Just a procedural question:

where is the NOA2 information sent (petitioner or beneficiary) and what is in that information?



The NOA2 is sent to the Petitioner. It is an approval from the USCIS telling you that your that your petition has been approved by them. After that it will soon be sent to the National Visa Center, (NVC), for distribution to the U.S. Embassy in the beneficiary's home country.

Firstly hats off to visa journey for being an invaluable source of information to those (like us) who weren't smart enough to appoint an immigration attorney.

Secondly enjoy your sigh of relief when your visa arrives as it will be a short-lived respite from the joys of dealing with the exceedingly knowledgeable (sorry what year is it again) chaps at USCIS

I guess the first thing to mention is do not bother doing what I did and flying a 3 hop (terribly expensive) journey to the mid west just so I could go via JFK in hope of getting I94 stamped work authorized for 90 days.

I did easily get a work stamp by the way which lasted until I invalidated it 6 days later.

Here's what they don't tell you.

You can't apply for a work permit (1 year) until at the same time (or after) as you apply for adjustment of status.

You cant apply for adjustment of status until after you are married (obvious)

What they don't tell you however is that as soon as you get married you nullify your visa and any temporary work authorization you might have.

There will therefore be a 1 to 3 month period (depending on processing times for status adjustment) when you don't have any work authorization irrespective of whether you obtain a temporary work visa.

Also worthy of noting is that when you arrive apply for a social security number before you get married. Some states allow marriage without an SSN however you cant get an SSN after marriage without going via USCIS

Yes it is advisable to wait for two after arrival to ensure you appear on the "save" database however you cannot apply for a social security number after marrying unless your status has been adjusted.

Hence in short follow this time line

1. Don't bother going via JFK to get work permit
2. Wait 2 weeks after arrival
3. Apply for social security number (this takes about two weeks) via local social security office. Go to their website www.socialsecurity.gov to download the form for New Social Security Card
4. Marry (If you haven't already just gone home)
5. Send file of forms to USCIS being
a. I765 Employment Authorization ($180 for this baby)
b. I485 Adjust Status to LPR ($325 thank you very much)
c. G325a Biometric Services ($70 that's for taking your fingerprints again even though they reside on immigration computer already)
d. I864 Affidavit of Support ($0 yes really, although you may recognize this as being almost identical to I134 Affidavit of Support) Still needs to be filled out again though in new format
e. Photocopy of Visa from Passport
f. Photocopy of I94 (arrival/departure card)
g. 4 x color photographs 2 each for 765 & 485
h. Copy of birth certificate
i. Separate Checks for processing fee's is advisable so $180 for 765 & $395 for 485 & 325a
j. Medical Info (see below)
k. Copy of Wedding Certificate
6. Send package to address on I485 assuming you send all forms in one go

Form 485 clearly states that as a K1 you do not need a full medical only proof of vaccinations
This needs to be on a specific form of course only available from USCIS doctors (list on website) and of course every doctor I spoke to would not transfer Vaccination info from form they use at London medical onto correct sheet without of course you undergoing another full medical.

If you shop around you can get some doctors willing to transfer the data from your UK records although if not expect another $150 fee
I phoned a dozen and eventually found an emrgicare willing to do it for $36 while I waited

Don't bother getting the vaccinations done at the London medical center as their paperwork doesn't have any effect here either.

Sorry to be the bearer of ill tidings however fore warned is fore armed

Wow, what a thread. A lot of emotion here. The only thing that really sticks in my head is: Why did you marry with an iterview only two months away? What were you thinking? If you only waited to bring your fiancee to the U.S. in June, then you would not have to start all over and wait another 6 to 8 months. Jeeeez!!

Perhaps you may try the customer svc number for USCIS, to verify that they have the correct address for you on file. If you have a case number, then your petition has been entered in the system and theoretically a NOA1 has been mailed to you. So....either it is lost in the mail, or your address was entered incorrectly. Try 1-800-375-5283
Someone correct me if I'm wrong, but the NOA1 is not essential to have as long as you have your case #, but if you did not receive yours because of an address mistake, you need to have that corrected, because it may impede receipt of your NOA2, and that you will need, in order to send a copy of it to your fiancee for the interview..

Thanks for you advice. I have been thinking of calling the USCIS, but I didn't really want to deal with them. :wacko: I might call my attorney again and make sure he doesn't have the NOA1. I know my address is correct, because I have reviewed the copies I sent. I have noticed some people here on VJ never get an official notification. But this has just been a small thorn in my side that I would like pulled out. :-)

Hello Everyone,

I have asked this question a few times, but never have got a concise answer, so I will ask again.

