Thanks for the feedback. She is getting the vaccinations now and she will be able to present the documentation at the medical interview. I think it will be cheaper for her to get them there than here in the states. She can get the HPV for about 3500 pesos ... I think. The HEPA A & B will run about 10,000 pesos for the full series of each. If anyone else has any information please share.

How soon before the interview do you go to get your vaccination? The HEPA A&B and the HPV take several shots over the course of several months. Do you need to have these completed along with the other vaccines before you have interview or get visa? Would you please give your experience dealing with this in the Philippines?

You need to file the I-130 form for the CR-1 when you get an NOA-1 for it you can submit the I-129 for the K3 for no additional cost. With the I-130 you will need to provide support of Bona fide marriage and relationship. I think if you marry in the US you have your interview in the US . If you marry in your country you would interview at the embassy there. There are others who can tell you more about the process if you marry in the US.

In addition you should go back and file jointly and amend your returns. I think you can do that for the last three years. This should result in a nice refund. In a few cases it might be better to file seperately as the tax refund checks was only allowed if you did not have someone on the return who filed with an ITIN. I think it will be worth going back and amending the returns...talk to a tax pro they will be able to help you and advise if that is possible.

I have studied this also. You have to apply for the ITIN W-7 and send it with your tax return to the address they give for the W-7. They then will assign a tax ID number for your spouse. If the spouse has not lived in the country that year you have to send in a letter stating that your non-resident spouse wants to file as a resident for tax purposes.

I did read few of our VJers friends sending an email for the DS3023- Choice of Agent. NVC is taking at least 7-14 days to respond to this request. NVC will accept choice of agent email, if you email them after NVC generates choice of agent (DS 3032). If you email them before it is generated, then it will be ignored.



Are you sure about that? My understanding and it could be wrong is that once the Case number is generated you can send in the DS3032 by e-mail. If you wait till they generate the DS3032 I don't think you would know until you got it in the mail.

Legal expenses that are paid in order to keep your job are deductible as employee business expenses. Legal expenses that are of a personal nature are not deductible.

How long after your NVC case entered DS230 to "case complete"? They say on the NVC line to wait 6 to 8 weeks but I do not think it is taking near that long. Can someone let me know how long it took them? My case was entered with all the documents on Nov 12th. Trying to plan trip back to see wife and bring her back if everything is completed.

My wife's visa application was entered into the system at the NVC on the 12th of Nov and went case complete on the 27th. It will start showing that they have your package after about a week after the NVC gets it. I have seen about this same length of time for others. If you are signed up for e-mail notices they will send you an e-mail when it goes case complete. You will get another e-mail that will tell you about the interview and that the case has been sent to the embassy. The email will tell you the date and time of the interview. Your interview should fall in January or beginning of Feb.

Asked a lot of questions about petitioner to make sure wife knew me. Embassy looked at documents and they had everything already that we had sent them. Make sure to include letters or cards with the envelope that has the stamp on it. Make sure that she knows as much as possible about you and your family and have receipts of support if any has been provided. Know the name of the Church you married and the address where you will be living in the US. Overall did not give my wife too hard of a time. Dress professionally it helps!! Wife was done in a couple of hours and was approved. Received Air21 package 2 days latter.

The I-864 is not used in a fiance visa case. The Consulate may choose to consider the beneficiary's income or assets but it is entirely up to them.

If his income from the same source will stay the same he can use his income. He can also use his assets if they can be converted to cash within a year. Your assets can also be used. Read the I-864 instructions and do what is best for you. In any case if he presents his assets it should help along with a co-sponsor if needed.

A false RFE for most people is when NVC completes the processing of the affidavit of support but has not yet opened up your IV package. Because of the two different tracks at NVC (AOS is one, DS-3032 + IV package make up the other) the timing can be a bit funny. For many people it takes NVC so long to 1) accept the choice of agent and generate the DS-230 (up to 2 weeks it looks like these days) and then 2) enter the IV package, that their computer automatically generates an RFE for the missing IV package, even if they've got it already. Then just give it a day or two and they'll register it.

Btw, I just received my NOA1 last friday 8/10/12 and i am stoked! Yay! :dance: But on to my question.. as excited as i am, i just spent the last hour reviewing other poster's timelines hoping to get an idea of how long before i get my NOA2 (crossing fingers that there are no RFEs), and i noticed that some couple already have an appointment date even before the consulate receives their packets. So now, my question is, when in the K1 Visa timeline/process can i set an appointment for my finacee's interview? I want to be present for her interview in Manila but my belief was that she cannot set up for an interview until the Manila Consulate calls her.. which makes it very difficult for me to plan my trip to the Philippines because of time constraints. Is this incorrect? Thanks in advance! :)


My wife was sent a letter and the time for the interview is posted on it. They give you quite a bit of notice. I think ours was about 2 months so you have time to make travel plans if you want to be present. If you do not like the time they give you may be able to call to get it changed but it might end up being later.

If it is a spouse it has to be 3X your assets if you do not have enough income

 

If it is K1 or other family members it is 5X 

 

The difference between your income and the poverty level times the 3 or 5X.
