yes it will affect it, you're receicing a benefit that will likely extend to your family as well, and that is exaclty what US government is trying to avoid; you need to either a) graduate, get a good job, file taxes for 2-3 years with steady income and then file for K1, or b) go to Ghanna, marry her, come back, file CR1, get a sponsor (and yes, sponor needs to cover 125% of poverty level for him, you, your kids, your future wife/her kids, and the rest of his family, hopefully your brother is a rich man)

btw, u have almost full timeline? is this for a different person or you're not talking K1?

a) you will have to file a waiver if you file another petition within less than 2 years of the previous, first waiver is granted for sure, however if you change your mind one more time - u might be in a tougher world, make sure it follow through with your commitments this time.

b) there is a guest visa, its called tourist. She can try filing for it in Kiev but will need to prove that she intends to come back: has property, investments, good job, etc; if she travelled through europe - will be an easy one; if she never travelled is in the sweet age of 20-30, has no kids, few relatives and no high-end job to come back to - chances are slim. You go to Kiev, or you both go to some warm place like caribean or turkey.

c) you definetly need to tell her about "first attempt" as she will find out sooner or later, and trust me, you do not want to start a family with a lie like this.

best of luck, but imho wait at least 6 months from the moment you meet your lady to the moment u file K1 to just make sure she is into you.

remember, they will be checking your jobs against your tax records, so anything you've done for cash (I know how college is) would not be included, any job that you held even for 4 hours but ended up paying taxes for should be on the list. Dont be afraid to use additional pages, i know someone who used half a stack of paper for one of the immigrational forms while form itself was only 2 pages.

And yes, do not forget to put "see attached page", or better yet put a specific number of a page where each part begins (if multiple pages need extra space)

hope you have a good job now, so you dont have to do the mess with sponsors.

You've got to create a document that would be very long, very detailed, very precise, very easy to follow that would include all the info on how you met, travelled to her, etc Expect to spend 12-16 hrs preparing and perfecting this document, at least.

Caryh should be charging you by the hour for a detailed response like this.

MY k1 got to moscow embassy and we're trying to schedule an interview; looks like we need to pay the $240 fee to some VTB24 in Russia to get a receipt number which would be entered into the website to allow scheduling screen to show up.

As you all know Russia gets unreasonable number of holiday days, and it would be a noticeable ~2 weeks delay before this can be done unless one of the branches would be working.

The question is... is there any humanly way to pay this fee online using credit/debit/check/certified check (hek, Im willing to go to my bank and make them wire money). Anyone done this before for Russia embassy?

Just talked to my future wife about this, and she confirms that any russian not living in moscow permanently has to register within 3 days of arrival or risks being stopped by police, etc.

Sounds like your GF broke this law, which is fine as long as nobody would have found out. But if you already mailed I129 that included moscow in it you probably need legal advice on this matter.

I see 2 possibilities, either you must retract your petition and start over skipping this part, or must prepare some kind of letter explaining situation for the officer doing the interview. I'm sure you've seen other posts describing situations where everyone says not to lie even if there is a bad situation and be open about it. Here, I believe, you may have shot yourself in a foot. Definetly seek a legal advice as you will need legal help in case interviewer will ask this question.

Congrats on your engagement.

I am known as a worst skeptic around here, so you can choose to skip my opinion if you feel like it.

I see 4 problems with your situation. None are critical, but each one needs attention.

a) She definitely needs passport, and you stated that you have already applied. As long as it comes together prior to the appointment to the embassy - all ok.

b) she was never married and has 4 children: you will definitely need to get some official document that proves that. If I was CO I'd investigate this seriously.

c) pictures, I submitted only 6 pics for my application of us together, and seems like it was enough. Hope you have at least some as it would be very suspicious for a CO if you don't have at least one.

d) 42000 salary is just enough for covering 125% income: as CA resident you need to show $38712 unless you're in armed forces. This is in case you do not have any more dependents on your income taxes. Also I am unclear on your tax situation while you lived in Mongolia for 9 months: if this took place within last 2 years you will have to show your tax forms.

Finally being 12 years older and from a completely different culture also may raise some questions on the interview but I completely believe that you can get this case going.

Never heard of this one before... but a logical idea to research would be to find a country that does allows two of you to get legally married and you both can legally visit (like Netherlands), and then apply for CR1. And then if you home state recognzies same-sex marriage you might be able to fight it through USA legal system.