I sent my petition to USCIS and they recieved and cashed my check on 03/05/07. I got the WAC # off the back of the cancelled check and registered on the USCIS website. It says my case is pending.

My question is: Should I have got an email or letter from USCIS at CSC telling me they are in reciept of my 129F, (NAO1)? It is going on 60 days now and I have heard nothing from them; no emails or a letter. Should I be concerned? I also have not had any touches since then, even though I know this doesn't really matter. Has anyone else had this problem and eventually got their NOA2? Should I call the USCIS?

Any thoughts would greatly be appreciated.

You are not alone with your feelings. This is a very hard process emotionally. I always tell my fiancee that when we are finally together after waiting for so long, we will have a very strong relationship that will last forever. Most relationships don't go thru what all of us have to on VJ. So just hang in there and everything will be fine.

You mean in the K1 stats link? you're right, I haven't noticed that, that's weird

Maybe I wasn't very clear on the initial post. The question is:
What would be the most accurate way to calculate estimated adjudicated date? using the received date, the day NOA1 was received, or the date the first package was sent?
Many things can delay the date the NOA1 is received (I've even read about some people that never got the NOA1 at all!)
for example....someone that lives it Texas is bound to receive the NOA1 later than someone that lives next door to CSC.
or maybe they just didn't tip the postman on christmas! :P
Same thing with the date the package was sent...and keep in mind that NSC and TSC applications are being forwarded to California, so between the time we sent the the first package and California received it, 9 days went by. (we sent the first package march 27 with next day delivery to TSC and because of the transfer hassle, CSC received it april 5th)

So my question is...with all this factors in mind...why is the rule that we are using date of NOA1 to calculate estimated adjudicated date? is there something I'm missing? :innocent:

I think the most logical way to calculate the NOA1 start date is not the day you send it or the day it was signed for; but the very first date recorded at USCIS,(CSC, NSC, VSC, TSC) on your petition. Of if you are lucky enough to actually get an official NOA1,(I didn't), the date on that should work. The bottom line is when you read the sentence from USCIS; " On (date) we received your 129F petition for alien fiancee'.....). That is the most accurate date to use, regardless where we send it. Just my opinion.

I think I will send this link to Captain Ewok and see what he says about this.

Hmmmmmm....I have been wandering about the timelines also. The VJ timeline shows me waiting 88 days. I really don't know where this number comes from. My NOA1 was 03/05/07 and that is 81 days. I mailed it on 02/27/07; which still doesn't add up to 88 days. None of this is really a problem, but I have been curious anyway. And my estimated time of approval on my timeline shows me at 06/19/07, which puts me around 105 to 113 days until approval. With all of the March Filers getting approvals already I would think that day would get nearer. But I know this is all about averages...I will just have to wait and see when my NOA2 arrives and it will all be a moot point anyway..

Basically, your employer letter should state "To whom it may concern: (first name,last name) has been employed full-time with the XYZ Company since 200_ as a (name of your job), and is an employee in good standing with an annual salary of $XXXX. Signed, John Doe, Supervisor (or whatever title)" The letter should be on company letterhead.

Pushbrk is right since you are filing your INITIAL K-1 package. All you need is a copy; I don't believe it will need to be stamped or have a raised seal on it. In fact I sent mine in on the initial K-1 package and all I had was signatures as you are saying.

I am sorry if I confused you, however you will need a "certified" copy of the original. (i.e. raised seal, court stamp) when your SO has the interview. That I know for sure. Yes, of-course you don't need the original, the "real one", when your SO has the interview. Of-course people lose these and just go to courthouse and get a certified copy of the original.

I really think you will be ok with you intitial K-1 package. I have just had a tough day concering originals and copies, while preparing for my SO's interview. I don't want people here on VJ to have to go what I am going through now. Again I am sorry for the mis-understanding.

Brain Wright is the best in Bangkok. I used him and we got our visa finished one month early. He finished early because he already had packet 3 done and waiting when my fiancee's packet arrived to the embassy. I recall seeing, more than once, the name of an attorney in BKK specialing in this process. He came highly reccomended but I do not recall the name.

PLEASE DON'T MAKE ME READ THIS THREAD AGAIN!!

