What happened to you was horrible and it's made you view the world in a different way. Moving away from all he knew has made hubby view his world in a different way. Sadly, because you are both trying to cope with fear, loss and change at the same time you've come up against a wall of "I need this, please!" and "Sure, sure, but I need THIS instead" and while you're both expressing your honest feelings, neither of you are moving to fix the problems because you're focused on your own needs as individuals.

Allow me to be a little blunt (and please don't think I'm being cruel, I hope to help you!) and say that you need to take control of your sense of security again, for yourself, not simply focus that onto your husband. It's a burden that he can't really take on board on top of his own feelings. I know it's incredibly hard to get down to resolving it without someone you thought you could absolutely 100% rely on but ultimately you need to get past your fear or it's going to dictate your entire future. Nobody else can restore your sense of security (well, unless you have the entire military camped out in your front and back yards, right? wink.gif ).

Have you had any counselling for anxiety and fear? Joined a self-defence class that will teach you how to be aware of your environment without viewing everyone as a potential threat and protect yourself should you be put in that situation again? Checked the internet to see if there are any women's support groups in your community? Checked out if there are any Neighborhood Watches that you could join? Anything that would help change your psychological "victim" approach to the break-in. If you can't get past it then you aren't going to build a happy and successful relationship with any man, not just your husband.

Although it's hard to deal with his sarcasm and his anger, it's a positive sign that the love is there as those emotions aren't part of being disinterested, so you have a reason to push to succeed if you can get past your disappointment, frustration and negativity.

Depends how the visas themselves are issued. Power failure during the process resulting in duplicate allocation. Sloppy recording of data against the visa serial number. Any number of computer error issues could account for it.

The fact that it's cancelled WITHOUT prejudice is a notation that the error was their fault, so you shouldn't have any issues at all with the valid visa being active.

At the very least, you should be able to make the POE Officer laugh about how even USCIS staff have bad days and a "betcha haven't seen one of those before" comment. wink.gif

CanadaK 1 visa application- where do I begin?
In addition to reading the K1 guide, you might want to join the Regional forum .. Latin America, Mexico and Caribbean and read through some of the issues experienced at your particular consulate, as they often have slight variations on their customs and practice when reviewing applications. It helps to know where the danger spots are in advance so you can prepare as well as possible.

The only other recommendation is to visit USCIS.gov and download the forms for the process WITH their accompanying guide notes. Fill in the obvious information and then jot down any questions you have, bring them back to VJ and ask. VJ has a good community spirit, with some very knowledgeable folks and they'll either point you in the right direction or recommend you hire a lawyer if they think you need more assistance.

Sounds like you have been issued a recycled SSN.     Either it's incorrectly issued by SSA, or it hasn't been cleared off the Credit Reference Agencies list of defunct SSNs.

Start with the SSA office.  Ask them to verify that the SSN you have been given is correct and that your personal details attached to it are correct.   Assuming this is so, ask them to print multiple copies of them out on headed stationery.   Google the numbers for each of the credit reference agencies and call them, requesting the mailing address for you to send an SSN correction record.  They should be able to contact the SSA and ask them to confirm and correct the credit reference tables they use.

If the attorney is part of a practice, then demand an appointment with a Senior Partner and politely give details of the mistakes and fees paid. If it's a solo attorney, then insist upon a cost-free interview to fix the errors that have been made, either by the attorney or by his legal assistant(s).

It's shoddy and unprofessional of them to charge you for a service they're either incapable of undertaking or unwilling to provide. That doesn't mean that YOU have to accept it. If you're paying for the service, don't let them sign it off until you are happy with what you've received.

At the least, either get them to make good on the service you've paid for (where THEY take responsibility for the accuracy of the record they intend you to submit) or demand your money back and complete the application yourself.

This is EXACTLY how shyster lawyers make their money. They hope that you'll be afraid of their profession and not pursue them for what you're entitled to. Don't let them get away with it.

I think you're missing the obvious starting point.

