Hi all,

 

My wife is working in American University in Cairo

I have a 10 year greeen card

I applied for expedited naturalization twice and I got rejected.

The first time they said the fees is not correct (paid $595). The second time, I am waiting to receive I-797c notice (cheque amount $680)

 

My wife's contract is going to end in less than a year

Will expedited naturalization work for me?

My wife has been working in American University of Cairo (a US research inistitute recognized by US attorney General) for the past 5 months. Her contract was extended until end of June 2014.

 

Will I qualify to apply for expedited naturalization under 319 (b)>

 

P.S: I am a green card holder since Sept 2011. Since then, I did not lived outside USA for more than 180 days

I have a question about expedited naturalization under 319 b. I applied twice to Phoenix office. Applications were returned to me twice, the first was because incorrect filing fees and the second because they've updated N-400 application and no longer recognize old forms.

 

I am getting all documents back together to refile. My wife has been working at American inistitue of research regognized by attorney general since feb 2013. Her contract is renewed on yearly bases. That is to say, contract expires in June 2014 with possiblity of expansion.

 

Will I be eligeible for 319b?

Where to file; Vermont or FAirfax?

I traveled outside USA 9 times since I ve got my GC in Sept 2011. Two of which, I overstayed the 6 months period. Will that be a problem hen filig for naturalization under 319b (does not require physical presence in USA)

Hi guys,

I am a student in Canada for 1 1/2 years and I have a study permit valid untill the end of 2010. My wife (US citizen) has an open work permit valid untill 2010. My concern is that she came to Canada ( from Egypt) 3 weeks ago. She was living in Egypt her entire life.

I do, I completely understand your question 100%.

I posted the information from the US consular services for you yesterday - I also suggested that you pay the consulate in Calgary a visit and ask them directly. Why? Because although your wife has only been there 3 weeks, who knows, they might make an exception - or they may just require that she have a long term visa, which she does. No one here can give you at 100% accurate answer.

It has been found that consulates will not process DCF applications when the petioner has not been a resident in the country for 6 months or more - that is why they are asking for proof of 'long term residence status' (see below).

The consulate in Calgary is easily accessible - you don't need an appointment - if you get there early you will be out of there no later than noon and probably much earlier.

Local Consulate:

Evidence of Petitioner's legal long term residence status in Canada, such as a provincial healthcare card, provincial driving license or Canadian immigrant card

You would file at the consulate in Calgary:

615 Macleod Trail, S.E.
Suite 1000
Calgary, Alberta
T2G 4T8

It will probably take around 7-8 months - you will have your actual interview in Montreal.

Hi all,

If my wife gives birth for our child in Canada. Will that affect my immigration file to the states as she has the issue of establishing domicile. My wife was naturalized in 2003 as she got the US citizenship from her mother. My wife has not lived in the US more than 5 months since then. The I-130 application was accepted and we are getting all other documents to mail them to US embassy in Montreal.

My I-130 petition was approved. It will be challenging for my wife to re-establish domicile in US as she was naturalized in 2003 and she did not live in US since then. Although, she was visiting US twice a year.

We both applied for immigration to Canada to get PR cards. We want to get a line of credit to cover our moving expenses to US when I get greencard, and all banks here in Canada want us to have PR in order to approve the application for a line of credit.

My question is whether our application to immigrate to Canada will affect my green card application? Is there any communication between US and Canadian governments regarding immigration applicaitons?

To answer your question - probably. However, unless you are going to be able to juggle the residency requirements - it would be a waste of time.

Let's separate the two, as they have different sets of rules attached to them (briefly):

Canadian PR .

If you have been a permanent resident for less than five years:

show that you will be able to meet the minimum of 730 days physical presence in Canada at the 5-year mark.

If you have been a permanent resident for five years or more:

have been physically present in Canada for a minimum of 730 days within the past 5 years.

So basically, if there were some way that you could prove that you are able to meet the 730 days of physical presence at the 5 year mark beforehand - will you be living in Canada for at least 730 days over the next five years and be able to prove it when it comes time to renew your PR card? If not, I wouldn't bother applying at this point, you will be wasting your money.

Permanent residents who depart and remain outside the U.S. for more than 365 contiguous days risk losing their status and might need to undergo the entire petition and immigrant visa process anew if they wish to re-enter the U.S. as permanent residents. Permanent residents who obtain re-entry permits from USCIS prior to their departure from the U.S. may remain overseas for up to 2 years. Permanent residents who fail to file income tax returns while living outside the U.S. or who declare themselves as "non-immigrants" on tax returns may also lose their status
