This is what my lawyer recently sent me after i complained about how the Transfered cases are almost being forgotten.

Shawn, The notion of filing a mandamus court action is likely not viable at this time. Cases are moved systematically. If one group of cases is taking longer than another group, this is not a USCIS concern, or a court concern for that matter. For those of us who have been working with the USCIS for years it becomes apparent that individuals come second. From a government standpoint, what is important is how to function as a bureaucracy. The more visceral the consumer becomes, the less willing are government agents willing to help. Your focus should be on whether your particular case is tracking outside your group.

I have found that protests do work. If you can get a bunch of people outside a service center with signs and get the media involved, you can receive attention and get results for the group. Government officers respond to public pressure. I hope this helps.

I got this message from TSC today saying all applications will have a response within 2 weeks:

"Unfortunately, our office is closed today because of the ice/snow storm that has hit Texas, but I did not want you to wait to hear from me. The I-130s are the priority for the Texas Service Center and we will have an action taken on every petition within the next 2 weeks. On a separate note, we are working with our call centers to ensure a more accurate and consistent delivery of information so hopefully your experience will not be repeated."

Thank God I will be in my wife's arms on Wednesday (finally able to take time for a visit). I need her every day, but have to settle for a few days every 2 to 3 months.

I believe that all of this delay was a policy decision to reduce the burden on certain consulates. A tier 2 USCIS rep told me 2 weeks ago that all transfers from CSC to TSC were on a 60 day "hold".


I was told something similar yesterday. Every time I think about it I feel like my blood is boiling! And then this a@@hole had the nerve to tell me the pettitions are processed in the order they are received. I wish I could have stuck my hand thru the phone and slapped him a couple times. I think I need to stop making phone calls. I'm going to get myself in trouble.

At first when I mentioned this forum she said she didn't care for forums because they tend to lead to mass hysteria but I think she's coming around. She's from one of the best immigration law firms in Detroit and I can't afford to pay her for "extras". She didn't anticipate this (Texas) happening. This is actually my 2nd I-130 for my husband. Too bad I let the first one expire.... :bonk:

My lawyer admitted today that there may be a "problem" in Texas, and I say that is the first step to recovery!

Called USCIS again.. I am a Aug Filer who got transferred to TSC.

Same response, they can't even put in a Service Request even though all of them agree my case is out of normal processing time.

How many folks have called and they were actually able to submit a Service Request?

I have been calling for 3 weeks now and every time same response. Even after I sent to Tier 2 where an IO says that your case is beyond normal processing time but the system will not let them submit even a service request. Getting very frustrating as I approach the 6 month mark.

I contacted my Congressman over 2 weeks ago and that isn't going anywhere either.

Anyone have any additional ideas? I am all ears. At this point I would be happy someone acknowledging my case is beyond normal processing time and start looking into it. They can take their sweet time but at least officially start looking into it.

I just found this CSC to TSC forum!

Jan 27th will be 6 months for me and I am separated from my 1.5 yr old son and 3 yr old daughter (and husband), I'm going mad!

Did anyone else get a notification in late November that their case was transferred from TSC to "a local USCIS office"?

My senator checked up on my case just now and she said Detroit (my local USCIS office) said they didn't have it and that it was still at TSC. Anyone have a similar experience?

My 5 months were over on Dec 27th. I called USCIS yesterday and was told the processing time is 6 months due to the 30 day extension of "mail processing time". I looked at the USCIS' site, while I had her on the phone, which said the I-130 processing time was 5 months and told her that is what it says, she said he system says 6 months, I said my system says 5 months....it went no where. Its like banging your head against the wall.
But, she did put in a service request so I should receive an UPDATE in 30 days....HOW HELPFUL!!!! :bonk:

So, I called my senators aid who is in charge of immigration and she said she would look into it but said it was likely my file is in Detroit and I will be called for an interview. Which should add 30-90 days to the process. And I called my lawyer and she didn't return my call. :rofl: I feel like my sanity is decreasing linearly with time at this point.

Is anyone else out there dealing with a deportation? Or am I totally alone?

I just want to share my sympathy.

I too have two under 3. I am a full time grad student. My kids are on the other side of the world with my husband. But for us, we have to do a waiver after the I-130, so I am a solid year from having my family back. I think I'm going insane. Should I bring my kids home? They'll have to stay with a babysitter 10 hrs a day but at least I'll have them in the evening. Or should I leave them in Albania with their Dad, Nana and Aunts, where they get plenty of exercise and fresh air. But will my one yr old forget who I am? Probably! I can't afford a babysitter anyways. Maybe I should quite school? But then I'd be a single Mom with no degree...What can I do? I feel so stuck.

:) Anyways, I'm glad I found someone who can relate!

This is taking soooo long. I am 3 months in and already I am going crazy. I check here everyday and check on my case status. I wish that this will speed up. It's hard being a single mother to two children under the age of 3. I miss my husband and so do the kids.

We've begun preliminary waiver preparation already. I expect the waiver to take an additional 4-6 months.
Maybe my family will be home in 16-18 months. :(
My lawyer seems fairly confident with our ability to prove "extreme hardship" (I am not attempting waiver preparation myself).

your husband will need to file a waiver, after the interview. prepare the waiver now, have it in his hand on interview day, so he can start the waiver process immediately after the interview, same day.

suggest you visit http://www.immigrate2us.net and study, study, study. Being Deported Sucks, but (as you'll learn) is possible to get the waiver done, when submitted 'at the right time'.

Hi, I'm new to the site.

My husband (Albanian) was picked up by ICE on June 29th (his voluntary departure date was March of 2000, before I ever met him, so I couldn't help him with his illegal status problems).

We own a home and a restaurant and have two kids, 1 and 2.5 yrs old.
I'm a natural born US citizen. I'm working on my PhD in Biochemistry. I make $1600 a month.
We had to sell the restaurant. I had to leave the kids in Albania with him (can't afford daycare and better to stay with Baba than a babysitter).
Now I'm sitting in our 3 bedroom home alone. I put all the kids toys away where I couldn't see them.
I received the NOA1 on July 27th.
Now begins the waiting game.
It's going to be a long time before my family can come home.

I am so frustrated with this government.
They've known where he is this whole time. The house and restaurant are in his name and he pays his taxes in his name. Removing him seems so pointless. We employed 10 people.
They should fix the border issues so more ppl don't come in BEFORE they focus on deporting contributing members of the community.
Plus, I'm pretty sure I could dig a hole from Canada to the US with a teaspoon before the paper work clears.