I seem to have had a bit of a falling out with the *&^*& we hired to do our visa. All that is left is filling out packet 3 (etc). I am in Hawaii and cannot (immediately) go back to the Kingdom. Does anyone know the name of the attorney so highly reccomended...or a legit visa agency that can help my wife (in Thailand) thru these last steps?

I am using Brian Wright, www.mythiafiancee.com. His office is located in BKK. Read his website and see what you think. He prepared all of our paperwork. There were a couple of mistakes on the paperwork and he had to redo them. But the main reason I hired him is that he will walk my fiancee' through everthing she need to do in Thailand. A representive from his office will be with her during her medical, police report, and even be with her during her interview. The main thing you need to do is double check his work.

Since I am finished with USCIS/CSC, now it feels like starting over, (in a good way :) ).

I have read the threads telling us that we will get a NVC case # assigned and read a few other threads also, but I am still a little confused. So what do I do next? Do I sit on my butt and wait for a case # from NVC to be mailed to me or is there some other way to get the case #? I have read a few threads that have said by the time you get your NVC case # the petition is already at the embassy, or at least on its way. So do I call the NVC and how long should I wait to call? What is the telephone number? How long does it usaully take to get from CSC to the NVC? I know these questions have been asked a million times, but I ask you guys to indulge me. :)

I have hired a BKK attorney and spoke to him about this. He said it is no problem and don't worry about it. If they do ask about this in the interview, just don't say you paid for a service. There are many ways to meet on-line besides hiring a introduction service....just remember that. I have heard that most interviewres don't even ask about this. If you really think about this, most couples do meet on-line. I hope this helps.

Weird that the interviewer would ask a question like that. At least it seems weird to me. The ex-wife's SSAN is not even asked for on the I-129. Oh well, that is why we are here on VJ; we find out something new everyday.

Hi, I just received my NOA 2 approval notice in my e-mail so I am happy about that :star: , but I am a little worried too. My fiance has a tourist visa to England and will be there from May 1st until May 30th. But I'm wondering, if our case is forwarded to his embasy and he receives his letter while he's gone, will it be ok if we don't return the required documents until he gets back? I was just wondering if there's anything that has to be returned immediately. Also, do they schedule our interview after he returns the forms or before? I hope we won't have to delay the interview..



Hmmmm....What I would do, (and this is just my opinion), is for your fiancee' to take everything. (paperwork) with him/her to England with him. Have someone check his mail daily and if anything comes from NVC, have a friend overnight it to you. I really don't know if they schedule interviews before or after paperwork, I am sure someone else here will know. May 1st, is still a month away and you might get your mailings and emails before he leaves and not have to even worry about anything. This is just my opinion and I am sure more VJ'ers will have more info for you. Good luck with everything.

The interview itself took about 10 minutes. We were both sworn in and the questions were directed at the both of us. Very straight forward. Some of the questions they asked Sveta was if I knew what I did for a living, and if she knew the name of my mother or had sopken or met her. How many times I had gone to see her, etc...

This will be quick and I just want to see what you all think. I have technically been employed by the same place since September 5, 2006. However I started as "on-call," meaning working full time and same pay just no benefits. I finally switched to full time the end of December. Do I just go ahead and have my employer put the start date as December since that was when I went full time? I am only asking because I was thinking it would look better if I had been there longer, but maybe I am overthinking this. Thanks for your help.



Will your employer give you a letter stating that you have been employed since 09/06/07? If so, then you put the start date in September. I can't understand why your employer wouldn't; just because you were not getting benefits, doesn't mean you were not employed. Good luck.

Hi Guys and Gals,

Anyone know how often the BKK Embassy updates the interview schedule on their website? The last time it was updated was June 26th. We have finished "everything" and just waiting for interview date. We are getting soooo close now. :) Can anyone tell me how long after you get notified how long of a wait it is for your interview date? I have heard around 3 to 4 weeks.

Just a tidbit of information. When I was in Bangkok this week, I met with my attorney and he said that during the summer there are not as many applicants for the embassy to interview. So he said the interview process moves quicker. Good news! Also he said they have a new person starting this week doing the interviews. He was slightly concerned because he was used to the last person who did the interviews and he doesn't know a lot about this new person. He had a real good working relationship with the last interviewer, but now he will have to establish one with the new person. But all and all he said nothing will really change.

