Yup the petition validity can be extended up to a year. Call the embassy, she can mention the extension when she calls to cancel the interview.

Hank, I already canceled the interview online. St. Luke advised my fiance to cancel it and they will do the rescheduling themselves. Do you think it is best for my fiance to call the embassy and mention about the extension just to be safe?

Yes! You can schedule your medical right away however, you have to set an appointment with the USEM for atleast a month to give ample time for the USEM to receive your physical file from NVC. The reason behind is you need the Appointment Confirmation page to show St. Luke's in order to undergo the medical if you haven't receive the letter from NVC yet. We've been through it...

Yes, it is normal for cases that were processed and approved by California Service Center. It will still be forwarded to NVC first for your case number then will be mailed to your consulate which I'm guessing is In Manila. It is a quite a wait before CSC sends your case file to NVC..around 6-8 weeks. So, for now that it got approved prepare the documents that your fiance/e will be needing for interview.


Oooppss, i didn't get your next questions and neither I know the answer on that.. I hope someone can enlighten you on that...

Sorry about the confusion, embassy instructions for sure are not the clearest (which I copy). I made an adjustment to the site regarding the receipt number.

 

Hi Hank! I guess the confusion came from BPI handing out applicants their own Bank's deposit slip forms aside from the one that was printed online by the applicant. That confused my fiance as well and I told him to copy the 9-digit Receipt Number that was generated online as instructed by your link.  BPI used their own deposit slip for teller's validation and receipt of payment purposes but still is important for proof of payment/required during the interview. 

 

So, for all other applicants that will pay for visa, as mentioned in your link, should take the 9-digit Receipt Number generated online. Also make sure that it matches the number that is validated on the BPI Deposit Slip form.

Yes, unfortunately... $223 doesn't even cover the psychological evaluation and exam, if needed. There was a thread here at VJ that they asked the applicant to bring money for the pregnancy test.

hi! Okay I'm a lil' bit confused again..... Who will receive my packet 3? Is it from Manila? me or my fiancé? And it's been 3 weeks already but no packet 3 yet.... Is packet 3 same with packet 4? Oh my, i'm so confuse.
And can I take my medical this december but my interview will still be on April? I want to have my interview soon but as what the vj people keeps on telling' me Patience is a virtue..... I really miss my fiancé just like anybody else, God bless to us applicants.....

 

Hank was right, forget about that packet. However, I was surprised ( I'm the petitioner) to received a 1 page- letter (not a packet) from USEM last December 6. The letter was dated Nov 22 stating that my fiance was eligible for K1 visa interview in Manila. The letter also had instructions of what my fiance needed to do like visa payment, medical, and going online (USEM website) to print/follow the "instruction packet". My fiance who are in Manila never received this letter but honestly, you don't really need it! Everything you need to follow is here at VJ's guidelines and Hank's guidelines. So, don't worry about that packet and don't confuse yourself.. you are in the right track. good.gif

Hi, I arrived here in California two days ago. I miss the weather in Manila. It is freakin' cold here, I don't wanna go out of the house. haha

Hey, consider yourself lucky and you're not here in Minnesota with all the snow and below 0 degrees temp.. lol! I am so happy for both of you.. My fiance kept on complaining about how hot in Manila right now and here we all are in America complaining about the cold. hehe.. well mostly us here in snowy states!

 

Anyway, enjoy being together.... explore the place.... prepare for the big day! whoohooo... (oh, I'm a bit jealous.. sleep.png )

 

Oh and from what I learned you can go to Social Security office in two weeks after your arrival to apply for the SSN. Also, study for the driving license exam if you're planning to get one which I highly recommend that you should.

 

I used to live in Santa Clara, CA.. tell your hubby-to-be to take you to Valley Fair Mall or Santana Row.. love the place!

PhilippinesAnybody with experience doing sputum test at St. Luke's?

My fiancee Lyn went for her medical this week and now she has to go back next Tuesday, Wednesday and Thursday for the sputum test.

I have been doing some reading and it sounds like best case scenario is a 8 week wait for the cultures before she can finish the medical.

