Make that eight months for the CR1. I am in the process of doing it now. The NVC appeared to get a little snowed under with the faster times USCIS was processing the paperwork.

If they have been married for four years and he has been supporting her there should be plenty of paper evidence that they are married and it is a legitimate relationship. He needs to be there for the interview. It might be to the point that she is not even wanting to go because it has been a bad experience for her. If I was interviewing her I would wonder why if he already knows she has problems at the interview he is not there with her.

My understanding is that if he is in the country more than one year after his 18th birthday he can be banned for 10 years from getting a visa. If he worked and did not file or pay income taxes that could also be a problem. A wavier seems to be the best option if it is even possible to get one.

I think we would all have liked to have been able to do that!!!! That is not normally allowed and I have never heard of anyone being able to do it. You will have to take some care to support your relationship to prove she is not coming to the US and getting a visa through you so she can join friends and family in the US.

How long it takes depends on the country also. You should get a K3 visa about 2 mos sooner than the CR1 if my experience is anything to go by but these times change depending how busy they are. You will have more do do once the K3 is approved and she is in the US but she will be here a little faster. I could of had the K3 in 5 mos or so but waited for the CR1 that took 7 mos. I did not fool around and sent paperwork as soon as I could and did not have any RFEs. Good luck!

I just did this. My wife went and paid for the marriage lic before I came and had all the paperwork filled out. The first day I arrived I went to the Embassy and got the ability to marry. He will need to bring any divorce papers. You both should go as they like to ask a few questions sometimes. He has to be prepared to fill out some paperwork stating where he is staying and a phone number of an emergency contact in the US. This is good for you as you can see where you will need to go for your interview latter.

We then went back to the courthouse and took a marriage class and finished up with the papers for the marriage lic. You then have to wait 10 days and go back and pick up the marriage lic and take it to whoever is going to marry you. You can do it in 12 days but you will be busy. Make copies of everything. There are copy machines in the courthouse if you are in Manila. Make sure there are no holidays when things will be closed and go to the Embassy early and grab a number.
