i am referring to the i-129f packet, it states that if you use your passport instead of your birth certificate for proof of citizenship that it must have a validity of at least 5 years.

I am having trouble comprehending what it means by "Validity of atleast 5 years" , does this mean it was valid for atleast 5 years when it was issued, IE, I got it in 2002 and it expires in 2012, or does this mean that it had a life time of atleast 5 years, in this case mine had 10 years.

Someone please clarify.

From what I've read/heard here the process is the same for non-military petitioners - including processing times - unless you are immediately deploying to a combat zone or something along those lines. Yes I haven't seen anything that says its any faster for military, I know there is a military only phone number to call USCIS, but I don't think they expedite except for what you said, if I was deploying.

For now --(and I stand corrected ) --you can put your parents address , then after you get an apartment off post --you can update your current address .I suggest getting an apt off post (unless if you are in basic training ) .Fron your initial petition to NOA2 approval will be withing 1-2 mths since you are active duty --lol . So I suggest you start making preparations .Good luck on your journey .

Hi I have a question about the I-129F, Question number 14.

"Where does your fiance(e) intent to live in the United States?"

Here is my dilemma, I am currently on active duty in the US Army and I reside in on post quarters. Obviously once I am married my fiance(e) cannot live there with me, as it is for single soldiers only, my dilemma is that I do not currently have an apartment, and I will not until she is here and we are married, because thats how the Army operates. So how would I answer this question, since I do not currently have the answer, and I will not before I would submit the form.

Any help is appreciated, thanks.

I printed out two photos per page, and included below each one the date, location, and a brief blurb explaining what the picture is and who is in it. It doesn't seem to be an issue to use photos on paper rather than printed on photo-paper.

Keep in mind that photos are considered secondary evidence. Make sure you have boarding passes/passport stamps and other information to prove that you've met in the 2-years.

So I received my NOA2 hard copy about a week ago, and it says on the NOA2 that the petition was sent directly to the consulate, which in my case would be the Embassy in the Philippines. Now I'm confuse I thought we had to get the letter from NVC before we go to the Embassy. We can actually go directly to our Embassy and inquire or possibly get our case moving faster. In the NOA2 it does say in the bottom that the case is moving to NVC or Embassy. Can't that be possible. Does anyone know.

What we did was call NVC everyday until I knew they mailed it out, then you can go pay your fee for the embassy. And make your appointment, most embassys have the instructions needed for the K1 interview on their website (like what to bring, what forms, where to do medical)

So you can just download the instructions, and follow them, all you need in Philippines for medical is the Interview Appointment Letter (which is emailed to you) and thats also all you need to get into the embassy on your appointment day, just make sure NVC has mailed the petition, the embassy will most likely have it within 10 days of NVC mailing it, but you don't actually have to wait on the embassy to mail you stuff.

It seems NVC is very back logged on sending out the notice that they received the petition from USCIS.

My fiancee has already gone to the embassy and been approved for her visa, and I still have not received anything from USCIS, I did call them, and they had my case 10 days after NOA2, but I never received the hard copy they said they mailed to me.

Also, sometimes USCIS send the petition directly to the consulate (Embassy) , make sure you read the NOA2 carefully.

All couples argue.  Sometimes it goes a little further than is ideal.  The fact that your wife  chose to stay with you and improve your marriage should count for something.

As Darnell says ... apply for RoC.  You may be asked some questions, separately or together, regarding the offence but I think you may be worrying needlessly.  Best of luck to you both.

Have you received a letter confirming receipt of your I-751 package? 

Although the green card itself expires on 11/20, your residence is extended with the NOA letter + the expired card.   Make sure that you have received the NOA and that you take copies of it.  Keep the original safe at home  (take it to show to anyone who needs proof, like an employer) and carry around a copy.

If you haven't received the NOA but you applied for the RoC in August, you should call the local USCIS office and make an Infopass appointment so they can get a duplicate out to you before your card's expiry date.

Removing Conditions on Residency General DiscussionInterview coming, we're sepparated, need an advice.

Tell the truth.   Marriages fail for many reasons, not only distance.  USCIS understands this and allows someone who has built a home and a career in the US to remove conditions on their own, but it has slightly different requirements. 

Instead of proving that you HAVE a valid marriage that satisfies the requirements of RoC, you have to prove that you HAD one.  If your separated spouse attends the interview with you, and you take supporting documentation that you were genuinely married and did things together, shared property, bank account and bills, proof of visits in both directions it doesn't really matter that you lived apart because of education/employment in different states.  There are many people who do this, just like you.