There is now further information about the possible background of the U.S.
Embassy's request for additional documents: There seems to be a new
consular officer handling marriage- and fiance visa cases at the Bangkok
Embassy. Within the last week, this official (she is described by our
clients as chinese-looking, with almost no thai language skills) has
handled three cases of our clients (2 K1 and 1 K3 visa), and she requested
additional documentation on all three cases. This is more than unusual, as
we usually have an average of one request of additional documents per year
(as opposed to three per week!). It seems that this new official has a
policy of always requiring additional documents in every case. So it might
not be related to your specific situation at all, but simply bad luck with
the official who was assigned to conduct the interview.

Oh just wonderful. :blink: My attorney in BKK told me in late June that there was going to be a new person, (female), doing the interviews. He wasn't very happy about it. But this is the first negative thing I have heard.

What a wealth of information from everyone! Thanks! I live in Tennessee and my two divorces was in Los Angeles and Oakland, Ca. I was on the telephone all day trying to get certified copies mailed to me by next week. It just is not going to happen. Both counties said it would take 3 to 4 weeks to get certified copies sent to me. Her interview is in two weeks! I have the originals, however they are so old that they look like copies.

So I will be flying to LAX Sunday night and then drive to Oakland all day Monday. I will pick up the one in Oakland on Tuesday and fly back to Tennessee on Tuesday afternoon.

These "originals" will cost me around $1000.00 after airfares, hotels, and car rental. :wacko: Oh well, NOTHING is worth taking the chance of having something like not having the proper paperwork at the interview. I don't want to be delayed in anyway.

So it is all worth it, to have my fiancee' here on time with no stress for either one of us.

Thanks again everyone. Appreciate all the answers. By the way I know VJ guidelines are just that...guidelines. That is why I asked if there was any goverment website that would tell me exactly what was needed for the interview. But it is all a "moot" point now, as I will go get the docs in person.

My attorney in BANGKOK just called TWO weeks before my SO's interview and said the U.S. Embassy requires the original decrees of my divorces; not copies. Has anyone ever heard of this? Is this true? The VJ guidelines state copies of the decrees.

Has anyone's SO had their interview yet that the interviewer has required originals? Can anyone point me to USCIS or DHS webpage that states these requirements? Or is it up to the embassy to what they want?

She arrived at 7:45am and got called to the window at 10:00am. The interviewer was not the the Japanese woman that people have been talkinging about here on VJ. It was a new guy. He was Japanese also.

These were the questions:

1) How did you meet?
2) Where does your fiancee' work?
3) Where was the engagement party? Was it at a hotel?
4) Did your fiancee' kneel when he ask you to marry you? (I put this in my letter of intent)
5) How many times has your fiancee' been married?
6) How many times have you been married?
7) What kind of work does your fiancee' do?
8) Does your fiancee' have any children?
9) What was the name of the place where you had the engagement party?
10) When did your fiancee' visit? How many times?

There was one more question but I just can't remember. I felt that this was more questions asked than usaully are asked. The other girl interviewing at the same time was asked what her fiancee's email address was. They didn't ask that question to Sao. She also told me as the interviews progressed he asked more and more questions to each girl. By the end of the day he could be asking 20 or 30 questions! Sao was the 3rd to be interviewed. The first lady got asked 4 questions. Believe me there was nothing out of the ordinary at all with our application. I don't know why he asks so many questions, but she knew all the answers.

I hope this helps for people being interviewed in BKK. I will put more in the embassy review section when I have time.

Hello there,

I am wondering what I can do while waiting to receive packet 3, hoping to save me at least a couple of weeks of waiting.

I heard that, after knowing my case number and while waiting for my case to travel from NVC to the consulate in BKK, I could fill out a form and a checklist available online and then send them to the consulate in BKK before I actually receive packet 3.

my questions are:

1. Am I allowed to do that?

2. If that is allowed, what form do I fill out? Is it DS-230 part 1?

3. Will that make packet 4 (with the interview date set) come sooner?

Thank you for your help. I am thinking about the visa thing every day and trying to shorten my waiting time if something can be done on my part. We have waited for nearly 2 years to file I-129F because of the restrcition on my part. I don't want to wait any longer than I need to.

I believe that you can do everything before packet three arrives. I hired an attorney in BKK and he told me as soon as I get my NOA2, that he will start the process in BKK even before the 129F has arrived at the embassey. He said he has all the forms to do this. I think mostly packet three is instructions on how to get your medical and police report taken care of. There might be more, but I think that is the gist of it. So by the time my 129f has arrived in BKK, my fiancee will have already have her medical and police report done and my attorney will take the completed package directly to the embassey and request an interview date.
