO account.

 

I used internet banking and printed a screen shot of the payment as proof of payment to the interview.

What to send your fiance once the I-129F is approved:

(B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available) 
© If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern 
(D) List containing serial numbers and denominations of bonds and name of record owner(s). 

Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form.






 

6. A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well)

Do you expect any issues with your petition, do you have any red flags? If not save yourself a lot of hassle and postage money. Front-loading is required/recommended in high fraud and countries with worse economic situation which Germany is far from that.
Normally you only need to write down a simple statement when filling I-129f about how you met in the last 2 years and support it with evidence like boarding passes, copies of all passport pages showing entry stamps, few pictures.
A lot of vj users statement is short enough that it fits in the space provided on the form and go smoothly through the process.

They approve after the medical and interview, what would be the point of the interview and medical if they did before?

 

I don't know about London but in Amsterdam there is a week in between the two.

After approval I received my visa within 4 days and booked my one way ticket the next day no problems. 

 

If you book before your interview be prepared for a disappointment, even the consulate tells you not to book anything or quit your job until visa is in your hands.
