Hello there,

I am wondering what I can do while waiting to receive packet 3, hoping to save me at least a couple of weeks of waiting.

I heard that, after knowing my case number and while waiting for my case to travel from NVC to the consulate in BKK, I could fill out a form and a checklist available online and then send them to the consulate in BKK before I actually receive packet 3.

my questions are:

1. Am I allowed to do that?

2. If that is allowed, what form do I fill out? Is it DS-230 part 1?

3. Will that make packet 4 (with the interview date set) come sooner?

Thank you for your help. I am thinking about the visa thing every day and trying to shorten my waiting time if something can be done on my part. We have waited for nearly 2 years to file I-129F because of the restrcition on my part. I don't want to wait any longer than I need to.

I believe that you can do everything before packet three arrives. I hired an attorney in BKK and he told me as soon as I get my NOA2, that he will start the process in BKK even before the 129F has arrived at the embassey. He said he has all the forms to do this. I think mostly packet three is instructions on how to get your medical and police report taken care of. There might be more, but I think that is the gist of it. So by the time my 129f has arrived in BKK, my fiancee will have already have her medical and police report done and my attorney will take the completed package directly to the embassey and request an interview date.

US Citizenship General DiscussionN-400 Cover Letter?

Hello Ladies and Gentlemen,

 

It has been a few years since I have posted on Visa Journey, but have always been checking in and keeping up and reading posts. I haven't posted, but have always kept up.

 

Well, since my wife and I got married in September of 2007, we have had a wonderful marriage and are growing together everyday. She is the best thing that has ever happened to me, that is for sure. She has and always will be the greatest and biggest part of my life. I can't imagine a life without her now. She has had a great job as a pharmacy tech since 2008 and is enjoying living here in the USoA. We have made 4 trips to Thailand to visit her family since we were married and plan to go again the end of this year. She loves it here, but she always misses her family that is 12,000 miles away; as I am sure all of you that have spouses far away from their home can attest to.

 

Anyway, the reason I am posting is that I have the N-400 package and all supporting documents ready to mail. One question I do have is, is it necessary to send the package in with a cover letter? I know the answer might be somewhere here on VJ, but to be honest I did do a search, but didn't spend a lot of time doing it, so I thought I would just ask the question by this post. I did not see anything about a cover letter in the N-400 guide, so I am assuming I don't need to send one, but want to make sure first.

 

Well, the cover letter question is the only one I can think of asking, but if anyone thinks of anything else that I might need to know before sending, please don't hesitate to tell me. I plan to make copies of everything today and probably mail it out tomorrow or next Monday. As far as "supporting documents", I have, >last 3 tax returns, bank/charge account statements, marriage certificate, her two photos, copy of MY passport, current mortgage statement, color copy of permanent resident card, and a few more docs. All of the bank/charge/tax and mortgage docs have her name on them also.

Hi Everyone,

 

I am getting ready to send my wife's N-400 package on Monday. By looking at the timelines here on VJ, it seems that a lot of people are getting their interviews around four months later. In four months, (November),  we will be going to Thailand for 3 weeks. IF she gets scheduled for and interview while we are away on vacation, is it a "big deal" to reschedule her interview? If we do have to reschedule how much more time are we looking at? Should I make a note of this in the N-400 package?  Hopefully this will not happen, but wanted to check in and see what you guys think.

The first Notice/NOA1 will be the proof of the one-year extension - hang on to it.

Also - if you don't already know - the receipt number on the NOA1 is not the one you can use to track your case on the USCIS website or if you need to call them. The receipt number on the biometrics appointment notice (which will come maybe 30 days or so after the first notice) IS the case number you can use to track/call with.

Hi Everyone,

Well it has been a wonderful two years for my wife and I! After going through the K-1 and AOS now we are starting our Removal of Conditions. The VSC got our package last week. So now I guess we play the waiting game one more time.

Reviewing the timelines, it is looking like it might be up to a six month wait. WOW wacko.gif I thought when the USCIS raised their fees, that the process would be more streamlined and faster...wishfull thinking! Remember during the K-1 process how fast VSC was to CSC...I don't guess that applies for the ROC.

Anyway, I was wandering..about my wife's Driver's License. Hers will of-course expire before we get her 10 year card. Will the USCIS send something showing her status is extended so we will have something to show DMV? She works and really needs to have a license. How has everyone dealt with this situation?

Hi Everyone,

We just got her NOA 1 today! Now we wait. At least we have something official now. So on Removal of Conditions do the USCIS always do fingerprints and photos? We did that aleady for the AOS. Why do they do it again? I noticed on the NOA 1 that they will be sending us an appointment time for the fingerprints and photo at our local office.