If the culture is positive it would be 6 months of treatment before trying again. I have seen several references to supervised treatment, where she would need tostay in Manila for 

the entire treatment.

I know I am jumping the gun on assuming the worst but, is it required to stay in Manila or could she return to her home and get treated there?

She was devastated by the initial diagnosis and I really don' want to subject her to 6 months in Manila.

I am just trying to figure out our options if she does end up testing positive.

Well, we're on the same boat! My fiance is on his 2nd week of 8-week sputum culture test. His smear result was negative (thank God!) and crossing our fingers that the culture will turn out negative as well.

 

Unfortunately, the 6 month treatment will require the applicant to stay in Manila because it will be done everyday at St. Luke's.

 

Let us hope and pray that both our love ones will not go that route! Sending us good vibes...

I did a search (because I have way too much time on my hands and it distracts me while waiting for my interview date lol) and found a few K1 cases in USEM who were informed they had to leave the country within 90 days either because of TB history or following treatment for TB. I linked you one example via PM. That, plus the earlier post I linked, suggests SLEC does indeed adhere to the regulations that Manong Vendor attached.

 

I think this is something that is dependent on the type of TB classification (class A with/without waiver, class B1/2/3). Not all TB cases require exit within 90 days (e.g. class B2 and B3 do not, if I am reading the 2007 regulations correctly).

 

The tricky part is in the wording. In certain cases, the medical is valid for 3 months. If the applicant does not depart for the US within the specified period of time, they would need to get another medical done. This is not contradictory to what is written on the USEM website - K1s are valid for a maximum of 6 months, but they can certainly be issued for less than that. Since the validity of the K1 is tied to the validity of the medical, in such cases, the applicant would be informed that they should leave within 3 months or get a new medical.

Oh no, don't feel sorry..that's fine. So are you saying that after 2 months of culture..if it turned out to be positive, depending on the classification.. fiance can leave the country within 3 months even while on treament?

 

negative result - need to leave the country within 4 months

positive result:

Class A - needs to leave the country within 90 days (with treatment or treatment to be done in US?)

Class B - needs to leave the country after 6-month treatment if turned out to be negative result from 2nd medical???

 

Am I making more sense?????

sorry guys but I want to provide a scenerio for my best interest as well... and this is the case for my fiance right now...

 

 

Nov 13, 2013 - medical, at 2pm his x-ray resulted to suspected positive of TB so needed to come back for sputum test

Nov 25-27, 2013 -  sputum test

Nov 28, 2013 - result of  smear (positive or negative ???)

Jan 27, 2014 - the wait of 2 months culture test result (positive of negative ????)

(2 MONTHS HAVE PASSED then)

 

IF NEGATIVE TB result:

Needed to get scheduled for interview ASAP - he has only 4 months window left since K1 visa is valid for 6 months)

let say March 2013 - interview and passed (My fiance has 2 more months to get his visa and be booked to US)

 

TOTAL: 6 months (NOV 13, 2013 -MAY 13, 2013)

 

IF POSITIVE TB Result (PLEASE NOOO!)

Needed to do a 6-month treatment

 

let say Feb 1, 2014 - start of the treament

August 1, 2014 - done treatment

August 3 - NEW MEDICAL START DATE (need to pay again?)

all test negative result

 

then he will be given a 6-month K1 visa validity from Aug 3,2014 ????

My fiance's interview is tomorrow as well. I only had provided him ITR for 2012. Since I can't file my ITR for 2013 because I am still waiting for some 1099 docs, However, I emailed him my 2013 W2, January paystubs, and signed letter of employment. I have faith that these will be enough. Fortunately though, I have been in the company for over 6 years and met 125% of poverty guidelines..

 

Don't worry, as long as your fiancee met the 125% poverty guidelines, I'm pretty sure, you'll be fine.

  Hello fellow VJ's. Just trying to get some idea on how long folks had to wait to get their fiancé visa approved, My fiancé & her son had their interviews on, 03, Feb. 2014. At that time the interviewing officer requested new NBI certificates as well CENOMAR certificates. That the embassy would pick them up on, 07, Feb. 2014.  And make a decision about issuing visas. We are both wondering how long you fiancé had to wait till they were issued? Its been 3 weeks since their interview tomorrow & end of the week since embassy was going to pick up the paper work. Were almost to the finish line now & are getting antsy to be finished. We haven't been face to face for so long.  Any help would be appreciated. Maraming salamat in advance.