What does she actually want? Obviously there is something, whether she can articulate it or not. The fact that she won't leave, she's physically and verbally violent towards you and she's threatening to take all you have if you divorce her tends to indicate that she wants to be with you. She could remove conditions on her own by divorce so it seems unusual that she would be behaving this way to gain legal status.

Nobody knows the ins and outs of your relationship except the two of you, but could this be about insecurity? Obviously, the girl is messed up with a childhood like that and maybe she's just not wired the right way to be able to communicate what it is that she does want from you.

Quite frankly, sit her down and talk to her. Make a list of all the options she has, with or without you, and find out just what is driving her behaviour.

Of course, everyone here could be assuming that you're the victim, instead of suggesting that maybe you've had a change of heart and withdrawn from her, leaving her in a miserable pit that she doesn't know how to crawl out of. Every story has at least two sides. Maybe you're coming at this one from the wrong angle. Be the better person and work for a solution that gives her some peace of mind. If you ever gave a damn about the person you married, you owe her that much at least.

Get your paperwork filed as soon as you can. Include a letter stating that you will be out of the country between X and Y dates and request that the biometrics appointment be scheduled AFTER your return. Basically, when you return using your soon-to-expire GC, if you have applied for your renewal then it will be on the computer at your POE and there shouldn't be any unexpected issues. Of course, as your card will still be valid, there shouldn't be issues anyway, but it's nice to have the security of knowing that you can prove you have applied to remove conditions/extend gc. :)

Put a covering letter in explaining why you have two addresses. Such things happen in modern lives.

Quite frankly, provided you submit the ROC and USCIS acknowledges it with the NOA stating that your residence has been extended for a year if presented WITH the expired card, you are covered for plenty long enough not to worry about deportation.

Other than getting a load off your mind by submitting the paperwork at the start of the 90 day window, and being done with USCIS for 10 years (Hallelujah) I can't see any reason to panic over when in that timeframe your application is mailed in.

Looks fine. Remember to get him to sign the I-751 as well. If there are any changes you can always put in an Addendum and indicate that he is deployed and therefore unable to sign.

I didn't put a covering letter, just a summary of the enclosures detailing what items and what period was covered. You should be fine. My husband was deployed through the middle of my conditional residence so not many joint photos, but I think USCIS is used to handling military apps. :)

Absences from the US of more than six months raise a rebuttable presumption that an individual intends to abandon permanent resident status, and absences of more than one year invalidate the green card as an entry document unless the person holds a valid re-entry document. This means that a foreign national who has been continuously abroad for more than 12 months may still be a permanent resident, but a special immigrant visa issued by a US consul may be necessary to re-enter the US unless the individual has a valid re-entry permit.


As Anh map says ... speak to the Embassy about your situation. If your circumstances are well documented, you may be in a position to apply for the special immigrant visa.

While I agree that it should be made clear it's additional evidence for I-751, I certainly wouldn't put either my name OR my Alien Reg number on the outside. You simply never know who is going to view that envelope in addition to USCIS.

It would make sense, because if one's spouse is deployed for 12 months and one's conditional residence falls somewhere in the middle it isn't really practical to be preparing a packet 6 months out, and the 10 weeks prior to deployment are full of major priorities like wills, power of attorney, getting house and car squared away, suspending cellphone accounts, visiting family, getting pre-D medicals, gear checks and a whole boatload of other issues that military members go through before deployment; not to mention spending time with a loved one who will be left behind for a considerable length of time.

Getting them to sign a form while they're in a war zone is also darned difficult (any military spouse can tell you about the lack of reliability of mail) and receiving the form back in the US isn't guaranteed. If you'd seen the state boxes arrive in, you'd understand. I certainly wouldn't want to trust my luck with a piece of paper in a flimsy or card-backed envelope. :)

I have a feeling its all about numbers, how many they have where you fall in the stack. Some get finished before others why? They seem to not update the site, i think applicants would be calmer if they at least mentioned something.