Hi Guys and Gals,

I have done a small amount of research here on VJ and have found after you get your NOA1 for Removal of Conditions, the average wait for your Biometrics appointment notification is a month. We received our NOA1 on November 23, 2009 and still haven't got the biometrics appointment yet. We are fast approaching two months now.

Should I be concerned that maybe something got lost in the mail? When should I start trying to contact USCIS about this? I am not really concerned now, however it is starting to make me wonder a little. Any inputs or suggestions would really be appreciated.

Well, that is interesting. Fingerprints are supposed to be valid for 15 months yet the removal of conditions are to take place 90 days before the expiry of the 2 year card so at the very least that would be 21 months. Did your wife re do her biometrics recently for some reason? I have never heard of this happening before except for one case where the green card had been lost and they requested new biometrics when they sent in the request for a replacement. The biometrics were less than 15 months old when they filed to Remove Conditions. There have been a few cases where Citizenship applicants did not have to redo biometrics as they were told theirs were still valid, although most people end up redoing them even though they are within the 15 month time period. Regardless, whether you redo biometrics or not, you won't be getting a refund. That word is unknown in USCIS' vocabulary.

Yes, it is very common just to receive the 10 year card in the mail without any other type of communication - except the biometrics. Very few people end up having interviews for the Removal of Conditions so this is the norm. The major exception is when someone receives a Request for Further evidence (RFE), otherwise you just receive the card.

Thanks for your prompt answer. To answer your question we did not re-do her biometrics. The only biometrics that was done was her original one in or around January 2008.

Yeah, I figured that we wouldn't get a refund. I guess the USCIS keeps her photo on a database somewhere to use if they issue the 10 year green card? Maybe all of this is a blessing in disguise and the next thing we will hear from them is getting her card. We will just wait and see.

Hi Everyone,

We never received an appointment for our biometrics after 60 days of waiting. I finally called USCIS and told them. After a few days we received the email below from the USCIS stating that my wife's biometrics was current and she doesn't need one. They also stated that we would not get a refund for the biometrics.

I am glad that the USCIS answered our request for information so quick, but I am a little torqued about paying the $85.00 for the biometrics and not needing it; then the USCIS telling me they are not going to refund it. What a SCAM!

Is this a normal occurance? Do people pay for the biometrics and then the USCIS tells them they don't need it? I have also heard that some of my wife's friends sent their 751 package and the next communication they got was the 10 year green card in the mail. Does this happen or is my wife getting bad info? Do you think I have a chance of getting a refund on my $85.00?

I really don't know; The USCIS just sent us a notification telling us that her Biometrics were current, (even though they were almost two years old). I won't question the USCIS on this one though! :whistle:

Hello Everyone,

We just received in the mail today that the USCIS has approved the permanent residency status and the card will be here in 60 days!! :dance:

The process did not take as long as I thought it would. It only took three months! All we did is send the fee and application; nothing else was required; like Biometrics. The process was smooth and simple. Although I was never able to track her case on the USCIS website though. She registered and when we put her case number in, it came back saying they do not recognize the case #. Oh well......

Anyway, can anyone tell me how long it takes to get the 10 year card after her status is approved? I know the notification says 60 days, but how long does it really take? I am assuming that it will actually take a shorter time; am I correct?

We received in the mail today the approval for the 10 year green card. Now we are just waiting for the card. The process was very simple---no RFE's, Biometrics, or Interview. I hope it will go this smoothly for all the November filers! :thumbs:

Update...

I called the USCIS last week and after about 5 minutes of getting thru the automated phone system, I finally was able to speak with someone. I told her it had been more than 30 days since we received the I-797 and still haven't got our biometrics appointment yet.


This simple information I was trying to pass alone turned out to be a 20 minute call to a person who sounded like they were reading off of a prepared statement and checklist. I must of repeated the same information to her at least 3 times. She just took information and did not know anything or even have my wife's record in front of her. I asked if she knew if the appointment time had been mailed, but she couldn't even tell me that. I felt like I was talking to an automon.

The results of the 20 minute conversation about having no biometrics appointment was that I would be contacted after 45 days and they gave me a reference number. I guess that puts us behind schedule a little..huh?

We have been lucky since we started dealing with the USCIS for the K-1 and have had no complaints. So now I guess it is "my time" to start working and dealing with the system. I just hope all of this works out OK. Has anyone else had this problem before and what were you outcomes? I guess the 45 day wait is normal?

Hi Guys and Gals,

Well, after making the phone call above, a few days later we received the email below. Now, they are saying we don't need the biometrics, that ours is current. Go figure. They also stated that we would not be refunded the cost of the biometrics. HOW IS THIS FAIR? I pay the $85.00 for the biometrics fee, but don't receive the services. What a rip-off! Of-course in a way I am happy that we don't have to do it, but paying the fee for nothing, is kinda frustrating.