Try calling them.. Ours says Ready last Friday and hopefully get issued in a couple of days.. Interview date was same as your fiance..

Hello everyone!  I need some advise on this please.

 

I had my interview last Feb 3, but i didn't have my CENOMAR, so USEM advised me to request for a copy from NSO Pasay which I

 

did the ff day.  The week after I checked with NSO and they said doc has been forwarded to the USEM.  The guy from the USEM

 

during my interview told me that if my cenomar is cleared then I'd receive my passport with Visa in three weeks time.  It's been a

 

month now since my interview but i still don't have it yet.  Does it normally take that long for the visa to arrive?  I am starting to

 

worry. Can anybody please tell me if you have the same waiting period?

Hi, my fiance had his interview on the same day as yours and was also asked for CENOMAR reverification which he applied from NSO Pasay on that same day. Our CEAC status went "READY" last Thursday at 3pm and "ISSUED" on Friday at 4pm. As of yesterday morning, passport status via USTRAVELDOCS. com was:

Passport Status :

Passport has been received from the consular section, and is currently being processed for delivery

 

 

Yesterday also around 4pm, he called 2Go MOA to check if they received his passport/visa/packet but they don't have it yet so we hope that they will receive it today from USEM.

 

So, from Feb 3 - March 1, it took us a month to have it issued... Have you check your CEAC status?

Hello VJ members!

I always check the website to see the latest approvals and the processing time it took them. I recieved my NOA1 Jan 14th, 2014 and its being processed in California. I know my case has not been that long at all, but i just wanted to ask how people are getting their NOA2 in California and Texas under 3 weeks or so. I saw somebody got their petition approved recently in California in 7 days. My case is not complicated at all. Both same age, no prior marriage, no kids, no criminal record and she was in the States for almost 10 years as a student. 

 

I keep on hearing mixed things on how California has slowed down the K1 processing times due to DACA; but from what I see how fast our fellow VJ members are being approved i think differently. 

 

I got this message within a couple days after my NOA1 "your Alien Registration Number was changed relating to your I129F, PETITION FOR FIANCE(E)" 

 

 

Does anyone know for certain what this actually means, I looked up older postings but no one had a concrete answer.

 

Trying to stay patient as possible through this.

My wife delivered healthy beautiful son on Friday June 13, 2014. I am waiting on birth certificate for the child to complete Birth on broad paper work and passport for him. As of my wife case I summit evidence on April 11, 2014 to local immigration office who originally approve the petition. Some of the evidence include. Wedding video, new pictures, proof of prefnancy with a due date of 6/5/14. Affidavit from my mother, affidavit from me, receipt of money wired for support, and receipt of airline ticket showing I visit my wife after her visa deniel. It has been more than 60 days and did they did not make decision. To me I understand it as they are waiting for my wife to deliver the baby. My question for you guys is how can I request dna test to proof our relationship.

I received a notice of intent to revoke my wife's visa petition and i only have 30 days to respond. Comments are appreciated. Ground of denial and my answer's are below.

 

Issues that need to be addressed.

1.       Beneficiary stated that you and she met in July 2011 when you visited the city where her family lives, Goldogob. The beneficiary did not provide a reason why you were visiting Galdogob.

a.       My wife did not recall about being asked the reason of my visit during the interview, however I visited Goldogob for several reasons.

                                                                 i.      I went to Goldogob for a vacation

                                                               ii.      To see my family

2.       Beneficiary incorrectly stated that you were not married at the time of your visit. The records show that you were married at the time of your visit and that you did not divorce your first wife until February 2012. The beneficiary incorrectly stated that you divorced your first wife in 2010.

a.       She mistakenly confused my divorce from previous wife and my separation from her which started beginning of 2010.

b.      Also, there was a glass barrier that obscured the voice of the translator during the interview, and the difference in dialect between my wife and the translator made it difficult for her to understand the questions.

