K-1 Fiance(e) Visa Process & ProceduresWill a 3/4 frontal view photo be excepted?

We got our photos taken last week based on the confusing directions from 8B of the I-129F packet. It states the photo should be"...full frontal view facial image.....in 3/4 frontal view" #######???

We took the photo with the 3/4 frontal view, with our right ear showing. This morning I did a search on this site and found an old post that said the 3/4 view thing is from 2004 but is still on the form. Withou getting into the obvious of why they haven't changed the form, I'm wondering if our photos will be accepted or should we get them redone? Has anyone else sent the 3/4 photos.

Ryan

All you need is is a regular passport photo. See Guidelines: http://travel.state....de 10-01-04.pdf Just go to any photo shop that does passport photos and get them taken there. It cost around $15.00.

I hope this helps.

K-1 Fiance(e) Visa Process & ProceduresOnly 4 days of meeting physically!

Dont know how much you've already done, but send love letters and e-mails. Make sure to keep the envelope to prove the date it was sent. You can cross out the naughty bits :) Phone records show contact, these show the feelings involved. If nothing else, you'll have an excellent collection to look back at in 10 years and get warm fuzzies hehe!

You have fufilled the requirements of meeting in the last two years. I disagree that your petition would be denied, especially if you are going there again in July. When she finally goes for her interview, she will not only have just one visit with you, but two. Just take many, many, photos in July and have copies of your phone calls, emails, whatever else you have for the interview. I personally would not wait to file after July. Her interview will be long after the 2nd visit. That is were you really have to prove your relationship.

Just my humble opinion. Good Luck!

K-1 Fiance(e) Visa Process & ProceduresCHECK CASHED!!!

My check was posted as "cashed" March 8. All the worry for nothing. I can't believe I'm so happy to turn over 170 to the government, but I am.

My worst fear was that the package would get sent back as incomplete or something ... I can't imagine they cash your check anyway.

So now the longer wait begins...

Thanks for listening.

K-1 Fiance(e) Visa Process & ProceduresAffidavit... who and when to file it?

Hi everyone, I've read in the USCIS web page that the I-134 Affidavit Form must be filed at the same time that the I-129F petition. But going through the VJ's K-1 guide I've read that I should send the I-134 to my Fiance after I get the notification that the I-129 is approved (NOA2). So, I don't know what to do... I hope you can help me, Faye.

I believe that the I-134 gets completed after the NOA2. I sent my I-129 in without the I-134.

K-1 Fiance(e) Visa Process & ProceduresWhat problems have I caused myself?

I have broken things off with my fiancée because of something that became known thought the medical testing during the K1 process that I didn't know before I started. I allowed the visa to be processed because I do care for this person even though I choose not to marry her because of this. I thought that if I canceled the petition It would have left her in a bad spot with the embassy (Manila) and she would have even a harder time getting approved if she finds another or even attracting another if they knew what they were up against to get her. Believe me It wasnt good!! Anyway when I found out about the problem it caused me to have to fly to Manila three times this year to deal with it. I jumped through all the embassy hoops to clear her name so she would be ok in the embassy eyes. It was difficult but she was cleared and approved but by getting her approved I never thought about the problems it could cause me.

Since then I have met another that I'm interested in so I'm wondering if I petition this person in the near future will this cause me a problem even though I never fulfilled the visa of my X-fiancée? This has all happened over the last year and I figure if things go well I will petition a K1 again next year.

Niceguy,

You are right; we don't know your whole story. And I agree you shouldn't be judged, like so many are here. You have taken the time to write a lot on this BB and you seem sincere to me. I thought VJ was a place you could go to get help and not be judged. Maybe I am wrong. No-one here really knows what you have been going through and they shouldn't jump to conclusions like so many have.

What-ever happens, I hope it works out for you in the end. By the way, I applaud you for protecting your children.

Hello,

Is April 2006 the only time you guys have met? That is ok. You will need passport stamps, a copy of your visa, as many photos as you can find of you and him together, and anything else that might help. Such as airplane boarding passes, hotel receipts, anything that shows you were together when you visited. In my opinion the main things are the passport stamps and your visa and photos of you together. I hope I was some help.

K-1 Fiance(e) Visa Process & ProceduresMailed I129F to smaller office?????

