K-1 Fiance(e) Visa Process & ProceduresImmigration service

Since this is primarily a 'Do-It-Yourself' site, I would daresay that most of the folks here refrain from retaining the services of an immigration lawyer or legal service. There are those that have initially retained legal counsel and then have cancelled their services. If your immigration issues are complex or too involved for your comfort, you are advised to retain appropriate legal counsel.

YMMV,

Good luck on your visa journey.

Totally agree, if you have no complicated issues you can do it yourself and use the money for a beautiful weddingPosted Image

K-1 Fiance(e) Visa Process & ProceduresWhat to Expect When Entering US

At POE they will take the sealed envelope and look inside to make sure all of the papers are in order. They may ask a few questions and they will take fingerprints. My husband arrived in Boston a few weeks ago, it took him 10 minutes to get through immigration, it was easy and painless. Good luck!!!

Agree with above, make sure that they staple the I-94 in her passport you will need it during the rest of your proces

K-1 Fiance(e) Visa Process & Proceduresnot sure if this is noa 2

Caps lock = shouting...no need to shout at us. :)

The "NOA2" is just VisaJourney vernacular. The petition approval notice is mailed to the petitioner from the USCIS and would have I-797 on it. You can see an example in the gallery: http://www.visajourn...p_display_media

If you haven't received that petition approval/I-797 document, contact the USCIS on Tuesday (Monday is a federal holiday) to confirm your mailing address and to see what happened. You'll need that document for adjustment of status.

K-1 Fiance(e) Visa Process & ProceduresCorrection
You will need form I-134 form I864 is for the AOS, http://www.visajourn...content/k1guide and http://www.uscis.gov.../i-134instr.pdf

What to send to your fiance(e) once the I-129F is approved (Receive NOA2):

1.A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).
2.Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.
3.Send an original letter affirming your desire to marry your fiance(e) and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
4.I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
5.You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.
6.A copy of the NOA2 that you received in the mail.
7.Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).

Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

On getting the marriage license, it will depend on where you're getting married. The K-1 visa itself is only for allowing you in the country.

You can click on the "Find a County" link in my signature and then look up the marriage license information for specifically where you plan to marry as the requirements vary by state and even by county within a state. Good luck!

You can either get your vaccines done again, or get your titres done, which is a blood test that looks for the anti-bodies in your blood against those diseases. Just take a look at the vaccine requirements for the Netherlands embassy. More than likely you'll have to get your TDap shot anyway.

You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

NOTE: Tip Regarding Vaccination Records

The K-1/2 beneficiary will be required by the embassy to have a "medical" done prior to the visa interview. Part of this interview will require that previous vaccinations are documented and potentiallyadditional required vaccinations performed. Once this is complete the doctor will note this on a DS-3025 form that will be sent to the embassy. During the medical appointment request an official copy of the vaccination records from the physician (or a copy of the completed DS-3025 if they will give it to you) as this will be helpful to have on hand in the future (specifically it can be helpful when filing for Adjustment of Status if your DS-3025 form is not available).

K-1 Fiance(e) Visa Process & ProceduresVisiting the USA while I-129F is pending

You'll be fine. Bring evidence in case they ask for it, but you probably won't need it. Don't volunteer any information unless they ask. I visited while my I-129f was pending, as have many others, I brought what evidence I had (basically all I had was the NOA1), they didn't ask to see it, they asked me what I was doing in the US (visiting my fiance) and how long I was staying (6 weeks), no problem whatsoever.

K-1 Fiance(e) Visa Process & ProceduresBuy your ticket before the interview..

It doesn't affect the decision but it could certainly hurt your pocketbook as you don't know the result of the interview or how long it will take to get the visa in hand.

We have seen time and again on VJ, people in a panic because of wedding plans, flights, whatever.

K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support I-864, worried about finances

No, every embassy is the same and you have to make 18,912 or more to be able to sponsor him. Assuming it's only you and him than thats how much you have to make..For k-1 visa they dont use the I-864 they use the I-134. Why dont you just find a part time job you can always combine the income. you make 14k for the other job and than find another job that you can make 5 to 6k to meet the poverty guideline.. Good luck dear!!

K-1 Fiance(e) Visa Process & ProceduresQuestion about medical.

As far as I know, the consulate sends you to specific doctors that are somehow "authorized" to perform medicals for K-1 or other types of visas.
So when the time comes, you should expect a letter guiding you where to go and how to book the exams.

Someone correct me if I'm wrong.

I've heard they've been returning the baggies with pictures in them. It is best to scan them and/or print them out on paper 2-4 a page labelled.

what i want to do is: have our pictures glued on a sheet of bondpaper (like 2 pictures each page) then have the labels below each picture.

K-1 Fiance(e) Visa Process & ProceduresK-1 petition denied

Because they were right to deny the petition. You would be appealing whether the reason they gave you was correct. Since it was, you'll lose the appeal AND the time. You could only win the appeal if you can show compelling evidence that you actually DID send all the required supporting documentation.

This ain't my first rodeo. Same goes for the others telling you to skip the appeal and file again. We see this frequently. Time to bite the bullet.

Just to be clear, you aren't appealing whether you qualify to have a petition approved. You're only appealing whether you filed what you were supposed to file. You didn't, so you lose.

Taxes and paystubs should be fine if you have enough of them. We never used a letter from work, just taxes paystubs and w2.

If your income meets the requirement it shouldn't be a problem, but if its very close to the line of not meeting it then you may want the letter as added proof.

Take also your last few paystubs to verify your employment if the letter is an issue

K-1 Fiance(e) Visa Process & ProceduresIs a K-1 Fiance Visa Lawyer a waste of time?

The I-129f is TWO pieces of paper (2) plus a G-325a. It is all personal information you know off the top of your head and some copies of documents you have in your desk drawer. What on earth would a lawyer DO?

College applications are FAR more difficult and those are completed all the time by high school students not even old enough to get married.

A job application for Home Depot is more complex than an I-129f. Requires a background check and a drug test, in addition to at least TWO interviews. Who hires an attorney for that?