It's probably more to do with the way files are allocated internally. If they're anything like other government department, one person takes a batch of files and is responsible for the completion. They work through them, flagging them up for RFE's or searches. Everyone has targets, so they probably push through a number of the easier cases as a priority in between handling those that need more work. You also need to allow for them being sick and having vacation time and the phenomenal number of applications that they have. Vermont recently moved premises, so that's going to add time, too.

No offence intended, but I don't understand why people removing conditions suffer any angst at all. You have a NOA1 that extends your green card for a year. It covers the same functionality as the new 10 year green card, so what's the problem? :)

If you're with Vermont, it's going to take the full 6 months at present. They know that and we know it from the timelines of the monthly application updates in the RoC forum. Nothing you can do will speed it up prior to the six month processing window. After that, you can get your Senator/Congressman involved, but nothing doing until then. Patience, grasshopper! :)

In terms of evidence, I'd look back through your AoS packet for what you provided as proof of being a genuine couple and pull out more recent versions of the paperwork. You can't provide what you don't have. What about joint ownership or insurance for cars, medical, home insurance?

All she needs to do is prove that the marriage was genuine and, let's be honest, Scotland doesn't have a huge fraud rate in the first place so it shouldn't be that difficult. If you've been church members, what about seeking an affidavit from your clergy stating that your relationship was real, but has sadly deteriorated to the stage it's no longer what either of you wants? If you'll be helping her with the divorce and submitting the paperwork, a letter from yourself stating it may also be beneficial. Who better to confirm that the relationship existed than an ex-spouse?

Kudos to you for being such a gentleman in this situation. :)

You won't get your conditions removed before your return. What you should have is the NOA1 acknowledging receipt of your I-751, which extends your green card validity for a year from receipt of your paperwork. This should be enough to get you back into the country, along with your expired green card and passport. So, get your package in as soon as possible so you get that NOA1. If you get to within 10 days of your travel and you haven't received it, make an Infopass appointment and get the I-551 stamp.

Write a covering letter with your I-751 outlining that you were given advice, followed it and the person officiating your replacement disagreed with that advice.

I'm sure it's not a unique situation and they already have it on file that you requested a stamp to be allowed to return, so it's documented with USCIS already.

We're closing next week as well, but we weren't asked for anything from my husband, who is in the middle of ROC. We did have to state he was a permanent resident on the loan application though - it was one of the standard questions.

Just a tip, if you add your spouse as an authorized user on your credit cards (get them a card in their name on your account), your credit history will become their credit history. So even though my husband has only been here 2 years and only working a short while, he has my 20 years of credit history on his credit report, so his score is almost as good as mine. Because of that we got a really great rate. So if you have good credit, get your spouse a card on your existing accounts.


We did this, too. My credit score (after nearly 3 years of marriage) is barely 100 points behind hubby's. It's definitely the best way to go, rather than one of those prepaid credit cards which takes AGES to accrue a good history.

The only other alternative is to get your prior credit reports from your home country's credit rating agencies and letters from any banks or financial organisations that you used as confirmation that you have good history. :)

Hubby and I will be closing some time in February, so I'll be interested to hear how you get on, OP, if you'd come back and confirm how it all went.

Look at the expiry date on your green card and count back 90 days for the correct I-751 submission date.

USCIS will send you a NOA1, which extends the validity of your expired green card by a year. Once you have this, you can travel freely until the 10 year green card arrives and supercedes the NOA1 extension letter.

Provided your green card hasn't expired and you are not actually divorced there shouldn't be any problems getting back into the US.

Divorce happens. So do reconciliations. This is why USCIS allows you to file to remove conditions on the green card with sufficient evidence that it was a good faith marriage. If you have evidence, apply on your own with a letter informing them that a divorce is pending. They normally extend the validity period by NOA letter and once they have paper confirmation of the divorce decree they will issue an unconditional resident card.

USCIS are realistic, and I doubt there's any possible scenario that they haven't already seen. Make copies of all your evidence now and start building the RoC packet ready to file.

Sorry to hear your marriage didn't work out, but try and make the divorce on amicable terms as it will make the paperwork so much easier to compile.