Hi

I have another odd question.I talked to my Fiance the other day,he said he is going to send or Petition to a smaller office(St.Louis) instead of Nebraska where we should be filing.
We sent them the I129F before but they sent it back cos something was missing.
Is it okay to send it there? I am really not sure...but I am pretty sure it is fine cos they would of said "you cant file here" the first time,or something like that.
Anybody out there done the same?
I know that Nebraska does forward it to California anyway,so maybe it could really work out faster going to a smaller "Immigration office".
Maybe they even forward it to California.

A real bad idea. Tell your fiancee' to follow the guidelines.

K-1 Fiance(e) Visa Process & Proceduresanyone looking for immigration legal advice?

Wow, is that ever NOT the way to find a qualified immigration attorney. There are safer bets.

This is a good place to start for practical, non-legal advice. Your local state bar is the next good place.

She isn't hiring an attorney, she is just getting advice. I don't see anything wrong with that. Who says the pre-paid legal doesn't have any good immigration attorneys? I have a plan and used a great attorney. But alas, he was to much $$$ for my taste. You say she should only get "non-legal" advice; why? After all she is getting advice from an attorney, not all attorneys are idiots. And not all attorneys know everything.

I totally agree. I was just thinking of this same thing yesterday. I live in TN and mine went to TSC and onto CSC. I can see a week or two difference in processing times between VSC and CSC, but two and one-half months difference is ridiculous! All I can say is that is the US goverment in true form! I really envy the people who file with VSC. They are getting their interview by the time we are getting our NOA2. But, never-the-less I am happy for them and wish them the best.

K-1 Fiance(e) Visa Process & ProceduresYahoo Chat

After your chat, go on the messenger under archive, it will bring up a list of who you have talked to, hit save and name it, this will print page after page but once you shut off the machine that chat session will disappear

You can change your settings so that the session will not get deleted after you sign out. Just go to preferences under messenger on your top line menu, or hit Ctrl+Shift+P with the yahoo window active and click on archive and change that option to "Yes, save all my messages". If it's deleting after you close Yahoo then you have the second option selected which is "Yes, save all my messages but clear them each time I log out"

Many people have brought this up and all you need is one page from some selected dates. Be sure to print out the log that shows all the chat sessions with their dates. This will show how often you chat in Yahoo.

Thanks for all the responses. Yeah, we save our chat sessions in the archive. We only have the printing problem. I never thought of saving it to a text file and then printing. I also agree that they will never read all of them anyway. :) I think just printing the first page of a few selected chats will probably be enough. Thanks again.

K-1 Fiance(e) Visa Process & ProceduresEmergency visa?

My 21 yo cousin died yesterday in a gruesome accident. I am a USC, and I want my fiance to come to the funeral with me. Is there anyway to get an emergency visa?? I see that the embassy does offer visas to those traveling with a close family member for support in these types of sitautions?

Does anyone know anything??

I am really sorry for your loss. Wow...I just don't know the answer. I really don't think the US will consider your cousin's death an emergency for your fiancee'. Getting a Visa in a few days, seems like a long-shout to me. But that is just my opinion. I suggest you contact an immigration attorney for a consult and see what he/she has to say about it. We sent out I-129F package to TSC Fri 30th by USPS express. They tried to deliver it to TSC Mon 2nd of April at around 2 pm, but were unable to????? Is no one working in that place during normal office hours? Is it normal?

It's already April 4th, and still not received. :crying: Should we call to USPS and kick their butts, or is it something on the TSC end? I'd just like to know if this is normal, or something we should be concerned about. Your answers are much appreciated :)

Don't worry about this. I sent my package return receipt and the same thing happened. The USPS tried to deliver but I checked tracking and it said delivery attempt failed, (or something like that). The next day it was signed for and delivered. I think a lot of people here have this same problem; but all get delivered. GOOD LUCK!

K-1 Fiance(e) Visa Process & ProceduresTimeline question

I'm a little bit confused about how the timelines work, I'm hoping some of you may be able to set me straight. :)

I sent in my I-129F application to the Texas Service Center last week, and according to the tracking information they have in fact received it. I understand that as a resident of South Carolina it will most likely be forwarded to the California Service Center where, according to the uscis website, they are currently processing applications from mid September. I gather from reading this board that the entire process can take around 8 - 9 months or so. My question is whether or not that length of time factors in the several months of waiting for your application to be processed, or if it applies to the amount of time it takes once your application is actually looked at.

