Hi, there. My fiance will file K1 visa for me in june, and i've started getting all worried and nervous about it. We've met twice in 18 months and have lots of proof of our relationship but i still feel worried.
I guess main concern is that I had 3 denials of visas from Nov/04 to June 05, one was tourist visa and the other two were medical. There is the fact that i come from a Latin American country (El Salvador), and i've heard that your chances of getting K1 visa depends on the country you come from. There's a third concern, should my income here in my country be an issue? I don't know, i'm just worried already. If there's anyone who can help me clear my doubts, please do, i will greatly appreciate it.

The amount of money you make in El Salvador is not an issue.... how well she's gonna be able to support you in the US is.
And the amount of times you were denied a tourist visa won't matter either.
Now you said you were denied a medical visa. I just thought I should let you know that you'll have to have a medical exam done before the interview, after your petition is aproved. They basically want to know if you're healthy and will not become a public charge once you arrive in the US. I don't know about your medical record and you really don't have to say the reason why you tried to get a medical visa to the US, but just do some research if you think there'd be any reason to worry about your exam. :thumbs:
I hope there's nothing to worry about though.... and someone please correct me if I'm wrong!!

Just a quick msg to say we mailed our k1 app on 27 feb and we still havent received the NOA1 from nebraska, David received the certified mail thingy to say it was signed for but we havent received anything... am I just worrying for nothing? could they have misplaced our file? is there an email address at nebraska we can email to find out? I noticed the other couple who filed at the same time got their NOA!

I have to disagree.

When a USC and USC get married, neither USC has the right to see the others past records. This law goes past the "RIGHT" to know and makes it a "MANDATE".

Before a USC can get contact information for a forgiener via an international contact, we must release all of our personal criminal history, wether we have any or not (and I do not)

This law puts a time based restriction on the number of petitions which can be filed. Since when is love and marriage timelines dictated by the govt?

A second application puts you in an abusers database to have extra screening, like there isn't enough and this process isn't slow enough?

Since when did your govt decide they have the right to tell us what we must disclose about ourselves prior to ever meeting someone?

It also creates two set of marriage standards. Marry another USC and you have to do nothing. Marry a none USC and you must disclose everything about yourself to the govt, an over seas embassy, and your potential mate.

And when exactly does it go against what I said?? :unsure:
I didn't say it was right or wrong.... I just said that if the check is something they already do during the K1 process, then the new law on disclosing the information found shouldn't slow things down even more.

Well, for all i've read the last few days, they already perform all the checks but now they'll only start to inform the foreign fiance about the USC's background. If that's the case, then it shouldn't slow things down..... and the only people that will see any difference are the ones getting informed or the ones who are hiding something.

Yes, I'm more worried about how much longer it's going to take than knowing (one more time) about my fiance's past. First of all I miss him like crazy. :crying: And second, his mom is going through a rough time (medical reasons) and everyone wants me there as soon as possible(what can I do? Mom Sandy loves me :star: ) I want to be there for my fiance in case something happens to his mom.
We've already lived together for 2 years, went through hell(and heaven of course (L) ) together and we've had every chance in the world to know everything about each other. Including family, friends, medical record, police record, school record, sex history.....
Well I could be wrong but it sounded like you were trying to say I'm reckless or irresponsible or something like that. And of all the relationships you'll find here on VJ, mine is one of the ones you sure can't come down on... so if you like to hear stories about people that don't know each other very well and decide to get married, so that you can criticize them, I'm not what you're looking for.

Hey guys.... when is that new law (the one that will ensure that the foreign fiance knows about UCS's past)
going to take effect? I know it's supposed to be in March but I'm not sure....
We're almost ready to send in our I129-f and I was curious about this...... I mean we'll send our petition to Nebraska sometime next week so I was really hoping this new law wouldn't hurt our timeline so much.

Isn't the intent of the K visas to rejoin couples in a shorter time? ... They are already joined.

Well if that was the intent then a lot of couples here couldn't get a K1 because they already live together too. I believe that the intent is to bring a foreign fiance to the US to marry.
It's their right, not their job, to change status. But I do understand they expect it from the couples that file a K1.
I really don't think they'll have a visa by may though :blush:

The OP stated that he plans to marry his Chinese fiancee stateside. Granted, he's up against some challenges. That doesn't mean we shouldn't suggest to him honestly and completely the avenues available to him.

The only thing I want to say is that I'm pretty sure you only have to send the petitioner's birth certificate, and not the other two you're gonna send.
Also, isn't the FC-029 not required anymore??
Oh yeah one more thing.... only proof of meeting is required with the I129F too. Proof of ongoing relationship should be taken to the interview.

Just make sure you guys know a lot about each other. One thing is to get the petition approved.... another thing is to get the visa! You'll have the interview to get the visa and they can ask just about anything to see how well you know one another.