3.       The American telephone records indicate that most calls were 0 minutes in length w/you calling multiple Ethiopian Telephone Numbers. Beneficiary claimed you do not call another person but her.

a.       Her number is 25193250866 which is registered to my name, since I was the one who opened the line for her. Please see exhibit #6 - phone records from Addis Ababa Telecommunication which clearly shows all the call records that I placed to my wife?s phone. Also, please see exhibit #8-  Cedar pinless call records + billing records which shows call records that I placed to my wife?s phone and the $750 spent on phone bills alone in order to communicate with my wife.

b.      The 0 minutes that you have referred to are the number of attempted calls that did not go through due to long distance connection issues.

c.       The multiple calls refereed to are only 5 calls that I tried to reach my wife thought her roommates when the connection was bad in her line.

4.       All photographs submitted were taken with 2 days time.

a.       The photos submitted were our wedding photos. However, if more photos are needed please see exhibit 2; a) old photos, b) new photos.

5.       The beneficiary provided insufficient physical evidence of relationship with you during the interview.

a.       See exhibit 1 - Wedding videos.

b.      See exhibit 2; a) old photos, b) new photos.

c.       See exhibit 8 - Affidavit of my aunt Nasra Giama.

d.      See exhibit 7 - Proof of Pregnancy w/due date.

6.       The beneficiary correctly stated that you work as an assistant manager at Pillsbury maket, but she could not state what your company produces or what jobs you have held prior to working at Pillsbury.

a.       Pillsbury Market is a grocery store that does not produce any products. I believe my wife correctly answered this question when she told the consular the name of the place I work at and my position.

b.      I told her about my previous work and job titles. However, my wife is a simple woman who grew up in a small, undeveloped town in Somalia.  She does not understand or comprehend the complex job tiles that I held in America.

7.       The beneficiary did not know whether you live in a house or an apartment.

a.        The Somali language is a diverse language and the same is true when it comes to Somali customs. In some regions more than others, there is no differentiation between apartment, condo, townhome, house or a mansion.  The word for ?home? is simple that, a home.  My wife has always lived a simple life, and therefore she is not familiar with the diverse connotations for the word home.

b.

8.       The beneficiary could not relate the climate patterns of the metropolitan Twin Cities area, nor could she guess at the time difference between Minnesota and Ethiopia/Somalia (despite citing telephonic communication as her primary means of communication with you).

a.       My wife is aware of the different seasons in MN.  We have spoken over the phone when I am walking it is snowing for example, even though she has never seen snow in her life. Again, I need to reiterate that when my wife was being interviewed, she was on one side of the glass by herself while the interpreter and the interviewer together where on the other side of the glass barrier.  In addition to that, the translator who was with interviewer, spoke a different dialect then the on my wife spoke, which made it difficult for the person to adequately translate her responses. My wife has informed me on several occasion that  she had to request the interpreter to repeat the questions being asked several different times, because she had a difficult time understanding the dialect of the translator and also because it was very difficult for her to hear them adequately.   

b.      My wife has related to the interviewer that she?s aware of the time difference between Africa and America but not to the precise hour and minute.  She informed the interviewer that when we talk, it is day time for her and night time for me.

c.        

9.       The beneficiary could not state whether or not you have any friends in the U.S., signifying a lack of knowledge of basic details of your life in Minnesota.

a.       I don?t have a lot of friends to begin with and I didn?t know that I had to  introduce them to my wife

b.       My wife speaks to my close family members whenever possible.

d.       

10.   The beneficiary also stated that you and she married each other one year after meeting. You have not returned to visit the beneficiary since the marriage. The beneficiary?s lack of knowledge regarding your life in the U.S. was evident during the Interview.

a.       I have traveled to Goldogob on _______ and married my wife on ________. Traveling back and forth from Africa to America is finically straining; however, I did visit her in Addis Ababa, Ethiopia in __________ .

b.      My wife is well-informed about my personal life in the US.  She has a good relationship with my family, is aware of my hobbies, and what is important to me through my conversations with her over the phone. However, I do not expect my wife to be an expert on my life, and I don?t think that is possible for anyone to knowing everything about another person.