Has this ever happened to anyone before? My wife is telling me some of her friends just got their 10 year green card mailed to them one day, without any communication from USCIS. Have you ever heard of that happening?

We received our NOA1 on 11/23/09. It has been almost two months since then and we still haven't received our notification or our Biometrics appointment yet. I see that most VJ'ers receive their Biometrics appointment notification around a month after they receive their NOA1.

Should we be concerned yet? How long should we wait before we try to contact the USCIS? I am not too concerned now, but it seems that almost everyone that got their NOA1 around the same time frame has already got their Biometrics Appointment already. Any ideas of what I should do, or should I just keep on waiting?

Updated my NOA 1 date. The "day" was blank. It has been more than a month since NOA1 and still no Biometrics Appt. yet. I guess it was the holidays. We hope to get it soon! I didn't change anything on the edit, just added the date. I hope I did this right. :)

So I sent my I-129F last week to NSC, who transferred it to CSC, who sent me the NOA1! At least they got it...now if only the rest of the steps moved as fast as this initial processing.

Now I guess I can expect to wait until at least May, most likely June before any actual news....the wait begins!

Congrats!!! I mailed mine in late February and they recieved it on 28 February. My checked was cashed on 5 March and I was in the system the same day. I never did get an official notice in the mail. I really don't expect one. But at least I know my case is, "pending".

Just wandering....So how often do we get touches? Is it normal for someone not to get any touches at all? I haven't had a touch since 03/12/07, which I think was the same day CSC received my application. I notice some people get touches quite often. So what does everyone think? At least I know they have my petition, but maybe they have just not done anything with it yet???? I am not really worried, just curious is all.

I respectfully disagree.

I frame the unfairness, however, with a bit more detail. I think the wait times are unfair to US Citizens because they are so drastically different depending on in which state of the Union a citizen lives. That's not only uncool, but, potentially illegal (though for a whole, long, stupid judicial reason - based solely on case law creativity, is probably an unwinable case). The whole benefit of having united States (capitalization not a typo) is guaranteed rights to the citizens of the several states. When VT filers enjoy basically expedited service and CA/TX/NE filers enjoy longer delays, that's unfair.

We may not have a right to have anything processed in x number of days, but we do have a right to have all our petitions processed in a similar number of days.

(That's one easy way to highlight fundamental unfairness - but I'm not entirely sure I'm willing to waive away a right to feel like the process, even in VT, isn't unfair to US Citizens as well.)

My estimated time for my NOA 2 has changed from 06/08/07 to 06/13/07. It sure doesn't look like things are speeding up. But, I do think 06/13 is to much. 06/02/07 is 90 days for me. I will just have to wait and see.

I am in the same boat. My checked was cashed with a WAC # on back of it. I entered the number into the USCIS website and saw that they had received my case and it was pending. I NEVER GOT AN OFFICIAL NOA1, EITHER BY MAIL OR EMAIL. It has been since March 5th now. I guess I should call????????

Im so exited because i fianlly receive MY NOA1. woot. omg.. i was so worried because i did not recieve anything and i had sent it to vermont the fastest in the country, well i did not get itany sooner just because they didnot see the little attachment onthe backof an change of address but its okay, the postal service did... but i sent it the 12 and i got the notice date on the 16th .. 4 days =], mailed the 18th so must of gotten here around the 20th.. yey... imecited, lets just pray and hope for no RFE and just straight NOA2 =] :D



I am thinking of calling CSC. They cashed my check on March 5th, and I took the case number of the back of the check. I considered that my NOA1. I still haven't recieved an email or a hard copy of my NOA1 yet. I am wandering why I haven't received anything yet. I haven't really worried about it since I have a case # and they have cashed my check. But it would be nice to get something in the mail.

Me and other VJ'ers have posted this question about not receiving NOA1 in the mail or email, but the answers have been very few. So I would say, as long as you can track your case, you should be OK.

Hello everyone!

We filed our application last March 23, 2007 in California Service Center and we're patiently waiting for the development of our papers.

My fiancé & I have complicated issues when we fell in love. We're not anymore considered as "single" as it is, since we both have issues in our past lives.
Inspite of these complications, we strongly believe that we're meant to be together. Now, we're very thankful to God for the continuous guidance & wisdom. We feel so blessed that we want to share it to other applicants and looking forward that this information will be a great help. :)

Now, I'm looking for other applicants who have similarities with my situation. If you fall in any of the following categories, I will highly appreciate if we can share ideas/concerns regarding this application.

1 – K1 application filed from Jan 2007 up to present (specially March Petitioners)
2 – Filed documents in California Service Center