The onus is to prove that you didn't immigrate on a marriage visa without having a genuine relationship.   You are entitled to remove conditions on your own, based on that premise.   They will extend the valid period on your temporary green card (normally with a letter, the same as your AoS) and put you into a "pending" mode while you arrange the divorce.  Once the divorce is final, you submit your paperwork to remove the conditions and you're done for 10 years (or 5 if you go for citizenship).

It's an unhealthy relationship for both of you.   Time to cut your losses and walk away knowing that you've tried to get her to get help and you've tried to get her to join you in saving the relationship with the help of experts.

She cannot get you deported at this stage.  Divorce her, file RoC with divorce pending and move on with your life.   If she requests a meeting with you, make sure you take a witness with you or have her meet you in a public place for YOUR safety.
 


When you love someone you don't play games with their emotions, you don't score points and take revenge, you don't threaten them and you don't abuse them.  She's unwilling to take responsibility for herself and you cannot build a relationship with a person in this mental state.

If your baby is 7 months old and you don't want to reside in the US until s/he is ready for school, then you don't want to spend money on a green card at this stage.  The whole point of the green card (more appropriately named as a Lawful Permanent RESIDENT card).    It's not something you get for future use somewhere many years ahead.

apparently now *some* people get a second NOA receipt number that can be individually tracked online. It's the one with a header CRI89 , CONDITIONAL RESIDENCE I-89 CARD RECEIVED AT SERVICE CENTER which leads ME to believe that that is the card order form, and this is a new entry in the process--we didn't get to hear about the card order before. Some folks are asked to send in their biometric info *before* approval, and they are the ones who get this email.

You still can't check your initial submission number.



I noticed that the original NOA case number comes up invalid on a search, but the biometrics notice letter has an EAC reference which happily brings up the status, pointing to a CRI-89 application for removal of conditions.

Six years down the line from the K1 process, let me share a tip with you.

If you're planning on spending the rest of your life with this person who lives in America, spend time building and mending relationships in your life at the moment.   Once you make the move, it's incredibly easy to lose touch, to feel homesick and lonely, even when you're with the one person who makes you feel whole.

Trust me ... take the time to enjoy the family and friends that you have NOW.  Planning for tomorrow is great, knowing how the process works before and after you arrive in the US is even better, but the best thing is building a lot of memories of the loved ones that you are going to see much less of once that visa is in your hands.

Best of luck in your process, but please don't wish your life away.  The time will come.  :)

In 10 months time when you're with your husband you'll be crying over missing the people back in your home country.  Trust me, once you have left home you will suddenly realise just how much family and friends mean to you.

Instead of being miserable about being apart, go visit your friends and family.  Take a camera, a notebook, something to record video snaps of your everyday lives together so that when you do arrive in America you have them to watch and enjoy, because it will probably be at least a year before you see them again.  Start planning what items you can't take with you are going to which people.  Think about what you want to do for employment, for hobbies and social life in America and start researching your new home town in the US.  Don't just sit there and drown in self-pity, that won't help the time pass any faster.


We've all been through the separation issue and it sucks, but there's no reason to drown in sorrow at both ends of the immigration process.

A green card is a resident's card. For that you need to maintain residence in the US.

Check out the timelines for the various processes involved, and I think it will give you a better idea of what your future plans could/should look like, in order to make your joint future a lot less troublesome moving between two countries.

AOS - is done immediately after marriage. This is the green card application that confirms you have fulfilled the terms of your fiancee visa and married within the 90 days allotted after entry. This results in a resident's card (green card) being issued for 2 years, but it has conditions.

ROC - applied for 90-days short of 2 years of issue of the conditional resident's card. Once this is approved, a 10 year resident's (green) card is issued. While many people believe they can move between another country and the US freely with this, it is still necessary that a permanent residence is maintained (and lived in) for a significant portion of the year in order to maintain residency, otherwise it can be considered abandoned by USCIS.

Naturalization - the process of becoming a US citizen. This can be applied for after 3 continuous years of marriage, provided the residency requirement has been met. Only once an LPR has been naturalized can they apply for a US passport.

You might want to check what period of absence qualifies as abandonment of LPR status. Couple of links from reputable websites are:-

If you intend leaving before your then-wife gets her citizenship, you may end up choosing to file for a multi-entry visitor visa for trips to visit family here in the US if you reside abroad.

In Hawaii, the person who registers the marriage is the one who conducted it. This is why it can take forever to get registered. While you have no choice but to wait until the original arrives, you can order copies of the marriage certificate with an expedite and collect them in person as soon as the marriage has been registered. From memory, there is a form you fill in (giving your contact information) and they will call or email when that has happened so you can toodle down to the office and pick them up. You'll almost certainly want extra copies to notify various departments, so this works out pretty well.