After my wife's visa war denied and recomended for revocation from USCIS on 08/06/2013. I waited and waited. I called NVC several times to see if they received my case back from the Embassy and I was informed on November 12, 2013 they said they received it and sent it ti USCIS. I contacted uscis several times to confirm if they received my case back from NVC and I was told no,  Today, i received an email from uscis stating:

On March 3, 2014, your Alien Registration Number was changed relating to your I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN.

 

What does this mean my friends.

Mimolicious _ she did answer those questions asked about my exwifes name date of our seperation but officer asked her how do you know. My wife replied that I told her about it during before marriage and officer interapter her andasked my wife if she knew her and she said no. My wife even handed him the copy of the decree I sent it to her.

The other thing is my wife does not speak English and there is an interpreter in middle that I am not sure if information is really coming from the officer or those were his words. All in all really un happy and I am getting less tense reading your post.

One last help request,

If nothing is reverse how can I reapply as the officer mention to my wife if I love her that I would reapply for her. How long do I wait to reapply another visa and where do I start.

Dear Honarble Conselor this email is regards to my wife Mrs FXXXXXXX XXXXX XXXXXXXXX case #ADDXXXXXXXXXXX her interview conducted on August 6, 2013. I want my case reviewed by head of immigrant visas please. I respect the counselor decision but those questions asked her was unfair. My wife would not know my previous employments and residents. She did tell the officer my current employment information and my current address. She is also does not know about my previous marriage live. I love her to death and this is not fair.I will like to request a second interview please from head of immigrant visas.

I tried calling the embassy spend $50 dollars in phone cards and I am not able t get thru to talk to some one. The receptionist is transferring me to automated system that is keep repeating over and over. I know know what to do. I went to my senator office today and her receptionist had me fill out a freedom of privacy form and said they will forwarded to the senator. I have missed 2 days of work because i am not feeling well and I am feeling helpless.

Thank you all for you inputs i really appreciated you kindness. I have submitted all documents required, wedding video, pictures, affidavits, phone records, they have no question regarding the evidence just the interview went wrong. I sent an email to the counselor requesting to have my case reviewed by senior counselor. This is the reply i received back.

 

Dear Mohamud:

 

This is in response to your email dated August 7, 2013 regarding the Immigrant visa of  your spouse , case number ADDXXXXXXXXXXX.

 

According to our records, Ms. FXXXXX XXXXXX XXXXXX was interviewed at the U.S. Embassy on 6 August 2013.  The interviewing consular officer carefully reviewed the evidence presented by Ms. FXXXXXX XXXXXXX XXXXXX during the course of the interviews.  However, the officer was not convinced, based on the presented evidence, that the petition represents a bona fide relationship as required by the Immigration and Nationality Act.  This case has been recommended for revocation.  The petition will be returned to the National Visa Center (NVC).

 

The petitioner can contact the USCIS National Customer Service Center at 1-800-375-5283 (1-800-767-1833 for TYY calls) or the USCIS office in which he filed the petition to inquire about the status of the petition.

Help please.

My wife had her interview appointment scheduled yesterday. She went to the US Embassy early morning she got there 6:30 am and her appointment was schedule to be done at 07:30 am. She got went in at 6:30 am and waiting until 8:15 am to be called at a window. She was asked a series of questions regarding my previous marriage. She was asked about about how and where we meat. Everything was going well and the counselor asked my wife my employer information and she answered them correctly and she was asked about my previous employers and she told him she does not know and counselor responded he should have told you that information if he loves you. The consular clearly intimidate her and asked her how we contact each other and she told them by phone, counselor asked for phone records and she provided to them and told her does he seemed to call other people more than he call you which, the record clearly lists all the contacts to her number is 80%. He told my wife, you husband does not love you and he talks to other girl. HUUUUUUUH. My wife told him that is not true...and finally he told her "If your husband loves you he will reapply for you. I am depressed and sad about the situation and needing you feed back. I contacted my senator and her assistance had me fill out privacy form and said they will forward this to her. Please help!     Attached is the letter given to her after the denial.