You know... everyone is saying she should meet him before getting married. Well, she IS gonna meet him before getting married anyway. After he gets in the US they'll have 90 days to see if thats what they want.
But.... I'd still make an effort to go see him though. Both because it'd be great to get to meet the person that makes me feel so good and because it'd help getting the K1 visa approved. :thumbs:

I am quoting this one, but in reference to your previous posts containing past posts, not one of those is saying sending in a truck load of proof of the relationship when submitting the petition is beneficial.
Look at the amount of RFE's that VJ members have been getting over the past many months even when supposedly submitting x amount....look at the amount that are under reviews at SC level and they aren't just ones from high fraud countries. Submitting evidence of the relationship could create a whole different picture in the adjudicators mind and I believe it is just as irrisponsible to have such information in the Guides that is contrary to what is in the instructions for the forms when even just one member is affected by it. IF there are embassy's where it would be of benefit then I believe that information can then be given them seperate to the Guides. It seems at times that a petitioner is putting more focus on submitting proving the relationship as opposed to ensuring that they have strong complete evidence of the 2 year requirement of having met and evidence to show they intend to marry which is required with the I-129F.

Hi Paul, I'm going to tell you what happened to me.
My fiance (the USC) lived here in Brazil with me for two years before we decided it was time for him to go back to the US and start the K1 process. We didn't want to be apart for almost a year either... so, after he was already back in the US, we decided that instead of sending the petition to Nebraska right away, I'd try to get a tourist visa first so that I could visit while the K1 process was going on (we'd send the petition in right after I got the tourist visa).
I scheduled my interview and had to wait for it for about 2 months. I really thought I'd get the visa since my parents have stable jobs (my mom has a federal job and my dad works for the government too), they have good income, I had a letter from one of the best schools in the country saying I had no intention to stay in the US, and a letter from my grandpa who was a Secretary of Transportation once, saying that he was giving me a trip to the US as a birthday present. I'm actually pretty much like your fiance.... I don't have anything to prove I'd come back to Brazil other than that(and trust me, a letter from her school is just not enough when you go for the interview in Rio, specially when you're a young girl ).
I went to Rio and my interview lasted about 30 seconds. Needless to say I was refused.
Waiting to get that tourist visa was the worst thing I've ever done.... I'd probably be in the US right now if we had sent the petition right away. :blush: It cost me months.... and $100 :angry:
But hey if she already has the visa then forget about my little rant as you don't need to worry as much! :no:
Maybe get her an insurance before she tries to visit (it's cheap.... about 60 dollars for 30 days coverage). A girl from my gym was turned down and the insurance helped making sure she was well taken care of before being put in the flight back to Brazil, paid for her food, and her flight back from Rio to Espirito Santo.

I'd like to understand something..... it's very clear that all they ask for is proof you've met in the last 2 years. So why do people keep sending e-mails, letters and phone bills? How does any of that prove you meet that requirement?

And yes, picture is good too.... but doesn't it make sense that it's secondary since it doesn't prove when it was really taken (dates on them can be easily fake...)?
To me it all just makes sense.... if there's more to it then please just let me know. :unsure:

Not that this helps you at all, but I would like to ask if this makes sense to anybody else.

I get that pictures are apparently not good enough for immigration, yea, sure we could all be photoshoping it up... BUT why then are airline ticket stubs and other pieces of paper worth anything?? I sent in pictures and airline tickets, and some other receipts of things from visits, but doesn't all that paper stuff just prove I visited Ireland? In my case, most of the receipts weren't even from the county that James's address has always been as most of my visiting was done while he was at college and a secondary address. If you were to take the pictures out of my pile of evidence, I would not think that it proved anything other then that I was in the country he lives in. Sorry, just a little rant about immigration...

That's why combining both is the "ideal".
Picture (shows you were together) + Boarding pass, plane ticket (shows when you were in the country) = a solid proof you were together on a certain period.

But... there certainly ARE things that he SHOULD know about, such as NOAs!!! I think, in general, this whole process is a great test of a relationship.
They say there are three ways to get to know another person and find out if there is compatability: live, work and travel together. I think that saying should include the K1 Visa process. If you can do any of these sucessfully without a thermal meltdown of any kind, you are truly lucky! It sounds like you touched upon one of his idiosyncrasies that bothers you.
My advice: kick him in the ### (for motivation) and tell him how you feel.

In our case, I am (non USC) is more comfortable doing paperwork because that is what I do at work. Hubby (the USC) involved when it has to be done from the US side. I still remember telling him same thing over and over and it can frustrating at times ... :lol: and it sometimes got interesting :lol:

I do almost everything (he only had to have his visa photos taken, his birth certificate and copy of his passport, signing the forms and coming up with the $ for the the application).
I filed out all the forms, came up with proof of meeting, translations, nights reading and posting my doubts, and stressing over the process ;)
I chose to do everything because he's under treatment for his anxiety and immigration stuff would not help much :no: He always asks me if there's anything he can do but there really isn't.... I think I do a better job anyway! :lol:

How about being grateful to the fact that you're getting a visa to the US because of him??

I know it's blank..... but when you copy it, doesn't it say something?
The one Dave has says something when photocopied..... it says on his original one: WARNING: Original document has a multicolored background on special white security paper and the great seal of the State of Indiana on back that turns from orange to yellow when rubbed. Original document has hidden void that appears when photocopied.

We sent the original with the I129F btw.