In other words, does the timeline for the actual approval and my fiance being able to enter the US start from the date our application is touched, or does it start from the time we sent it in - taking into account that we are April filers and California is almost 7 months behind? If it matters any, my fiance lives in The Netherlands.

Thanks!

The processing times on the USCIS site are are not very accurate. Look more at people's timelines here at VJ. Good Luck!

K-1 Fiance(e) Visa Process & ProceduresHow many of you used a lawyer to help you
I am using a lawyer. The main reason I used an attorney is not that I couldn't do the paperwork or my fiancee' wouldn't understand how to do it. The reason I hired an attorney is after the NOA2 he will become a big help with my fiancee'. My fiancee' travels all over Thailand with her job and is very busy. At least the attorney will take care of the paperwork for her and all she will have to do is sign it. In fact he has already filled out most of the forms. Also representives from his office will take her to her medical, police station for her police report and will be with her during her interview. Anywhere she needs to go they will be with her. This is very important to me to know she will have someone by her side during the whole process. I wish I could be with her, but that just can't happen. Yes, my petition was not a complicated one, but hiring an attorney did save us time and has given us piece of mind. At least at this time. :) :)

K-1 Fiance(e) Visa Process & ProceduresI 129f and G325A Details

I am new here and I just started the K1 Process. I am a USC and my fiancee and I have just completed these forms and are almost ready to submit.

I would like to know how important the detail of completing this information is. It is very difficult to recall exact dates of when I moved into my last residence. I can remember when I moved to my current residence. It was 6 years ago when I moved into my last residence but the detail of which month escapes me. Also two of my fiancee's 5 jobs in the past 5 years were for short periods of time (one for 2 weeks, one for one day). She doesn't recall the exact dates.

Do you suggest that she just leave those 2 jobs off the forms? Also if my prior address goes past five years is it acceptable to just put 5 years from now or just guess the approximate date? I have exhausted all of my resources to find this info.

Any input with these types of experiences would be greatly appreciated.

You have a while yet. The G-325 doesn't need to be filed until after the NOA2. As far as the dates of employment all I can say is; make sure the last five years are all accounted for. As far as the two week job and the one day job, well, again just make sure all time is covered; one day jobs, personally I wouldn't put down on the form. Sorrry to be so vague. Remember, I don't really think anyone goes back to check employment history of the SO, but I could be wrong. Maybe other people here will know more. Also, again the G-325 doesn't need to be filed with the petition. I hope I was some help.

K-1 Fiance(e) Visa Process & ProceduresVSC lose my petition, now I have to refile.

Well,

As I talked about in my other thread, VSC 'lost' my petition when attempting to mail it to the NVC, back in November. We escalated this to our local senator and they eventually admitted it was lost, but they had an electronic record and they would reissue and expedite it.

They just called us back today to inform us this won't happen and we will have to refile. My fiancee was too upset to make sense of the whole thing but they are apparently emailing us some special instructions.

THIS IS SO UNFAIR, because of their screwup I now have to refile my entire petition, regather all the paperwork etc. I have a duplicate of it all in my house in the UK, but I now have to send this over, she has to get some stuff re-signed and so forth.

This is the most upsetting day ever and I have lost ALL faith in their ability to do a damn thing for us.

I am so sorry to hear about that. But maybe since they are emailing you "special instructions", maybe they are going to expedite your 2nd petition. I sure hope so! Good luck!

K-1 Fiance(e) Visa Process & ProceduresNo notice sent yet for my 2-15-07 I-129F
I have the same situation also. I got the case number off of my cashed check and entered into the USCIS website. The website says the petition is pending. I have not got an email or anything in the mail. I am wandering what to do also?

K-1 Fiance(e) Visa Process & ProceduresNOA 2

Just a procedural question:

where is the NOA2 information sent (petitioner or beneficiary) and what is in that information?

The NOA2 is sent to the Petitioner. It is an approval from the USCIS telling you that your that your petition has been approved by them. After that it will soon be sent to the National Visa Center, (NVC), for distribution to the U.S. Embassy in the beneficiary's home country.
