I wish I had returned the RFE sooner. Sadly we had to wait until the 19th to send it back and they sent the confimation email on the 28th.... so I really hope they process my case sometime this month!

Anyone out there with RFE from around the 28th????

Well, when he sends the I129f petition he won't have to send your birth certificate with it.
And when you need to get something translated, it won't have to be a certified translation. Jusk ask the person translating it to sign an statement saying he/she is fluent in English. Here's an example:

Certification by Translator

I typed name , certify that I am fluent (conversant) in the English and ........... languages, and that the above/attached document is an accurate translation of the document attached entitled..............


Signature
Date Typed Name
Address


If you still want to get certified translations you can go to the website of the US Embassy in Peru and they'll have a list of translators there.

We dated for almost 2 years before filing - IN PERSON, not online. We both have never married. We are in our mid 30s. But England is not a high fraud country. But neither is Canada, is it? (Some Canadians are having delays)

We lived in the same town together in Canada (how we met) and have been dating for more than 2 years too - both never married before. Very straightforward case like yours, and yet we are still waiting. Clearly that isn't the reason some people get approved sooner.

Below are just my attempts at answering your questions

1. They are accountable to nobody.
They are responsible to DHS
2. The petitioner is left entirely in the dark except for sporadic, awful, inaccurate updates. This is the age of computers, people! Write a script that shows exactly what stage of the process a petition is in, etc. etc.
The paperwork is all human read its hard to put "steps" to it. Each of our petitions is gone to by a human
3. They have outright lied about the process (processing by NOA1, then RFE, then essentially no timeframe will be provided).
I don't think they ever docuemented what they process by .. it was all just heresay..
4. The National Service Center hotline is useless.
Of course they handle all visa petitions they can not be experts at all stuff5. They blatantly lose/misfile/ignore cases (like RFEs that have no been sent out, that have been lost, etc)
I don't think they blatantly do that.. do you know how much paperwork they get for all different visas?
6. The service centers obviously have grossly disproportionate workloads.
How so .. its 1/2 and 1/2 .. west coast cali .. east coast vermont

The 'touch' date changes when a case is handled for any reason.
They specifically state that touches can happen and nothing update on their website.
My case 'touch' date has not changed.
They have alot of paperwork
A background check requires looking at a case.
Background checks are not done at USCIS
Looking at a case should require a change of the touch date.

I completely understand what onyxrev is saying. And he meant that background checks were the reason for the delay, he'd have already been touched... since a touch means your case has been worked on.

It looks like CSC is doing a good job of clearing out their backlog. I predict that virtually all the March and April ones left will be cleared in the next few weeks. If we're lucky, most May filers will also hear in September, and maybe even some June ones.

How They Process Your Application at a Service Center (according to their website)
Normal Processing:
The first step is the receipt of mail. Mail is generally opened within twenty-four hours of receipt. The majority of mail arrives on Monday (40%) and Friday (20%). The other three days of the week share an equal amount of mail. Because of the volume of mail arriving on the two busiest days, sending a case via express mail to arrive on either of those days does not ensure faster processing. The lower volume of mail arriving on Tuesdays means that the mail is usually opened by Tuesday evening.

Applications are stamped with the time and date of physical receipt, not the time and date they are actually opened. Mail with fees enclosed is routed immediately to mail assembly. Cases that are filed prematurely (before the applicant was eligible or met the legal criteria) or that were filed on an outdated form are prepared for manual rejection at this point. Cases lacking proper signature or correct fee are identified for system rejection.

Mail without a fee enclosed is considered correspondence and is sorted by type, if the appropriate destination can be quickly determined. If mailroom personnel are unsure as to the routing, the material is sent to the Customer Contact Services unit where it is read and either responded to or routed to the appropriate division for action.

Properly filed cases and cases flagged for system rejections are then forwarded to the Data Entry unit. In the Data Entry unit, information is keyed into the USCIS computer system and fees processed.

The Data Entry unit collects the appropriate fee or when necessary, rejects the case if the fee is incorrect or the form is not signed. If a case is not clearly acceptable, it is immediately passed to our Case Resolution unit for review. If they are unable to overcome the obstacle to processing, the case is returned to the applicant/petitioner for correction. Receipt or rejection notices are generated during Data Entry and mailed no later than the next morning.

Fee receipts are printed and mailed after the electronic record is created. This means the date on the fee receipt may be different from the date the mail was received for priority date purposes.

Once the fee has been properly receipted and the electronic records created, cases are routed to the Work Distribution unit to await a call for work by the Product Line or Field Office.

If the application will be adjudicated at the Service Center, an Adjudications Officer will review the case; the appropriate data (including cable requests) will be noted on a processing sheet and forwarded with the application/petition to the clerical section. The system is then updated, and the completed application or petition is sent to the file room, consulate or other appropriate office, and original documents are returned as required.

Hey guys... I have a friend who's looking into the possibility of trying to get his girl a fiance visa and I'm trying to help him the best way I can. So I have a few questions:

She's from the Philippines and she's been separated from her "ex-husband" for awhile but she's still legally married. What is the process of getting divorced there like? Is it too hard? This friend of mine said it's not possible to get divorced there but I'm not sure about that.
Can anyone point me to the right direction here?
