CR-1 is a multiple entry visa. You can travel back and forth between Canada and the US once it has been approved. That means visiting Canada is ok. I am sure others will tell you about their CR-1 being granted and visiting Canada to see family and friends.

With any pending petition - the US wants to ensure that you're not going to take up residence in the US before they've granted you a visa. I was officially confused before and now am even more so! I have a friend of mine that works for US Customs at a border crossing in ND so I have been talking to him about this process.

He tells me that the K-3 is the better route for my situation because with the cr-1 I would not be able to leave the US until I have the conditions lifted after 2 years of marriage. I thought that was not the case and the cr-1 was a multiple entry visa?

Other question is that with the cr-1 are you not allowed to enter the US while your case is pending? The reason being is, we have purchased tickets to fly back to Vermont at Christmas time for 10 days to visit her family.

If we file the I-130 in the next few weeks would this be considered as having a case pending and then in December when we go through customs they say to me " Uhh, sorry buddy but you cannot go, sorry you paid for those tickets" ?

What are our options and what is your advice? Thanks again!!

For some reason, I would err on the side of a CD, rather than a webpage. Mostly because I would be worried that the link didn't work for them, the webpage was down the day they tried to access it, maybe they don't have internet access at the processing center. That's just me. blush.gif

Ok here are a few more,

For the affidavit of a bonafide marriage, what would that letter look like? Is there an example somewhere, or is it even necessary if you have other proof like pictures, and bank statements?

And then for the cost, as I understand the initial cost is $355 for the I-130 and $0 for the G-325a's. Is there any other forms/costs that I'm not aware of? I'm just following the guide that is listed on this website.

I am the dual citizen and have never lived in the U.S.. There is an outline in the instructions for the I-864 which really tells you what you need to know.

They give three categories in the instructions (page 6):

To answer your question more directly, no, simply having her mail delivered to a U.S. address probably won't cut it. The answer to your sponsorship question is also in the I-864.

All I am saying is that you are going to have to read them sooner or later so you can figure out how it is going to work for you but certainly if you have any questions after that, don't hesitate to ask!

You absolutely can use a joint sponsor. Don't forget your wife still needs to file the Affidavit of Support as the main sponsor though, even if she has no income.

We did DCF through MTL and got a joint sponsor and there was no problem.

As far as residence, my husband still had some bank accounts in the US, and was in Canada on a student visa, so he never gave up residence. He was also registered to vote and the like. What is your wife's status in Canada?

In regards to the I-864, since my wife is currently living with me here in Canada on a visitors visa she no longer has her job in the US.

Can we use her Dad as a sponsor so long as his income meets the minimum poverty guidelines?


Also someone was saying that you can still prove US domicile without actually living there, which is currently my wife's case. Is it as simple as keeping some of your mail going there, or should you have other proof as well?

I've been following the guide on this website for the CR-1 Visa, but I do have some detail questions.

For the pictures that we're putting in the package as proof of a bonafide marriage, how should we attach those? Glue them to a sheet of paper or put them in a plastic bag? Any suggestions?

Also when we attach our passport photos, they will be in a plastic bag and it says to attach them to a sheet of paper and then attach that to the corresponding G-325A. Would you just staple them together or use paperclips?

Are there any other tips for putting these together?

From Montreal it will take you about 2hrs and 45 mins to get there. As for what to see.... they have a six flags amusement park there. The town is also nice to just walk around and enjoy the lake. I'm sure there is much more to do, but thats all I know. I've been there once.

Ok after much searching I have become only slightly confused.

1. For the police certificate. Do I need to get one from each local police dept in the areas that I have lived or just one that states a search of CPIC was done?

2. In regards to where I plan to live when arriving in the US. My USC wife currently lives with me in Canada and so we dont know exactly where we'll end up. Can we just put down her parents address?

I just got some more passport photos taken at Costco yesterday. I'm almost certain that when I got my first ones for the I-130 done a few months back they asked if it was for Canada or the US. I told them US and they made them to the US specs - 2" X 2"

But the ones that they took yesterday are the Canadian size, 2" X 2 3/4". Is this going to be a problem?

My wife's visa is good until June of 09. So if we were here past that, then yes, we would be overstaying the visa.

We do have a joint account already opened in the US along with joint credit card accounts. She should be able to get a voting record since she has kept that up since leaving last June.

What I was planning on doing after listening and reading all this information is to say that she is only out of country temporarily. The proof of that would be the temporary visitor's visa from Canada, bank accounts still open in the US, vehicle registration still in the US. We might also get a letter from her folks saying that we will be living with them when we move back, if necessary.

Does this sound like a good route to go? Because it seems like the easiest and best to me.

1. On the form I-864 question 12. It is asking for mailing address and then place of residence in question 13.
So the question is, my wife is the USC and lives with me in Canada right now on a visitor's visa. Is this the place where we want to say the mailing address is here in Alberta and her residence is in the US?

2. If that is the case where we say her residence is in the US then since her Dad is the co-sponsor should we have had him fill out the I-864a? They both "live" at the same address or at least did up until she moved up here with me. At some point here I thought we wanted to prove domicile in the US, is this that stage?

If you're flying to MTL or VAN, make sure that you bring an alternate piece of ID to board the plane. Make sure you show up to the Consulate with the Xpresspost envelope, otherwise you'll be sent away to buy one and come back.

Also, I believe your passport needs to be valid at least 6 months beyond the date of your interview.



Ugh that stinks! We were planning on going to Vermont on that same trip to visit my in-laws! My guess is that the interview will be in June sometime since I'm mailing that last bit of paperwork tomorrow. Isnt it in June when everyone is required to have a passport even for land border crossings?

Since you really only want around 6 months to get everything tied up in Canada, I think it's a good idea to wait to activate it and then take a bit more time after that if you like.

One doesn't have to activate the Visa right away either--U have like 6 months to do that! OK, I knew about the six months after the interview time frame, but I was wondering about beyond that. I do already have my SSN from when I was in college in the US a few years ago, but I checked off to get another one since my current one reads "Valid with INS authorization".

I was just thinking that if everything doesnt fall into place like we would want in the six months after the interview if a guy could just cross the border get that stuff out of the way and then come back for a few months, no more than 6 at best.

CanadaHypothetical Question

What would be the situation if I received all my paperwork, crossed the border, got all my stamps and proper visas and then went back to Canada?

IF I did go back it would only be temporary for at most a few months to finish up some loose ends with selling the place and stuff like that. Could this be seen as abandoning our visa?

The reason I ask all this is because housing prices have obviously dropped and if we sold our place now we'd still have a mortgage. I was thinking of the possibility of moving to the US but coming back for a few months of work and waiting for the price to rise.

Any thoughts?

They give you an option to enter your party's extension if you know what it is. So I just punched in random extensions until I got someone on the line and they were very helpful. good.gif

I currently work as a site supervisor for a home builder. Basically what I do is make sure that the houses get built on time and to the specifications that they have.

I'm a bit nervous of moving to the states later on this year and hope to find in the same line of work. I've been in the home building industry for 14 yrs now.