My 5 cents go against most on this thread. I understood that US parents that will act as sponsors have combined income of 100k. But it also sounds like there is a number of dependants they're claiming that needs to be accounted for. I am unclear on the number, but if they have 3 kids, it means that they claiming 5 allowances on their tax return, with you being 6th dependant they need to show 18.9*6 ~ 113.4k+ earned in each of the last 3 years, AND both must sign co-sponsor petition.

Also, I used to have that college job where they give tuition money, only the taxable part of it will count toward the income needed. The part whoch goes toward the tuition does not exists for these purposes.

And I also strongly believe that it was completely unprepared situation, which is why interviewer did not give any info.

Basically you have to show a proof that you will not become a burden for USA tax payers, and food stamps is one of the benefits that you would need to repay for (or your sponsor will need to) in case you do get those.

I'd hope that UK is somewhat ok with financial questions, at least compared to some of the smaller countries. However her getting food stamps will be a big warning sign for the interviewer. You definetly need to prepare strong supportive case where her close relative / friend of a really long time will sign sponsorship papers, your assests would also help but they'd ask for *3 times more in assests than proven income.

Wow!!! I am so happy with site from all the responses I am getting both good and bad...I will share and continue to share this info with my fiance in China. As for me, I would have to grin and bear it to live in China.. Its a pain for foreigners to live in China if you dont know the language.. I was there for 2 months and honestly I prefer to live in the good old USA..But for her I can live there a year or so-- sounds like that is going to be a given from what I am reading...AND from some of you, even after that, its not 100%...

Hi Everybody!!!

Here is my story:

My name is Ray and I am divorced. The last one was filed on Feb 6 2008. and now I am single. I am 61 years old, married 3 times, the last time was to a Chinese woman who I met in China and brought over here on a K-1 visa..(We are now divorced and she is a US citizen.) As a result of that marriage, I understand I am on some kind of database that says I was married to a K1 holder. I don’t know the official name of this database I am on….

I went to Shanghai on April 10, 2008 and met Yili at a coffee shop and instantly fell in love with her!...I spent 2 weeks with her, then came back and filled out a K-1 application and submitted it on 5/4/08…I received the I-797C on May 29, 2008…Then she received her packet to go to Guangzhou nine months later and after the interview, she received a denial because the officer didn’t think there was a bona fide relationship. She got the form 221G and that was it…She was denied on March 19, 2009. (I have received letters from the INS that the K1 is totally dead and they will not honor it anymore- so there is no appealing it....)

After being denied she was in a very depressed state of mind and wanted to break off our relationship, thinking it would be the best for both of us. Around that same time, her old former boyfriend had contacted her...Subsequently she was coerced by her former boyfriend and his mother into marrying him. Both the mother and her son got down on their knees to ask this favor of Yili = to marry her son.…. The reason being was that the boyfriend’s father was on his deathbed and wanted to see his only son marry a girl the father always liked…Four months later, the father died and they divorced….Yili was not thinking properly when she did this and didn’t know that this would cause a wrinkle in our future plans together….she was married on 4/27/09 and divorced sometime in August of 09….

After her denial, I wrote letters to both Senators, the director at Guangzhou, to Janet Napolitano and to Obama. I was pretty angry…Result is nothing. Seems nobody cares….After talking with an assistant at Frank Pallone’s office, I understand that I raised some huge red flags in their eyes:
1- my age (61)
2- I was married to a Chinese before. (major issue?)
3- Very quick to fill out the K-1 after having just met her.
4- Our age discrepancy (38 year difference)

My last trip was for 2 months this past July. We toured 3 countries and I have run out of most of my cash but it was worth it and she had a great time and her spirits were lifted.

My trips to China to see Yili:
4/9/08 – 4/22/08 2 weeks
9/17/09 –9/28/09 2 weeks = toured Hang Zhou / attended her cousin’s wedding.
5/23/10- 7/20/10 2 month visit.= toured Japan, Hainan, France, Italy and Switzerland.

Yili has lost faith in the K1 and K3 process, she doesn’t like the interviews and is now hesitant that the K-3 will result in failure as well…..

We need a sure fire method to bring her to me…she has some money saved up and she was considering a tour guide trip to the USA – when she comes, of course we will get married right away.. What is her chances to come here on tour considering her youthful age?

Quick dates:
Met on 4/10/08 = stayed for 2 weeks
K-1 visa application on 5/4/08
K-1 denied on 3/19/09
Yili married someone else on 4/27/09
Yili divorced him on 8/09
Met Yili again on 9/17/09 = stayed for 2 weeks
Met Yili again on 5/23/10.= stayed with her for 2 months


I need some good advice as we want to be together and we love each other.
